Until the Board of Adjustment has met and made a decision on this item, the City of Tukwila will not be issuing a building permit. Depending on the outcome of the Board of Adjustment, it may be that the decision of the Planning Commission will stand or that the parking mentioned above will not be allowed. Bauch, Mayor TO: Board of Adjustment FROM: Kjell Stoknes, OCD Director jg SUBJECT: Interpretation of Title 18, Zoning Ordinance The situation is as follows: This is a request to the Board of Adjustment for an interpretation regard- ing what a useable parking space is. This situation arises from action taken by the Tukwila Planning Commission in which parking stalls are allowed to which access or egress may not be allowed based on truck parking. Fiberchem wished to make a building expansion. In order to pro- vide adequate parking, they proposed parking stalls to be counted that would be blocked from entering or exiting when a truck is parked at a truck door. This, to my knowledge, has not been approved before and appears to be an interpretation of something the zoning code does not say is authorized. Code interpretations are made by staff and appealable to the Board of Adjustment. The Planning Commission does not have authority to make code interpretations. In this case, I am referring this matter to the Board for their decision similar to an appeal pro- cedure. Based upon this, I am seeking the Board of Adjustment's position and direction on the following items: 1. Was the Planning Commission decision to allow certain parking stalls which would be blocked off by trucks when loading or unloading an interpretation of the zoning ordinance? (If not, no further action is requested from the Board of Adjustment.) 2. If the Planning Commission's action authorizing the allowance of those parking stalls was an interpretation of the Zoning Ordinance, what is the Board of Adjustment's position on this same question? (Should the Board of Adjustment support the action of the Planning Commission, no further action need be taken by the Board on this item.) KS /ckh Attachments. Chairman Kirsop called the regular December meeting of the Planning Commission to order at 8:10 P.M. Commissioners in attendance were Avery, Bowen, Sowinski, and Welsh. Roger Blaylock and Fred Satterstrom were present representing the Planning Division staff. MOTION BY MR. BOWEN AND SECONDED BY MR. WELSH TO APPROVE THE MINUTES OF THE REGULAR NOVEMBER MEETING AS PRESENTED. MOTION CARRIED. MOTION BY MRS. AVERY AND SECONDED BY MR. SOWINSKI TO APPROVE THE NOTES OF THE 14 SEP- TEMBER, 12 OCTOBER AND 9 NOVEMBER 1978 WORK MEETINGS AS PRESENTED. MOTION CARRIED. Mr. Satterstrom informed the Planning Commission that the Ehmke -Kato rezone had even- tually been approved by the City Council upon reconsideration. The new site plan sub- mitted for reconsideration indicated 102 units on the property, 12 less than the Com- mission's recommendation. Mr. Satterstrom also informed the Commissioners that 62nd Avenue South was going to be improved by L.I.D. during 1979 and that formation of the L.I.D. has begun. Mrs. Avery excused herself from the proceedings due to a conflict of interest on this matter. Mr. Blaylock read the staff report and explained the displayed drawings. Mr. Blaylock explained that the master landscape plan for Segale Buisness Park had contemplated street trees at 40' on- center. Mr. Kirsop noted that the development plans for the Fiberchem addition had been approved by the A.C.C. last month. Mr. Tom Sconzo, architect, explained the plans for addition to Fiberchem. Stated that the number of employees will not exceed 20 and that there is presently truck maneuvering on the street. Mr. Don Leuthold, representing the Fiberchem Company, stated that the proposed plans will merely enclose a storage area which is presently fenced. He stated they wished to protect certain items from the elements. Stated that most trucks maneuver on -site, only the 42+ trucks must maneuver into loading spaces from the public street. Also, stated that he did not contemplate an increase in activity on the site. Only 18 employees currently working at Fiberchem. Mr. Blaylock informed the Commission that the building could be sold in the future and new owner may need all of the parking area. Air. Satterstrom explained the intent of the staff report is to allow additional time for applicant to explore alternative site plans in order to accommodate as much truck maneuvering on -site as possible. Explained that proposed site plan requires on- street truck maneuvering by all