Dear. Mr. Sasonoff:

Your letter regarding Mr. Aiton's development is well taken. I have had
this matter investigated and have the following findings:
1. Mr. Aiton has violated Ordinance #809 by cutting vegetation
and grading without approval of the City.
2. There has been some congestion of the street, particularly
when the storm water system was installed. A permit was issued
authorizing this work.
3. Mr. Aiton has been warned by the Building Official to not. do
more work without benefit of approvals from the City. This
will be reaffirmed in writing.
4. The street has had considerable dirt strewn on it from time
to time from this development. This is being monitored as best
we can.
To suggest that the City does not care what the developer does is not
accurate. My staff has probably spent more time on the Aiton development
than any other in the City. I do not see my staff as responsible for the
construction habits of developers. Certainly some are better than others,
as I am sure you well know.
It is our intent to implement Ordinance #809 and other laws of the City.
Mr. Aiton is very difficult to work with because he often does the work or
starts it without approval leaving us in a position of placing stop work
orders or working out compliance after the fact.
It is our commitment that compliance with Ordinance #809 will be met by the
time the project is complete.

S U BJ EQT : Possible Violations of Ordinance 809
The developer, Mr. Tom Aiton, has complied with the provisions of Ordinance 809
in so far as submitting plans for review. During the last several. months I have
conducted several on site inspections of the building sites; however, I haue not
inspected the upper portion of the property where the alleged violations of
cutting trees has occurred. The first building has not been completed and
a final inspection to determine compliance has not been made. The problem
that I am aware of results from the operating procedure of the contrator,
which is not addressed directly in the scope of Ordinance 809. The developer
presently has submitted site plans for the second office building. Review
by the Board of Architectural Review is pending the submission of a grading
plan.

In my letter of November 17, 1978, regarding the
development of property at the south west corner of 53rd
South and South Center Boulevard, I expressed several
concerns. (I am enclosing a copy of that letter.) Please
refer to Page two where I mentioned violations of Ordinance
809.
This Ordinance continues to be violated by the
property developer. I cannot understand why the law has
to be obeyed by some who develop land and not by others.
This developer continues to move thousands of yards of
earth and demolish trees over the upper portion of his land
where he has no permit, and no approval of the Planning
Department.
Evidently the Ordinance has no teeth to it or no
one in the City cares what this developer does. I believe
the Prosecuting Attorney should file an injunction to
stop these repetitive violations.
If this injunction is not filed, I am going to appeal
to the press to publicize all of my correspondence and
these obvious violations.
This type of developer clearly has an "don't care"
attitude on how he goes about developing his land. This
is being reflected when the developer uses the entire
street (53rd South) as a staging area for his development.
There are times when absolutely no one can use the street.
This man has over five acres of land. I believe he should

be told to set up an area within that five acres to park
all of his vehicles, store materials, and so on.
I am appealing to you again as a last resort before
taking further action.
Please let me know what is going to be done
as possible.

November 17, 1978
I want to express .a concern to me and other neighboring
land owners in the Tukwila community. A development of
approximately five acres is underway at the South West corner
of 53rd South and South Center Boulevard. A Building Permit
has been issued for the first building of a four lot short
plat in a C -2 Zone.
The Building Permit should not have been issued for the
following three reasons:
1. The total short plat and its development, 'roads,
ingress and egress, land characteristics, drainage,
soils tests and the impact of five acres of commercial
development un substandard roads should have been analyzed
prior to issuance of the first Building Permit,
2. Th drawings as corrected by the B u i l d i n g Department
indicate serious corrections such as slopes, drainage
and building placement that should have demanded °a'.
resubmittal of the plans after the 'corrections ' had '.:been
made on the drawings. -
3. There is a discrepancy of ten feet on the south
property line of this development. This discrepancy
has not yet been resolved and may go into some serious
litigation.
After construction was underway, I and other neighbors
pointed these discrepancies out to the Building Inspector,
but to no avail. The construction continued, fill up to

twelve feet in depth was placed over very unstable subsoil.
The soil has a high water table as indicated by soils tests which
.Were performed on Mr. Hall's property to the East, and Mr. Foster's
property to the South. Also by visual inspection anyone . could
see water seeping out of the hillside into the open culvert
during the summer and more in the winter.
I attended the October Planning Commission hearing when
Landscape Plans for the first building were submitted. During
the hearing I expressed some of my concerns.
I also asked if the Planning Department had reviewed and
approved the plans for the rest of the five acres. They said they
had not. At this point I indicated that the developer had violated
Ordinance 809 which specifically states that plans will be reviewed
prior to any earth moving, tree removal, or grade changing.. The
developer has moved several thousand yards of earth over the other
portions of his land without the approval of the Planning Department
and without a Building Permit, as required by Section 17.20.040 of
Title' 17. This is appalling to me when,people in other sections
of Tukwila are being denied land fill and earth moving permits.
There have been no environmental considerations looked into
as this developer continues his merry way. The attitude seems to be
that once it is done, nothing can be done about it. There is a
stream that will be endangered at the North West corner of this
property, if the development is allowed to continue as shown on
additional drawings that were submitted by the developer at the
October hearing.
In summary, I would like to know what is going to be. done
about the violations of Ordinance 809 and 17.20.040 of Title 17.
I believe that prior to the issuance of any further Building
Permits on the subject short plat development, serious 'cons .
should be given to all of the items I have listed (in item one). on .
the first page of my letter.
I will be anxiously waiting to hear from you persohally .
and also by letter.

