FILE NO. 77 -18 -R. WHEREAS, An environmental questionnaire has been com- pleted and a negative declaration has been issued, and; WHEREAS, The Planning Commission reviewed the rezone application at their regular meeting of May 26, 1977, and did recommend a modified approval subject to certain conditions, and; WHEREAS, The City Council considered the matter at their regular meeting of June 6, 1977, and concurred with the recommenda- tion of the Commission. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the property described in the attached legal description, (Exhibit "A ") lying below the natural toe of the slope is hereby reclassified to C -2 and the City Council hereby adopts the map attached hereto as Exhibit "B" as illustrative of the property described herein. Section 2. The rezoning to C -2 is subject to the following stipulations: (1) Setbacks. 15 feet on front and side yards, and five feet on rear yards. a. The C -2 classification shall not exceed the natural toe of slope and shall be confined to that area depicted for commercial development in the attached survey drawing. b. Three of the stipulations contained in Ordinance #567, as recited below, shall apply to that land area hereby reclassified: * (Insert) Five feet of the 15 foot landscaped area will be sidewalks. RECESS 8:30 P.M. - 8:35 P.M. RESOLUTIONS Resolution #587 - Urging the Fed. Comm. Commission to consider the City as a Community Resolution #588 - Authorizing Mayor to enter into Developers Agree- ment with W.P. & H.H. Ketcham (So. 153rd St.) /g6 3 Councilman Bohrer asked Mr. Kenneth D. Long, representing Benaroya Co., what development is planned for the portion of the property in the canyon and indicated west of the railroad tracks? Mr. Long explained that it is an area large enough for development of a building but at this time they have no client for that area. It would be eventually developed in accordance with the zoning of the area, possibily a small furniture store or restaurant. Councilman Bohrer expressed concern about starting development in the cany area which could lead to further development on the hillside and also, getting a development which is not appropriate to the area. He suggested deleting the area west of the railroad tracks from the rezone. MOVED BY BOHRER, SECONDED BY SAUL, THAT COUNCIL DELETE, FROM THE REZONE, THAT PORTION WHICH LIES 20 FEET WEST OF THE WEST RAIL OF THE RAILROAD TRACKS. * Councilman Traynor suggested this should go back to Committee to clarify some of these points. Mayor Bauch explained that, due to an error on a City map, the Carriage House is tied up in a finance problem and they would appreciate it if Council would resolve their problem. Councilman Bohrer, to clarify his motion, explained that he is not concerned with that portion west of the railroad tracks north of the Carriage House but, he is concerned about the North Canyon. Mr. :Ken Long suggested making the boundary the westerly line of the easement for the railroad in the North Canyon. * SECOND TO MOTION WITHDRAWN BY COUNCILMAN SAUL TO ALLOW RESTATEMENT OF AMENDMENT. MOTION AMENDED TO READ "THE WESTERN LINE OF THE EASEMENT IN THE NORTH CANYON." SECONDED BY SAUL. MOTION CARRIED. Councilman Saul suggested an amendment to Section 2. b. Staff recommends the City Council concur with the Commis- sion and approve the rezone as recommended. This would grant approval for C -2 zoning only to the natural toe of the slope and denial for the land lying in elevation above the natural toe of the slope. 90' CITY OF TUKWILA PLANNING DIVISION 26 May 1977 PLANNING COMMISSION STAFF REPORT AGENDA ITEM VII A : PUBLIC HEARING: REZONE •- R-J. to C -2 (BE,marQyAL REQUEST: REZONE from R -2 to C -2 APPLICANT: Benaroya Company, 5950 Sixth Avenue South, Seattle LOCATION: Between Southcenter Parkway and I -5 and near the rail service line crossing Southcenter Parkway. SIZE: Approximately 6 acres COMPREHENSIVE PLAN: Industrial The City Council granted a Waiver from Resolution #489 on 2.May 1977 and the applicant has made formal application for rezone. FINDINGS: 1. The subject parcel, commonly referred to as the Giovanelli property, is situated as portrayed in Figure 1, attached. 2. The City zoning map, as a result of a drafting error, indicated this parcel was located farther north and that the entirety of the Benaroya property was zoned M -1 (Light Industry). (SEE, Figure 2, attached.) 