Councilman Van Dusen asked what the procedure is under the Appearance 1
Fairness Doctrine. Attorney Hard• said he felt it was not necessary to
leave the room; it is sufficient to ask to be excused from the table al
indicate no opinion. There is no need for a vote of the other Council
Members, as they should not tell you if you have a conflict of interes
that is up to each individual member to decide. When in doubt, ask to
be excused. He further stated he did not think Councilman Saul should
be excused.
Councilman Saul explained that the only time he even mentioned purchase
of property was in a public meeting while seated at the Council table.
Councilman Traynor stated that he bet enough reasons could be found
to vacate the whole table.

Deputy City Attorney Hard read an ordinance adopting a new Comprehensi
Land Use Plan for the City and its defined planning area, pursuant to
R.C.W. 35A.63.061, and repealing the existing Comprehensive Plan as
adopted by Ordinances 347, 484, and 768.
Kjell Stoknes suggested waiting until Fred Satterstrom, Associate
Planner, arrived with the revised map.

Kjell Stoknes, OCD Director, explained the location of the proposed
rezone application. He stated the Planning Coiurni',.;lon had recommended
the reclassification of the property with some s t i p u l a t i o n s . This being
in the event that development of the property Wont the land area
above approximate 35 feet elevation, a grading and reclamation plan
consistent with Chanter 70 of the Uniform B u i l d i n g Code and a recl amati o
bond posted with the City of Tukwila in an amount oqual to 150% of the
estimated cost of reclamation shall be required prior to issuance of
the Building Permit. That development of the site , hall include a
pedestrian sidewalk of five feet in width. That the forced main sewer
connection line be installed in accordance with City of Tukwila stand-
ards at the full expense of the property owner. Operation and mainten-
ance of the pump and sewage force main shall be at the expense of the
owner. At such time as a L.I.D. is formed the property will agree to
participate in such L.I.D. A charge in lieu or assessment to be paid
to the City at a rate to be established by the final assessment roll of
t.I.Q. Mo. 27. On -site construction shall conform to the height, yard,
and area restrictions and architectural review of the Tukwila Municipal
Code. Mr. John Markinson, representing the Skarbo s, stated they are
agreeable to the conditions that have been imposri(l Councilman
Rohrer said when this matter was discussed earlier there was a question
about the placement of the building. Mr. Stoknes sold the location of
the building had been approved. Councilman Gardner asked if this is
going to be a retail store. Mr. Stoknes said it was. Council President
Hill asked about fire protection. Mr. Fred Satterrtrom, Plarning
Assistant, said the Fire Department reported they would not have any
problems.

latest wording by the City Attorney. He explained t;he latest wording
and gave examples of its use. He stated this ordinance gives the City
Council the opportunity to mold the community and how it is to be
developed. Council President Hill asked que tion% about the application
of this ordinance. He said the definition of "prrelr,ryt community values"

1. Both curb cuts be 40 feet wide and those parking spaces consequently
affected be deleted.
2. Architectural screening of roof - mounted equipment.
3. Planning Commission review and approval of detailed landscape plan
prior to issuance of Occupancy Permit.
4. This site plan is subject to revisions as may be required subsequent
to Subdivision review.
B. Landscape Plan: McCann Project #293
Mr. Crutchfield displayed the landscape plans and explained their contents.
Chairman Kirsop indicated the length of the building should be broken by in-
clusion of a minimum number of landscape areas.
Mr. Crutchfield explained development pattern of this and neighboring complexes.
Commission discussed need for additional planting areas.
Motion by Mr. Hartong, seconded by Mr. Bowen and carried to approve the land-
scape plan with the stipulation that a minimum of four (4) landscape areas be
provided along the west elevation in addition to the two (2) transformer land-
scape areas.
C. Landscape Plan: McCann Project #368
Mr. Crutchfield displayed and explained the landscape plan and suggested land-
scape breakup of building length along west elevation.
Motion by Mr. Hartong, seconded by Mr. Bowen and carried to approve the plans
with the following stipulations:
1. Street trees not be located more than 30 feet apart.
2. Provide a minimum of two (2) landscape areas along the west elevation.

