BOARD OF ADJUSTMENT
The regular December meeting was called to order by Vice - Chairman Richard Goe at 8:12
p.m. Board members present were Mrs. Altmayer, Miss Morgan, Mrs. Rinehart and Mr. Goe.
Roger Blaylock represented the Planning Division.
Acting Chairman Goe called for approval of the minutes dated 2 November 1978.
MOTION BY MRS. ALTMAYER, SECONDED BY MRS. RINEHART TO APPROVE THE MINUTES OF 2 NOVEMBER
1978. MOTION CARRIED.
DOUBLETREE INN /CONFIRMATION OF VARIANCE INTENT
The staff report and background information was presented by Mr. Blaylock.
Mr. Duffie came in and Acting Chairman Goe turned the Chairmanship over to him.
The public hearing was opened by Chairman Duffie. Mr. Timothy Dubois, Manager of the
Doubletree Inn was present to answer questions of the Board.
The Board discussed the modifications in design from 312 rooms to 393 rooms plus the
elimination of the free standing restaurant. The problems of pedestrian and motor
vehicle traffic on Southcenter Parkway and Strander Boulevard were discussed. Increased
traffic congestion especially on Strander Boulevard prompted the

Chambers to the Board of Adjustment for regular meetings. Chairman Duffie turned
the chair over to Vice - Chairman Goe so he could make the following motion:
MOTION BY MR. DUFFIE, SECONDED BY MISS MORGAN THAT WE WRITE THE MAYOR TO ACKNOW-
LEDGE RECEIPT OF HIS LETTER AND WE THANK HIM.
Mr. Duffie, Mrs. Rinehart, Miss Morgan and Chairman Goe voted yes.
Mrs. Altmayer voted no based on the belief that it is unnecessary. She did not
object to the use of the conference room, but the Board should feel free to use
the Council Chambers if necessary. She wanted it clearly understood that it was
not a demand of the Mayor or the City. Council to use the Council Chambers.
The possibility of the Southcenter Office Building having to apply for a variance
was discussed. The staff informed the Board that the Planning Commission had
reviewed the site plan and had approved the development plans with certain condi-
tions; however, the developer had not been able to meet one of the conditions.
It is possible that meeting all the conditions could result in the proposal not
complying with the Tukwila Municipal Code and a variance having to be requested
by the applicant.
The Board discussed the implementation of their definition of a "truck terminal ".
Mr. Goe felt the staff's method of reviewing business licenses was too slow and
ineffective. The Board was informed that a variance request for Garfield Trucking
from the automobile parking requirement would be on thier January 4th agenda.

INTRODUCTION:
FINDINGS:

The normal intent of a variance is to "take care of a special situation.
that cannot be dealt with in the ordinance without making it unduly com-
plicated." The Planning Commission has granted a Conditional Use Permit
to Garfield Transfer conditioned on obtaining a variance of the auto-
mobile parking requirement. Tukwila Municipal. Code 18.56.180 states,
"all industrial buildings hereafter erected, and all buildings converted
to such use or occupancy, shall provide on the premises, one off - street
parking space for each two employees or one thousand square feet of
building area (whichever is the greater), plus one parking space for
each temporary occupant during normal business hours, to be certified
by the owner of the building."
1. The building at 1040 Andover Park West was built by Cabot, Cabot,
and Forbes for a warehouse facility.
2. The 126,000 square foot building has 138 parking spaces for auto-
mobiles, plus loading and maneuvering areas in front of the loading
docks as per requirements of Tukwila Municipal Code 18.56.180 and
18.56.210.

