PROPERTY USE AND DEVELOPMENT AGREEMENT
THIS INSTRUMENT executed this date in favor of the City of
Tukwila, a municipal corporation of the State of Washington
(hereinafter called "City "), by Schneider Homes, Inc., (herein-
after called "Owner "),
W I.T N E S S E T H:
WHEREAS, Owner is the owner in fee simple of the described
property in "Exhibit A ", attached to this agreement (hereinafter
called "the Property "), located in the City of Tukwila, Ping
County, Washington; and
WHEREAS, Owner has requested a rezoning for construction of
a structure or structures upon said property; and
WHEREAS, the City of Tukwila has determined that in order
to provide for the public health, safety and general welfare
with respect to the subject property and other property located
in the vicinity of this property, a local improvement district
may at some time in the future be formed for the purpose of
improving the forty (40) foot wide right-of-way adjacent to the
northeast property line, and to improve said right -of -ways by
grading, filling, paving, providing curbs and gutters, sidewalks,
street lighting, sanitary and storm sewers, water and underground -
ing electrical power lines as deemed necessary; and
WHEREAS, Owner is willing to equitably participate in said
local improvement district in the event it is created and the
improvements are constructed; and
WHEREAS, the use of the property is subject to the terms and
conditions of City of Tukwila ordinance #1041 as passed by the
City Council on October 17, 1977.
NOW, THEREFORE, in consideration of the terms and conditions
contained herein, the parties hereto covenant and agree as follows:
1. In the event the City finds that the creation of a local
improvement district, which will include within its boundaries

the subject property to this Agreement, is within the public
health, safety and general welfare, the Owner agrees to parti-
cipate equitably in said LID, hereby waives any right to protest
the formation of any said LID; provided, however, that the im-
provements constructed within said LID especially benefit the sub-
ject property.
2. In the event said Local Improvement. District is formed,
and Owner has already constructed at its expense utility lines to
its subject property, which utilities are in conformance_ with all
applicable federal, state and local laws, rules and regulations,
then any assessment against the subject property in the proposed
Local Improvement District shall not include charges for any such
utilities already constructed and provided by Owner.
3. All of the remaining terms and conditions of Ordinance
#1041 shall remain in effect.

ORDINANCE RECLASSIFYING CERTAIN REAL PROPERTY LOCATED AT THE
NORTHEAST CORNER OF THE INTERSECTION OF 65TH AVENUE AND SOUTH -
CENTER BOULEVARD FROM R -4 ZONING CLASSIFICATION TO C -1 ZONING
CLASSIFICATION WITHIN THE CITY OF TUKWILA.

WHEREAS, the owner of the property described in Exhibit "A" attached
hereto has petitioned the City requesting reclassification of said property from
R -4 to C -1, and;
WHEREAS, adequate environmental information was submitted and a nega-
tive declaration made by the responsible official, and;
WHEREAS, a public hearing on said petition was conducted before the
Planning Commission as required by law on 25 August and 22 September 1977 after
which a favorable recommendation with stipulations was made, and;
WHEREAS, the City Council, at a regular meeting thereof, has considered
the recommendation of the Planning Commission and has concurred with said recom-
mendation.
FOLLOWS:
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA DO ORDAIN AS
Section 1. That the real property generally located at the northeast
corner of the intersection of 65th Avenue South and Southcenter Boulevard, as
further described in Exhibit "A" attached hereto, is hereby classified C -1 in
accordance with Ordinance /251 of the City of Tukwila, as amended, and the City
Council hereby adopts the map attached as Exhibit "B" hereto as illustrative of
the property described.
Section 2. This classification to C -1 shall include the following
stipulations.
A. Vehicular ingress /egress to and from Southcenter Boulevard is
specifically prohibited.
B. Development of the property under the C -1 classification shall be
limited to a single office building which may contain commercial
service uses customarily incidental to office use.
C. Development plans, including but not limited to site, elevation,
landscape and building materials shall be subject to review and
approval of the Planning Commission sitting as the Board of Archi-
tectural Review as established in Chapter 18.'32 of the Tukwila
Municipal Code. The express purpose of such review is to ensure
the development design complements the residential neighborhood.

D. The owner, his heirs, successors and assigns, shall equitably

E. All buildings shall be set back 25 feet from the right -of -way
line of Southcenter Boulevard and 65th Avenue South and 10 feet
from the right -of -way line of Bluff Street.