Mr. Crutchfield introduced this item and explained its location. Chairman
Kirsop opened the Public Hearing at 9:00 P.M. and Mr. Crutchfield read the
Staff Report.
Mr. John Mahlum, architect, stated his objection to Findings #4 and #6 in that
the property is virtually level for the most Hart and noticeably slopes only in the
very rear of the site. Also, the site is virtually void of trees excepting the
very rear portion of the site. Submitted topographical survey and two photo-
graphs of the site.

Mr. Crutchfield stated the topographical survey is more accurate than the
aerial topography maps on which the Staff Report was based.
There being no further comments, Chairman Kirsop closed the Public Hearing at
9:15 P.M.
Motion by Mr. Hartong, seconded by Mr. Sowinski and carried to recommend the
City Council reclassify the subject parcel from R -1 to C -2 with the following
stipulations:
1. In the event that development of the property will affect that land
area above approximate 35 feet elevation, a grading and reclamation
plan consistent with Chapter 70 of the Uniform Building Code and a
reclamation bond posted with the City of Tukwila in an amount equal
to 150% of the estimated cost of reclamation shall be required prior

5. At such time as an LID is formed for a gravity flow sewer system serving
the vicinity of this property, as shown in the Tukwila Comprehensive
Sewer Plan, the property will agree to equitably participate in such
LID in accordance with Section 14.60.076 of the Tukwila Municipal Code.
6. A charge in lieu of assessment to be paid to the City at a rate to be
established by the final assessment roll of LID #27.
7. On site construction shall conform to the height, yard'and area re-
strictions and architectural review as outlined in Sections 18.32.030

Mr. Crutchfield introduced this item and explained its location. Chairman
Kirsop opened the Public Hearing at 9:20 P.M. and Mr. Crutchfield read the
Staff Report.
The applicant was neither present nor represented.
Mr. Lee Phillips, 6550 South 154th, stated his opposition to the application due
to the residential character of development adjacent the site. This will elim-
inate the buffer provided by R -4 and he stated his opposition to anything but
R -1 zone.

PUBLIC HEARING: REZONE ( Skarbo)

REQUEST: REZONE from R -1 to C -2
APPLICANT: Peter Skarbo
LOCATION: Immediately north of the Puget Power Substation on
west side of Southcenter Parkway
SIZE: Approximately 12,000 square feet
ZONE: R -1 -7.2
COMPREHENSIVE PLAN: Industrial (Existing Plan)
Commercial (Proposed)
The City Council granted a waiver from Resolution #489 authorizing Staff
to accept this application for rezone and the Staff Report follows.
FINDINGS:
1. The subject parcel is situated between the existing C -2 zone and the
parcel occupied by the Puget Power substation. (SEE, Exhibit A)
2. The C -2 classification north of the subject parcel was granted in 1976
under Ordinance 966. (SEE, Exhibit B)
3. The nearest single- family residence is located approximately 250 feet
south of the subject parcel and is separated from the subject parcel
by the Puget Power substation.
4. The site is generally flat and level with the adjacent street for about
half its depth; it then rises at an average grade of 13 %.
5. A variety of soil types can generally be found on the site, normally
.indicative of poor arability, fair internal drainage, severe erosion
hazard and low bearing capacity. (SEE, Tukwila Data Inventory, Map 1 -6)
6. The subject property is situated on the fringe of a major wooded area
and is generally covered with a dense growth of ±10 year old deciduos
saplings which tend to retard storm runoff from the steep slope above.