3. Strains Transportation, the parent company of Garfield Transfer,
purchased the facility and began operation on June 1, 1977, as an
auto freight warehouse.
4. Garfield Transfer began operation from the site on January 3, 1978.
5. On September 21, 1978, the Board of Adjustment determined that Garfield
Transfer was operating as a "truck terminal."
6. On September 28, 1978, the Planning Commission approved a Conditional
Use Permit for Garfield Transfer to operate a "truck terminal."
The Craig Corporation leases 21,000 square feet in the northwest corner
of the building. Their offices and service center occupies 4,000 square
feet, the remaining area is warehouse storage.
S. Minimum parking required for the Craig Corporation per Tukwila Municipal
Code 18.56.160 and 18.56.180 is 30 spaces. Only 22 spaces are leased
to the Craig Corporation by Strains Transportation.
9. Strains Transportation and Garfield Transfer jointly employ approximately
30 employees.
10. United Parcel Service and Lincoln Moving and Storage are similar uses
in the immediate vicinity.
CRITERIA FOR GRANTING VARIANCE /CONCLUSIONS:
1 ''ize variance shall not constitute a grant of special privilege incon-
sistent with the limitation upon uses of other properties in the vicinity
and in the zone in which the property on behalf of which the application
was f'i Zed is located;
Conclusion: The United Parcel Service and Lincoln Moving and Storage
facilities were specifically designed for use as truck terminals,
providing truck storage areas in addition to the required automobile
parking. Allowing Garfield Transfer to provide less parking than
required of other similar uses in the vicinity gives them an unfair
economic advantage not enjoyed by others and will be granting of
special privileges.
2 That such variance is necessary because of special circumstances relating
to the size, shape, topography, location or surrounding of the subject
property, to provide it with use rights and privileges permitted to
other properties in the vicinity and in the zone in which the subject
property is located;
Conclusion: The special circumstances relate to the building size and
location on the subject property. No flexibility of site design
remained after the construction of the building for a change in use
to a truck terminal. Therefore, it would provide the owner with use
rights and privileges not permitted other properties in the vicinity.

Conclusion: Strains Transportation purchased the building and property
realizing the scope of their business needs. Therefore, the special
conditions and circumstances are a result of their own actions.

Conclusion: The Planning Commission has determined that the use will
not materially injure the appropriate use of neighboring property.
Therefore, it must be assumed that the conditions of their approval
would mitigate any use which is materially detrimental to the public
welfare.

Conclusion: The Comprehensive Plan specifically addresses on -site
parking for industrial uses in both Policy 7 of Objective 1 and Policy 4
of Objective 2.

"Promote adequate provisions for parking for all land uses."
Policy 4 - Objective 2 ;page 63)
"Discourage any changes from industrial or warehousing land uses unless
there is reasonable provision for parking demand."
Both policies use the words "adequate" and "reasonable." Therefore, a
special use would have to consider its own peculiar parking demands.
The Planning Commission considered those parking demands when reviewing
the Conditional Use Permit.

Conclusion: The property rights with the construction of the building
on the site were limited. Other facilities operating as "truck terminal"
in the vicinity do not enjoy a reduced automobile parking requirement.
SUIT :
The conclusions for criteria No. 1, 2, 3, and 6 do not support the granting
of a variance. Criteria No. 4 and 5 do support the variance request.
REam IENDATION:
The staff recommends that the Board of Adjustment deny the request based
on the above findings and conclusions.

The Tukwila Planning Commission at their regular meeting on Thursday, Septem-
ber 28, 1978, approved a Conditional Use Permit for your operation of Garfield
Truck Lines, if the following conditions are met:
1. A variance from the automobile parking requirement is granted from
the Board of Adjustment.
2. That all overnight storage of trucks and trailers be concentrated
to that area south of the building and east of the front yard setback,
and in front of the loading docks on the building's north side.
3. That the southerly portion of the west parking lot be modified to
accept truck parking and manuevering and will include a new 40 -foot
curb -cut and to separate automobile parking from truck use of lot.
4. New landscaping must be planted to screen the truck storage areas
south and west of the structure.
S. That a twelve (12) month time limit is placed on the permit for comple-
tion of the above stipulations.
To comply with the first condition it will be necessary for you to complete the
enclosed application. The deadline for processing the application on the Novem-
ber Board of Adjustment meeting is Thursday, October 12, 1978. If you are unable
to meet this deadline the Board of Adjustment will meet again on Thursday,
December 7, 1978.

