Dear Mr. & Mrs. Dickey:
The Tukwila Planning Commission, at its regular August meeting, conducted
a public hearing to consider your application for classification of M-1
for the half-acre parcel of land recently annexed to the City of Tukwila.
The Planning Commission, upon due consideration of the application, Staff
Report and testimony received during the public hearing, unanimously voted
to deny the requested M-1 classification due to the particular use desired
to be placed on the land and its unsafe and unduly detrimental effect on
the surrounding residential neighborhood.
As applicant, you maintain the right of appeal if filed in writing with the
City Clerk within ten (10) calendar days from date of receipt of this letter.

Chairman Kirsop declared a 5- minute recess at 10:10 P.M.
Chairman Kirsop reconvened the meeting with all Commissioners and Staff present
as previously noted.
PUBLIC HEARING: REZONE, Unclassified (R -1) to M -1 (Dickey)
Mr. Crutchfield introduced this item and explained the location of the proposal.
Chairman Kirsop opened the Public Hearing at 10:25 P.M. and Mr. Crutchfield read
the Staff Report.
Mr. Jack Resner, agent representing the applicant, stated he agreed with the
Staff Report and changed the application to reflect the applicant's agreement
with and desire for CM zoning.
Mr. Elray Simon, 4625 South 134th Street, asked if the proposed use of the site
is a towing impound lot for derelict cars.
Mr. Resner stated yes.
Mr. Simon stated his house is 40 feet from the site and South 134th Street is
too narrow for this kind of use. There will be noise and traffic increases
which will devalue his property.
Upon explanation of uses allowed in M -1 and CM zoning, it was noted by Mr.
Crutchfield that Section 5.44.130 of the Tukwila Municipal Code, Tow Truck
licensing, specifically excludes towing impound yards from CM zone.
Mr. Resner changed the application to request M -1 zoning to allow a towing
impound lot in conformance with Section 5.44.130.
Mr. Ed Davenhauer, 4526 South 135th, stated he does not want to look at a
vehicle storage yard and objected to the certain noise impacts from tow
trucks operating at night and the subsequent loss in value for his property.
Mr. Resner asked if Staff would change their recommendation to M -1 with the
17 restrictions listed under Ordinance #743.
Mr. Satterstrom stated that recommendation could not be made without further
study.
Mr. Simon stated his objection to M -1 zoning even under the 17 restrictions
of Ordinance #743. Submitted two (2) photographs of the existing facilities
developed under Ordinance #743 depicting several violations of the restric-
tions regarding outdoor storage.
Mr. Davenhauer stated the applicant currently maintains an impound lot nearby
in a very messy condition and does not want to see it nearer the residential
neighborhood. Also noted his objection to the City not strictly enforcing
Ordinance #743 provisions on the facilities developed there.
Mr. Resner requested the Commission view the proposed site plan which included
significant yard setbacks,landscaping and fencing. The Commission reviewed such.

Mr. Paul Sanders, 13407 - 48th Avenue, stated South 134th Street is too narrow
and the restrictions of Ordinance #743 are worthless.
There being no further comments, Chairman Kirsop closed the Public Hearing at
10:40 P.M.
The Commission discussed the character of the surrounding residential develop-
ment with respect to the proposed use.
Motion by Mr. Sowinski, seconded by Mr. Bowen and carried unanimously to deny
the request for M -1 classification because the proposed towing impound lot
would be unsafe,and unduly detrimental to the surrounding residential neighborhood.
D. PUBLIC HEARING: RECREATION SPACE ORDINANCE (Proposed)
Mr. Crutchfield introduced this item and Chairman Kirsop opened the Public
Hearing at 10:50 P.M. Mr. Crutchfield read the proposed ordinance.
Commission agreed to revise the proposed ordinance as follows:
1. Add to Section 3, paragraph 1, a provision establishing a minimum
of 1,000 square feet of recreation space for any multiple - family
development.
2. Revise Section 3, paragraph lc, to reflect that dwelling units with
2 o more bedrooms shall provide recreation space for children.
3. Revise Section 3, paragraph 2, to require Planning Commission reviews
prior to issuance of Building Permit.
Chairman Kirsop closed the Public Hearing at 11:15 P.M.
Motion by Mr. Sowinski, seconded by Mr. Bowen and carried to recommend the City
Council adopt the proposed Recreation Space Ordinance as amended.
Motion by Mr. Sowinski, seconded by Mr. Bowen and carried to adjourn the meeting.
Chairman Kirsop adjourned the regular August meeting at 11:30 P.M.

