Bauch, Mayor BOARD OF ADJUSTMENT Minutes of the regular January meeting, 4 January 1979. The regular January Meeting was called to order by Chairman Duffie at 8:12 p.m. Board members present were Miss Morgan, Mrs. Rinehart, Mr. Duffie and Mr. Goe. Al Pieper and Linda.Stansfield representing the Building Division and Roger •Blaylock representing the Planning Division were present. Chairman Duffie called for approval of the minutes dated 7 December 1978. MOTION BY MISS MORGAN, SECONDED BY MR. GOE TO APPROVE THE MINUTES OF 7 DECEMBER 1978. MOTION CARRIED. FIELD TRANSFER /VARIANCE TO PARKING REIUIREME /MF #78 -38 -V Mr. Blaylock informed the Board that Garfield Transfer had withdrawn their application for a variance. Garfield Associates was constructing a facility in Renton that would house both Garfield Transfer and Strains Transportation. SOUTHCENTER SOUTH INDUSTRIALPARK /SHARED DIRECTIONAL SIGN VARIANCE /MF #78 -43 -V Mr. Ed Hunt of McCann Construction Company and Mr. Tom Croonquist of Alfred Croonquist & Associates,- Architects were present representing the applicant, Corporate Investors. The staff report and background information was presented by Mr. Pieper. He also read the letter denying the original request of McCann Construction Company for a sign permit. Chairman Duffie opened the hearing to the public. Mr. Hunt explained the reasons why they believed a sign of the size requested was necessary. The Board discussed at length the.•intended size, shape, location, style, and function of the shared directional sign. The traffic hazard problem and other methods of signing were discussed. The general consensus of the Board members was that an adequate review of the variance request could not be completed until the interrelationships of design, size, number of tenants, location and function of the sign were formally presented by the developer. The staff would then review the proposal and specifically look at alternatives. 4 January 1979 CITY OF TUKWILA PLANNING DIVISION BOARD OF ADJUSTMENT STAFF REPORT AGENDA ITEM I V A : Variance to Parking Requirement - Garfield Transfer REQUEST: Variance from off - street parking requirement (Section 18.56.180 TMC) .APPLICANT: Garfield Transfer Co,, Inc. 1040 Andover Park West, Tukwila, WA 98188 LOCATION: 1040 Andover Park West SIZE: 126,000 square foot warehouse ZONE: C -M, Industrial Park District COMPREHENSIVE PLAN: Light industrial INTRODUCTION: 8:00 P.M. The normal intent of a variance is to "take care of a special situation that cannot be dealt with in the ordinance without making it unduly com- plicated." The Planning Commission has granted a Conditional Use Permit to Garfield Transfer conditioned on obtaining a variance of the auto- mobile parking requirement. Tukwila Municipal Code 18.56.180 states, "all industrial buildings hereafter erected, and all buildings converted to such use or occupancy, shall provide on the premises, one off - street parking space for each two employees or one thousand square feet of • building area (whichever is the greater), plus one parking space for each temporary occupant during normal business hours, to be certified by the owner of the building." FINDINGS: 1. The building at 1040 Andover Park West was built by Cabot, Cabot, and Forbes for a warehouse facility. The 126,000 square foot building has 138 parking spaces for auto- mobiles, plus loading and maneuvering areas in front of the loading docks as per requirements of Tukwila Municipal Code 18.56.180 and 18.56.210. •' Board of Adjustme Page 2 Staff Report 4 January 1979 3. Strains Transportation, the parent company of Garfield Transfer, purchased the facility and began operation on June 1, 1977, as an auto freight warehouse. 4. Garfield Transfer began operation from the site on January 3, 1978. 5. On September 21, 1978, the Board of Adjustment determined that Garfield Transfer was operating as a "truck terminal." 6. On September 28, 197S, the Planning Commission approved a Conditional Use Permit for Garfield Transfer to operate a "truck terminal." The Craig Corporation leases 21,000 square feet in the northwest corner of the building. Their offices and service center occupies 4,000 square feet, the remaining area is warehouse storage. 8. Minimum parking required for the Craig Corporation per Tukwila Municipal Code 18.56.160 and 18.56.180 is 30 spaces. Only 22 spaces are leased to the Craig Corporation by Strains Transportation. 9. Strains Transportation and Garfield Transfer jointly employ approximately 30 employees. 10. United Parcel Service and Lincoln Moving and Storage are similar uses in the immediate vicinity. CRITERIA FOR GRANTING VARIANCE /CONCLUSIONS: 1. The variance shall not c::ns ;itu:e a Grant of special privilege incon- sistent with the Zimitct:.on upon uses of other properties in the vicinity and in the zone in which the property on behalf of which the application was filed is located; Conclusion: The United Parcel Service and Lincoln Moving and Storage facilities were specifically designed for use as truck terminals, providing truck storage areas in addition to the required automobile parking. Allowing Garfield Transfer to provide less parking than required of other similar uses in the vicinity gives them an unfair economic advantage not enjoyed by others and will be granting of special privileges. 2 That such variance is necessary because of special circumstances relating to the size, shape, topography, location or surrounding of the subject property, to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located; Conclusion: The special circumstances relate to the building size and location on the subject property. No :1exibility of site design remained after the construction of the building for a change in use to a truck terminal. Therefore, it would provide the owner with use rights and privileges not permitted other properties in the vicinity. •' Board of .4djustm( PE,ge 3 Staff Report 4 .January 1979 3. :hat the special conditions and circumstances do not result from the actions of the applicant; Conclusion: Strains Transportation purchased the building and property realizing the scope of their business needs. Therefore, the special conditions and circumstances are a result of their own actions. 4. That the granting of such variance will not be materially detrimental 70 the public welfare or injurious to the property or improvements in the vicinity and in the zone in which the subject property is situated; Conclusion: The Planning Commission has determined that the use will not materially injure the appropriate use of neighboring property. Therefore, it must be assumed that the conditions of their approval would mitigate any use which is materially detrimental to the public we lfare. 5. _he authorization of such variance will not adversely affect the imple- ' ntation of the comprehensive land use plan; Conclusion: The Comprehensive Plan specifically addresses on -site parking for industrial uses in both Policy 7 of Objective 1 and Policy 4 of Objective 2. Policy 7 - Objective 1 (page 621 "Promote adequate provisions for parking for all land uses." Policy 4 - Objective 2 ,page 63) "Discourage any changes from industrial or warehousing land uses unless there is reasonable provision for parking demand." Both policies use the words "adequate" and "reasonable." Therefore, a special use would have to consider its own peculiar parking demands. The Planning Commission considered those parking demands when reviewing the Conditional Use Permit. 6. That the granting of such a variance is necessary for the preservation anw enjoyment of a substantial property right of the applicant possessed .y the owners of other properties in the same zone or vicinity. (Ord. 889 023, 1974: Ord. 608 .s1(1), 1970.) Conclusion: The property rights with the construction of the building on the site were limited. Other facilities operating as "truck terminal" in the vicinity do not enjoy a reduced automobile parking requirement. SUM1L&RY: The conclusions for criteria No. 1, 2, 3, and 6 do not support the granting of a variance. Criteria No. 4 and 5 do support the variance request. fECON1' 1ENDATION: The staff recommends that the Board of Adjustment deny the request based on the above findings and conclusions.
