Included with this application are the detailed revisions to the permit's plans as specified by W.A.C. 173 -14 -064. There are no revisions included with this application to the permit's text. The revisions to the plans are made to update our 1974 permit to conform with existing park development, are minor, and are within the scope and intent of the original permit. You may wish to recall that our permit is a master permit, was the first of its kind, and was an innova- tion lauded by the state and others. It is our under- standing that other jurisdictions have now followed the innovative lead taken by the City of Tukwila and Segale Business Park and have adopted the master permit concept. As provided by W.A.C. 173 -14 -064 (4), upon a finding that the proposed changes are within the scope and intent of the original permit, the revised permit is approved and it becomes effective immediately. Pursuant to W.A.C. 173 -14 -064 (4), within eight (8) days of approval, the approved revision should be submitted by certified mail to the D. O. E. Box 88924 Tukwila, Washington 98188 Dear Mario: During the last several weeks, the Planning staff, and myself have considered in detail your request for a revision to the Shoreline Master Permit for Segale Business Park. It has been brought to my attention by the staff that there is a direct conflict in the processing of your request as presented under WAC 173 -14- 064. Specifically, WAC 173 -14 -064 (2)(b) defines the concept of "within the scope and intent of the original permit" to exclude new structures. Since any attempt to process a revision of this scope would most probably be appealed by the Department of Ecology to the.Shorelines Hearing Board, I would advise you to withdraw the revision request and submit a new application for a Shoreline Substantial Development Permit to cover the sixth row of buildings along Southcenter Parkway. A new Substantial Development Permit can be processed solely on the sixth row of buildings and not affect your existing Shoreline Master Permit. A revision to the existing Shoreline Master Permit would be appropriate only if the modifications were limited to a maximum ten (10) percent expansion of one of the allowed five rows of buildings. This would allow you to add on to Building 781 at sometime in the future. If this does not provide you with enough design flexibility, I would suggest that you complete the enclosed application. If I can be of any further assistance please feel free to telephone me at 242 -2177. Eventhough the project expansion appears to be within the intent and scope of the original permit issued, WAC 173- 14- 064(2b) states that "revisions involving new structures not shown on the original site plan shall require a new permit ". Therefore, if the City of Tukwila was to approve the revision it would probably be appealed by the Department of Ecology to the Shoreline Hearings Board. This could delay Mr. Segale's plans. FROM: KiRoger Blaylock, Assistant Planner SUBJECT: Amendment to Shoreline Substantial Development Permit Segale Business Park 6230 Southcenter Boulevard is Tukwila, Washington 98188 a (206) 242 -2177 The revisions to the original permit issued to Mario Segale on November 13, 1974 for the Segale Business Park are within the scope and intent of the origi- nal permit. However, it should be noted that the new drawing is more detailed than the original one in 1974 and that a conflict exists. The text of the origi- nal permit allows five rows of buildings. Project 781 is the fifth row, but there is enough area for another (sixth) row. along Southcenter Parkway. The original permit requires that any buildings in the sand and gravel areas would require a new shoreline application. This should be corrected in the drawing to show that area adjacent to Southcenter Parkway is used for sand and gravel storage. ' W.A.C. 173 -14 -064 (4) requires that a formal decision be reach by the local government, no time period is set. However, within eight (8) days after the decision, if favorable, it mustibe forwarded to the Attorney General and Department of Ecology. August 7, 1978 SEAL_ E BUS /NESS PARK City of Tukwila Office of Community Dev. Tukwila City Hall Annex 6200 Southcenter Blvd. Tukwila, WA Attention: Mr. Kjell Stokeness, Director. Dear Mr. Stokeness: P.O. BOX 88050 • TELEPHONE: (206) 226 -3202 • TUKWILA, WASHINGTON 91118 Pursuant to our previous discussion with your office, en- closed please find Segale Business Parks application for revision to its Shoreline Substantial Development Master Permit No. 74 -09. Included with this application are the detailed revisions to the permit's plans and text as speci- fied by. W.A.C. 173 -14 -064. Also please find enclosed for your information copies of our 1974 permit and text with accompanying information. The revisions to the text and plans are made to update our 1974 permit to conform with projected park development, are minor, and are within the scope and intent of the ori- ginal Permit. You may wish to recall that our permit is a Master Permit, was the first of its kind, and was an innovation lauded by the State and others. It is our understanding that many other jurisdictions have now followed the innovative lead taken by the City of Tukwila and Segale Business Park and have adopted the master permit concept. As provided by W.A.C. 173 -14- 064(4), upon a finding that the proposed changes are within the scope and intent of the original Permit, the revised Permit is approved, and it be- comes effective immediately. Since W.A.C. 173- 14- 064(2B) requires that no significant environmental impact be caused by project revision, and there is no such impact from the subject revisions, upon your requested approval we assume a negative declaration for the revision is to be issued. Pursuant to W.A.C. 173 -14- 064(4), within eight days of ap- proval, the approved revision should be submitted by Certi- fied Mail to the D.O.E. Regional Office and the Attorney General's Office for completion of their files. City of Tukwila August 7, 1978 Page 2 Since to our . knowledge no persons have previously notified your offices of their desire to receive notice of action pertaining to our permit, we have enclosed four sets of re- vised plans and text, two of which are for the City's use and the other two of which are for the D.O.E. and the At- torney General's Office. Thank you for your attention to this matter. If you have any questions or comments, please call. We shall await notification of the City's action. Sincerely yours, SEGALE BUSINESS P Mario A.