This parcel of land, previously referred to as the Bradley property, was
annexed to the City and was granted a Waiver from Resolution #489 to
authorize application for rezone.
FINDINGS:
1. The subject parcel was annexed to the City of Tukwila under Ordinance
#1026 in June 1977 and is unclassified pending classification pursuant
to rezone application.
2. The property adjacent to the subject parcel and situated within the
City of Tukwila is classified M -1 while the land area outside the'City
and under the jurisdiction of King County is generally classified SR
(Suburban Residential), similar to Tukwila's R -1 classification. (SEE,
Exhibit A)
3. The subject site is currently occupied by a vacant residential unit and
is approximately 2 acre in size.
4. Utilities available to the subject parcel include a 10 -inch water line
and 8 -inch sanitary sewer line.
5. Storm water runoff presently enters a drainage ditch adjacent the east
property line. The capacity of the drainage ditch is being fully utilized
at the current level of industrial development.
6. South 134th Street, a 30 -foot public right -of -way, provides a 20 -foot wide
driving surface.

7. Reclassification of a large portion of the existing M -1 land area was
accomplished in 1972 under Ordinance #743 which included 17 develop-
ment restrictions. (SEE, Exhibit B)

8. The surrounding residential neighborhood is some instances, showing
signs of deterioration and diminished quality.
CONCLUSIONS:
1. While the utility sizes and roadway improvements can generally be
assumed to support dense residential development, they are large enough
to support minor industrial development.
2. The residential neighborhood in the immediate vicinity appears to be
in a state of slow transition to industrial use.
3. The residential neighborhood further removed from the industrial area,
particularly along South 135th Street, appears to be of a more stable
nature and must be protected from incompatabilities associated with
industrial development.
4. The existing storm drainage ditch is inadequate to support additional
industrial development and therefore industrial classification must
make provision for storm drainage improvements.
5. Ordinance #743, which classified much of the existing industrial area
adjacent this parcel, included all of the restrictions found under the
CM (Industrial Park) classification of the Tukwila Zoning Code. This
appears to be an effort to protect the less transitional residential
area nearby.
RECOMMENDATION:
Based on the Findings and Conclusions contained in this Report, Staff deems
classification to M -1 with the 17 development restrictions outlined in the
previous Ordinance #743 to be unorthodox and confusing and therefore recom-
mends the Planning Commission, upon agreement of the applicant, recommend
the City Council classify the subject parcel CM with the following stipulations:
1. The property owner, his heirs, successors and assigns agree to equitably
participate in the cost of any future LID to include but not be limited to
street and storm drainage improvements.
2. The use of the site shall not be unduly detrimental to the surrounding
residential neighborhood.

AN ORDINANCE R,E- CLASSIFYING CERTAIN "PROPERTY
FROM R -1 ZONING TO IMI -1 ZONING WITHIN THE
CITY OF TUK'v'iILA.

WHEREAS, The owners of the following described property
have petitioned the Planning Commission requesting re- classification
of said property from R - zoning to M - 1 zoning in conformity with
the comprehensive plan, and
WHEREAS, Public hearings on said petition were held
before the Planning Commission of the City of Tukwila, and the City
Council having received a favorable recommendation from the Planning
Commission with respect to the aforementioned petition; and
WHEREAS, The City Council finds the requested classi-
fication to be in furtherance of the public health, safety and
general welfare,
NOW, THEREFORE, The City Council of the City of
Tukwila, Washington, do ordain as follows:
That the following described real property is hereby
classified as M -1 in accordance with Ordinance No. 251 of the
City of Tukwila, as amended, and the City Council hereby adopts
the attached map showing said classification for the real property
described as set forth in Exhbit A attached hereto, subject to
the following conditions:
1. Processes and equipment employed and goods
processed or sold shall be limited to those which
are not objectionable beyond the boundaries of the .,v7;1 t)
district by reason of offensive odors, dust, smoke t, ON'
or gas.
2. Waste disposal shall be by a method or methods
approved by the Puget Sound Air Pollution Control
Agency, or any other governmental body having
jurisdiction thereover.
3. NO use shall be permitted if it results in

the outer bourdary of this district.

4. Necessary public rights -of -way shall be
dedicated. to the public either as a portion of
a plat or upon acceptance of street dedication
by the City Council.
5. To protect the abutting contiguous uses,
a protective strip of land bordering the external
boundaries and along any frontage on public rights -
of -way and devoted to the planting, cultivation,
growing, and maintenance of sight- obscuring trees,
shrubs and plant life shall be established and
maintained. The maintenance guarantee of such
protective strips and the planned landscaping of
the site may be bonded to the city in a reasonable
amount if required by the City Council. In lieu
of such protective strip, under appropriate circum-
stances, there may be substituted a use classifica-
tion of the outer margin of this district consistent
with or not objectionable to the use classification
of the peripheral area.

