Satisfactory completion of plat internal and external public improvements or sufficient bond to guarantee such prior to City Council approval. 2. Obtainment of a written franchise agreement between the cities of Renton and Tukwila per Condition "A" of Resolution #617 prior to City Council approval. 3. Provision of specifications for materials to be used for all subdivision improvements. 4. Provision of walkways along one side of subdivision streets; sidewalk to extend to the redius of cul -de -sac street. 5. Provision of corner point survey markers for individual lots within the subdivision. 6. Provision of a bill of sale for utilities. 7. Provision of a unit cost breakdown of the installed costs for water and sanitary sewers. 8. Accommodations for power, gas, television cable, and telephone. 9. BOARD OF ARCHITECTURAL REVIEW LANDSCAPE PLANS: XEROX BUILDING Fred Satterstrom, Planning Supervisor, read the staff report which included a review of the proposal and recommendations. Mr. Paul Bianchi, Thomas L. Berger Landscapers, said the alternates have been approved and they will be installed. He said they would work with the City staff on the screen on the east site. ' Mr. James asked why they were required to plant down to Southcenter Boulevard when the Schneider Building and the City Hall were not required to do so. Al Pieper, Building Official, said the Public Works Department originally planned to develop Southcenter Boulevard in 1979 and by widening the street, the plant- ings of the Schneider Building and City Hall would come to the edge of the improved street. The improvement will not take place until 1980 and when it is done the planting will be to the edge of Southcenter Boulevard. Mr. Kirsop said all of the alternatives have been approved and will be taken care of which will include all of recommendations 2, 3, 4, 5, and 7. Approval was granted for the Preliminary Plat by the City Council on 21 February 1978 per Resolution #617 (Exhibit C). The proposed Final Plat depicts the general concept of revision as required by Resolution #617. An initial review of the plat, submitted by Gardner Engineers for Burlington Northern, has been performed by the City Public Works Department; fulfillment of criteria, as set forth in a meeting on 14 August 1979 between Planning and Public Works personnel and Mort Thomas of Gardner Engineers, has been stipulated as a condition for approval by the Public Works Department (see "Recommendation "). No written franchise agreement has yet been established between the cities of Renton and Tukwila as requird by Condition "A ", Resolution #617, nor has the design for and construction of Longacres Parkway been completed per Condition "C" of the Preliminary Plat approval. Other conditions attached to the preliminary approval have been complied with on the Final Plat. RECOMMENDATION: Staff recommends that the Final Plat for the Orillia Industrial Park be approved by the Planning Commission subject to the following conditions: 1. We have the following com- ments: 1) As discussed in the attached memorandum, the preliminary plat has expired,without recording of the final plat. Thus, . there is no plan -line of record specifying the alignment of the so- called "Valley Parkway" arts underlying utility structure. The secodd.paragraph indicates their understanding of the fact that the platting process was not completed. It is not apparent that they understand, however, that failure to file and gain approval of a final plat within one year of preliminary plat approval invalidates the preliminary Ol It seems inappropriate, therefore, for the city staff to ad- vocate sewer and right -of -way extension actions since no valid subdivision approval exists. 2) As a reminder, TMC 14.16.040 (d) requires City Council approval of sewer service extensions beyond the corporate limits of the community. > GARDNER ENGINEERS, INC. The street will be constructed in accordance with City of Renton per Condition C of the Resolution. Condition A requires a written franchise to define the extent of utility service by Renton within Tukwila's limits. This had been stopped while the possibility of a land exchange between the two cities was investigated. Although the exchange concept should undoubtedly be pursued, we suggest that, to expedite the project, the franchise agreement be resurrected. Water service is logically provided by Renton as the area is separated from Tukwila's water service on West Valley by 1000'+ of private property including two mainline railroads and the future P 1 drainage channel. Sewer service could be provided by Tukwila. This might be the simplest solution as Renton has an ordinance precluding sewer service outside the city limits. I believe it would be acceptable to them for Tukwila to extend from Renton's future sewer on Valley Parkway to serve your area. Renton would then carry the sewage a few hundred feet in their system to Metro. After researching our files on the Orillia Industrial Park Project, it appears that the final subdivision plat was never submitted to City Council for acceptance, nor was the final plat recorded with King County. According to Section 17.12.030 (9) of the City of Tukwila Subdivision Code, the preliminary plat approved under Resolution 617 has expired. Thus, no valid plat for this project exists in our available records. I am not sure what impact the plat status has for the proposed action by Metro; however:, 'I am interpreting their request for "land use compliance certification" to mean that the project has completed all necessary steps in the City's approval pro- cess, and that no further impediments to field construction are anticipated. Fail- ure to complete the platting process is a serious obstruction to construction on the individual parcels within Orillia Industrial Park. The Commission recessed the hearing to allow the applicant and the two juris- dictions to resolve the conflicts with respect to the proposed roadway pattern. Following a joint meeting between the applicant and the cities of Renton and Tukwila, the railway and roadway patterns were revised to A) provide rail service to all proposed lots within the Tukwila plat, and B) to eliminate the cul -de -sac within the Tukwila plat and provide a loop roadway pattern between S.W. 33rd Street and S.W. 38th Street. A copy of the revised Preliminary Plat is attached as Exhibit A. It should be noted the proposed lots have been decreased in size so that the smallest lot appears to be approximately 2.8 acres. All lot- abut at least one public right -of -way; however, access to lots 3 and 4 is restricted to 100 feet of cul -de -sac frontage. Also, the revised plat fails to identify the use of the land area lying immediately west of the temporary cul -de -sac noted at the north end of Longacres Parkway. Upon conclusion of the public hearing Staff recommends the Commission recommend the City Council approve the Preliminary as revised and dated 4 January 1978, with the following stipulations: 1.
