COUNCIL ACTION MElait:G (AiE AGEAOA ACTION WE IflM CITY T WASHINGTON REPEALED BY 025 ORDINANCE NO 1e WHEREAS, An environmental checklist was submitted and reviewed by all affected parties and agencies; WHEREAS, Comments received prompted a Proposed Declaration of Signi- ficance on May 18, 1978; WHEREAS, The applicant submitted a revised application mitigating the points of concern; WHEREAS, A Withdrawal of the Declaration of Significance was made 'on June 22, 1978 based upon compliance with mitigating measures in the Planning . Division's EPIC File No. FD -58;. WHEREAS, Mr. Horst Ehmke has agreed to the above mitigating measures on June 23, 1978; WHEREAS, the Planning Commission at their 24 August 1978 regular meet- ing and after holding a public hearing has recommended approval of the rezone conditioned upon fulfillment of eight (8) stipulations; and, WHEREAS, the City Council has duly considered the environmental impact of the proposed action and the recommendation of the Planning Commission. That the property described in the attached legal descrip- tion (Exhibit "A ") and as shown on the attached site map (Exhibit "B ") is hereby reclassified to R -4, with conditions as specified in this ordinance. Section 2. The rezoning to R -4 is subject to the following stipulations: a. Dedication 5' of property along 62nd Avenue South to the City of Tukwila and participation in an L.I.D. for the improvement of said street, utilities, sidewalk, lighting and all related im- provements. b. This ordinance shall not become effective until such time as a joint egress easement is executed and recorded with the property to the north. Review and approval of the above by -laws by the city and recording by the owner shall occur prior to issuance of any occupancy per- mits for the project. f. The Planning Commission recommended the City Council approve the reclassification with the following conditions: 1. Development of the property under the C -1 classification shall be limited to a single office building which may contain related commercial service uses customarily incident to office use. 2. All buildings shall be set back a minimum of 25 feet from the right -of -way line of Southcenter Boulevard and the unvacated portion of the Renton -Three Tree Point Road. 3. The side and rear yard setback requirements of the R -4 district shall apply to this property. 4. Rear property line to be landscaped to create an effective buffer to the medium- density residential land to the north. 5. Development plans, including but not limited to site, elevation, landscape, and building materials shall be subject to review and approval of the Planning Commission sitting as a Board of Archi- tectural Review as established in Chapter 18.32 of the Tukwila Municipal Code. Page 69, Administration did not accept Mr. Mecklenburg's definition of recreation vehicle which would be any vehicle 8' 6" x 20' x 8' high and shall include travel trailers, campers, busses, and boats. He said a lot of small recreation vehicles could park in a regular parking space. Mr. Ehmke said they had to draw the line somewhere, it looks pretty cluttered up with recreation vehicles parked around. He said there are plenty of storage facilities around where they could be parked. Councilman Bohrer said this recreatic vehicle parking does not appear to be part of the condition of the rezone the rezone only uses the site plan as a matter of reference. Councilman Harris said this recreation vehicle parking would have to be policed by the condominium owners and not the City. MOVED BY HILL, SECONDED BY SAUL, THAT THE NECESSARY ORDINANCE BE PREPAREC FOR THE REZONING OF THE EHMKE /KATO /KATO PROPERTY AND IT BE ON THE AGENDA OF THE DECEMBER 4, 1978 REGULAR COUNCIL MEETING. CARRIED. John McFarland, Administrative Assistant, said we have a franchise with Cable TV. He said the Federal Communications Commission is turning over to local government the responsibility of regulating and administraI ing the CATV and CATV franchises. He said we have contracted with the City of Seattle for about $500 a year in 1978. He continued that the former director for the City of Seattle has established a consulting service which would offer a scope of services not to exceed 5175 a year. Some of their services would be receiving and solving complaints, admin- istration of all franchises, consumer protection, advise the City regard- ing bonds and insurance, evaluate and ascertain if the City is properly protected. Mr. McFarland continued that Mr. Hurd has a lot of experiencE in this field. He said he thought language could be inserted in the contract that would permit the City to terminate the contract if they were not satisfied. Administrative Assistant John McFarland stated Administration Policy Procedure 01 -25 was to establish procedures for securing City Hall durin non - working hours, weekends, and holidays and to establish procedures fo providing access to City Hall by employees during non - working hours, weekends, and holidays. The Committee of the Whole meeting was called back to order by Council President Van Dusen with Council Members present as previously noted. Police Chief Sheets said he felt it was important to have two lieutenant He said the supervision of two is important. He said the Police Departs has asked for this second lieutenant for the past three years. He said they have to have this division of supervision to operate efficiently. One would supervise the training and the other the operations. Counciln Hill said his concern is what will do the most good for the City, the addition of two patrolmen or one lieutenant. Chief Sheets said it