6. Outdoor storage facilities shall be obscured
by an approved architectural screen or buildings
specified on the plat plan and approved by the
Planning Commission.
7. A plot and building plan showing compliance
with the provisions herein stated and consistent
with the amenities of the land use shall be filed
with the Planning Department and the building per-
mit application shall comply with this approved
plot plan.
8. Structures shall not exceed thirty -five feet
in height and /or three stories except that when
the site exceeds five acres, the height may be
raised one additional story for each additional
two and one -half acres within the site area bound-
aries when specifically approved by the Council
upon recommendation of the Planning Commission.
9. Outdoor storage shall not exceed twenty feet
in height,,and shall be screened from abutting
public streets and from adjacent properties. Such
screens shall be a minimum of eight feet high, and
not less than sixty percent of the height of the
material stored.
10. The minimum setback from all publicly used
rights -of -way shall be adequate to provide a
park -like atmosphere, and at least fifty feet.
The same to be clearly set out in the plot and
building plan and upon the building permit applica-
tion when filed.
11. Off -stret parking shall be provided as stipu-

Mr. Elray Simon, 4625 South 134th Street, asked about Resolution N
and stated that he is against the rezone. He had heard that the
developer hopes to put en impound lot on the property and he is oppos
to it as the site is approximately 40 feet from his back door.
Impound lots cause undue noise and commotion,and he felt it would be
detrimental to the value of his property. •
Mayor Bauch explained that the Resolution requires a waiver from the
Council to allow the applicant to apply to the Planning Commission for
a rezone. At this time, Council is not hearing the merits of the casE
He recommended Mr. Elray present his objections to the Planning
Commission.
Councilman Bohrer asked if'the motion included accepting the staff
recommendation? He was told that it did not.

that they satisfy the Fire Department that they can get fire protectt

SUMMARY OF PROPOSAL:
The applicant, contract - purchaser of the subject property, recently annexed the
parcel to the City and now wishes to proceed with a rezone action from Unclassi-
fied (R -1 -12.0) to M -1 (Light Industry). Rezone actions require that a waiver
from Resolution #489 be granted by the City Council before Staff may accept an
application; hence, this application for waiver from Section 4A of Resolution
#489.
Staff analysis of the four criteria are as follows:
CRITERIA #1: Is the proposed action consistent with the presently emerging
Land Use Policy Plan?
STAFF COMMENTS:
The proposed rezone would extend the existing M -1 zoning to the new corporate
boundaries in this vicinity, an action which is depicted in the Preliminary
Comprehensive Land Use Plan Map. Policies of the Plan which are relative to
this proposal are numerous. However, the principal policies relate to
juxtaposition of incompatible land uses. The properties adjacent to the west
and south property lines are currently zoned SR (Suburban Residential) in
King County, whereas the property adjacent to the north and east lines are
classified M -1 in Tukwila. That zoning was authorized under Tukwila Ordinance
#743.

CRITERIA #2: Does.the proposed action represent a unique condition which
is insignificant in scale and to which no other apparent
alternatives are reasonable?
STAFF COMMENTS:
Although this property cannot be said to represent a unique condition, the
proposed action would seem insignificant in scale in relationship to the
neighboring industrially - classified property. Apparent alternatives would
include zoning to a classification more compatible with the residential zone
on the neighboring King County land. However, if the existing Tukwila land
area is to remain classified industrial, that alternative is unreasonable.
CRITERIA #3: If the request for waiver involves grading, excavation, filling,
or development in.geographical areas identified as having
potential natural limitations for development, are mitigating
measures provided?
STAFF COMMENTS:
The proposed action is not located in a geographical area identified as having
potential natural limitations for development.
CRITERIA #4: Do the requirements contained in Resolution #489 impose a special
hardship to a site for which a waiver of the provisions would not
necessitate a major policy commitment prior to adoption of the
Land Use Policy Plan?
STAFF COMMENTS:
The proposed action, if processed in consideration of the surrounding properties
and Tukwila Ordinance #743, would neither constitute nor necessitate a.major
policy commitment and denial of the waiver would impose a hardship to the
reasonable use of this site.
RECOMMENDATION:
Staff recommends the Council grant the waiver to authorize application for
rezone with the stipulation that staff analyze the rezone application with
particular respect to Tukwila Ordinance #743 and the neighboring residential
properties.