PLANTING COMMISSION
Minutes of the Meeting, 15 December 1977.
The regular December meeting of the Tukwila Planning Commission was called to order
at 8:15 P.M. by Chairman Kirsop with Commissioners Hartong, Sowinski and West
present. Fred Satterstrom and Gary Crutchfield represented the Planning Division.
Mr. Crutchfield noted that Commissioners Richards, Avery and Bowen had all noti-
fied the Planning Division of their inability to attend this evening.
Chairman Kirsop asked for approval of the November 1977 minutes.
Commissioner West noted that he had informed the Planning Division Secretary that
he would be absent from the 17 November meeting.
Motion by Mr. Sowinski, seconded by Mr. West and carried to approve the minutes
of 17 November 1977 as amended by Commissioner West.
Mr. Crutchfield suggested the Commission split the Agenda after Agenda Item VII A
and recess the meeting to 8:00 P.M., Wednesday, 21 December 1977.
Motion by Mr. Sowinski, seconded by Mr. West and carried to table the Agenda after
completion of Item VII A until 8:00 P.M., Wednesday, 21 December 1977.
Chairman Kirsop informed the audience that Agenda Items VII B through IX will be
considered the following Wednesday.
CITY COUNCIL ACTIONS
Mr. Crutchfield read the Staff Report explaining planning - related actions by the
City Council.
Mr. Satterstrom explained Ordinance #1035 and the waiver procedure.
BOARD OF ARCHITECTURAL REVIEW

Mr. Crutchfield read the Staff Report and explained the site, elevation and land-

scape drawings and building materials noting the plan s d been revised because
the survey had shown less property than originally assumed by the applicant.
Mr. Gerald Schneider, applicant, stated his agreement with the Staff Report.
Mr. Simonds, 15460 - 65th Avenue South, asked if the revised building is the
same height as the previous plan.
Mr. Schneider stated yes.
Motion by Mr. West, seconded by Mr. Sowinski and carried to approve the site and
landscape plans, elevation drawings and building materials with the following
stipulations:
1. Provision of deciduous street trees along 65th Avenue South planted at
a maximum of thirty (30) feet on center.
2. Provision of automatic irrigation in major landscape areas.
3. Use of live groundcover in lieu of "gravel mulch ".
4. Turn angle of parking provided along Bluff Street to emphasize the
circulation pattern.
5. Installation of appropriate safety curb along Bluff Street at the ivifl
expense of this property owner.

Councilman Bohrer asked how the other elements will be fit into
this plan. Mayor Bauch stated that a formal motion or a
resolution, approved by Council, will spell out the elements as
a guideline for the Administration. Mayor Bauch noted that he needs
the guidelines to put the salaries in the 1978 Budget.

Deputy City Attorney Hard read an ordinance defining "Recreation
Space" and providing standards and regulations for the provision
of recreation space in all R -2, R -3, R -4 and RMH Zone Districts.

BE ADOPTED AS READ. *
Councilman Traynor asked if the question on the R -2 zoning had
been settled. Kjell Stoknes, OCD Director, illustrated the problem
and explained that there are no R -2 Zone Districts in the City.
Council can direct Staff to remove this from the new Code revisions.
Attorney Hard stated that he did not see any problem in passing
the ordinance now but would like to see the Code amended in the
near future.

Councilman Hill asked if Mr. Stoknes had looked at the property and
see if it is possible to realign the road and vacate a portion
of Bluff Street.
Mr. Stoknes stated that he hadn't had time but did not recommend
it because it takes time and the applicant may not want to wait
that long to develop the property. This is creating an Office
Zone which is consistant with the new Comprehensive Plan.

Councilman Saul asked if 25 feet was enough set back. Mr. Stoknes
stated that more of a set back would be good but would be creating
a hardship on the size of the property - maybe the 25 feet is a
hardship.

Deputy City Attorney Hard read the ordinance of the City of Tukwila,
Washington, fixing the amount of tax levies necessary to raise
funds to meet the estimated expenditures for the year 1978 as
required by RCW 84.52.020; authorizing the City Clerk to certify
such budget or estimate of the amount to be raised by taxation on
the assessed valuation of the property located within the City
of Tukwila, Washington, and declaring an emergency.

AS READ. MOTION CARRIED.
The total assessed vaulation is $360,409,786. The General Levy
will be $2.845.
Mayor Bauch read a letter to Police Chief John Sheets commending
the conduct and total involvement of the Tukwila Explorers. They
worked at the PI /KJR cyclathon for 12 hours assisting in traffic
control.
The City received official notice that they were awarded a grant for
the Christianson Trail.
Ten applications have been received for the position of Finance
Director.
They are again reviewing the applications for Public Works Director
as the first two applicants are unable to take the position at this
time. Mayor Bauch asked Council to grant a $150 per month acting
pay for the Office Engineer for the length of time he is serving as
Public Works Director.

This pay will be retroactive to the date he started.