7. Southcenter Parkway, adjacent the east line of the subject parcel, is
a 72 -foot developed right -of -way.
8. A 10 -inch water line is located on the east side of Southcenter Parkway.
9. A 12 -inch sanitary sewer line is located at the intersection of South -
center Parkway and Strander Boulevard, a distance of approximately 1100
feet north of the subject parcel.
10. A 24 -inch crossover is available approximately 100 feet north of the
northeast corner of the subject property to facilitiate storm water
runoff.
11. The sanitary sewer line on Strander Boulevard was created by LID #5 and
the subject property did not participate in the cost of that LID.
12. A recent supplement to the storm water system south of Interstate 405
and between Interstate 5 and the river was finance by all commercial
and industrial classified properties within that area. The subject
property was excluded from the cost of LID #27 due to its residential
classification.
13. The subject parcel is planned to be used by the owner of the parcel im-
mediately north for a single commercial development as depicted in Exhi-
bit C.
14. Ordinance #966, reclassifying the parcel immediately north of the sub-
ject parcel, includes several restrictions one of which provides that
the land area above the approximate 35 -foot elevation be left in a
natural state. The proposed development, as depicted in Exhibit C,
will affect most of the land area situated above the 35 -foot elevation.
15. Ordinance #966 also includes the following restrictions:
A. The forced main sewer connection line be installed in accordance
with City of Tukwila standards, at the full expense of the property
owner, and a special connection charge be paid by the property
owner in accordance with Chapter 14.60 (Sewer Charges) of the
Tukwila Municipal Code.
B. Operation and maintenance of the pump and sewage force main shall
be at the full expentte of the owner.
C. At such time as a LID is formed for a gravity flow sewer system
serving the vicinity of this property, as shown in the Tukwila
Comprehensive Sewer Plan, the property will agree to equitably
participate in such LID in accordance with Section 14.60.076 of
the Tukwila Municipal Code.
D. A charge in lieu of assessment to be paid to the City at a rate
to be established by the final assessment roll of LID #27.

E. On site construction shall conform to the height, yard and area
restrictions and architectural review as outlined in Sections
18.32.030 and 18.32.040 of the Tukwila Municipal Code.
F. All of the above conditions shall be a part of the ordinance
granting the rezone in a form of a developers agreement properly
executed, recorded, and filed in the office of the City Clerk.
16. The City Council required a 5 -foot wide sidewalk under Ordinance 1023
which reclassified the Benaroya property located approximately 1500
feet south of the subject site.
17. The existing Comprehensive Plan promotes industrial use in this vicin-
ity while the proposed Comprehensive Plan indicates commercial use for
the entire length of Southcenter Parkway.
CONCLUSIONS:
1. The subject parcel is separated from the existing residential use by
an electrical substation, providing ayi adequate transition or buffer
area between the two uses and both of the Comprehensive Plans (existing
and proposed) promote the requested use classification.
2. While the site can generally support commercial use, the integrity of
the sloping portion as well as the control of storm water runoff are
of principal concern and reclassification must include provisions to
ensure that development pursuant to commercial reclassification is
responsive to the natural characteristics of the site.
3. Since this parcel is adjacent and has natural characteristics similar
to the parcel immediately north and is planned to be used as an inte-
gral part of the proposed development, the stipulations included in
Ordinance #966 and attached to the parcel immediately north should
also be included as stipulations of reclassification of this site.

4. The policy pr€edent being established by the City Council under Ordi-
nance #1023 to provide a sidewalk along the west side of Southcenter
Parkway due to the ever - increasing amount of commercial development,
reclassification of this parcel should require a complementary sidewalk.
Based on the Findings and Conclusions contained in this Report, Staff recom-
mends the Planning Commission recommend the City Council reclassify the sub-
ject parcel with the following stipulations:
1. That land area above approximately 35 feet elevation be left in a natural
state.
2. In the event that development of the property will affect that land area
above approximate 35 feet elevation, a grading and reclamation plan con-

ORDINANCE RECLASSIFYING A CERTAIN PROPERTY LOCATED ON
THE WEST SIDE OF SOUTHCENTER PARKWAY APPROXIMATELY
1,000 FEET SOUTH OF STRANDER BOULEVARD FROM A R -1 -7.2
• ZONING CLASSIFICATION TO A C -2 ZONING CLASSIFICATION
WITHIN THE CITY OF TUKWILA.
WHEREAS, the owners of the following described property have
petitioned the City requesting reclassification of said property from R -1 -7.2
to C -2 in conformance with the Comprehensive Plan, and;
WHEREAS, adequate environmental information was submitted and a
negative declaration made by the responsible official, and;
WHEREAS, a public hearing on said petition was held before the
Planning Commission as required by law on February 26, 1976 after which
a favorable recommendation was made, and;
WHEREAS, the owners of said property have executed a developers
agreement in favor of the City of Tukwila implementing the recommendations
of the Tukwila Planning Commission as contained in the Staff Report dated
15 March 1976, the agreement having been properly recorded and a copy filed
with the City and which is made by reference a part of this ordinance.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA DO ORDAIN AS
Section 1. That the real property located on the west side of South -
center Parkway approximately 1,000 feet south of Strander Boulevard, as further
described herein, is hereby classified C -2 in accordance with Ordinance #251 of
the City of Tukwila, as amended, and the City Council hereby adopts the map
attached hereto as Exhibit "A" as illustrative of the property described herein
as follows:
North 100 feet south 400 feet SE % NE .* Section 26,
Township 5N, Range 4 EWN, King County, Washington,
lying east of Interstate Highway number 5 and west
of Southcenter and more commonly described
as lot 11, block 3, McNicken Heights division number