Minutes of the meeting, 28 September 1978.
Chairman Kirsop opened the public hearing at 8:20 p.m.
The regular September Planning Commission meeting was called to order by Chair-
man Kirsop at 8:05 p.m. Other Planning Commission members present were: Mrs.
Avery, Mr. Bowen, Mr. Richards, Mr. Sowinski and Mr. Welsh. Fred Satterstrom,
Roger Blaylock and Charlene Howat represented the Planning Department.
MOTION BY MR. BOWEN, SECONDED BY MR. RICHARDS AND CARRIED TO APPROVE THE REGULAR
MEETING MINUTES OF 24 AUGUST 1978 AS PREPARED.
Mr. Bowen excused himself from participating on this item due to business rela-
tions with the Frandsens.
Mr. Blaylock explained the Board of Adjustment's determination that Garfield
Truck Lines is operating as a truck terminal and read the revised staff report.
Mr. Carl Jonson, 300 Central Building, representing the Frandsens, introduced
Mr. Kenneth Frandsen.
Mr. Kenneth Frandsen, 4640 Summerset, Bellevue, explained that they were going
to landscape with plants that would grow 4 to 5 feet tall. He also explained
that they would park the short box trucks along south parking area and park the
larger trucks at the loading docks. He said he could not comply with stipulation
#2 of the staff report.
Chairman Kirsop closed the public hearing at 8:30 p.m.
Mr. Satterstrom explained stipulation #2 of the staff report. Discussion on
truck parking areas followed.
Mr. Blaylock explained that stipulation #1 of the staff report would be required
if the Conditional Use Permit was granted.

AGENDA ITEM I I IA: REVISED STAFF REPORT - Garfield Truck Lines
BACKGROUND UPDATE INFORMATION:
New information obtained from Mr. and Mrs. Frandsen and from an on -site
inspection by staff forms the basis for this revised staff report. Origi-
nally the building was constructed by Cabot, Cabot & Forbes as a warehouse
consisting of 126,040 square feet. The parking requirement of 126 cars
was exceeded by 12 spaces. No space for parking trucks and trailers was
provided except for that area immediately in front of the nine loading docks.
Strains Transportation subleases 20,000 square feet to Craig Stereo. Strains
Transportation owns Garfield Truck Lines, which is also operated from the
site. The warehouse is used mainly for the storage of Proctor and Gamble
products. Strains Transportation has allocated the use of 20 parking stalls
to Craig Stereo. Garfield Truck Lines and Strains Transportation employ on
an average of 35 employees. It appears that the present operation may not
need all of the automobile parking area originally required. Staff is un-
certain as to what the present or future need is.
On September 28, 1978, I.1r. Frandsen conducted a tour of the site with the
planning staff. Seven trucks and twenty -six trailers were on the site.
Of these eight were not owned by Garfield Truck Lines. This activity
appears to be somewhat greater than that observed on June 29, 1978 when
seventeen (17) trailers and four (4) trucks were observed. The majority
of the trailers are being stored along Andover Park West on the west side
of the building, while the employees are parking on the south side of the
building by the main loading docks.
Access to the major truck storage areas on the south and west sides of the
building is limited to two curb cuts on Andover Park West. The southern
curb cut was authorized at 40 feet, while the northern curb cut was 30 feet.
The trucks enter mainly through the southern entrance and leave through the
northern curb cut. The conflict between auto and truck traffic at the northern
curb -cut makes it a hazardous condition.
INTENT OF SITE PLAN REVIEW IN C -M ZONE:
The basic intent of the C -M zone is to create a park like atmosphere for
industrial users. Therefore, all requirements are reviewed by the Board
of Architectural Review. Normal off - street truck loading and unloading is
addressed as an activity that normally accompanies warehousing and is
required under Chapter 18.32.030(d).