Councilman Saul read the report submitted by Mabel J. Harris, City
Treasurer. Invested during September, $2,250,000; investments sold,
$2,425,000; and interest income, $16,389.12

Mayor Bauch reported on the progress of new city hall. Tom Emrich,
Mithun Associates, has three landscape architects for Council to
interview. Council concurred that three are enough.
Councilman Bohrer reported that the asphalting is done on 58th, 59th
and 149th to the relief of all those along the street.

Councilman Traynor arrived at the Meeting at 7:05 P.M.
Council Chambers•
Council President Hill asked OCR Director Kjell Stoknes to explain the
proposed ordinance. Mr. Stoknes said the Commission had looked at the
ordinance and felt the intent was proper. Councilman Pesicka asked if
you can build apartments or anything if it is zoned that tray. If some-
one owned commercial property and wanted to build apartments would this
still stand? Mr. Stoknes said you could build to a certain density.
This would apply if apartments were built in a commercial district.
Council President Hill said the Council would go through the proposed
ordinance section by section. He said there will be a Public Hearing
on the ordinance on October 17, 1977. Mr. Stoknes said the biggest
impact of this requirement is the 1,000 square foot minimum and it has
a heavy impact on R -2. He said there are legal questions that should
be answered by the City Attorney. He said he would seek these legal
answers. Mr. Stoknes said when you apply the 1,000 square foot require-
ment there would not be a lot of design flexibility. In the R -3 desig-
nation you have more units and the 1,000 foot requirement becomes less
problem. He continued that the Village Green Apartments have an acre
of green space. That does not include the strip that is out in front.
The Stardust has one swimming pool, enough for eight units. Only about
half of the apartments under this ordinance would qualify. Councilman
Saul asked for some comparisons where the recreation space has been
provided. Fred Satterstrom, Planning, said the Village Green has 464
feet per unit; Hampton Heights has 120 feet per unit; the LaVista
Apartments do not have much. It has depended on the attitude of the
developer as to what open space will be given to the apartments. He
said they felt this requirement was the minimum amount every individual
unit should have. Councilman Pesicka said the parking areas are not
enough; if an apartment has two or three bedrooms it is likely they
have more than one car. Mr. Satterstrom said parking limits open space
more than anything.
Council President Hill said the proposed ordinance would be considered
at a Public Hearing on October 17, 1977 and the proposed ordinance
— would be on the agenda of the Regular Council Meeting on October 17, 197
Kjell Stoknes, OCD Director, explained the Schneider rezone request and
indicated the location of the property on a wall map. He said the
Planning Commission had recommended approval on this, subject to certain
conditions. He said he felt it would be better to define "commercial
services" in the ordinance. He said he would suggest the Council limit
the use of this property until that time. He said he recommended
Section 2.B. be rewritten to read as follows: "Development of the
property under the C -1 classification shall be limited to a single offic
building." He continued that the setbacks in the C -1 zone are not
relevant to the office uses and therefore he recommended the following
minimum setbacks to this property. He suggested a new Section 2.E. be
added to read as follows: "All buildings shall be setback 25 fegt
from the right -of -way line of Southcenter Boulevard and 65th Avenue
South and 10 feet from the right -of -way line of Bluff Street." Mr.
Stoknes said the'reason this property is being treated differently is
because the City does not have an office zone. Council President Hill
asked why the City is maintaining Bluff Street, it cannot be opened ontc
Southcenter. Mr. Stoknes said the streets to the west are steep and
dangerous. If the property is ever built on it is likely Bluff Street
will be reopened.

Councilman Pesicka said there is a letter written by Mr. and Mrs. Lee
R. Phillips stating their objections on the rezone. Mr. M. E. Simonds
audience, said the last he knew the Phillips had dropped any complaint
against the rezone request. He said he had no objections to the rezon
His only objection is if the street has to be rebuilt the City should
take care of it and he should not have to Help pay for that. Council
President Hill said with no parking along there 65th Street could be a
four lane street. Councilman Traynor said he did not see anything in
the Minutes about sidewalks. Mr. Stoknes said Southcenter Boulevard
is planned for improvement; being taken care of mostly by grant money
Council President Hill said a 35 foot building would screen Mr. Simond
home from a lot of noise. Councilman Bohrer said there had been some
comment about L.I.D. 27. Mr. Stoknes said with respect to an L.I.O.
single family dwellings were excluded. If the single family dwellings
were rezoned they would have to contribute on an L.I.D. Council Presi
dent Hill said he would like to see some kind of access put in for the
people. Mayor Bauch said under the 6 year street plan it showed an
overpass over Highway 405. If you have an overpass you have to have
some place for it to end. It could end on Bluff Street. Wynn Andersc
audience, said a 25 foot minimum set back had been mentioned. You nee
to take into consideration the shape of a piece of property like this
if you are establishing minimums. This property is in the shape of a
triangle.
Mr. Stoknes said the Council would have to decide what additional uses
can be allowed on the office property. Council President Hill said
when he reads this, it says C -1 classification shall be limited to
one office building. Mayor Bauch said a medical center with doctor
offices could be built and doctors frequently have a pharmacy in their
building where they sell only drugs. That would be an incidental use.
It could be an architect's office and sell drafting supplies, it coulc
have a lunch counter or sandwich shop. Councilman Saul said when
Public Works looks at this they can tell whether or not this can be dc
Wynn Anderson, audience, asked for the procedure to establish use witF
an office. Mr. Stoknes said the owner would come in and explain the
use he wants to put in there. The staff would make a ruling on it.
If the owner disagreed it can be taken to the Board of Adjustment. TF
are the arbitrator between Staff and property owner. Councilman Trayr
said there seems to have been a designation as to what goes in an offi
building. Jerry Schneider, audience, said he did not know the type of
business that was going in there. It could be anything from a lawyer!
office to an architects office. He said he would like to know what c�
go in C -1. Can a barber shop go in? Mayor Bauch said if professional
offices are put in, the pharmacy is about the only thing, or an offic(
supply store, that would be incidental to office use. He continued
that Section 2.B. of the proposed ordinance spells this out. Councilr
Saul suggested Section 2.B. be left as is.

