This is to inform you that the Tukwila Planning Commission considered
your application for conditional use permit at their continued December
meeting held 11 January 1979. The Planning Commission approved the
permit with the following conditions:

1. No parking of trucks shall be allowed in the streets or over
required parking.
2. Semi - trucks shall be permitted to park in the dock - loading
stalls only.
3. No combination of truck and trailer(s) over 60 feet long shall
be allowed to use the loading docks.

Chairman Kirsop answered each question as follows:
1. Yes, the Conditional Use Permit is good for as long as Courtesy Moving
and Storage is located there and obeying the rules.
2. There are no additional fees.
3. Other truck terminal buisnesses located in the M -1 district (such as
Garfield Transfer and Time D.C.) are operating with Conditional Use
Permits.
Chairman Kirsop closed the public hearing at 10:15 p.m.
There was a discussion concerning type of services the applicant provides. Mr.
Finkel mentioned they primarily store items and trucks leave in the morning and
return in the evening.
MOTION BY MR. RICHARDS AND SECONDED BY MR. WELSH TO GRANT THE CONDITIONAL USE
PERMIT WITH THE FOLLOWING STIPULATIONS:
1. NO PARKING OF TRUCKS SHALL BE ALLOWED IN THE STREETS OR OVER REQUIRED
PARKING.
2. SEMI- TRUCKS SHALL BE PERMITTED TO PARK IN THE DOCK - LOADING STALLS ONLY.
3. NO COMBINATION OF TRUCK AND TRAILER(S) OVER 60 FEET LONG SHALL BE ALLOWED

OTHER BUSINESS
Mr. Satterstrom requested a work meeting on the zoning ordinance be scheduled for
next Thursday, January 18, 1979.
Commissioners agreed.
Chairman Kirsop mentioned he would not be able to attend the regular January
meeting on the 25th.
Mrs. Avery expressed her concern regarding the roof - mounted equipment on one of
the buildings located in the Southcenter South Industrial Park. She said it was
not screened.
Mr. Satterstrom explained that the other buildings have screening and this build-
ing may not be complete. He said he would check up on it.

MOTION BY MR. SOWINSKI AND SECONDED BY MR. BOWEN TO RECOMMEND THE CITY COUNCIL
APPROVE THE REZONE WITH THE FOLLOWING STIPULATIONS:
1. DEVELOPMENT OF THE PROPERTY UNDER THE C -1 CLASSIFICATION SHALL BE
LIMITED TO A SINGLE OFFICE BUILDING WHICH MAY CONTAIN RELATED COM-
MERCIAL SERVICE USES CUSTOMARILY INCIDENT TO OFFICE USE.
2. ALL BUILDINGS SHALL BE SET BACK A MINIMUM OF 25 FEET FROM THE RIGHT -

COMPREHENSIVE PLAN: Light Industry
1. The subject property is proposed to be used for a truck terminal as defined
by the Board of Adjustment. Such a use requires Planning Commission appro-
val under Section 18.40.010 (TMC).
2. The Board of Adjustment on the 21st of September adopted the following
detailed definition of a "truck terminal ":
A truck terminal provides the following functions:
(1) A location to receive, pick -up and /or delivery of orders
which are placed by customers.
(2) The location of the dispatcher (functioning with that or
any other title) which directs the activities of the
truck driver.
The location used by the truck common carrier to receive
shipments for transloading, transhipping and /or consoli-
dation or from which transportation ensues after trans -
loading, transhipping or de- consolidation.
(4) The location where rolling stock of the common carrier
is parked during periods of non -use.
All four of the above functions must be present on the site to be
determined to be operating as a "truck terminal ".

3. Courtesy Moving and Storage, Inc. is independently owned and an agent of
Atlas VanLines. Said company handles household storage (warehousing) and
commercial and residential moving. Courtesy Moving and Storage currently
owns 3 semis which are 60 feet long and 4 vans.
4. Courtesy Moving and Storage would be one of four businesses within a large
warehouse (McCann Project 377) leased from McCann Development Corporation.
5. Section 18.40.010 requires Planning Commission consideration and approval
with respect to all of the following criteria:
a. Traffic requirements of the streets on which said terminals would
have access.
b. Location and width of entrances and exits to such terminals
c. Provision of sufficient space, and open, enclosed and covered docks
to allow the trucks when loading, unloading, maneuvering and parking
to be entirely on private property.
e. Possibilities of additional traffic hazards or congestion.
f. The effect of the proposed use on the present character or future
development of the surrounding community.
7. The proposed use consists of a loading dock approximately 70 feet long and
60 feet wide situated at the front of the building. The dock is proposed
to facilitate loading and unloading activities of 6 trucks. Rail service
is provided at the rear of the building.
8. Access to and from the subject property will be from a cul -de -sac, south
Glacier Place. A 40 foot curb cut has been cut in the loop of the cul -de -sac
connecting the parking lot to south Glacier Place. South Glacier Place is one
block from Todd Boulevard which is connected to West Valley Highway. (SEE,
Exhibit B)
9. A procedure of the City of Tukwila has been to consider office space, which
takes up no more than 10 percent of the total floor space of a building, to
be ancillary to the principal use of the building or lot. In these cases the
City has permitted the parking requirements for the office space be the same
as those for the principal use of the building space. The total square foot-
age of the subject building is 15,000 sq. ft. of which 8 percent is office
space. The developer has provided 15 parking spaces in keeping with said pro-
cedure.
CONCLUSIONS:
1. Local streets provide access between the subject site and West Valley Highway.
Said local streets providing access to the subject site meet the Tukwila Public
Works Department's traffic requirements. Said streets are adequate for Courtesy
Moving and Storage at its proposed size.

