No cutting of any trees between the identified fill area and the river. 2. The northern toe of fill area is to be staked and inspected prior to issuance of grading permit. No fill to disturb existing groves of trees. 3. Stake all property corners prior to issuance of a grading permit. 4. Fill only allowed to bring the level of the identified fill area up to an elevation of 21 feet. (100 -year flood elevation) irrespective of whether it takes 45,000 cubic yards or not. 5. Raise present top cover of sanitary sewer man hole on Maule Avenue to 21 foot elevation. 6. Submit an erosion control plan to show location of temporary holding pond. 7. This permit to expire one year from the date of approval by the Department of Ecology. A maximum of a one -year extension may be allowed by the ap- proval authority upon written request of property owner. At the end of one year, if a renewal is not granted, or at the end of two years, if a renewal is granted, this permit shall be void and all conditions of this permit shall be complied with. Upon expiration of shoreline permit for fill, applicant must submit new application together with new filing fees and other application requirements in order to continue or re- institute fill activities. Seattle, WA 98104 RE: Flood Control Zone Permit - .Frank Todd Dear Mr. Gillespie: This letter is in regard'to my earlier letter to you dated June 27, 1979 as it relates to your letter to us dated April 24, 1979. At the time that Mr. Todd applied for a shoreline permit from us, I discussed the matter of a storm drainage easement across his property and -that it may be necessary to drain the general localized area in the vicinity.. At that time it was my position that, if this was not required by the Public Works Depart- ment, that it could be an item that could be required in conjunction with the issuance of a future building permit, should one be applied for. Based upon this, I appreciate your comments that the property acts as a- natural outlet for discharged waters, however, I would recommend that you further pro- cess the flood zone control permit without. further consideration of this item. We will attempt to resolve this issue in the future at such time as a proposed building or other improvements are proposed on this property. Again, thank you your concern on this property. Bauch, Mayor 30 January 1979 M E M O R A N D U M TO: Kjell Stoknes, OCD Director oger Blaylock, Assistant Planner SUBJECT: Shoreline Substantial Development Permit - #78- 40 -SMP The shoreline application and the environmental checklist for the requested filling of lots 1, 2, 3, 4, 5, 6 and 7 of Blue. Hillman's Sea Garden Tracts by Mr. Frank Todd have been reviewed. The 40 to 45,000 cubic yards of fill will be confined to the area south of the existing stand of cottonwoods and north of Interurban Avenue. The Green River is diked along the length of the property. Some trees have been removed; however, they are outside of the 200 foot shoreline area. Specific development plans have not been sub - mitted at this time. The only point of concern raised by nearby property owners was that of storm water drainage. (See letter from Oak Harbor Freight Lines, Inc.) A twelve inch storm drain is proposed;on the eastern boundary of lot 7. Storm water retention should be required probably in the area along the dike where the cottonwood stands are located. I recommend that a Declaration of Non - Significance and a Substantial Development'Permit for the 45,000 cubic yards of fill and the 12 inch storm drain be approved conditioned upon on -site storm water retention as per King County Hydraulics requirements and hydroseeding to.1imit erosion prevention. I have prepared the appropriate documentation.