The applicant, desiring to construct an office building, received from the
City Council a waiver from Resolution #489. Insofar as application for rezone
was accepted prior to City Council adoption of the new Comprehensive Plan, this
report addresses both the old and new Plans.
FINDINGS:
1. The subject parcel is currently zoned R -4 and the zoning of surrounding
parcels is depicted in Exhibit A.
2. The site slopes somewhat gently from about elevation 30 at Southcenter
Boulevard to about elevation 50 at the north end of the site, an approxi-
mate grade of 8 %. (SEE, Exhibit B)
3. Southcenter Boulevard and 65th Avenue both are classified as Collector
Arterials, Southcenter Boulevard feeding Secondary and Major Arterials.
(SEE, Circulation Map, Proposed Comprehensive Plan)
4. Southcenter Boulevard between 65th Avenue and Interurban Avenue is planned
to be improved in the near future but all improvement will take place within
the existing right -of -way.
5. The site is bounded on the northeast by Bluff Street, a 40 -foot wide right -
of -way, providing access to two residential lots to the northeast of the
subject site but does not provide access from Southcenter Boulevard.

6. Available utilities include a 10 -inch water line amd 8 -inch sanitary sewer
line. Storm drainage is available at the southwest corner of the site.
7. Sight distance for west -bound traffic on Southcenter Boulevard is poor and
planned improvements of Southcenter Boulevard do not include left -turn
stack lanes for east -bound traffic.
8. The applicant proposes to construct an office building with lease space for
such uses. (SEE, Exhibit C)
9. The existing zone classifications of Title 18 (TMC) do not include an
office classification per se, but the C -1 district allows office buildings.
10. The proposed development will utilize the old 65th Avenue right -of -way for
ingress /egress.
11. The old Comprehensive Plan indicated industrial use while the new Compre-
hensive Plan promotes office use.
12. The Planning Commission conducted a public hearing on 25 August and 22
September 1977. (SEE, Exhibits D, E and F)
CONCLUSIONS:
1. All necessary utilities and roadways are available and capable of supporting
the proposed classification. Old 65th Avenue, however, may require signifi-
cant upgrading if future uses develop to the east in fulfillment of the new
Comprehensive Plan.
2. The site being located on the fringe of the residential area and at an inter-
section which is the principal entrance to the residential neighborhood demands
building design and uses which are complementary to the residential character
of the neighborhood.
3. Inasmuch as the C -1 district is the "lowest" zone which allows the proposed
use, is far more compatible with the residential neighborhood than is com-
mercial use and conforms to the new Comprehensive Plan, the proposed classi-
fication is a rational one if the allowed uses and site /building design plans
are tempered so as to complement the residential neighborhood.
4. Due to the poor sight distance for west -bound traffic and lack of stack lane
for east -bound left -turn movements and the site's proximity to the intersec-
tion with 65th Avenue, access to the parcel from Southcenter Boulevard should
be prohibited.
RECOMMENDATION:
Based on the Findings and Conclusions of this report and upon due consideration
of testimony received during the public hearing, the Planning Commission recom-
mends the City Council reclassify the subject parcel from R -4 to C -1 with the
following stipulations:

