I would like to direct your attention to two items in Resolution 677.
In Section 1.(a), the wording "resurface of 54th Avenue South" should require
the clarification that it may need to be "rebuilt ",and "resurface" may not be
adequate.
In Section 1.(b), a retaining wall or other approved device to be constructed
on the west•right -of -way line of 54th Avenue South should be reworded to read
the east right -of -way line of 54th Avenue South. Our original comments on the
preliminary plat were as we define them in this memo.

Dear Mr. Hogsett: .'
The City Council at their last regular meeting of March 19, 1979, approved
the preliminary plat of Bel -Crest Heights. This approval was granted by
Resolution #677, attached, with the conditions as shown in section 1.
Please be sure to contact both the Fire Department and the Public Works
Department regarding the necessary water flow requirements 41w64111. the
property before going into final design on the water system. I would
assume your engineer will also get in contact with Tukwila Public Works
Department prior to going into final design on any of the improvements
that are to be dedicated to the City in order to varify the standards
required by the City.
This preliminary plat approval will expire within 1 year of the date of
approval by the City Council unless a final plat application is submitted
to the City of Tukwila prior to that time. A 1 year extention may be
allowed by the City Council on the preliminary plat approval should this
be necessary.

RESOLUTION NO. 77
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA
GRANTING APPROVAL, SUBJECT TO CERTAIN CONDITIONS, OF THE
PRELIMINARY PLAT OF THE BEL CREST HEIGHTS SUBDIVISION
BEING PLANNING DIVISION FILE NO. MF 78 -37 -SUB.
WHEREAS, pursuant to the regulations as required by Title 17 of the
Tukwila Municipal Code, C & H Partnership, contract purchaser of the subject•
property, has submitted for approval a preliminary plat proposal for Bel Crest
Heights subdivision, as contained in Planning Division file no. MF 78 -37 -SUB:
and,
WHEREAS, said property, the legal description of which appears in said
Planning Division file and on the preliminary plat application, is generally
located between South 166th Street and Slade Way along 54th Avenue South on the
west side of said street, and lying entirely within the R -1 -9.6 zone district;
and,
WHEREAS, the environmental impact of the proposed preliminary plat was
considered by the appropriate administrative officials and a declaration of non-

significance was issued and is contained in file no. EPIC- FD -78; and,
WHEREAS, the Tukwila Planning Commission, following a public hearing
on 25 January 1979 and again on 22 February 1979 has recommended to the City
Council approval of the preliminary plat for Bel Crest Heights subject to certain
conditions as set forth in the minutes of said meetings adopted by said Planning
Commission.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TUKWILA AS FOLLOWS:
Section 1. Preliminary approval of the Bel Crest Heights preliminary
plat, attached hereto as Exhibit A, and contained in Planning Division file no.
MF 78 - 37 - SUB, is hereby given subject to the conditions-of approval by the Plan-
ning Commission, all as set forth herein under: '
i-
a. Existing S4th Avenue South abutting the plat shall be resurfaced
to accommodate the new plat, plans to be approved by the Public
Works Department.
b. A retaining wall or other approved device be constructed on the
west right -of -way line of S4th Avenue South, plans to be approved
by the Public Works Department.
c. Widening of the proposed intersection shall be r quired to accommo-
date left -turn movement, plans to be approved by the Public Works
Department.
d. Storm drain control (detention /retention) facilities and connection to
existing storm drain system shall be required, plans to be approved
by the Public Works Department.
e. The cul -de -sac on the subject property shall be named South 165th
Street.
f. A detailed surface water drainage plan shall be submitted to and
approved by the Public Works Department.
g. There shall be no unnecessary removal of existing trees (conifers
4 inches in diameter or greater, deciduous trees 8 inches or greater
measured 2 feet from the ground) during construction of required
public improvements.
,/ h. The proposed cul -de -sac shall be constructed according to City of
Tukwila standards and dedicated to the public. Sidewalks shall be
constructed on one side of the street. The side to be determined by
the Public Works Department.
On the final plat, all lots with slopes in excess of 15% in the
building site area shall conform to the general guidelines attached
hereto as Exhibit B and labeled "Residential Density Guidelines for
Sloping Ground."
Section 2. A copy of this resolution shall be furnished to the subdivider
and to the following City of Tukwila Departments:
a. Office of Community Development
b. Department of Public Works
c. Fire Department
d. Planning Commission

