THE CITY COUNCIL OF THE CITY OF TUKWILA DOES ORDAIN AS FOLLOWS:
Section 1. Purpose. It is the purpose of this ordinance to pro-
vide for both active and passive recreation areas for apartment tenants; to
separate such areas from automobile- oriented space; and to enhance the
environment quality of multiple- family residential districts, thus promoting
the public health, safety, and general welfare of the residential community.
Section 2. Definitions. Add a new Section to Title 18 of the
Tukwila Municipal Code and amend Ordinance #251, as amended, as follows:
18.06.575. Recreation Space. "Recreation space" means covered and uncovered
space designed and intended for active and /or passive recreational activity
including but not limited to tennis courts, swimming pools, cabanas, playgrounds,
playfields, or wooded areas and specifically excluding any parking area, driveway,
or rockery.
(1) Add a new section to Title 18 of the Tukwila Municipal Code and
amend Ordinance #251, as amended, as follows:
18.06.576. Recreation Space, Covered. An area of ground
covered or overlaid by an artificial or man -made surface, such as
rooftops or pavement.
(2) Add a new section to Title 18 of the Tukwila Municipal Code and
amend Ordinance #251, as amended, as follows:
18.06.577. Recreation Space, Uncovered. An area of ground
characterized by a natural surface, such as lawns, forests, or
sandboxes (for children's play).
Section 3. Add a new Section to Title 18 of the Tukwila Municipal
Code and amend Ordinance #251, as amended, as follows:
18.60.200. Recreation Space in Multiple - Family Districts. In all R -2, R -3,
R -4, and RFIH zoning districts, any proposed multiple - family structure, complex,
or development shall provide on the premises and for the use of the tenants a
minimum amount of recreation space according to the following provisions:
(1) For each proposed dwelling unit in the multiple- family structure
complex or development a minimum of 200 square feet of recreation
space shall be provided. Any multiple - family structure, complex,
or development . shall provide at least 1,000 square feet of
recreation space.
(a) No more than fifty (50) percent of the required recreation
space may be indoor or covered space.
(b) No more than fifty (50) percent of the required space may
be used for single - purpose permanent facilities such as
swimming pools, tennis courts, and similar facilities.
(c) Apartment complexes which provide dwelling units with two (2)
or more bedrooms shall provide adequate recreation space for
children. Such space shall be at least twenty -five (25)
percent. but not more than fifty (50) percent of the total
recreation space required under subsection (1) above and
shall be designed, located, and maintained in a safe condition.
(d) No more than fifty (50) percent of the open or uncovered
recreation space requirement may be located on slopes greater
than four horizontal to one vertical (4:1 slope).
(e) The front, rear, and side yard setbacks required by the
applicable zoning district shall not qualify as recreation
space:
(f) In the event the total area required under subsection (1)
above is less than 3,000 square feet, that portion required
to be outdoor and uncovered shall be one continuous parcel
of land.
(g) Adequate fencing, plant screening, or other buffer shall
separate the recreation space from public streets, parking
areas, or driveways.

(2) It shall be the duty of the Planning Commission, acting as a
Board of Architectural Review, to review all recreation space
plans for design, location, function, adequacy, and compliance
with the above - stated standards prior to issuance of the building
permit for any multiple - family structure, complex, or development.
Section 4. Severability Clause. If any portion of this ordinance
is deemed to be in violation of the constitution of this State or of the
United States of America or of any other law, rule or regulation, said
finding shall not render the remaining sections of this ordinance void.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, at a