woulc be most difficult to weigh and balance an answer. Each person has an important roll in the Police Department. If the officers are untrained they are of no value to the City. Council President Van Dusen asked if all training is done in- house. Chief Sheets said there is a program in conjunction with Washington State. He said he would like 40 hours of training for every officer. He said they also feel in the Department that one of the priorities is the job evaluation program. Kjell Stoknes, OCD Director, indicated the location of the property on the wall map. Mr. Monaghan explained the assessment roll is made up and the assessment to each property owner is apportioned according to the amour of property that will be affected and benefitted by the LID. Mr. Monaghan said the next step will be to prepare an ordinance establishing the LID. The affected property owners can then file a protest. If 60% object the ordinance will be null and void. He said there will be development on 62nd Avenue and the proposal is to have streets and utilities adequate to serve the developments. He said the street has to be improved, we can do it on an LID or we can do it on a petition of the property owners who will benefit from the improvements, or it can be done by the property owners under a property agreement. He said he thought it would be reasonable to give the two week extension requested by Mr. Frick. He said the property owners would have to accept some method to improve the street. Council President Van Dusen said the same method was used for this assessment as those in the past. Councilman Bohrer said he was in favor of the two week extension. He said he felt it would be unwise to delay the improvement for a long time, if it is delayed a year it would mean prices would escalate at least 10 %, and the City was criticized on a recent LID because it had to be delayed and prices increased. He sai there are lots of units that will be served and development will be stymie if we cannot get underway with the LID. Councilman Harris asked if this LID was started as a result of a petition, a developer's agreement, or in- house. Mr. Monaghan said it was established as a result of a developer agreement. He said water was added because the water system was not adequate, there are no sanitary sewers on 62nd and that had to be provided Mayor Bauch said this is a health and safety factor. The road has to be improved and occupancy permits will be withheld until the roads are improved. Mr. Ehmke, property owner, said his original plans had been revised. He said the total number of units would be 102 rather than the original 114. It would be 17 six- plexes rather than the original 19. There would be 20 parking stalls, two per unit, the units would be 19.4 per acre rather than 21.7. He said the site coverage was 112,472 square feet or 49 %; recreation space required was 20,400 square feet and they had provided 29,000 plus square feet. Council President Van Dusen asked if the drive- ways had been changed. Mr. Ehmke said they are 23 feet which was shown on the old plan. Kjell Stoknes, OCD Director, said he thought the parkin aisles should be 23 feet. He said the code required one and one -half parking spaces per unit and theyy had provided two. Mr. Mecklenburg, architect, said it was their intent that the Condominium Owners Associati Declaration, By -Laws and Covenants, shall provide that no recreation vehicle be allowed to park on the site. He said they feel it would be impossible to provide such parking for all owners, therefore, in fairness to all it seems that off -site storage arrangements by each individual would be more equitable. Mr. Stoknes said he did not see a problem re- garding the parking of recreation vehicles. He said the density is down two units and everything has been reduced. The areas will be isolated and defined in a conceptual way of what is needed by the City. They would work with the City in setting up priorities. They would work out a rational way to do this. He said they do not sell anything. He said they would wog out alternatives and select the best approach for the City. He said they would put out a RFP (Request for Proposal). He said the would help the City choose the best proposal. They would work wit the City in the implementation of its needs. Council President said there were steps they had outlined in the development of the study. Mr. McLean said they would set up an interview schedule to find what information is needed and the needs the City is not get ting.They would be plugged in along with the other departments within the City as to needs. When all of the steps have been completed they would come back with a summary - time, money, type of computer. Council President Van Dusen asked Mr. McLean if they would be agreeable to set up a contract with the City evaluating each step with payment being received at completion of each step. Mr. McLean said that would be agreeable. They could break off at any point, if desired. Councilman Harris said Mr. McLean had started out with the assumption a computer was necessary. Mr. McLean said they would do a needs study and see the needs. He sai if they find the City's current systems are complete as they are, they would so state. He said in about 10 to 25% of the reports they make they recommend against computers, at least at that time. Council President Van Dusen asked Mr. McLean if, as. they go throus the needs study, would they recognize administrative problems the City might have. Mr. McLean said yes, if they find things that can be done more efficiently they would suggest and report on then Councilman Bohrer