Mr. Crutchfield stated the topographical survey is more accurate than the
aerial topography maps on which the Staff Report was based.
There being no further comments, Chairman Kirsop closed the Public Hearing at
9:15 P.M.
Motion by £1r. Hartong, seconded by Mr. Sowinski and carried to recommend the
City Council reclassify the subject parcel from R -1 to C -2 with the following
stipulations:
1. In the -event that development of the property will affect that land
area above approximate 35 feet elevation, a grading and reclamation
plan consistent with Chapter 70 of the Uniform Building Code and a
reclamation bond posted with the City of Tukwila in an amount equal
to 150% of the estimated cost of reclamation shall be required prior
to issuance of the Building Permit.
2. Development of the site shall include a pedestrian sidewalk of five
(5) feet in width.
3. The forced main sewer connection line be installed in accordance with
City of Tukwila standards, at the full expense of the property owner,
and a special connection charge be paid by the property owner in accor-
dance with Chapter 14.60 (Sewer Charges) of the Tukwi l a Municipal Code.
4. Operation and maintenance of the pump and sewage force main shall be
at the full expense of the owner.
5. At such time as an LID is formed for a gravity flow sewer system serving
the vicinity of this property, as shown in the Tukwila Comprehensive
Sewer Plan, the property will agree to equitably participate in such
LID in accordance with Section 14.60.076 of the Tukwila Municipal Code.
6. A charge in lieu of assessment to be paid to the City at a rate to be
established by the final assessment roll of LID !27.
7. On site construction shall conform to the height, yard and area re-
strictions and architectural review as outlined in Sections 18.32.030
and 18.32.040 of the Tukwila Municipal Code.

P1r. Crutchfield introduced this item and explained its location. Chairman
Kirsop opened the Public Hearing at 9:20 P.M. and Mr. Crutchfield read the
Staff Report.
The applicant was neither present nor represented.
Mr. Lee Phillips, 6550 South 154th,stated his opposition to the application due
to the residential character of development adjacent the site. This will elim-
inate the buffer provided by R -4 and he stated his opposition to anything but
R-1 zone.
Motion carried.
Mr. Hartong requested the applicant be notified in writing.

Mr. M. E. Simon, 15460 - 65th Avenue, questioned the height of the proposed
structure.
Mr. Crutchfield explained the requested C -1 zone height limit is 35 feet while
the existing R -4 zone height limit i s 45 feet.
Mr. John Merrick, 6532 South 154th, stated the noise from an office building
will travel right up to his home. Requested this be delayed until the new
Comprehensive Plan is adopted.
Mr. Hartong asked why these people don't object to the R -4 zone existing on
the property?
Mr. Phillips stated his opposition to R -4 zoning also but feels the property
will stay vacant since it isn't big enough to support R -4 development.
In response to questions regarding interference with established views, Mr.
Crutchfield explained the concept of construction envisioned by the applicant
at this time. Generally, the applicant proposes to construct a two -story
office building situated near the center of the site. According to the aerial
topography maps, it would not necessarily inhibit the view of the one (1)
house near it.
Mr. Wynn Anderson, 6415 South 153rd, explaining he is the seller of the property
to P-1r. Schneider, also explained he felt R -4 zoning is far worse than the pro-
posed use due to the nature and bulk of apartments. Also noted that Mr. Simon's
house is the only one which might be affected due to elevations.
Mr. Satterstrom noted several reasons in favor of the request:
1. The proposed office use conforms to the emerging Comprehensive Plan.
2. Office uses are compatible with residential uses due to the facts they
operate only during the day and can be architecturally complementary.
3. The requested reclassification can include the requirement that the
Planning Commission review all plans with revision authority whereas
the existing R -4 zone authorizes no Planning Commission review but
mere adherence to minimum zoning requirements.
4. The use of this site can be specifically restricted to an "office
building" only rather than any commercial use or the potential 3 -story
apartment building under the existing zone.
Chairman Kirsop suggested delay until the regular September meeting to allow
the applicant to better describe the proposed use and how it will affect neigh-
boring properties.
Motion by Mr. Bowen and seconded by Mr. Sowinski to table this Public Hearing
until the regular September meeting.

