THIS DECLARATION OF RESTRICTIONS, made and entered into this day of , 1978, by and between DJD PARTNERSHIP, a general partners,3ip comprised solely of John R. Tomlinson, Don Jenne, and Simon R. Justham, hereinafter referred to as "DJD," and WILLIAM E. BOEING, JR., hereinafter referred to as "Boeing," and and DECLARATION OF RESTRICTIONS WITNESSETH: WHEREAS, DJD is the sole, current holder of fee title to the following described property (the "DJD Property ") in King County, Washington, described as follows: The West 23 feet and the South 20 feet of Lot 7, UPLAND'S TUKWILA INDUSTRIAL PARK, City of Tukwila, King County, State of Washington, as recorded in Volume 104 of Plats, Pages 8, 9 and 10, Records of King County, Washington, being part of the SW 1/4 SE 1/4 of Section 26, Township 23 North, Range 4 East, W.M.; WHEREAS, Boeing is the sole, current holder of fee title to all that certain property (the "Boeing Property ") in King County, Washington, described as follows: The East 23 feet of Lot 6, and the North 20 feet of Lot 10, UPLAND'S TUKWILA INDUSTRIAL PARK, City of Tukwila, King County, State of Washington, as recorded in Volume 104 of Plats, Pages 8, 9 and 10, Records of King County, Washington, being part of the. SW 1/4 SE 1/4 of Section 26, Township 23 North, Range 4 East, W.M.; WHEREAS, the City of Tukwila, Washington, has required, as a condition to granting certain building permits and permissions for the construction of improvements upon the premises adjacent to the DJD Property and the Boeing Property, that said owners enter into this Agreement; and WHEREAS, the parties hereto are desirous of obtaining such permits and permissions; NOW, THEREFORE, each of the parties hereto, -j consideration of and in reliance upon the signature of the other, as"a principal inducement for the City of Tukwila to issue certain building permits and other permissions in connection with the development of tracts adjacent to the aforementioned properties, and $10.00 and other good and valuable considerations, the receipt and sufficiency of which are hereby acknowledged, agree as follows: 1. DJD hereby covenants and agrees that the DJD Property shall not be improved with a building, and Boeing hereby cove- nants and agrees that the Boeing Property shall not be improved DJD PARTNERSHIP -2- with a building, both so long as and to the extent that the City of Tukwila requires said properties not to be so developed. As used herein, buildings include only those structures which have a capacity to contain, and are designed for the habitation of, man or animals, or the sheltering of property. Without limitation thereof, it is specifically understood that railroad tracks and appurtenant facilities may be constructed on said real property. 2. The restrictive covenants herein contained shall con- tinue in duration until such time as the City of Tukwila, Wash- ington, or its successor, agrees in writing, duly recorded with the Department of Records, King County, Washington, that it no longer requires the same. 3. The covenants and restrictions herein contained may be enforced by either party hereto, their successors or assigns, or the City of Tukwila, Washington, or its successor, through any available legal or equitable action, including, without limita- tion, temporary and permanent negative and affirmative injunc- tions; provided, however, no breach of any of the covenants herein contained shall result in any reversion of title; and provided further, nothing contained in this paragraph shall be interpreted or construed as extending the duration of said coven- ants and restrictions beyond that which is set forth in paragraph 2 hereof. 4. The terms, covenants and conditions herein contained shall run with the land, and shall be binding upon and inure to the benefit of the respective parties hereto and their heirs, successors and assigns. The Planning Commission approved the development plan for D.J.'s Sound City with the following stipulations: ./1. Curbing be installed along the rail easement on the west property line. 2 Planning Commission approval of a detailed landscape plan prior to issuance of occupancy permit. 3. Screening of roof - mounted equipment. 4. Building easement agreement with adjacent property owner on the south shall be required prior to issuance of building permit. 