"An off -street loading space, having access to a public thoroughfare,
shall be required adjacent to each business building, hereafter erected
or enlarged, if the use of such building entails deliveries to it or
shipments from it, and such loading space shall be of adequate size to
accommodate the maximum number and size of vehicles simultaneously
loaded or unloaded, in connection with the business conducted in such
building. No part of the truck or van using the loading space may pro-
ject into the public right -of- way." (Ord. 635 S11, 1970; Ord. 251
S4 -12 (part), 1957).
The Board of Adjustment has determined that Garfield Truck Lines is operating as
a truck terminal.
CONSIDERATIONS FOR APPROVAL OF TRUCK TERMINALS IN A M -1 ZONE BY THE PLANNING
COMMISSION PURSUANT TO TMC 18.40.010 (41)
The following criteria are placed in the Tukwila Municipal Code for the Planning
Commission to review and consider in the decision process for allowing or not
allowing truck terminals in an M -1 zone, or C -M zone:
1. Traffic requirements of the streets on which such terminals would have
access.
COMMENTS: The streets appear to be adequate to handle truck traffic.
2. The location and width of entrances and exits to such truck terminals.
COMMENTS: The curb cuts are typical of the size curb cuts in the indus-
trial area which are supported by trucking traffic. However, the turn-
ing radius of some of the larger tandem trucks create a hazardous situa-
tion when using the northern exit. Two -way use of the accesses is limited
when occupied by a truck.
3. The provision of sufficient space, and open, enclosed and covered docks
to allow the trucks when loading, unloading, maneuvering and parking to
be entirely on private property.
COMMENTS: There is sufficient space for maneuvering trucks to the
loading docks. The parking lots, however, were designed for passenger
cars and not for trucks, consequently truck trailers are parked at an
angle and occupy 5 or 6 parking stalls for each trailer unit. The
blacktop in the parking lot is breaking up due to the heavy weight of
the trailers. All parking of trailers is on private property, with the
majority of it being parked adjacent to and along Andover Park West.
There appears to be adequate parking available on the site, if a
variance is obtained to reduce the automobile parking required for the
warehouse.
4. That the use will not effect adversely the present character or future
development of the surrounding community.
COMMENTS: The property is functioning as a truck terminal but it was

not specifically designed for a truck terminal. Similar nearby uses such
as United Parcel and Lincoln Moving and Storage have provided special
storage yards for the majority of their overnight storage. The concentra-
tion of trucks on this site without a storage yard or screened visually
impacts the park like quality of the surrounding properties.
RECOMMENDATION:
The majority of the evidence indicates that a Conditional Use Permit should be
granted only if the following conditions are met:
1. A variance from the automobile parking requirement is granted from the
Board of Adjustment.
2. That all overnight storage of trucks and trailers be limited to that
area south of the building and east of the front yard setback, and in
front of the loading docks on the buildings north side.
3. New landscaping must be planted to screen the truck storage area south
of the structure.

At the request of the Planning Commission, the Board of Adjustment of
the City of Tukwila has considered the question of whether Garfield
Transfer is currently operating as a truck terminal. Their decision is
based upon their understanding of the staff's interpretation and a list
of functions of a trucking terminal presented by Mr. Dick Goe, a member
of the Board, at their meeting on Thursday, September 21, 1978. The
following is the motion of determination:

4. The location where rolling stock of the common carrier is parked
during periods of non -use.
Each common carrier, for various reasons, may or may not incorporate all
of these functions. It should also be considered that some of these func-
tions are common to companies which provide trucking services under con-
tract Carriage and by companies which have private carriage.
In the matter presently before this board we have been requested to deter-
mine if Garfield Transfer Company is operating a "Truck Terminal ". We are
advised that the land and facility owned by Garfield Associates is partially
leased to Strains Transportation which "Conducts a private warehouse busi-
ness for the Proctor and Gamble Co. (Company) ... " We are further advised
Strains Transportation, holding Common Carriage Permit number CC -10545 is-
sued by the Washington Utilities and Transportation Commission (W.U.T.C.),
is authorized to perform as a common carrier within the Seattle commercial
zone (as defined by the Commission).
Garfield Transfer Company, holding Storage Warehouse License number 420 and
Common Carriage Permit number CC -1596 issued by the W.U.T.C., is authorized
to perform as a warehouseman and to perform common carriage within the state
of Washington.
An easily understood explanation of the ownership and functions of these two
corporations is found in Mr. Carl Jonson's 5 September 1978 letter to the
Board of Adjustment.
From information received from representatives of the Interstate Commerce
Commission (I.C.C.) and the W.U.T.C. it is apparent that the term "Trucking
Terminal" is not defined by regulation as these bodies do not exercise their
regulatory powers in dealing with the physical site used by common carriers.
However, there are at least four functions of a truck line that are commonly
held by people in transportation to be functions of a truck terminal.
1. A location to receive pick -up and /or delivery orders which are placed
by customers.
2. The location of the dispatcher (functioning with that or any other
title) which directs the activities of the truck driver.
3. The location used by the truck common carrier to receive shipments
for transloading, transhipping and /or consolidation or from which
transportation ensues after transloading, transhipping or de- consoli-
dation.