Mr. Wynn Anderson, 6415 South 153rd Street, stated the old 65th Avenue right -
of -way remains as much of a buffer as it ever was and that the Phillips' pro-
perty location precludes their view of this site. The hill behind this parcel
is a natural buffer and the proposed building will tend to diminish the effect
of the freeway noise. The proposed office development will complement the
existing King County Housing Authority office building across the street and,
eventually, the other corner parcel at this intersection. Felt the combined
office development here would be an asset to the community.
Mr. Merrill Simonds, 15460 - 65th Avenue South, noted his concern for improvement
of old 65th Avenue since the proposed development will significantly increase
its use.
Mr. Crutchfield explained Mr. Simonds' concern is precisely the reason for
staff recommendation #4.
Mr. Simonds objected to the formation of an LID, in which he would be included,
since the existing improvement is sufficient for his use as residential.
Mr. John Merrick, 4907 - 19th Avenue S.E., Lacey, Washington, noted some adjust-
ment may be needed on the site plan regarding the curb cut on 65th Avenue.
Explained the new development should pay for all improvements. Also stated
there may be a problem with circulation within the site.
Mr. Crutchfield noted that the question before the Planning Commission is
whether or not the property should be classified for office use or remain as
apartment zoning.
Mr. Simonds stated the proposed building height and location is allright but
strongly objects to paying for a street improvement which he does not need.
Mr. Crutchfield explained the question of when and how an LID is formed rests
with the City Council and cited LID #27 as an example of residentially- classi-
fied lands being excluded from an LID.
Mr. Merrick stated his belief that the Phillips' property is within 300 feet of
the subject parcel and noted that in the event the office zone creeps eastward
the Phillips' property will certainly be affected. As a nearby property owner,
he desires the opportunity to have input on the design plans of the development.
Referring to the City Council's recent statement of policy that the City Council
will give due consideration to adjacent property owners in conjunction with
rezone applications, he favors this rezone application.
Mr. Al Henke, 6542 Southcenter Boulevard, stated his concurrence with this
rezone action so long as the office development does not move further east.
Vice - Chairman Richards explained the hearing procedures in that when the public
hearing is closed he will not accept any further input from the audience and
the discussion will be limited to the Commission.
Mr. Merrick asked what specific uses will operate from the proposed development.

construction company office will be there and he anticipates other professional

WHEREAS, the owner of the property described in Exhibit "A" attached
hereto has petitioned the City requesting reclassification of said property from
R -4 to C -1, and;
WHEREAS,. adequate environmental information was submitted and a nega-
tive declaration made by the responsible official, and;
WHEREAS, a public hearing on said petition was conducted before the
Planning. Commission as required by law on 25 August and 22 September 1977 after

Minutes of the Meeting, 22 September 1977.
PLANNING COMMISSION
The regular September meeting of the Tukwila Planning Commission was called
to order at 8:05 P.M. by Vice - Chairman Richards with Commissioners Hartong,
Avery, Sowinski and Bowen present. Commissioners Kirsop and West had noti-
fied Staff of their inability to attend this meeting. Gary Crutchfield repre-
sented the Planning Division.
Vice - Chairman Richards called for approval of the August minutes.
Motion by Mr. Hartong, seconded by Mr. Sowinski and carried to approve the
minutes of 25 August 1977 as prepared.
CITY COUNCIL ACTIONS
Mr. Crutchfield read the Staff Report explaining the Commission would be con-
ducting a hearing at the next regular meeting to establish the 1978 projects
under the H &CD Plan recently adopted.
Noted the City Council had recently adopted the new Comprehensive Plan as well
as Ordinance #1035 which is similar to Resolution #489.
OLD BUSINESS:
.?CESSED PUBLIC HEARING: REZONE R -4 to C -1 (Schneider)
Vice - Chairman Richards reconvened the public hearing at 8:15 P.M. and Mr.
Crutchfield read the Staff Report.
Mr. Crutchfield read a letter submitted by Mr. & Mrs. Lee Phillips, 6550 South
154th Street (Southcenter Boulevard), objecting to the proposed rezone. Letter
alluded to alignment of old 65th Avenue right -of -way and complained of not being
formally notified. (A copy of the letter may be found in Planning Division M/F
#77- 27 -R.) Mr. Crutchfield explained the old and new alignments of 65th Avenue
and its relationship to existing zoning patterns. Also explained that while the
Tukwila zoning code requires that all property owners within 185 feet of the
subject parcel be formally notified, the Planning Division, as a matter of policy,
formally notifies all property owners within 300 feet. The Phillips' property is
located beyond the 300 -foot radius.

Mr. Wynn Anderson, 6415 South 153rd Street, stated the old 65th Avenue right -
of -way remains as much of a buffer as it ever was and that the Phillips' pro-
perty location precludes their view of this site. The hill behind this parcel
is a natural buffer and the proposed building will tend to diminish the effect
of the freeway noise. The proposed office development will complement the
existing King County Housing Authority office building across the street and,
eventually, the other corner parcel at this intersection. Felt the combined
office development here would be an asset to the community.
Mr. Merrill Simonds, 15460 - 65th Avenue South, noted his concern for improvement
of old 65th Avenue since the proposed development will significantly increase
its use.
Mr. Crutchfield explained Mr. Simonds' concern is precisely the reason for
staff recommendation #4.
Mr. Simonds objected to the formation of an LID, in which he would be included,
since the existing improvement is sufficient for his use as residential.
Mr. John Merrick, 4907 - 19th Avenue S.E., Lacey, Washington, noted some adjust-
ment may be needed on the site plan regarding the curb cut on 65th Avenue.
Explained the new development should pay for all improvements. Also stated
there may be a problem with circulation within the site.
Mr. Crutchfield noted that the question before the Planning Commission is
whether or not the property should be classified for office use or remain as
apartment zoning.
Mr. Simonds stated the proposed building height and location is allright but
strongly objects to paying for a street improvement which he does not need.
Mr. Crutchfield explained the question of when and how an LID. is formed rests
with the City Council and cited LID #27 as an example of residentially- classi-
fied lands being excluded from an LID.
Mr. Merrick stated his belief that the Phillips' property is within 300 feet of
the subject parcel and noted that in the event the office zone creeps eastward
the Phillips' property will certainly be affected. As a nearby property owner,
he desires the opportunity to have input on the design plans of the development.
Referring to the City Council's recent statement of policy that the City Council
will give due consideration to adjacent property owners in conjunction with
rezone applications, he favors this rezone application.
Mr. Al Henke, 6542 Southcenter Boulevard, stated his concurrence with this
rezone action so long as the office development does not move further east.
Vice - Chairman Richards explained the hearing procedures in that when the public
hearing is closed he will not accept any further input from the audience and
the discussion will be limited to the Commission.
Mr. Merrick asked what specific uses will operate from the proposed development.