STAFF RECOMMENDATION AND REJECT ALL BIDS, SEE IF MORE MONEY CAN BE
OBTAINED FROM KING COUNTY, AND PUBLISH A NEW CALL FOR BIDS. *
Councilman Van Dusen stated that he would like to discuss this with tf
Senior Citizens at the next Committee of the Whole meeting. CouncilmE
Saul asked if there was any indication from King County that there mic
be more money available.
Mr. Crutchfield stated that he spoke with a staff member at King Count
Housing and Community Development and they have indicated the avail-
ability of additional funds is slim. He recommended going back to the
Senior Ad -Hoc Committee and the architect and revise the plans as mud
as is possible to still serve the needs of the Seniors.
Mr. Fred Shepherd, Senior Ad -Hoc Committee Member, stated that the plan
had been thoroughly reviewed by them and recommendations made on the
alternates.
MOVED BY VAN DUSEN, SECONDED BY MRS. PESICKA, THAT THIS ITEM BE PLACE[
ON THE AGENDA FOR THE COMMITTEE OF THE WHOLE MEETING OF OCTOBER 24,
1977, AND THAT THE SENIOR CITIZENS BY INVITED. MOTION CARRIED.
This being the time and date published, Mayor Bauch declared the
Public Hearing open.
Kjell Stoknes, OCD Director, reviewed the proposed requirement for
"Recreation Space" in all R -2, R -3, R -4, and RMH zone districts. The
Ordinance, recommended by the Planning Commission, provides for 200
square feet of open space per apartment unit with a minimum of 1,000
square feet. This would allow approximately 42 units per acre. Mr.
Stoknes further explained that requiring 300 square feet would allow
35 units per acre and 400 square feet would allow 33 units per acre.
Mr. Peter L. Buck, attorney representing S & M Investments, suggested
amending the proposed ordinance to add the following to Section 3(1)(1
"except when the setbacks are in excess of 50 percent . of the minimum
required setback in which event the entire setback area shall be used
in computing the required recreation space." Mr. Buck continued to
explain their proposal. There are many recreation activities that
could take place in a setback that is in excess of 50 percent of the
requirement. He encouraged Council to stay with the 200 square foot
requirement instead of considering 300.
Councilman Bohrer stated that this does not encourage an increase in
recreation space but reduces the total open space. Mr. Buck agreed
that this does reduce the total open space but still allows for
meaningful recreation space.
Mrs. Vicki Schildmeyer, 5821 South 152nd Place, commented that it is
very important to incorporate good recreation space in any apartment
unit where there is potential housing for parents with children.
There being no further comments from the audience, Mayor Bauch closed
the Public Hearing.

Councilman Bohrer asked how the other elements will be fit into
this plan. Mayor Bauch stated that a formal motion or a
resolution, approved by Council, will spell out the elements as
a guideline for the Administration. Mayor Bauch noted that he need:
the guidelines to put the salaries in the 1978 Budget.

Deputy City Attorney Hard read an ordinance defining "Recreation
Space" and providing standards and regulations for the provision
of recreation space in all R -2, R -3, R -4 and RMH Zone Districts.

Councilman Traynor asked if the question on the R -2 zoning had
been settled. K,jell Stoknes, OCD Director, illustrated the problem
and explained that there are no R -2 Zone Districts in the City.
Council can direct Staff to remove this from the new Code revisions
Attorney Hard stated that he did not see any problem in passing
the ordinance now but would like to see the Code amended in the
near future.

Councilman Hill asked if Mr. Stoknes had looked at the property and
see if it is possible to realign the road and vacate a portion
of Bluff Street.
Mr. Stoknes stated that he hadn't had time but did not recommend
it because it takes time and the applicant may not want to wait
that long to develop the property. This is creating an Office
Zone which is consistant with the new Comprehensive Plan.

order.