that Garfield is a properly permitted common carrier whose business is
primarily, but not exclusively, the transportation of Proctor and Gamble
proudcts at the direction of Garfield's parent company, Strains Transporta-
tion.
Mr. Jonson's letter, on behalf of Garfield's owner, has properly disting-
guished that the matter of Truck Terminal definition and application is a
matter of land use consideration and zoning ordinances instead of a matter
to be considered under transportation regulation. However, the type of
business which uses land must be considered to the extent that we must
examine the use of the land by that business. Mr. Jonson brings to our
attention that the facility (a warehouse) is used for receiving, temporary
storage and distribution of a single client's product line and that Gar-
field, being under management control of Strains, represents only an ex-
tension of Strains warehousing business.
In considering the use of land by a company we must consider in this case
that Garfield, although a wholly owned subsidiary of Strains, is in fact a
separate corporation which holds separate licenses and permits. The cor-
poration known as Strains has already been issued its Tukwila City Business
License. The other corporation known as Garfield has applied for but has
not been issued the Tukwila City Business License which is required for that
corporation to continue business in Tukwila. The reason for non - issuance of
that business license is because of the Planning Staff's determination of
land use that Garfield makes of this property. Therefore, our only con-
sideration should be with the corporation known as Garfield and how it uses
the property.
It should be understood that it is a common practice of truck lines to
leave trucks and /or trailers parked overnight at the loading dock of their
shipping clients which ship or receive in sufficient volume to require
truck -load or trailer -load trucking. This is usually done as a matter of
loading or unloading convenience for the client or trucker. It seems that
we are intended to understand that this is the only use Garfield makes of
this property. If Garfield did, in fact, operate its terminal at another
location we might be inclined to follow this thinking and dis -allow the
Truck Terminal use as concluded by the Planning Staff. However, since Gar-
field does not apparently have and use another location for terminal func-
tions it is apparent that this property is serving as the terminal location
and that personnel, either of Strains or Garfield, are performing functions
generally ascribed to a Truck Terminal.
It is my opinion, based on facts presented and opinions commonly held by
transportaion insiders, that the primary function of the property used by
Garfield is that of a Trucking Terminal.

Mr. Stoknes read the staff report, a letter from Mr. Charles Baker, Architectural
Control Committee and Mrs. J. Frandsen, President of Strains Transportation Com-
pany. (Both letters are attached as a part of these minutes.)
Chairman Kirsop opened the public hearing at 10:05 P.M.
Mr. Carl Johnson, representing Garfield Truck Lines, explained the warehouse proposal.
Mrs. Frandsen, 4640 Summerset N.W., Bellevue, described the proposal further. She
mentioned they will repair the asphalt in the parking lot as needed as well as the
curbs. She mentioned they distribute mostly Proctor and Gamble products who have
strict requirements which they comply with.
Chairman Kirsop closed the public hearing at 10:20 P.M.
A discussion regarding the parking lot followed. Mfrs. Frandsen mentioned they
intend to park the trucks at the south end of building.
Mr. Richards asked if number of parking spaces met code requirements after
the trucks were parked. Mr. Stoknes answered NO.
Mr. Richards suggested referring this item to the Board of Adjustment to deter-
mine if the proposal is a truck terminal and determine the issue on parking.
Mr. Satterstrom mentioned that the burden of getting a variance should be on the
applicant, not the City. The Planning Commission may refer the item to the Board
of Adjustment and if the Board determines that it is not a truck terminal, then
the applicant should apply for a variance from the parking requirement.
MOTION BY MRS. AVERY, SECONDED BY MR. SOWINSKI AND CARRIED THAT THE ISSUE OF
WHETHER OR NOT GARFIELD TRUCK LINES, IN THIS OPERATION, IS ACTING AS A TRUCK
TERMINAL BE REFERRED TO THE BOARD OF ADJUSTMENT.
Mr. Johnson agreed to bring this item before the Board of Adjustment during their
September meeting.