The Committee of the Whole Meeting was called back to order by
Council President Bohrer with Council Members present as previously

Councilman Van Dusen said the proposed resolution had come from
the Public Safety and Health Committee. Mayor Bauch reported it
was the thought that the grant was going to end this year, but it
was approved for next year.

Councilman Saul said the proposed ordinance had come out of the
Community Affairs Committee. He reported the County had increased
the fees for licenses, but the City would receive the same amount.

Councilman Van Dusen said the request had come from Fire Chief
Hubert Crawley that firefighters be trained in ventricular fibril-
lation. He said in addition to the training, it would be necessary
to buy equipment, there will be increased liability, and ongoing
training. Mayor Bauch said in case of an emergency the aid car
goes out first and if they determine they need a medic car they
call for it. He said he felt we would be duplicating Medic I
services.

Please be advised the Planning Commission recommended the City Council
approve the preliminary plat of Bel Crest Heights at their regular February
meeting with the following conditions:
1. Existing 54th Avenue South abutting the plat shall be resur-
faced to accommodate the new plat, plans to be approved by
the Public Works Department.
2. A retaining wall or other approved device be constructed on

City of Tukwila standards and dedicated to the public.

PRELIMINARY PLAT of Bel Crest Heights
C & H Partnership
West of 54th Avenue South and between South 164th
Street and South 166th Street.
Approximately 4.05 acres
Low - Density Residential
1. C & H Partnership has initiated platting procedures to subdivide the
land area depicted in Exhibit A to facilitate development of the plan-
ned Bel Crest Heights Development.
2. The proposed development is 4.05 acres in total size. The site is pro-
posed to be divided into 15 lots with the smallest lot size 9,600 square
feet. The average lot size is roughly 9,800 square feet.
3. As shown on the preliminary plat application, the subject site slopes
upward from 54th Avenue South with some slopes in excess of 20 percent.
Proposed lots 1, 2, 3 and 15 have such slopes. Proposed lots 4 and 14
have approximately 16 to 19 percent grades. The rear portion of the
site levels off to approximately a 7 percent grade. As noted by the
applicant on the preliminary plat, "based on recent site reconnaissance,
the aerial topography seems to be different from actual •ground slope."
4. The Tukwila Data Inventory indicates that this area has poor slope stability.
Small landslides occurred near this site during the construction of I -5. A
soils report has been requested by the City but was not available at the
time of writing of the staff report.
5. The vegetation is predominantly deciduous trees with interspersed con-
ifers. The proposal will eliminate approximately 50% of the existing
trees and about 75% of the existing shrubs and groundcover.
6. The City of Tukwila Comprehensive Land Use Policy Plan, Natural Environ-
ment, Objective 3, Policy 1 states: "Discourage development on slopes
in excess of 20 percent."