Council President Hill asked OCR Director Kjell Stoknes to explain the
proposed ordinance. Mr. Stoknes said the Commission had looked at the
ordinance and felt the intent was proper. Councilman Pesicka asked if
you can build apartments or anything if it is zoned that way. If some-
one owned commercial property and wanted to build apartments would this
still stand? Mr. Stoknes said you could build to a certain density.
This would apply if apartments were built in a commercial district.
Council President Hill said the Council would go through the proposed
ordinance section by section. He said there will be a Public Hearing
on the ordinance on October 17, 1977. Mr. Stoknes said the biggest
impact of this requirement is the 1,000 square foot minimum and it has
a heavy impact on R -2. He said there are legal questions that should
be answered by the City Attorney. He said he would seek these legal
answers. Mr. Stoknes said when you apply the 1,000 square foot require-
ment there would not be a lot of design flexibility. In the R -3 desig-
nation you have more units and the 1,000 foot requirement becomes less
problem. He continued that the Village Green Apartments have an acre
of green space. That does not include the strip that is out in front.
The Stardust has one swimming pool, enough for eight units. Only about
half of the apartments under this ordinance would qualify. Councilman
Saul asked for some comparisons where the recreation space has been
provided. Fred Satterstrom, Planning, said the Village Green has 464
feet per unit; Hampton Heights has 120 feet per unit; the LaVista
Apartments do not have much. It has depended on the attitude of the
developer as to what open space will be given to the apartments. He.
said they felt this requirement was the minimum amount every individual
unit should have. Councilman Pesicka said the parking areas are not
enough; if an apartment has two or three bedrooms it is likely they
have more than one car. Mr. Satterstrom said parking limits open space
more than anything.
Council President Hill said the proposed ordinance would be considered
at a Public Hearing on October 17, 1977 and the proposed ordinance
would be on the agenda of the Regular Council Meeting on October 17, 197
Kjell Stoknes, OCD Director, explained the Schneider rezone request and
indicated the location of the property on a wall map. He said the
Planning Commission had recommended approval on this, subject to certain
conditions. He said he felt it would be better to define "commercial
services" in the ordinance. He said he would suggest the Council limit
the use of this property until that time. He said he recommended
Section 2.B. be rewritten to read as follows: "Development of the
property under the C -1 classification shall be limited to a single offic
building." He continued that the setbacks in the C -1 zone are not
relevant to the office uses and therefore he recommended the following
minimum setbacks to this property. He suggested a new Section 2.E. be .
added to read as follows: "All buildings shall be setback 25 fegt
from the right -of -way line of Southcenter Boulevard and 65th Avenue
South and 10 feet from the right -of -way line of Bluff Street." Mr.
Stoknes said the•reason this property is being treated differently is
because the City does not have an office zone. Council President Hill
asked why the City is maintaining Bluff Street, it cannot be opened onto
Southcenter. Mr. Stoknes said the streets to the west are steep and
dangerous. If the property is ever built on it is likely Bluff Street
will be reopened.

Mayor's Report
REGULAR MEETING
Kjell Stoknes, OCD Director, stated that the Park Board did recommend
the Annex building be turned into an observatory -type structure and th
the pond be maintained. Their main comment.was that they be involved
in any changes that occur. He recommended asking the Park Board to th
meeting when the landscaping is discussed so they can have some input.
Councilman Traynor stated he thought Council had a consensus on how th
landscaping should look. Mayor Bauch stated that now the final plan i
needed so the City can go out for bids, and there is no one to do this.
Tom Emrich, Mithun Associates, stated that they will provide input if
it is desired.
Councilman Traynor asked if there is enough information now for Counci

Tom Emrich stated that Council approved a general schematic plan for
the landscaping. This represents the feelings of Council in very gene
terms about what the landscaping should be. It is a good tool for a
landscape architect to work with but it needs further refinements and
modifications to be more in line with what you have indicated. It nee
to be documented in working drawings and specifications to put out for
bid. He recommmended that Council hire a landscape architect to comple
the project.

Pursuant to the City Council's request to define "covered and uncovered
recreation space ", I suggest that the proposed ordinance be revised to
read as follows:
Section 2. Definitions. Add a new Section to Title 18 of the Tukwila
Municipal Code and amend Ordinance #251, as amended, as follows:
18.06.575. Recreation Space. "Recreation space" means covered and
uncovered space designed and intended for active and /or passive recre-
ational activity including but not limited to tennis courts, swimming.

said in his report the cut that had been made could reactivate the
slide. In the next report he had said a.large slide could occur in
case of earthquake or heavy rainfall. Mr. Koloski said he had seen
evidence of the old roadway. Mayor Bauch said he had not seen in
the report the recommended length of the'retaining wall that would I
put in. Mr. Koloski said he had indicated the construction of the
wall should be two and one -half feet in height. Mr. Koloski said
natural restabilization would take place if further unstable condit
do not exist. He said the test holes would be bored by a rotary
hand drill. Council President Hill asked if there had been an esti.
mate of the cost. Mr. Koloski said he had not estimated the cost.
Mr. Stoknes said he had discussed the amount of $5,000 with Mr.
Koloski the first time they had talked. Engineering estimates are
subject to the market prices -and change frequently. Council Preside
Hill said the Council was trying to get an estimate so they will kni
what they are going to have to spend. Mr. Stoknes said his
recommendation is to authorize staff to pursue getting an easement
from Mr. Popejoy for the anchors and bores, they would need authori
tion to go out for bid, and also authorization for Staff to negotia
an agreement with Mr. Popejoy to take out the trees. The Council c
accept any or none of the bids that come in. He said his office
would also get estimates for the removal of the trees. Councilman
Bohrer said a motion was made at the Committee of the Whole Meeting
held August 22, 1977 authorizing Mr. Stoknes to proceed with the
design of a bulkhead and the construction of it if it can be done f
less than $5,000. Mayor Bauch said the City could get an estimate
if less than $5,000 it will not have to go out for bid. Mr. Popejo
said he thought all of this was going right along, he had been wait
for someone to show up. He said he felt the matter was urgent. He
said he was willing to cooperate in any way to get things underway.
He said the surveyor had come to him for maps and the trail is actu