2. Comulative traffic from the total Southcenter South Industrial Park may
cause congestion at the intersection of West Valley Highway and Todd Boulevard.
3. The area surrounding the subject site is zoned M -2. The proposed use would
not affect the present character or future development of the surrounding
community. .
RECOMMENDATIONS:
1. No parking of trucks shall be allowed in the streets or over required parking
stalls for automobiles.
2. Semi- trucks shall be permitted to park in the dock - loading stalls only..
3. No combination of truck and trailer(s) over 60 feet long shall be allowed
to use the loading docks.

It is hereby stipulated and agreed between the appellants,
State of Washington Department of Ecology, and Slade Gorton,
Attorney General, acting through their legal counsel, Assistant
Attorney General Robert Jensen; the permittee, Bruce E. McCann,
through its legal 'representative, Richard E. Williams; and the
City of Tukwila through its legal representative, Wayne Parker,
that the Shorelines Hearings Board dismiss the action for the
reason that appellants are satisfied that the substantial
development complies with the provisions of the Shoreline
Management Act (Chapter 90.58 RCW), the guidelines and regula-
tions of the Department of Ecology, and so far as can be
ascertained, the master program being developed for the area;
PROVIDED that the substantial development permit be amended

(1) That adequate siltation controls shall be implemented
and maintained during the construction phases of the project;
(2) That at an accessible location between the storm

the Green River, a pond or low velocity ditch shall be installed
to allow collection in the event of a contaminant spill to
the storm drains.

(3) That, as delineated on the revised site plan which
will be provided for in the northeast corner and public
pedestrian access will be allowed throughout the length of the
shoreline for 30 feet inland from the outer edge of the top
of . the dike.
(4) That the permittee agrees to make a formal legal
dedication of said public access easement which is not incon-
sistent with the diking easements currently existing on the
property.
(5) That no part of the railroad lead track, as delineated
on Exhibit A, shall lie within a 50 foot inland conservancy
zone (or such lesser zone as may in the future be established
by the City of Tukwila under its Shoreline Management Program),
measured from the ordinary high water mark along the westerly
boundary of the site.
(6) That, as delineated on Exhibit A, no trees larger
than six inches in diameter will be removed in the northern
portion of the site during grading and land preparation stages.
At the time of further development only such trees shall be
removed as are necessary to allow development consistent with
zoning and /or platting ordinances for construction of
streets, buildings and the development of related facilities
such as parking lots, driveways, rail easements, storage areas
and utilities.
(7) That, as set forth in Exhibit B, the uses of the
property shall be restricted to those presently allowed under
City of Tukwils M -1 District Light Industry.

It is further stipulated and agreed that this permit
may be rescinded by the issuing authority upon the finding
that the permittee has not complied with the conditions of the
permit; in the event the department is of the opinion that
such noncompliance exists, the department may appeal within
30 days to the Hearings Board for a rescission of such permit
upon written notice to the local government and the permittee,
all pursuant to the provisions of RCW 90.58.140(7).

Dear Mr. Hunt:
The building permit for McCann Project 377 -L is being withheld at my request
pending compliance with Chapter 18 of the Tukwila Municipal Code. During my
review, I became aware that the funciton of Courtesy Moving and Storage, Inca
fell into the definition of a "truck terminal ".. The Board of Adjustment on the
21st of September adopted the following detailed definition of a "truck terminal ":
A truck terminal provides the following functions:
(1) A location to receive, pick -up and /or delivery of orders
which are placed by customers.
(2) The location of the dispatcher (functioning with that or any
other title) which directs the activities of the truck driver.
(3) The location used by the truck common carrier to receive
shipments for transloading, transhipping and /or consolidation
or from which transportation ensues after transloading, trans
• shipping or de- consolidation.
(4) The location where rolling stock of the common carrier is
parked during periods of non -use.
All four of the above functions must be present on the site to be
determined to be operating as a "truck terminal ".
The building permit will be held until after the public hearing of the Tukwila
Planning Commission on Thursday, 21 December 1978, in the Council Chambers of
the Tukwila City Hall located at 6200 Southcenter Boulevard. The Planning
Commission may impose conditions on the Conditional Use Permit, which will
have to be complied with on the site plans for the building permit.