Mr. Richard Davidson, A.C.C. member, advised the A.C.C. that a
number of trailer units were being parked and left on the Cabot,
Cabot and Forbes development located at the corner of Andover
Park West and Minkler. Boulevard. Mr. Davidson stated that the
people involved are, in fact, running a truck terminal. Mr.
Richard Kirsop, A.C.C. member and also Chairman of the Tukwila
Planning Commission, stated that he was aware of this and said
it was a conditional use, but has not been approved, and the
parties involved are without a business license for this purpose.
Charles Baker, Chairman of the Architectural Control Committee,
stated that he believed the A.C.C. should let the City handle
the problem.
When this matter was brought out for discussion again during the
July 11, 1978 Architectural Control Committee meeting, Mr.
William E. Boeing, Jr., A.C.C. member, made a motion directing
me, as Chairman of the Architectural Control Committee, to
write a letter to the City of Tukwila Planning Department
stating the A.C.C.'s objection.to the issuance of a conditional
use permit or variance for the truck terminal on the premises
located at the southeast corner of Minkler Boulevard and
Andover Park West. Mr.. Robert Keever, A.C.C. member, seconded
the motion. The motion passed unanimously.
I have requested our secretary to send copies of the minutes
of the June 13, 1978 and July 11, 1978 A.C.C. meetings to your
attention for your information. As you will note, the minutes
of the June 13, 1978 and July 11, 1978 Architectural Control
Committee meetings states the concern of the A.C.C. members
regarding the Garfield Transfer Company, Inc.'s practice of
parking numerous vans and trailers in the automobile parking
areas along Andover Park West and Minkler Boulevard which, in
fact, appears to constitute a freight terminal operation on
the premises. A.C.C. members pointed out that if this is a

freight truck terminal operation, it is apparently being
operated in violation of the Tukwila Zoning Code which requires
a public hearing to be held before the Planning Commission
after an application to establish a freight terminal operation

These references and others regarding the Garfield Transfer
Company, Inc.'s operation at the Andover Park West /Minkler
Boulevard location are briefly enumerated in the minutes of
the June 13, 1978 and July 11, 1978 A.C.C. meetings.
The motion previously mentioned stating the A.C.C.'s objections
to the issuance of a conditional use permit or variance for
the operation of a truck terminal at the southeast corner of
Minkler Boulevard and Andover Park West is included in the
last paragraph, page three, of the July 11, 1978 minutes of

In reviewing the .staff report recommendation regarding granting of
a Conditional Use Permit to Garfield Truck Lines, for action at the
July 27, .1'J'(8 Planning Co<<unisuion mooting, we are quite willing to •
work with City Staff to minimize the visual effect of truck and
trailer parking between the building and street, possibly using
increased landscraping, trees, or hedge plantings. However, it should
be noted that eight out of eleven industrial buildings between
Strander and 180th street along Andover ALSO park trucks between
the building and street and we. feel that the standards applied should
be no more stringent for Garfield than for other buildings.
Further, in relation to parking lot maintenance, this letter will
serve as our assurance to the City of Tukwila that we will maintain
our parking lot and repair any broken asphalt and curbs as needed.
If you disagree or have further question, please give me a call before

CONDITIONAL USE PERMIT: Garfield Truck Lines
Garfield Truck Lines is presently operating out of a building owned by
them at 1040 Andover Park West. When it was brought to the attention of
the City that they were operating in that location, the City notified them
that a truck terminal requires approval by the Planning Commission, after
public notice and hearing, prior to being to being allowed to operate in
a C -1 zone. Reference Section 18.40.010 (41) of the Tukwila Municipal Code.
BACKGROUND INFORMATION
On an inspection of the property and a tour with the local manager /operator,
the following information was learned or observed:
1. Strains Transportation is the parent company of Garfield Truck Lines.
Their primary function is warehousing and delivery of goods to other
corporations.
2. Approximately 90% of Garfield Truck Lines business is direct support
to Strains Transportation in moving goods to and from the warehouse
facility in the same building at 1040 Andover Park West.
3. Garfield Truck Lines presently owns 18 trucks and 21 trailers.
FINDINGS
1. During an inspection of the property on June 29, 1978, the following
were observed parked on the property:
a. Eight (8) 40 -foot container trailers and two (2) 40 -foot open
flatbed trailers parked along Andover Park West.
b. One (1) 26 -foot container trailer and one (1) tandem trailer
located on the north adjacent to Minkler Boulevard.
c. Four (4) trucks and five (5) 40 -foot enclosed trailers on the
south side of the building.
2. Some of the blacktop in the parking lot and curbs have been broken by
heavy vehicles.
3. The landscaping along Andover Park West is approximately a 3 -foot high
grass berm with a variety of deciduous and evergreen trees scattered
throughout.