Councilman Van Dusen said the proposed ordinance came out of the
Planning Commission and they had invited input. He asked if they had
sent a copy of the proposed ordinance to apartment owners. Mr. Stokn
said a copy of the ordinance had accompanied the letter. Mayor Bauch
said the managers would not be the one to make the comments. He
thought the developers would be the ones to make the comment, the
managers would like the ordinance. Councilman Pesicka said she was
thinking of the comment made by Mrs. Davis regarding the parking spac

look at the parking. Mayor Bauch said he thought the word "uncovered
space needs to be expanded.

Mayor Bauch said he had looked at the plaque on the Fire Department
building and it had ten lines on it, stating the date of dedication,
the name of the Mayor, the name of the,'Fire Chief, and the names of
nine councilmen. He stated he did not know the cost of the plaque.
He thought it would take about three weeks to get it after it was
ordered. Council President Hill said he thought the City Hall plaquE
should be more elaborate. He suggested the Park Board and the Histor
ical Society should help with the planning and come up with somethins
elaborate. Mayor Bauch said there would be a plaque telling about
the vault beneath the corner stone and specifying the date it is to t
opened.

Mr. Jim Ewins said he requested by letter that the City Council water
committee intercede in what they consider to be an arbitrary requirem
of Chief Crawley in regards to the installation of a fire hydrant on
the west side of Southcenter Parkway. He said the owner of the prope
has indicated that the intent of the City was to have located fire
hydrants at the stubs provided in the water main on the east side.of
Southcenter Parkway. Two such locations are closer than 300 feet fro
the furtherest portion of their building. They suggest that an east
side location would be in conformance with Ordinance No. 729. He sai
to their knowledge, this would be the only location in the City requi
to install hydrants on both sides of the street wherein the structure
is within 300 feet of a hydrant. He said their location adjacent to
the freeway precludes construction of structures west of them which
would need fire protection. They have concern for fire protection bu
it does not appear beneficial to expend upwards of $7,000 above the
cost of domestic water for a hydrant just 70 feet closer to the build

After considerable deliberation, the Planning Commission as well as
Staff deemed the objective of the City Council directive was to define
open space which is useable by residents of multiple - family developments
in your effort to ensure a suitable living environment in Tukwila.
Hence, the term 'recreation space' and its applicability to multiple- _
family developments.
The Planning Commission and Planning Division consider the proposed
ordinance to establish reasonable minimum provisions which will contri-
bute to a suitable residential environment.

and the restrictions of Ordinance #743 are worthless.
There being no further comments, Chairman Kirsop closed the Public Hearing at
10:40 P.M.
The Commission discussed the character of the surrounding residential develop-
ment with respect to the proposed use.
Motion by Mr. Sowinski, seconded by Mr. Bowen and carried unanimously to deny
the request for M -1 classification because the proposed towing impound lot
would be unsafe.and unduly detrimental to the surrounding residential neighborhood.
. PUBLIC HEARING: RECREATION SPACE ORDINANCE (Proposed)
Mr. Crutchfield introduced this item and Chairman Kirsop opened the Public
Hearing at 10:50 P.M. Mr. Crutchfield read the proposed ordinance. ,
Commission agreed to revise the proposed ordinance as follows:
1. Add to Section 3, paragraph 1, a provision establishing a minimum
of 1,000 square feet of recreation space for any multiple- family
development.
2. Revise Section 3, paragraph ic, to reflect that dwelling units with
2 or more bedrooms shall provide recreation space for children.
3. Revise Section 3, paragraph 2, to require Planning Commission reviews
prior to issuance of Building Permit.
Chairman Kirsop closed the Public Hearing at 11:15 P.M.
Motion by Mr. Sowinski, seconded by Mr. Bowen and carried to recommend the City
Council adopt the proposed Recreation Space Ordinance as amended.