To the members of th. Tukwila Planning Commission:
As we are unable to attend the planning commission meeting
of Sept. 22,19 ?? regarding the proposed rezone of property at
65th and Southcenter Boulevard we have requested that Mr Alvin
Henke present this letter in opposition to the proposed rezone.
The relocation of 65th Ave So. has removed the buffer
which protected R -1 property from lower zoning classification.
This put a portion of R -4 zoning in an unwarrented position.
We strongly feel and have been advised that the proposed rezone
would have a deleterious affect on the existing homes. Homes
that approximate a value of upwards of $200,000..
We as citizens of the City of Tukwila feel the planning comm-
lssion has an obligation to protect us from the encroachment
of a zoning that would adversely affect our properties. We be-
lieve that words to that effect are included in the ordinance.
For over 16 years the homeowners in this area have asked for
and roceived the courtesy of our voices being heard to keep this
area as R -1 -- now it seems our voices are to be overridden by
developers who do not live in the city who are speculating and
benefitting at the expense of the citizens and homeowners in
this area.
Even as of now, we have never been officially notified of
this requested planned rezone. Hardly seems that our wishes in
this projected rezoning are even being considered.
We sincerely hope the Planning Commission willttttke another
look at this situation and recommend to the council that the
rezone be denied.

Mr. Crutchfield stated the topographical survey is more accurate than the
aerial topography maps on which the Staff Report was based.
There being no further comments, Chairman Kirsop closed the Public Hearing at
9:15 P.M.
Motion by Mr. Hartong, seconded by Mr. Sowinski and carried to recommend the
City Council reclassify the subject parcel from R -1 to C -2 with the following
stipulations:
1. In the -event that development of the property will affect that land
area above approximate 35 feet elevation, a grading and reclamation
plan consistent with Chapter 70 of the Uniform Building Code and a
reclamation bond posted with the City of Tukwila in an amount equal '
to 150% of the estimated cost of reclamation shall be required prior
to issuance of the Building Permit.
2. Development of the site shall include a pedestrian sidewalk of five
(5) feet in width.
3. The forced main sewer connection line be installed in accordance with
City of Tukwila standards, at the full expense of the property owner,
and a special connection charge be paid by the property owner in accor-
dance with Chapter 14.60 (Sewer Charges) of the Tukwila Municipal Code.
4. Operation and maintenance of the pump and sewage force main shall be
at the full expense of the owner.
5. At such time as an LID is formed for a gravity flow sewer system serving
the vicinity of this property, as shown in the Tukwila Comprehensive
Sewer Plan, the property will agree to equitably participate in such
LID in accordance with Section 14.60.076 of the Tukwila Municipal Code.
6. A charge in lieu of assessment to be paid to the City at a rate to be
established by the final assessment roll of LID #27.
7 On site construction shall conform to the height, yard and area re-
strictions and architectural review as outlined in Sections 18.32.030
and 18.32.040 of the Tukwila Municipal Code.

Kirsop opened the Public Hearing at 9:20 P.M. and Mr. Crutchfield read the
Staff Report.
The applicant was neither present nor represented.
Mr. Lee Phillips, 6550 South 154th,stated his opposition to the application due
to the residential character of development adjacent the site. This will elim-
inate the buffer provided by R -4 and he stated his opposition to anything but
R -1 zone.