4. The building that Garfield Truck Lines operates out of is a concrete
tilt up building, attractively painted and well kept.
5. Development of the land on the west side of Andover Park West appears
to be going into a combination of warehousing and office uses, with a
probability of a majority of it being office related.
CONSIDERATIONS FOR APPROVAL OF TRUCK TERMINALS IN A M -1 ZONE BY THE PLANNING
COMMISSION PURSUANT TO TMC 18.40.010 (41)
The following criteria are placed in the Tukwila Muncipal Code for the Planning
Commission review and consider in the decision process for allowing or not
allowing truck terminals in an M -1 zone, or C -M zone:
1. Traffic requirements of the streets on which such terminals would have
access.
COMMENTS: The streets are adequate to handle truck traffic.
2. The location and width of entrances and exits to such truck terminals.
COMMENTS: The curb cuts are typical of the size curb cuts in the industrial
area which are supported by trucking traffic. Curbs have been broken up by
the truck traffic on this site.
3. The provision of sufficient space, and open, enclosed and covered docks
to allow the trucks when loading, unloading, maneuvering and parking
to be entirely on private property.
COMMENTS: There is sufficient space for maneuvering trucks to the
loading ducks. The parking lots, however, were designed for passenger
cars and not for trucks, consequently truck trailers are parked at an
angle and occupy 5 or 6 parking stalls for each trailer unit. The
blacktop in the parking lot is breaking up due to the heavy weight
of the trailers. All parking of trailers is on private property, with
the majority of it being parked.adjacent to and along Andover Park West.
There appears to be adequate parking available on the site.
4. That the use will not effect adversely the present character or future
development of the surrounding community.
COMMENTS: Visually, the trailer units parked along Andover Park West
are very visable from Andover Park West and surrounding properties to the
west. The development across the street to the west in the vicinity
includes vitual moving and storage, Hitachi, and office buildings.
Directly across the street to the west is vacant land, the development
of which could be influenced by the appearance of this property.
RECOMMENDATION
While quite a bit of the industrial area in the vicinity is supported by truck
traffic, none of them are as significant or approach the scope of this operation.

In other instances where truck traffic is present, it is parked in the rear or
sides of the buildings.
It is the recommendation of Staff that this Conditional Use Permit not be
granted unless the applicant can minimize the visual effect of the truck and .
trailer parking along the site. Additionally, some insurances will need to
be given by Garfield Truck Lines that they will maintain their parking lot
in an approved condition and repair any broken asphalt and curbs as needed.
It should be the burden of the applicant to propose to the Planning Commission
how the above can be accomplished. It is further recommended that if the appli-
cant cannot demonstrate this satisfactorily to the Commission by the regular
meeting on August 24, 1978, that this application be denied.

statement would not be required but the planning staff is waiting
for Garfield Transfer Company, Inc.'s filing fee. He suggested
that the Planning Commission hold a special meeting July 13,
1978, to review this matter. The Planning Commission, by motion,
tabled this matter until the July 27, 1978 regular meeting. The
ensuing A.C.C. discussion centered around Garfield Transfer
Company, Inc.'s practice of parking numerous vans and trailers
in the automobile parking area along Andover Park West and
Minkler Boulevard which, in fact, appears to constitute freight

This correspondence is intended to affirm the position of the Planning Division
of the Office of Community Development regarding the function of Garfield Truck
Lines at 1040 Andover Park West without a Tukwila Business License.
Inasmuch as this office deems the function of Garfield Truck Lines in and of
• itself constitutes a truck terminal (as that term was defined by this office in
September 1977) and the Tukwila Zoning Code (Title 18, Tukwila Municipal Code)
requires Planning Commission approval of truck terminals in the industrial park,
we are unable to authorize issuance of the Business License until the zoning .
requirements are fulfilled. A copy of the interpretation, as it applies to
Garfield Truck Lines, is attached for your information. •
Options available to you include:
A. Obtain a Conditional Use Permit;
B. Appeal the administrative interpretation; or
C. Lease and desist the operation of Garfield' Truck Lines.
One of the three alternatives indicated above must be implemented within thirty
(30) calendar days from date of receipt of this letter. Should you have any