5. Page 5 27 July 1978 BOARD OF RCHITECTURAL REVIEW . .'s SOUND CITY Mr. Satterstrom read the staff report and drawings were displayed. Mr. Tom Croonquist; architect for D.J.'s Sound City, displayed and explained drawings. Mr. Richards asked how the trucks intend to maneuver on site. Mr. Croonquist explained that D.J.'s uses 20 and 25 foot trucks. Number of required parking spaces was discussed. Mr. Croonquist mentioned that some of the building area is not inhabitable so less parking spaces should be required. He displayed a drawing showing how the building area is intended to be used and that they figured 67 parking spaces should be required. Discussion on parking and truck maneuvering continued. Mr. Richards described the amount of maneuvering space as tight; stated that maneuvering would be specially difficult when 1 or 2 trucks were already parked at loading docks. Mr. Croonquist assured the Commission that D.J.'s would be using strictly smaller trucks and the total number of trucks would not be significant. MOTIO. BY MR. SOWINSKI AND SECONDED BY MR. WELSH TO APPROVE THE DEVELOPMENT PLANS FOR D.J.'s SOUND CITY WITH THE FOLLOWING STIPULATIONS: 1. CURBING BE INSTALLED ALONG THE RAIL EASEMENT ON THE WEST PROPERTY LINE. 2. J.'s Sound City in Tukwila Dear Sir: The Planning Commission considered the above - referenced item during their regular meeting of June 22, 1978. The Planning Commission had some questions regarding the site plan and, lacking anyone representing the development in the audience, tabled the matter until their next regular meeting of July 27, 1978. The Building Department cannot issue a building permit on this project until it has received Planning Commission approval. If you are interested in pur- suing your development, I strongly recommend that someone knowledgeable on the proposed development be present at the next Planning Commission meeting of July 27, 1978. The meeting starts at 8:00 p.m. and is located in the old Tukwila City Hall at 14475 - 59th Avenue South. Development Plans: D. J.'s Sound City D.J.'s Sound City, Inc. proposes, to build.a 50,485 sq. ft. warehouse on Lot #7 of the Upland's Tukwila Industrial Park plat. The 2.41 acre site is located along the south side of the as yet unbuilt Upland Drive adja- cent to the Ivy warehouse. Access to the site is from Upland Drive. One 24' curb -cut is located at the west corner of the property and functions primarily ds automobile access to parking areas on the site. A second curb -cut, 40' in width, is located about 135' to the east of the first cut and functions primarily as truck access to the truck doors located along the building's north elevation. The building is proposed to be built of tilt -up concrete painted with earth -tone colors (buff). Front office areas will be heavy -duty glu -lam . with natural wood facia. Windows will be medium bronze glass. Metal truck doors will be recessed 5 feet. Staff recommends that the Planning Commission approve the proposed develop- ment plans subject to the following conditions: 1. Railroad line beside parking area was discussed. Motion by Mr. Bowen, seconded by Mr. Sowinski and carried to table this item until the next regular meeting. Reason being so applicant can be present with a more detailed plat plan of site. DEVELOPMENT PLANS: Aiton Office Building Mr. Stoknes read the staff report and displayed development plan. Mr. Stoknes explained that Mr. Aiton has modified the plan to meet most of the requirements of the staff report. Mr. Aiton explained changes to plan. Commissioners and staff discussed stipulations. Motion by Mr. Sowinski, seconded by Mrs. Avery and carried to approve the development plans based on the drawing dated 19 June 1978 as revised in red and with the following stipulations: 1. Curb -cut of 24' -width be established for the west parking area, such curb -cut to be located at least 20' from west property corner and at •least 100' from edge of eastern curb -cut; 2. Treatment of the north building elevation with stacked brick, same as other building elevations; 3. Screening of roof - mounted equipment; 4. Detailed landscape plan review by Planning Commission prior to occupancy; 5. Dedicate easterly 5 feet to the City for right -of -way prior to issuance of building permit; 6. Agree to improve 53rd Avenue South to City standards at time of develop- ment of property adjacent to the north and have road improvements made prior to occupancy on any structures on the land adjacent to the north. Mr. Hartong voted NO. NEW BUSINESS Commissioners and staff discussed what kind of irrigation to require in landscape areas. Commission generally agreed that "underground irrigation" was desired.
