Chairman Kjell Stoknes called the meeting to order at 10:O0.a.m. at the City Hall Annex. Members Hubert Crawley and Terry Monaghan were present. Fred Satterstrom represented the Planning Division. AGOSTINELLI SHORT PLAT The committee discussed the ownership of the subject property. It was discovered that parcel 1 and parcel 2 were owned by separate parties. It was noted by the committee that a complete short plat application must have the signature of the property owner of parcel 1. The relationship of the Puget Power right -of -way to the proposed subdivision was discussed. It was noted by the committee that the legal description on the short plat did not cover all the land to be subdivided. Gary A. Nilsen, the applicant, stated that it was not his intention to retain the division line between the Puget Power right -of -way and parcel 2 as shown on the short plat application. The committee discussed the title report. It was noted that the title report was incomplete due to the fact that it did not cover parcel #1. The committee discussed the parking needs of the Village Green Apartments. It was noted that the parking requirements on the Village Green site may be inadequate. It was decided that the city should investigate through the City Attorney to find out the obligation of the city to enforce the parking requirement of the Villiage Green site. Discussion of a pathway between Interurban Avenue and the Green River ensua It was noted by the committee that a drawing depicting the edge of pavement' of Interurban Avenue would be necessary in order to determine whether a pathway would be feasible. FACKGROUND: SUBJECT: Subdivision by Land Sales Agreement Prior to King County Ordinance #2908. On 27 September 1976, the King County Council enacted Ordinance 2908 which directed the County Assessor to disapprove applications for segregated assessment of real property unless the land or lot was within an approved short plat or final plat. This ordinance, in effect, put a stop to c7efacto subdivisions of land by land s ' es agreement (real estate contracts) filed with the county auditor and segre- gated for tax purposes by the County Assessor. Until the adoption of Ordinance ;:2908, subdivision of land by land sales agreement was a common practice, particularly in cases of large residential lots where the "excess" would be sold off as a bui iding site. The practice, however, was not limited to residential lots but involved commercial and industrial l ands as well. Those factors which probably contributed to the popularity of this practice were 1) the lack of short plat ordinances by local governments, and 2) the accepted procedure of the County to record real estate contracts and segregate taxes at the request of the new owner. It is expected that several such defacLo subdivisions of land have occurred in the City of Tukwila prior to the enactment of Ordinance ;12902. Indeed, it is because the Planning Division has encountered this situation that this policy procedure is created. On 2 Nay 1977, the City of Tukwila adopted revised preliminary and final plat requirements and established short plat regulations and procedures for the first time (Ordinance 1014). POLICY: Short platting will not be required by the OCD where a lot can be shown to have been created by real estate contract properly recorded with King County prior to the effective date of King County Ordinance #2908 and which has been segregated for real property tax purposes by the King County Assessor. In addition, this policy is conditioned upon all other laws of the City being complied with at the time of this sale. On 26 July 1978, Ron Agostenelli filed a short plat application with the City of Tukwila. The subdivision proposed to separate the Village Green complex from the vacant portion located to the south, (SEE, attached map). The Short Subdivision Committee (SSC) held a meeting on the proposed short plat on 10 August 1978. The Committee decided that the application. was incom- plete and voted to table the matter until certain documents were provided. Minutes of thfs meeting are attached. All but one of the documents requested by the SSC has been provided. to the City. Only the signature of the other property.owner (Len Rivero., who owns . the Village Green) indicating that he is a party in the short plat application has not been submitted to the City since 10 August 1978. . However, the period since the action of the SSC, the applicant has'verbally requested that the City of Tukwila recognize the site as already subdivided by virtue of.a recorded real estate contract. This real estate contract is dated 30 September 1974, conveys the Village Green Apartments along with a portion of • Tract 1 to Cussen /Quail (copy attached), and was recorded with King County 2 October 1974. Whether or not the abovementioned real estate contract in effect legally sub - divided,Tract 1 into two lots is the question in this case. If so, then a short plat at this time is not required: If not, then what? I am. including herewith a copy of. the subdivision regulations (Title 17) which were in effect during 1974 and remained in effect until our new regulations were adopted on 2 May 1977. Also, I have enclosed a copy of King County ordinance #2908 which requires compliance with local subdivision regulations as a prerequisite 6230 Southcenter Boulevard r Tukwila, Washington 98188 ■ (206) 242 -2277 Mr. Larry Hard LeSourd, Patten, Fleming et al to segregation for tax purposes. Prior to September 1976 when Ordinance #2908 was adopted, it was not uncommon for real estate contracts (such as the Village Green contract) to convey property which did not conform to an approved final plat or short subdivision. After King County implemented this ordinance, there was then a check on further "subdivision" of this nature. Please review the facts and the law in this matter and forward your analysis to me as soon as you can. I need to know whether the City must require a short plat in this case or whether we may consider the lot legally subdivided. Your consideration of this matter is appreciated.