7. The City of Tukwila Comprehensive Land Use Policy Plan, Natural Environment,
Objective 6 Policy 1 states: "In aras where the stability of slopes is
questionable, allow development only after a qualified professional can
demonstrate that slopes will be stable even after site modification."
8. The 15 lots are proposed to be served by a 40' -wide cul -de -sac running
east -west extending from 54th Avenue South.
9. Val -Vue Sewer District has submitted comments regarding the proposed pre-
liminary plat. They are.included in the staff report as Exhibit B.
10. The Public Works Department has submitted comments regarding the proposed
preliminary plat. They are included in the staff report as Exhibit C.
11. The Building Department has submitted comments regarding the proposed
preliminary plat. They are included in the staff report as Exhibit D.
12. Goal 1, Policy 5 of the Sidewalk Plan, under Residential Goals and Policies,
states: "New subdivisions should be required to construct sidewalks on new
streets."
13. It is not indicated on the preliminary plat whether the proposed cul -de -sac
is to be dedicated to the City.
14. As noted by the Public Works Department, the existing pavement on 54th
Avenue South has eroded and settled. Also, located directly west of the
intersection of the proposed cul -de -sac and 54th Avenue is the I -5 free-
way right -of -way. A severe slope exists between the east edge of 54th
Avenue and the south -bound lanes of I -5.
15. A final survey, including contours, has not been done for the subject site.
CONCLUSIONS:
1. As stated in the Comprehensive Land Use Policy Plan, it is generally
not desirable to develop on slopes in excess of 20 percent due to the
problems of construction, access, and the degree to which grading
activities disturb the natural landform.
2. As stated in the Comprehensive Land Use Policy Plan, development should
avoid slide prone areas or areas of questionable soil stability caused by
severe slope, soil characteristics, or surface and groundwater drainage.
3. The Subdivision Code generally encourages the dedication of roads to the
public when serving more than four (4) lots.
4. Due to the steepness of the subject site and the projected alignment of
the proposed cul -de -sac, the grading activities associated with street
improvement will eliminate a majority of the existing vegetation. Removal
of this amount of vegetation will tend to enhance the importance of the
remaining vegetation.

5. Th. proposed cul -de -sac appears to meet design standards of the
Subdivision Code.
6. Additional traffic on 54th Avenue may cause increased pavement erosion
and settlement, (SEE, Exhibit C). Also, a potential hazard may exist if
no barrier is constructed opposite the intersection of the proposed cul-
de-sac and 54th Avenue South.
7. Since a final survey has not been conducted, the contour lines on the
preliminary plat should not be considered as refecting actual, existing
grades.
RECOMMENDATION:
Staff recommends the Planning Commission approve the Preliminary Plat for
Bel Crest Heights with the following conditions:
1. Existing 54th Avenue South shall be resurfaced to accommodate the new
plat, plans to be approved by the Public Works Department.
2. A retaining wall or other approved device be constructed on the west
right -of way line of 54th Avenue South, plans to be approved by the
Public Works Department.
3. Widening of the proposed intersection shall be required to accommodate
left -turn movement, plans to be approved by the Public Works Department.
4. Storm drain control (detention /retention) facilities and connection to
existing storm drain system shall be required, plans to be approved by

NEW BUSINESS
PUBLIC HEARING: BEL CREST HEIGHTS PRELIMINARY PLAT
Mr. Satterstrom read the staff report along with letters from the Val -Vue Sewer
District, the Department of Public Works, and the Building Division.
Acting Chairman Avery opened the hearing to the public.' Proponents of the project
were asked to speak.
Mr. Chan Chou of Sephan Associates spoke as the engineer and as part owner. He
disputed points 1, 2 and 10 of the staff report. He stated that point one should
be specifically limited to improving that portion of 54th Avenue South abutting
the plat and that it should be resurfaced and not rebuilt. Point 2 should be
eliminated; a retaining wall off the subdivision site should not be the responsi-
bility of the developer. Regarding point 10, Mr. Chou suggested that the average
slope should only be considered for the building site area, not the entire lot.
Mr. Bowen asked Mr. Chou if the intersection could be slightly realigned. Mr.
Chou responded realignment would create the need for construction of a retaining
wall to protect a lot.
Chairman.Avery then asked for opponents to speak.
Mr. Satterstrom read a letter from Mr. George Z. Abbott, 16605 - 53rd Avenue South,
opposing the preliminary plat unless access was provided from . 53rd Avenue South.
Mrs. Darlene West asked, "What happens to the greenbelt ?" Mr. Satterstrom responded
that it would be an easement which would limit the property owner from cutting cer-
tain sized trees within the easement. In addition any trees that had to be cut down
for safety reasons would be the responsibility of the individual property owner.
Mrs. Ethel Bauch expressed her concern about the traffic demands on 54th Avenue
South and the pedestrian traffic. She stated that the pavement was very narrow
and that the construction of 15 new houses would increase the traffic hazards.
She felt that the developer should be required to improve the road and provide
a sidewalk for pedestrians.
Mr. Satterstrom responded that 54th Avenue South was scheduled for improvement by
the City in 1980- 1981. The typical road section on the 60 foot right -of -way
would be a finished 35 -foot wide surfaced section. He stated that development of
the entire road and sidewalk should not be the sole responsibility of the developer.
The development could result in the City Council rating the road improvement project
higher and consider construction at an earlier date.
Mrs. West stated that she was also concerned with the pedestrian problem and the
present condition of the street.
Mr. Mel Hogsett, part owner in the development, stated that they would be happy to
participate in a road improvement project for 54th Avenue South according to their
appropriate portion.
Chairman Avery closed the public hearing.