REQUEST: REZONE from R -1 to C -2

side of Southcenter Parkway

Commercial (Proposed)
The City Council granted a waiver from Resolution #489 authorizing Staff to
accept this application for rezone and the Planning Commission conducted a
Public Hearing on 25 August 1977.
FINDINGS:
1. The subject parcel is situated between the existing C -2 zone and the
parcel occupied by the Puget Power substation. (SEE, Exhibit A)
2. The C -2 classification north of the subject parcel was granted in 1976
under Ordinance 966. (SEE, Exhibit B)
3. The nearest single- family residence is located approximately 250 feet
south of the subject parcel and is separated from the subject parcel by
the Puget Power substation.
4. The site is generally flat and level with the adjacent street but rises
near the southwest corner to exceed elevation 35.
5. A variety of soil types can generally be found on the site, normally
indicative of poor arability, fair internal drainage, severe erosion
hazard and low bearing capacity. (SEE, Tukwila Data Inventory, Map 1 -6)
6. The southwest corner of property is situated on the fringe of a major
wooded area which tends to retard storm runoff from the steep slope above.
7. Southcenter Parkway, adjacent the east line of the subject parcel, is a
72 -foot developed right -of -way.
8. A 10 -inch water line is located on the east side of Southcenter Parkway.

9. A 12 -inch sanitary sewer line is located at the intersection of South -
center Parkway and Strander Boulevard, a distance of approximately 1100
feet north of the subject parcel.
10. A 24 -inch crossover is available approximately 100 feet north of the
northeast corner of the subject property to facilitate storm water runoff.
11. The sanitary sewer line on Strander Boulevard was created by LID #5 and
the subject property did not participate in the cost of that LID.
12. A recent supplement to the storm water system south of Interstate 405 and
between Interstate 5 and the river was financed by all commercial and in-
dustrial classified properties within that area. The subject property was
excluded from the cost of LID #27 due to its residential classification. '
13. The subject parcel is planned to be used by the owner of the parcel imme-
diately north for a single commercial development as depicted in Exhibit C.
14. Ordinance #966, reclassifying the parcel immediately north of the subject
parcel, includes several restrictions one of which provides that the land
area above the approximate 35 -foot elevation be left in a natural state.
The proposed development, as depicted in Exhibit C, will affect most of the
land area situated above the 35 -foot elevation.
15. Ordinance #966 also includes the following restrictions:
A. The forced main sewer connection line be installed in accordance
with City of Tukwila standards, at the full expense of the property
owner, and a special connection charge be paid by the property owner
in accordance with Chapter 14.60 (Sewer Charges) of the Tukwila
Municipal Code.
B. Operation and maintenance of the pump and sewage force main shall be
at the full expense of the owner.
C. At such time as a LID is formed for a gravity flow sewer system
serving the vicinity of this property, as shown in the Tukwila
Comprehensive Sewer Plan, the property will agree to equitably
participate in such LID in accordance with Section 14.60.076 of
the Tukwila Municipal Code.
D. A charge in lieu of assessment to be paid to the City at a rate
to be established by the final assessment roll of LID #27.
E. On site construction shall conform to the height, yard and area
restrictions and architectural review as outlined in Sections
18.32.030 and 18.32.040 of the Tukwila Municipal Code.
F. All of the above conditions shall be a part of the ordinance
granting the rezone in a form of a developers agreement properly
executed, recorded, and filed in the office of the City Clerk.