asked if they would define the existing system and see how the City might utilize data processing to make it more efficient. Mr. McLean said they would deal with the total process Councilman Bohrer asked if they were also going to look for changE to the whole procedure. Mr. McLean said yes. Councilman Saul asked about the cost. Mr. McLean said it would be $8,640 plus thE cost of typing the RFP. Councilman Van Dusen said he felt the services the City would get would be worth the cost. Mr. Swanson, Finance Director, said he thought it would show the needs of the various departments. He thought it would be good to have an expert do this study and offer alternatives. He said he liked the idea of an integrated plan. He said the City can evaluate thE report step by step and have formal approval by the City Council and the Mayor at the end of each phase. Council President Van Dusen said he had .been dissatisfied with some of the studies that have been made but he thought the City would get something out this one. Councilman Bohrer said if the Council reviews the study at each step it seems they will understand .it better. Count man Saul asked about the cost of computers. Mr. McLean said it if. hard to say, but looking at other cities and other activities he would say between 40 to 80 thousand dollars. That has been the range. CARRIED. 2h mke /Kato /Kato Rezone Kjell Stoknes, OCD Director, said the owners of the property (Property located on located at Interurban on the west side of 62nd Avenue South are ri 62nd Ave.. So.) questing a rezone from C -1 and R -3 to R -4 to allow development of 19 6- plexes (114 total units) on a 5.26 acres site located on the west side of 62nd Avenue between South 153rd Street and.Southcenti Boulevard. He said the Comprehensive Land Use Plan Map designate! the entire site as high - density residential, defined as 17 plus units per acre in apartment type development. The site is locates near the density break to medium density residential on the Comprehensive Land Use Plan Map. There would be approximately 21 . units per acre. Mr. Stoknes said 228 parking stalls are proposed Page 3 DISCUSSION - Contd. Ehmke /Kato /Kato Rezone (Property located on 62nd Ave. So.) - contd. RECESS 8:45 - 8:50 P.M. c and a number of the stalls will be covered. He said one and one -half stalls per unit are required per code. He said access to the property is from 62nd Avenue South. He said two curb cuts and a shared access road with the Park Place development to the north are proposed to ingress /egress to 62nd Avenue South. He said the proposed buildings will require numerous cuts and fills it order to provide suitable building sites. He said recreation space required for this development is 22,800 square feet. According to the applicant, approximately 27,000 square feet of recreation space is provided. Most of this space is located in the pool area and the four 6- plexes near the pool and around the four 6- plexes located to the west. The buildings will contain three levels of living units. Exterior of the buildings will be composition shingl roof with cedar siding and stucco. The development is proposed for owner occupancy. Mr. Stoknes said the proposed density appear! to be consistent with the Comprehensive Land Use Plan Map. He sal( the existing roadway (62nd Avenue South) and utilities appear to be inadequate to service the proposed development. Mr. Stoknes said the staff recommends that the proposed rezone be approved with some conditions; the dedication of 5 feet of property along 62nd Avenue South and participation in an LID for improvement of the street; construction, of sidewalk along 62nd Avenue South; submis- sion of detailed siteplan, landscape plan, and recreation space plan prior to issuance of building permit; access of 62nd Avenue South shall be reviewed and approved by the Public Works Department designation of a recreational vehicle parking area; such area to be located away from public view from all public rights -of -way; all buildings limited to three floors of habitable space; proposed rockeries or retaining walls be approved by the Planning Commissior prior to issuance of building permit. Mr. Ehmke, applicant, said every condominium would have a view and there will be terraces on all three levels. He said there is a large pool and covered parking. There will be a basement for stor- age. Councilman.Hill asked about the driveways. Mr. Ehmke said they had gone over that with the staff and Fire Department and the had complied with their requests. He said he thought they were 23 feet. Mr. Stoknes said the height of the apartments appears to be alright. Mayor Bauch asked when you come down 62nd Street woulc you be able to look in and see all of the cars lined up. Mr. Ehmke said the parking area would be covered, also the ends of the parkin area. He said the price of the condominiums would be $59,000 to $62,000. Councilman Traynor said this project does not seem to have adequate space between the units and the green area seems small. Mr. Ehmke said the buildings appear closer on the drawing. Councilman Bohrer asked about the deck around the pool. Mr. Ehmke said it would be tile and finished around so people can have chair There will be two parking stalls for each unit. He said they have some space for recreation vehicles. It will likely not be covered as the height needed would (not be known. He said there are no . trees on the property at present. Mayor Balch remarked that the re( reation vehicle space is in addition to the two parking stalls per unit. Mr. Ehmke said there would be 1200 square feet per unit wits one and three - quarters bath.