Mr. M. E. Simon, 15460 - 65th Avenue, questioned the height of the proposed
structure.
Mr. Crutchfield explained the requested C -1 zone height limit is 35 feet while
the existing R -4 zone height limit is 45 feet.
Mr. John Merrick, 6532 South 154th, stated the noise from an office building
will travel right up to his home. Requested this be delayed until the new
Comprehensive Plan is adopted.
Mr. Hartong asked why these people don't object to the R -4 zone existing on
the property?
Mr. Phillips stated his opposition to R -4 zoning also but feels the property
will stay vacant since it isn't big enough to support R -4 development.
In response to questions regarding interference with established views, Mr.
Crutchfield explained the concept of construction envisioned by the applicant
at this time. Generally, the applicant proposes to construct a two -story
office building situated near the center of the site. According to the aerial
topography maps, it would not necessarily inhibit the view of the one (1)
house near it.
Mr. Wynn Anderson, 6415 South 153rd, explaining he is the seller of the property
to Mr. Schneider, also explained he felt R -4 zoning is far worse than the pro-
posed use due to the nature and bulk of apartments. Also noted that Mr. Simon's
house is the only one which might be affected due to elevations.
Mr. Satterstrom noted several reasons in favor of the request:
1. The proposed office use conforms to the emerging Comprehensive Plan.
2. Office uses are compatible with residential uses due to the facts they
operate only during the day and can be architecturally complementary.
3. The requested reclassification can include the requirement that the
Planning Commission review all plans with revision authority whereas
the existing R -4 zone authorizes no Planning Commission review but
mere adherence to minimum zoning requirements.
4. The use of this site can be specifically restricted to an "office
building" only rather than any commercial use or the potential 3 -story
apartment building under the existing zone.
Chairman Kirsop suggested delay until the regular September meeting to allow
the applicant to better describe the proposed use and how it will affect neigh-
boring properties.
Motion by Mr. Bowen and seconded by Mr. Sowinski to table this Public Hearing
until the regular September meeting.
Mr. Hartong requested the applicant be notified in writing.

The applicant, desiring to construct an office building, has received a
Waiver from Resolution #489 granted by the City Council.
FINDINGS:
1. The subject parcel is currently zoned R -4 and the zoning of surrounding
parc' s is depicted in Exhibit A.
2. The site slopes somewhat gently from about elevation 30 at Southcenter
Boulevard to about elevation 50 at the north end of the site, an approx-
imate grade of 8 %. (SEE, Exhibit B)
3. Southcenter Boulevard and 65th Avenue both are classifed as Collector
Arterials, Southcenter Boulevard feeding Secondary and Major Arterials.
(SEE, Circulation Map, Proposed Comprehensive Plan)
4. Southcenter Boulevard between 65th Avenue and Interurban Avenue is
planned to be improved in the near future but all improvement will
take place within the existing right -of -way.
5. The site is bounded on the northeast by Bluff Street, a 40 -foot wide
right -of -way, providing access to two residential lots to the northeast
of the subject site but does not provide access from Southcenter Boulevard.
6. Available utilities include a 10 -inch water line and 8 -inch sanitary
sewer line. Storm drainage is available at the southwest corner of the
site.

7. Sight distance for west -bound traffic on Southcenter Boulevard is poor
and planned improvements of Southcenter Boulevard do not include left -
turn stack lanes for east -bound traffic.
8. The applicant proposes to construct an office building with lease space
for such uses. The existing zone classifications do not include an
office classification per se, but the C -1 district allows office buildings.
9. The existing Comprehensive Plan promotes industrial use while the proposed
Comprehensive Plan indicates office use.
CONCLUSIONS:
1. All necessary utilities and roadways are available and capable of
supporting the proposed classification.
2. The site being located on the fringe of the residential area and at
an intersection which is the principal entrance to the residential
neighborhood demands building design and uses which are complementary
to the residential character of the neighborhood.
3. Inasmuch as the C -1 district is the "lowest" zone which allows the
proposed use and is far more compatible with the residential neighborhood
than is the industrial designation on the existing Comprehensive Plan
map, the proposed classification is a logical one if the allowed uses
and site /building design plans are tempered.
4. Due to the poor sight distance for west -bound traffic and lack of stack
lane for east -bound left -turn movements and the site's proximity to the
intersection with 65th Avenue, access to the parcel should be restricted
to 65th Avenue.
RECOMMENDATION:
Based on the Findings and Conclusions contained in this Report, Staff recom-
mends the Planning Commission recommend the City Council reclassify the sub-
ject parcel to C -1 with the following stipulations:

1. Vehicular access to or egress from tie- s_i -te- is specifically prohibited.
2. Development of the property under the C -1 classification shall be limited
to a single office building which may contain commercial service uses
customarily incidental to office use.
3. Development plans, including but not limited to site, elevation, land-
scape and building materials shall be subject to review and approval of
the Planning Commission sitting as the Board of Architectural Review as
established in Chapter. 18.32 of the Tukwila Municipal Code. The express
purpose of such review is to ensure the development design complements
the residential neighborhood.