,REVIEW AND DISCUSSION: Open Space Ordinance
Mr. Crutchfield explained the proposal is in rough draft form and is wholly
open to revision. Noted that all apartment complex managers had been noti-
fied of the meeting.
Mr. Ronald Mettler, Village Green Apartments explained his agreement with
the concept but noted it needs some refinement to preclude the lack of open
grass areas.
Considerable discussion focused on types of open space.
Mr. Satterstrom displayed slides depicting several types of open recreation
areas in conjunction with multiple - family complexes.
General concensus of the Commission to direct Staff to prepare draft Ordinance
for "Recreation Space in Multiple - Family Development" rather than Open Space,
to include concerns expressed throughout the discussion, and have it ready for
Public Hearing at the regular August meeting.

The Tukwila Planning Commission, in response to a directive
from the Tukwila City Council, will consider an amendment to
the Tukwila Zoning Code to establish minimum recreation space
requirements for apartment complexes within the City of Tukwila.
Although the proposed amendment will not be retroactive and will
not apply to existing apartment complexes, the Commission desires
to address this issue in as practical a manner as possible. To
that end, the Commission invites you, as an apartment complex
manager, to attend an informal meeting and express the advantages .
and disadvantages of such an amendment as well as other related
factors.
The meeting is scheduled for 8:00 P.M. Thursday, 11 August 1977,
in the City Hall Council Chambers at 14475- 59th Avenue South in
Tukwila. A copy of what the proposed amendment would contain is
attached for your perusal. Should you have any questions or

The regular July meeting was called to order at 8:00 P.M. by Chairman
Kirsop with Commissioners Sowinski, Avery, Bowen, Richards, and Hartong
present. Commissioner West had not notified the Planning Division of
his absence. Gary Crutchfield represented the Planning Division.
Motion by Mr. Richards, seconded by Mrs'. Avery and carried to approve the
minutes of 23 June 1977 as prepared.
Mr. Crutchfield read the Staff Report explaining recent planning- related
City Council actions.
OLD BUSI►ESS:
ace Ordinance
Mr. Crutchfield explained the length of the agenda had led Staff to
suggest a Special Meeting be conducted on 11 August for this purpose as
well as the Housing & Community Development Plan.
Concensus of the Commissioners present to conduct Special Meeting on 11
August and to have a draft of the proposed Open Space Ordinance as redirected
by the Planning Commission on 23 June.
FINAL PLAT: Upland's Industrial Park
Mr. Crutchfield read the Staff Report explaining changes to the Preliminary
Plat made by the City Council under Resolution #584.
Mr. Dave Uhrich, Upland, stated his agreement with the Staff recommendation
and noted the cooperation of the Staff for their assistance in resolving the
south roadway problem.
Commission discussed potential curb cuts on Andover Park West for lots 1,
2 and 11.

NEW 6SINESS:
UBLIC HEARING: Open Space Ordinance
Mr. Crutchfield read the proposed ordinance and Chairman Kirsop opened the
Public Hearing at 9:00 P.M.
The Commission discussed the intended objective of the ordinance and various
methods to achieve the same.
Mr. Satterstrom noted several problems with the proposed ordinance and sug-
gested an ordinance for 'recreation space in multiple - family zones' rather
than open space in all zones.
Considerable discussion ensued regarding contents of formula.
Mr. Bruce Solly, Segale Business Park, noted the potential cost factor,
lack of maintenance provisions, and potential provision of unuseable open
space as major problems with proposed ordinance.
There being no further public input, Chairman Kirsop, closed the hearing at
9:40 P.M.
Commission again discussed need for extensive revision.
Motion by Mrs. Avery, seconded by Mr. Sowinski and carried to table this
matter . to allow time for extensive revision by Staff and future reconsidera-
tion by the Commission.
Chairman Kirsop noted Staff should attempt to complete the revisions in time
for Planning Commission discussion (without public hearing) at the next regular
meeting. Also directed that input be solicited from apartment managers.
There being no further business, motion by Mr. Richards, seconded by Mr.
Hartong and carried. to adjourn the meeting.