3. The land lying immediately south of this parcel was rezoned to M -2 by Ordinance W567 in 1969, a copy of which is attached as Exhibit "A". 4. The land area lying east of the site is zoned CM (Industrial Park) and is being developed primarily for commercial use. (SEE, Figure 2.) 5. The land area lying north of the site and west of Southcenter Parkway is zoned R -1 (Single - family) and is being used as such for distance of approximately 1000 feet north along Southcenter Parkway. (SEE, Figure 2.) 6. The subject parcel extends westerly from Southcenter Parkway to the east line of the I -5 freeway right -of -way, a horizontal distance of approxi- mately 800 feet, and includes the steep hillside and the area commonly referred to as the "north canyon ". (SEE, Figure 3.) 7. The relocated rail service line now extends from the northeast corner of the parcel to the south line of the property and generally follows the 30 -foot contour line, as depicted in Figure 3. 8:00 P.M. 8. The land area lying generally below the 30 -foot contour has been filled in conjunction with relocation of the rail service line while the hill- side above said contour is heavily wooded, with the exception of the north canyon floor. Planning Commission Staff Report CONCLUSIONS: 1. Since this parcel is anticipated to accomodate expansion of the commercial development existing and planned for the parcel immediately south, the complementary restrictions contained in Ordinance # #567 should be attached to this parcel. 2. Care must be taken in any development near the steep slopes and reclassi- fication of the property to accomodate such development should express maintenance of the natural slope 3. The requested classification (C -2) complements existing and anticipated development in the immediate vicinity as well as the Comprehensive Plan recently promulgated by the Planning Commission. RECOMMENDATION: Staff recommends the Planning Commission recommend the City Council reclassify the subject parcel from R -V to C -2 only with the following stipulations: 1. The C -2 classification shall not exceed the natural, toe of slope and shall be confined to that area depicted for commercial development in the attached survey drawing. (SEE, Figure 4.) 2. Staff recommends the City Council concur with the Commis- sion and approve the rezone as recommended. This would grant approval for C-2 zoning only to the natural toe of the Slope and denial for the land lying in elevation above the natural toe of the slope. CITY OF TUKWILA WASHINGTON ORDINANCE NO. J2 3 AN ORDINANCE RECLASSIFYING CERTAIN PROPERTY FROM R -1 ZONING TO C -2 WITHIN THE CITY OF TUKWILA AS CONTAINED IN THE PLANNING DIVISION OF O.C.D. FILE NO. 77 -18 -R. WHEREAS, An environmental questionnaire has been com- pleted and a negative declaration has been issued, and; WHEREAS, The Planning Commission reviewed the rezone application at their regular meeting of May 26, 1977, and did recommend a modified approval subject to certain conditions, and; WHEREAS, The City Council considered the matter at their regular meeting of June 6, 1977, and concurred with the recommenda- tion of the Commission. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. ,That the property desc in the attached legal description, (Exhibit "A ") lying below the natural toe of the slope is hereby reclassified to C -2 and the City Council hereby adopts the map attached hereto as Exhibit "B" as illustrative of the property described herein. Section 2. The rezoning to C -2 is subject to the following stipulations: a. The C -2 classification shall not exceed the natural toe of slope and shall be confined to that area depicted for commercial development in the attached survey drawing. b. Three of the stipulations contained in Ordinance #567, as recited below, shall apply to that land area hereby reclassified: (1) Setbacks. 15 feet on front and side yards, and five feet on rear yards. * (Insert) Five feet of the 15 foot landscaped area will be sidewalks. (2) Landscaping. As sites are develope shall be required that the 15 feet adiacc to the curb on Southcenter Parkway be lard sca ed, and all of the remaining P g portion of '.