Mr. William Gorjance, 16604 - 53rd Avenue South, stated his concern with the
access. In severe weather, the proposed finished grade of the cul -de -sac would
cause a serious access problem and traffic hazard. At the present time when
there is snow or ice, 54th Avenue South is blocked off. He asked, "Why access
could not be provided to Slade Way ?"
Mr. Hogsett responded that he had attempted to acquire additional property to
the north so that they could have access onto Slade Way, but the property owners
were not interested in selling at this time.
Planning Commission discussion continued on items #1, 2, and 10 of the staff
report. Mr. Bowen asked Mr. Chou to explain again what he had suggested on item
#10. Mr. Chou clarified his position by stating that the slope should be limited
to the building site area and not the entire lot.
MOTION BY MR. SOWINSKI AND SECONDED BY MR. BOWEN TO TABLE (THE PRELIMINARY PLAT
OF BEL CREST HEIGHTS) UNTIL THE NEXT REGULAR MEETING TO ALLOW THE APPLICANT TIME
TO PROVIDE THE PLANNING COMMISSION WITH A MORE COMPREHENSIVE SITE PLAN TO EVALUATE

Bel Crest Heights in McMicken Heights. The revised plat map indicates 14
lots, instead of 15 as in the original application. Three of the lots in
the revised plat drawing have been increased in size: Lot #1 is 18,000
sq. ft., Lot #2 is 13,400, and Lot #14 is 12,000. These lots have building
sites in excess of 15 %.
Staff recommends the Planning Commission recommend the City Council approve
the proposed (revised) preliminary plat subject to the following conditions:
1. Existing 54th Avenue South shall be resurfaced to accommodate the new
plat, plans to be approved by the Public Works Department.
2. A retaining wall or other approved device be constructed on the west

Mr. Blaylock read the staff report and explained the "temporary" landscape strip
on the west margin of the building site.
Mr. Mario Segale, owner, stated they did not yet have design plans for adjacent
building to the west. Stated his preference was to eliminate strip all together.
Said the landscape theme of the Segale Business Park would be extended to the
neighboring parcel along Southcenter Parkway.
Mr. Blaylock stated there were no standards or precedents for "temporary" land-
scape strips. Said any landscape area, whether temporary or permanent, should be
appropriately landscaped.
Mr. Segale stated there was no water main nearby so irrigation would be difficult.
Discussion ensued regarding the size and spacing of trees in the temporary land-
scape area and the type of groundcover which should be permitted.
MOTION BY MR. SOWINSKI AND SECONDED BY MRS. AVERY TO APPROVE THE PROPOSED LAND-

Mr. Blaylock read the revised staff report and explained the revised drawings.
Explained the intent of condition #1 was for applicant to improve that portion of
54th Avenue South which abutted the proposed plat, not the entire roadway.
Mr. Chan Chou, applicant, stated he agreed with the revised staff report.
Mr. Morgan, adjacent property owner, inquired as to the purpose or intention of
the red flag near his property.
Mr. Chou stated he thought the flag was related to the survey which had been done
and that it undoubtedly marked a property line.
MOTION BY MR. SOWINSKI AND SECONDED BY MRS. AVERY TO RECOMMEND THE CITY COUNCIL
APPROVE THE PROPOSED PRELIMINARY PLAT OF BEL CREST HEIGHTS SUBJECT TO THE FOLLOW-