trucks. Mr. Sconzo stated that warehouses in Andover Park have historically been designed for truck maneuvering on the streets. Mr. Gene Colen stated that he felt the roads in the Andover area were put in for industrial access not for access to Southcenter. He also stated that there was nothing on the site plan which was not in conformance with city codes. Mr. Bowen said that this matter is not an easy one to solve. Said that staff has done much research and has identified a problem. Added that the owner has to look out for his own interests. Mr. Sconzo stated that the City's ordinances must have changed since the indus- trial park first began to develop. Stated that the parking required at Fiber - chem would be less if they had developed years ago. Mr. Blaylock explained the policy employed by staff to determine whether the office function in a warehouse was actually incidental to the principal ware- housing use of a structure. Added that the Planning Commission has required "useable" parking spaces in past B.A.R. actions. Cited McCann Project #294 as an example. Planning Commission Page 4 Minutes 20 December 1978 Mrs. Avery stated that Andover Park East is not a freeway; it serves mainly shoppers and employees. Asked how the denial of this site plan might affect other similar businesses in Andover Industrial Park. Mr. Satterstrom explained that only in the review of proposed building expan- sions could the B.A.R. discourage increased ofEsite truck maneuvering. Businesses which presently relied on off -site truck maneuvering would generally not be affected by Commission's decision on this site plan. Discussion ensued regarding the blockage of parking stalls by parked trucks in front of truck doors. Mr. Kirsop stated that it was realistically practical to designate the blocked stalls for employee parking. Mr. Bowen stated that the city might have to live with truck maneuvering on the public streets. MOTION BY MR. BOWEN AND SECONDED BY MR. WELSH TO APPROVE THE SITE PLAN AS PRESENTED. MOTION BY MRS. Mr. Don Halbrook, designer, stated that he generally agreed with the conditions of the staff report except for the requirement that a stairway connect the parking lot with Southcenter Boulevard. Said the sidewalk would be unlighted and would constitute a potential hazard. Mr. Blaylock stated that multiple- family residential use was increasing to the north and there would naturally be more pedestrians in this area in the future. Said there would be a natural tendency for persons to cross the property on their way to bus or Southcenter.. Mr. Kirsop said he thought requiring a stairway would encourage trespassing and possible parking on the site. Mrs. Avery stated there was a sidewalk on 62nd Avenue and pedestrians should see it. Mr. Kirsop stated that he thought office buildings in particular should have adequate sized parking stalls and maneuvering aisles. Stephen Koehler, applicant. stated that i± was never their intention to encourage left turns onto Strander from the site, but that they would like to have vehicles be able to turn left from Strander onto the site. He stated they would eliminate one compact stall, if required. Said they wished to provide more than just the minimun number of parking spaces. Therefore, did not want to eliminate more than 31 stalls near egress point on Strander Boulevard. Mr. Norman Jacobson, engineer, stated that north entrance was never intended to be the main entry. Said the slow speed and good visibility would help alleviate any potential access problem at this point. Discussion ensued regarding left -hand turns onto and from the site along Strander Boulevard. Generally agreed this aspect of the site plan would fall into the hands of the Public Works Department at some future time. MOTION BY MR. SOWINSKI AND SECONDED BY MR. WELSH TO ACCEPT THIS PER STAFF RECOMMENTADION REVISION CONDITION #6 OF ORIGINAL APPROVAL OF 16 NOVEMBER 1978, ONLY. (CONDITION #6 WOULD READ AS FOLLOWS: THAT THE PARKING STALL DIMENSIONS BE REDESIGNED TO PROVIDE 9' BY 20' PARKING STALLS, ADJACENT TO THE REQUIRED LANDSCAP- ING, ALONG SOUTHCENTER PARKWAY AND STRANDER BOULEVARD. Mr. Al Pieper, Building Official, read the staff report and explained the cited portions of the sign code. Stated that the proposed design generally does not detract from the area. MOTION BY MR. WELSH AND SECONDED BY MR. SOWINSKI TO APPROVE THE PROPOSED SIGN PLANS WITH THE FOLLOWING CONDITION: 1. Read the proposed motion. Mr. Lowell Gordon from McCann Construction Co. stated that he knew of several B.A.R. approvals given on unsubdivided