16. The City Council required a 5 -foot wide sidewalk under Ordinance 1023
which reclassified the Benaroya property located approximately 1500
feet south of the subject site.
17. The existing Comprehensive Plan promotes industrial use in this vicinity
while the proposed Comprehensive Plan indicates commercial use for the
entire length of Southcenter Parkway.
CONCLUSIONS:
1. The subject parcel is separated from the existing residential use by an
electrical substation, providing an adequate transition or buffer area
between the two uses and both of the Comprehensive Plans (existing and '
proposed) promote the requested use classification.
2. While the site can generally support commercial use, the integrity of the
sloping portion as well as the control of storm water runoff are of prin-
cipal concern and reclassification must include provisions to ensure that
development pursuant to commercial reclassification is responsive to the
natural characteristics of the site.
3. Since this parcel is adjacent and has natural characteristics similar to
the parcel immediately north and is planned to be used as an integral
part of the proposed development, the stipulations included in Ordinance
#966 and attached to the parcel immediately north should also be included
as stipulations of reclassification of this site.
4. The policy precedent being establsihed by the City Council under Ordinance
#1023 to provide a sidewalk along the west side of Southcenter Parkway due
to the ever- increasing amount of commercial development, reclassification
of this parcel should require a complementary sidewalk.
RECOMMENDATION:
Based on the Findings and Conclusions contained in this Report, the Planning
Commission recommends the City Council reclassify the subject parcel with the
following stipulations:
1. In the event that development of the property will affect that land area
above approximate 35 feet elevation, a grading and reclamation plan con-
sistent with Chapter 70 of the Uniform Building Code and a reclamation
bond posted with the City of Tukwila in an amount equal to 150% of the
estimated cost of reclamation shall be required prior to issuance of the
Building Permit.
2. Development of the site shall include a pedestrian sidewalk of five (5)
feet in width.
3. The forced main sewer connection line be installed in accordance with
City of Tukwila standards, at the full expense of the property owner,
and a special connection charge be paid by the property owner in accor-
dance with Chapter 14.60 (Sewer Charges) of the Tukwila Municipal Code.

WITHIN THE CITY OF TUKWILA.
WHEREAS, the owners of the following described property have
petitioned the City requesting reclassification of said property from R -1 -7.2
to C-2 in conformance with the Comprehensive Plan, and;
WHEREAS, adequate environmental information was submitted and a.
negative declaration made by the responsible official, and;
WHEREAS, a public hearing on said petition was held before the
Planning Commission as required by law on February 26, 1976 after which
a favorable recommendation was made, and;
WHEREAS, the owners of said property have executed a developers
agreement in favor of the City of Tukwila implementing the recommendations
of the Tukwila Planning Commission as contained in the Staff Report dated
15 March 1976, the agreement having been properly recorded and a copy filed
with the City and which is made by reference a part of this ordinance.
• NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA DO ORDAIN AS
Section 1. That the real property located on the west side of South -
center Parkway approximately 1,000 feet south of Strander Boulevard, as further
described herein, is hereby classified C -2 in accordance with Ordinance #251 of
the City of Tukwila, as amended, and the City Council hereby adopts the map
attached hereto as Exhibit "A" as .illustrative of the property described herein
as follows:

Application for Change of Land Use Classification
Applicant: Mr. Peter Skarbo
The following are in response to application questions #1 -4.
1. No incompatible effects are foreseen. The land to the north is zoned C -2,
and the adjoining land to the south is developed as a power substation
which is a use visually compatible to this proposed use. The land across
the street is zoned Industrial Park.
The site will be landscaped in a manner compatible with other developments
in the area.
2. It is our understanding that the adjacent street is developed to City
standards.
3. The proposed project will connect to municipal storm sewer and water
services and to a sanitary sewer being provided by the land owner to the
north.
4. This request is for reclassification of only the southerly 1/3 portion of
the property. The other 2/3 of the property is currently zoned C -2.
The lack of C -2 zoning over the entire site of the land to the south was
not discovered until submittal of the Environmental Checklist. The appli-
cant at this time understands the project as proposed would provide an
inadequate south side yard, and he agrees to modify the project as required.