Mr. Blaylock read the staff report and explained the displayed drawings.
Mr. Rod Kirsch, representing the applicant, stated he.generally agreed with the
staff report but that they did not wish to hydroseed the levee area. Also stated
railroad tracks will be built between the building and river levee.
MOTION BY MR. SOWINSKI AND SECONDED BY MR. RICHARDS TO APPROVE THE PROPOSED LAND-
SCAPE PLANS SUBJECT TO THE FOLLOWING CONDITIONS:

LANDSCAPE PLAN: SEGALE BUILDING #781
Mr. Blaylock read the staff report and explained the "temporary" landscape strip
on the west margin of the building site.
Mr. Mario Segale, owner, stated they did not yet have design plans for adjacent
building to the west. Stated his preference was to eliminate strip all together.
Said the landscape theme of the Segale Business Park would be extended to the
neighboring parcel along Southcenter Parkway.
Mr. Blaylock stated there were no standards or precedents for "temporary" land-
scape strips. Said any landscape area, whether temporary or permanent, should be
appropriately landscaped.
Mr. Segale stated there was no water main nearby so irrigation would be difficult.
Discussion ensued regarding the size and spacing of trees in the temporary land-
scape area and the type of groundcover which should be permitted.
MOTION BY MR. SOWINSKI AND SECONDED BY MRS. AVERY TO APPROVE THE PROPOSED LAND-
SCAPE PLANS SUBJECT TO THE FOLLOWING CONDITIONS:

Bel Crest Heights in McMicken Heights. The revised plat map indicates 14
lots, instead of 15 as in the original application. Three of the lots in
the revised plat drawing have been increased in size: Lot #1 is 18,000
sq. ft., Lot #2 is 13,400, and Lot #14 is 12,000. These lots have building
sites in excess of 15 %.

✓ PUBLIC HEARING: BEL CREST HEIGHTS PRELIMINARY PLAT
Mr. Satterstrom read the staff report along with letters from the Val -Vue Sewer
District, the Department of Public Works, and the Building Division.
Acting Chairman Avery opened the hearing to the public. Proponents of the project
were asked to speak.
Mr. Chan Chou of Sephan Associates spoke as the engineer and as part owner. He
disputed points 1, 2 and 10 of the staff report. He stated that point one should
be specifically limited to improving that portion of 54th Avenue South abutting
the plat and that it should be resurfaced and not rebuilt. Point 2 should be
eliminated; a retaining wall off the subdivision site should not be the responsi-
bility of the developer. Regarding point 10, Mr. Chou suggested that the average
slope should only be considered for the building site area, not the entire lot.
Mr. Bowen asked Mr. Chou if the intersection could be slightly realigned. Mr.
Chou responded realignment would create the need for construction of a retaining
wall to protect a lot.
Mr. Satterstrom read a letter from Mr. George Z. Abbott, 16605 - 53rd Avenue South,
opposing the preliminary plat unless access was provided from 53rd Avenue South.
Mrs. Darlene West asked, "What happens to the greenbelt ?" Mr. Satterstrom responded
that it would be an easement which would limit the property owner from cutting cer-
tain sized trees within the easement. In addition any trees that had to be cut down
for safety reasons would be the responsibility of the individual property owner.
Mrs. Ethel Bauch expressed her concern about the traffic demands on 54th Avenue
South and the pedestrian traffic. She stated that the pavement was very narrow
and that the construction of 15 new houses would increase the traffic hazards. '
She felt that the developer should be required to improve the road and provide
a sidewalk for pedestrians.
Mr. Satterstrom responded that 54th Avenue South was scheduled for improvement by
the City in 1980 - 1981. The typical road section on the 60 foot right -of -way
would be a finished 35 -foot wide surfaced section. He stated that development of
the entire road and sidewalk should not be the sole responsibility of the developer.
The development could result in the City Council rating the road improvement project
higher and consider construction at an earlier date.
Mrs. West stated that she was also concerned with the pedestrian problem and the
present condition of the street.
Mr. Mel Hogsett, part owner in the development, stated that they would be happy to
participate in a road improvement project for 54th Avenue South according to their
appropriate portion.