�:a said site not covered by building or paved parking shall have a ground cover or land scaping to prevent wind and water erosion of the earth; the design of the landscaping and ground cover shall conform to similar standards as adopted for Southcenter Indus - trail Park. The architectural con- trol requirements of CM use area shall apply. Section 3. AGENDA ITEM VII A : PUBLIC HEARING: REZONE - R -1 to C -2 (Benaroya) REZONE from R -2 to C -2 Benaroya Company, 5950 Sixth Avenue South, Seattle Between Southcenter Parkway and I -5 and near the rail service line crossing Southcenter Parkway. Approximately 6 acres Industrial The City Council granted a Waiver from Resolution #489 on 2 May 1977 and the applicant has made formal application for rezone. FINDINGS: 1. The subject parcel, commonly referred to as the Giovanelli property, is situated as portrayed in Figure 1, attached. 2. The City zoning map, as a result of a drafting error, indicated this parcel was located farther north and that the entirety of the Benaroya property was zoned M -1 (Light Industry). (SEE, Figure 2, attached.) 3. The land lying immediately south of this parcel was rezoned to M -2 by Ordinance #567 in 1969, a copy of which is attached as Exhibit "A ". 4. The land area lying east of the site is zoned CM (Industrial Park) and is being developed primarily for commercial use. (SEE, Figure 2.) 5. The land area lying north of the site and west of Southcenter Parkway is zoned R -1 (Single- family) and is being used as such for distance of approximately 1000 feet north along Southcenter Parkway. (SEE, Figure 2.) 6. The subject parcel extends westerly from Southcenter Parkway to the east line of the I -5 freeway right -of -way, a horizontal distance of approxi- mately 800 feet, and includes the steep hillside and the area commonly referred to as the "north canyon ". (SEE, Figure 3.) 7. The relocated rail service line now extends from the northeast corner of the parcel to the south line of the property and generally follows the 30 -foot contour line, as depicted in Figure 3. Planning Commission l_ Staff Report 8. The land area lying generally below the 30 -foot contour has been filled in conjunction with relocation of the rail service line while the hill- side above said contour is heavily wooded, with the exception of the north canyon floor. CONCLUSIONS: 1. Since this parcel is anticipated to accomodate expansion of the commercial development existing and planned for the parcel immediately south, the complementary restrictions contained in Ordinance #567 should be attached to this parcel. 2. Care must be taken in any development near the steep slopes and reclassi- fication of the property to accomodate such development should express maintenance of the natural slope 3. The requested classification (C -2) complements existing and anticipated development in the immediate vicinity as well as the Comprehensive Plan recently promulgated by the Planning Commission. RECOMMENDATION: Staff recommends the Planning Commission recommend the City Council reclassify the subject parcel from R -2 to C -2 only with the following stipulations: 1. The C -2 classification shall not exceed the natural toe of slope and shall be confined to that area depicted for commercial development in the attached survey drawing. (SEE, Figure 4.) 2. Three of the stipulations contained in Ordinance #567, as recited below, shall apply to that land area hereby reclassified in accordance with stipulation #1 above: a. Setbacks. 15 feet on front and side yards, and five feet on rear yards. b. Landscaping. As sites are developed, it shall be required that the 15 feet adjacent to the curb on Southcenter Parkway be landscaped, and all of the remainingportion of said site not covered by building or paved parking shall have a ground cover or landscaping to prevent wind and water erosion of the earth; the design of the landscaping and ground cover shall conform to similar standards as asopted for Southcenter Industrial Park. This agreement shall be recorded in the records of the Xing County Auditor and the covenants herein shall be deemed to attach to and run with the land and shall be binding upon the Covenantor, his successors and assigns. The City may institute and prosecute any proceedings at law or equity to enforce this agreement and the City shall be entitled to reasonable attorney's fees for such enforcement pro- ceedings which may be imposed as a charge against said property. 4..