lots and he knew of no subdivision problems connected with these approvals. Stated that the City may be creating a lot of unncessary paperwork. Mr. Satterstrom stated that B.A.R. approval may sometimes dictate or tend to dictate access to future building sites and therein lies the conflict with the Short Subdivision Committee. MOTION BY MR. Mr. Don Halbrook, designer, stated that he generally agreed with the conditions of the staff report except for the requirement that a stairway connect the parking lot with Southcenter Boulevard. Said the sidewalk would be unlighted and would constitute a potential hazard. Mr. Elaylock stated that multiple- family residential use was increasing to the north and there would naturally be more pedestrians in this area in the future. Said there would be a natural tendency for persons to cross the property on their way to bus or Southcenter. Air. REQUEST: REVISED DEVELOPMENT PLANS have been submitted for a 9,700 square foot warehouse addition onto the Fiber - chem, Inc. Building. APPLICANT: Fiberchem, Inc. 1120 Andover Park East Tukwila, Washington 98188 LOCATION: 1120 Andover Park East SIZE: 52,371 square feet ZONE: C -M (Industrial Park) COMPREHENSIVE PLAN: Light Industrial A revised development plan has been submitted by Thomas A. Sconzo, Architect for the Fiberchem, Inc. Building. The plans call for (1) an addition of 9,200 square feet to the warehouse facility, (2) restriping of the existing parking lot from 22 parking spaces to 36, and (3) the creation of a second curb -cut, 24 feet in width. The use and setbacks comply with TMC 18.32. The plans provide 36 parking spaces. The office space (5,724 sq. ft.) requires 18 parking spaces, computed at 3.1 spaces per 1,000 square feet, while the 17,939 square feet of warehouse space requires another 18 parking spaces. Off- street loading space, TMC 18.32.030 (d), specifically requires: 1. An off - street loading space, having access to a public thoroughfare, shall be required adjacent to each business building, hereafter erected or enlarged, if the use bf such building entails deliveries to it or shipments from it. CONCLUSION: Off- street loading space is provided in front of the two major truck doors. The smaller truck door at the northwest of the building has an extra park- ing space 13' by 20' adjacent to it. 2. Such loading space shall be of adequate size to accommodate the maximum number and size of vehicles simultaneously loaded or unloaded, in connection with the business conducted in such building. Planning Commission 3. No part of the truck or van using the loading space may project into the public right -of -way. CONCLUSION: 1. Adequate on -site maneuvering space for trucks. 2. Adequate number of parking spaces as required in TMC 18.56.160 and 18.56.180. Page 2 Staff Report 20 December 1978 CONCLUSION: The loading space in front of the two main doors is approximately 54 feet in length. However, if both areas are being utilized, 6 parking spaces will be blocked. The space provided in front of the small truck door is only adequate for a pickup, van or small truck (not exceeding 20 feet in length). The truck loading areas are on -site and do not project into the public rights - of -way. However, moving into the loading areas will require on- street maneu- vering. TMC 18.56, Off- Street Parking and Loading Regulations, addresses the specific uses and problems in more detail. In TMC 18.56.210, the adequacy of maneuvering of trucks on site is discussed. It is specifically stated that "there shall be provided an maintained on the premises adequate space for standing, loading and unloading services in order to avoid undue interference with public use of the streets and alleys." Adequate maneuvering space is addressed in Policy 2 of the Transportation Objective and Policies in the Comprehensive Plan. Its intent is to "dis- courage the maneuvering of automobiles or trucks on public right -of- way." The existing parking lot at Fiberchem, Inc. allows the trucks to maneuver on the site. It would appear that the proposed addition and its associated parking area would force the trucks to maneuver on Andover Park East and back -in or use a portion of the parking lot designated for automobile parking spaces. RECOMMENDATION: Staff recommends that the Planning Commission table the request by Fiberchem, Inc. to expand their facilities at 1120 Andover Park East as presented based upon the fact that there is inadequate truck maneuvering space on -site until the applicant submits a new site'plan which provides the following:. 3.