Mr. William Gorjance, 16604 - 53rd Avenue South, stated his concern with the
access. In severe weather, the proposed finished grade of the cul -de -sac would
cause a serious access problem and traffic hazard. At the present time when
there is snow or ice, 54th Avenue South is blocked off. He asked, "Why access
could not be provided to Slade Way ?"
Mr. Hogsett responded that he had attempted to acquire additional property to
the north so that they could have access onto Slade Way, but the property owners
were not interested in selling at this time.
Chairman Avery closed the public hearing.
Planning Commission discussion continued on items #1, 2, and 10 of the staff
report. Mr. Bowen asked Mr. Chou to explain again what he had suggested on item
#10. Mr. Chou clarified his position by stating that the slope should be limited
to the building site area and not the entire lot.
MOTION BY MR. SOWINSKI AND SECONDED BY MR. BOWEN TO TABLE (THE PRELIMINARY PLAT

REQUEST: PRELIMINARY PLAT of Bel Crest Heights
APPLICANT: C E H Partnership
LOCATION: West of 54th Avenue South and between South 164th
Street and South 166th Street.
SIZE: Approximately 4.05 acres
COMPREHENSIVE PLAN Low- Density Residential
1. C $ H Partnership has initiated platting procedures to subdivide the
land area depicted in Exhibit A to facilitate development of the plan-
ned Bel Crest Heights Development.
2. The proposed development is 4.05 acres in total size. The site is pro-
posed to be divided into 15 lots with the smallest lot size 9,600 square
feet. The average lot size is roughly 9,800 square feet.
3. As shown on the preliminary plat application, the subject site slopes
upward from 54th Avenue South with some slopes in excess of 20 percent.
Proposed lots 1, 2, 3 and 15 have such slopes. Proposed lots 4 and 14
have approximately 16 to 19 percent grades. The rear portion of the
site levels off to approximately a 7 percent grade. As noted by the
applicant on the preliminary plat, "based on recent site reconnaissance,
the aerial topography seems to be different from actual ground slope."
4. The Tukwila Data Inventory indicates that this area has poor slope stability.
Small landslides occurred near this site during the construction of I -5. A
soils report has been requested by the City but was not available at the
time of writing of the staff report.
5. The vegetation is predominantly deciduous trees with interspersed con -
ifers. The proposal will eliminate approximately 50% of the existing
trees and about 75% of the existing shrubs and groundcover.
6. The City of Tukwila Comprehensive Land Use Policy Plan, Natural Environ-
ment, Objective 3, Policy 1 states: "Discourage development on slopes
in excess of 20 percent."

7. The City of Tukwila Comprehensive Land Use Policy Plan, Natural Environment,
Objective 6 Policy 1 states: "In aras where the stability of slopes is
questionable, allow development only after a qualified professional can
demonstrate that slopes will be stable even after site modification."
8. The 15 lots are proposed to be served by a 40' -wide cul -de -sac running
east -west extending from 54th Avenue South.
9. Val -Vue Sewer District has submitted comments regarding the proposed pre-
liminary plat. They are included in the staff report as Exhibit B.
10. The Public Works Department has submitted comments regarding the proposed
preliminary plat. They are included in the staff report as Exhibit C.
11. The Building Department has submitted comments regarding the proposed
preliminary plat. They are included in the staff report as Exhibit D.
12. Goal 1, Policy 5'of the Sidewalk Plan, under Residential Goals and Policies,
states: "New subdivisions should be required to construct sidewalks on new
streets."
13. It is not indicated on the preliminary plat whether the proposed cul -de -sac
is to be dedicated to the City.
14. As noted by the Public Works Department, the existing pavement on 54th
Avenue South has eroded and settled. Also, located directly west of the
intersection of the proposed cul -de -sac and 54th Avenue is the I -5 free-
way right -of -way. A severe slope exists between the east edge of 54th
Avenue and the south -bound lanes of I -5.
15. A final survey, including contours, has not been done for the subject site.
CONCLUSIONS:
1. As stated in the Comprehensive Land Use Policy Plan, it is generally
not desirable to develop on slopes in excess of 20 percent due to the
problems of construction, access, and the degree to which grading
activities disturb the natural landform.
2. As stated in the Comprehensive Land Use Policy Plan, development should
avoid slide prone areas or areas of questionable soil stability caused by
severe slope, soil characteristics, or surface and groundwater drainage.
3. The Subdivision Code generally encourages the dedication of roads to the
public when serving more than four (4) lots.
4. Due to the steepness of the subject site and the projected alignment of
the proposed cul -de -sac, the grading activities associated with street
improvement will eliminate a majority of the existing, vegetation. Removal
of this amount of vegetation will tend to enhance the importance of the
remaining vegetation.