SUBJECT: Proposed Aiton Office Building, Location, 53rd Avenue South South
of Southcenter Boulevard
The above - referenced development has been reviewed by the Planning Commission
pursuant to rezone ordinance #809.
As a result.of that, the Planning Commission has required and the applicant
has acreed to the following:
1. Dedicate easterly 5 feet to the City for right -of -way prior to .
issuance of Building Permit.
2. Agree to improve 53rd Avenue South to City standards at time of
development of property adjacent to the north and have road
improvements made prior to occupancy of any structure on the
land adjacent to the north.
I would like to talk to you regarding procedural implementation of the paper
work on these items. There is a point in time when there is a break between
what is Public Works related work and what is Community Development related
work. I would like establish these work separations mainly for clarity
purposes.so we can develop procedures as necessary.
I have attached a copy of the subject property for your review.

Dear Sir:
The Planning Commission at their regular meeting of June 22, 1978, approved
your development plans for your office building in Tukwila per the plans
submitted and dated June 19, 1978 with the following additional conditions:
1. Curb -cut of 24' -width be established for the west parking area, such
curb -cut to be located at least 20' from west property corner and at
least 100' from edge of eastern curb -cut;
2. Treatment of the north building elevation with stacked brick, same as
other building elevations;
3. Screening of roof - mounted equipment.
4. Detailed landscape plan review by Planning Commission prior to occupancy.
5. Dedicate easterly 5 feet to the City for right -of -way prior to issuance
of building permit.
6. Agree to improve 53rd Avenue South to City standards at time of develop-
ment of property adjacent to the north and have road improvements made
prior to occupancy on any structures on the land adjacent to the north.
Please incorporate the above conditions into your site plan in conjunction with
your building permit application.
In addition to the above, the Planning Commission latter discussed the subdivision
code. After our discussion, it is my conclusion that your property must be subdi-
vided now prior to issuance of any building permit by the City of Tukwila if there
is presently a structure on the property. The only way to avoid having to subdivide
now is if the building is removed prior to issuance of the occupancy permit or if
the demolision bond is submitted to the City of.Tukwila guaranteeing its removal
within a specified period of time. Please call me on this item so we can clear
it up as soon as possible.

AGENDA ITEM V G • Development Plans: Aiton Office Building
The Aiton Co., Inc. proposes to construct a 10,000 sq. ft. office building
on a portion of a lot lying along the west side of 53rd Avenue South just
north of the Foster's Unusual Furniture Store under construction. This
site was rezoned from R -1 to C -2 in 1973 by ordinance #809 with seven (7)
conditions.
The proposed building is designed for multiple - occupancy with tenant entries
on the east, west, and south elevations. Proposed treatment of the exterior
is stacked brick, except for the north elevation which is masonry block, with
wood dutch doors and wood trim windows. Roof is proposed to be clay tile.
Access to the site is from an easement road at the south end of the site.
Two entrances are shown, one a 20' -wide curb -cut, the other 65' -wide.
Parking along the south end of the buiding is proposed to back out into
the easement road in order to exit. Thirty -two (32) parking spaces are
proposed; thirty -one (31) are required. Stall width is 9 -feet. A 5' -wide
landscape strip is shown along 53rd Avenue South.

Motion by Mr. Bowen, seconded by Mr. Sowinski and carried to table this item
until the next regular meeting. Reason being so applicant can be present with
a more detailed plat plan of site.
LLOPMENT PLANS: Aiton Office Building
Mr. Stoknes read the staff report and displayed development plan. Mr. Stoknes
explained that Mr. Aiton has modified the plan to meet most of the requirements
of the staff report.
Mr. Aiton explained changes to plan.
Commissioners and staff discussed stipulations.
Motion by Mr. Sowinski, seconded by Mrs. Avery and carried to approve the
development plans based on the drawing dated 19 June 1978 as revised in red
and with the following stipulations:
1. Curb -cut of 24' -width be established for the west parking area, such
curb -cut to be located at least 20' from west property corner and at
least 100' from edge of eastern curb -cut;
2. Treatment of the north building elevation with stacked brick, same as
other building elevations;
3. Screening of roof - mounted equipment;

(.7) Mr. Hartong voted NO.
NEW BUSINESS
Commissioners and staff discussed what kind of irrigation to require in landscape
areas. Commission generally agreed that "underground irrigation" was desired.