5. Th1 proposed cul -de -sac appears to meet design standards of the
Subdivision Code.
6. Additional traffic on 54th Avenue may cause increased pavement erosion
and settlement, (SEE, Exhibit C). Also, a potential hazard may exist if
no barrier is constructed opposite the intersection of the proposed cul-
de -sac and 54th Avenue South.
7. Since a final survey has not been conducted, the contour lines on the
preliminary plat should not be considered as refecting actual, existing
grades.
RECOMMENDATION:
Staff recommends the Planning Commission approve the Preliminary Plat for
Bel Crest Heights with the following conditions:
1. Existing 54th Avenue South shall be resurfaced to accommodate the new
plat, plans to be approved by the Public Works Department.
2. A retaining wall or other approved device be constructed on the west
right -of way line of 54th Avenue South, plans to be approved by the
Public Works Department.
3. Widening of the proposed intersection shall be required to accommodate

on the above matter is conducted.
The southeast corner of our lot will be bordering on lots 7 and 8
as designated on the submitted sketch.
This adjoining section is part of a greenbelt with a number of
trees which added to the attractiveness of our backyard, providing
privacy.
Removal or destruction of this greenbelt would, certainly diminish .
the value of our property.
We assume the Planning Commission will request an da environmental .
impact statement before a final decision is reached.

As of late, there has been some question as to whether the subdivision of land
is within the purview of Ordinance #1035 and, whether waivers might be required
in certain circumstances.
After a review of Ordinance #1035 and the subdivision ordinance, I believe that
the subdivision of land is not within the scope of Ordinance #1035 and that in
no case should a waiver be required.
Ordinance #1035 requires a waiver to be granted by the City Council in two types
of cases (SEE, Section 3):
(1) "Land use actions which are inconsistent with the new Comprehensive
Land Use Plan Map.
(2) Proposals for building, grading, clearing, excavation or filling
which are located in a geographical area generally identified by
the Environmental Basemap of the Comprehensive Land Use Policy
Plan as an area of constraint."
It should also be noted that building permits for single - family homes are
exempt from the provisions of Ordinance #1035.
The subdivision of land is not, itself, a specific land use proposal. Lots
within the subdivision, of course, need to be of the size required by the
zoning code but, the City does not commit to a certain land use by virtue of
subdivision approval.
In addition, the act of subdivision itself does not involve grading, filling,
excavation, etc. Only the subdivision improvements such as roads and utilities

require any physical manipulation of the earth, and these improvements are usually
very minor and incidental to the eventual development.
SUBDIVISION CODE (TITLE 17)
In my opinion, the preliminary plat serves much the same function as a waiver
application. The waiver application, if approved, grants permission to the
applicant to apply for a building permit and ultimately build a specific develop-
ment. Likewise, a preliminary plat application, if approved, grants the appli-
cant permission to develop plans and ultimately construct s ecific improvements
required by the City, (SEE, specifically TMC 17.12.030 5.c1'). The require-
ment of a waiver, in this case, would be redundant.
RECOMMENDATION:
Based on the above analysis, I would recommend that as a matter of policy we
exempt subdivisions from the requirements of Ordinance #1035.
Please let me know how you feel about this. I anticipate an application will
be made soon which will force us to make a decision.
