As a follow -up to our recent discussion of an office development on the
site of the formerly- proposed Westwater Motel, we are pleased to provide
the following information:
1) Shoreline Management Permit
WAC 173 -14 -064 provides that Shoreline Management substantial
development permits may be revised, provided that the use
authorized pursuant to the original permit is not changed.
The Shoreline Management permit (77 -53 -SMP) granted 5 January
1978 is for a 250 room motel complex; therefore, you must seek
approval of a new SMP for the proposed office project.
2) Height Allowance
The Planning Commission, under application 77 -54 -CUP, approved
a conditional use permit for a seven -story hotel complex,
exceeding the 45' M -1 zoning district height limit. However,
per stipulation #8 of that approval, a building permit appli-
cation was not filed within 18 months of 15 December 1977,
invalidating the conditional use permit and its height allowance.
Height approval for your office project may be assessed according
to the criteria of TMC Sec. 18.60.035 (enclosed).
3) Parking Requirements
The variance approved under application 78 -01 -V which permitted
reduction in on -site parking for the motel structure according
to its multiple - useage concept has expired. Parking for the
proposed office complex, therefore, will be assessed on a gross
floor area, or gross rentable floor area basis per TMC 18.56.160
(enclosed); g of "floor area" (TMC 18.06.360) is also
enclosed.
4) Status of "Declaration of Non - Significance"

WAC 197 -10 -375 (State Environmental Policy Act) provides as
follows:

"The lead agency may withdraw any proposed or final declaration
of non - significance at any time when: (a) The proposal has
been modified after the threshold determination, and such
modification may cause the proposed action to have significant
adverse environmental impacts...."
The modified office proposal which you have described to us in
conceptual form will most likely not result in significant
adverse environmental impacts; therefore, the aforementioned
Declaration of Non - Significance (EPIC- FD -43) will remain in
effect. However, prior to release of building permits, the
City may require submission of a project - related traffic study
based on the now - contemplated office use. We shall advise you
of our needs in this regard with sufficient lead time to avoid
permit processing delays.
I hope that the foregoing information is of use to your project planning
efforts.

SUBJECT: SHORELINE MANAGEMENT PERMIT /MF #78- 34 -SMP
Mr. Tom MacDonald of Christensen MacDonald, Inc., consulted with me
concerning the extension of the Shoreline Substantial Development
Permit issued on January 11, 1978 by the City of Tukwila for the
Riverside Motel /Restaurant complex.. WAC 173 -14 -060 allows local
government to extend the 2 -year time period to initiate action by a
reasonable amount of time. Mr. MacDonald has requested an extension
of one (1) year. This appears reasonable, however, an extension of.
the 5 -year period for completion of the project is not warranted at
this time. The completion date would still be January 11, 1982.

Per our conversation of October 5, 1978 I would like to
request that the above Shoreline Application Approval be
extended for a period of one year, namely January 11, 1980.
As you are aware on January 11, 1979 our present
application will be void unless we ask for additional
time.
It is our intent to take steps immediately to build the
motel restaurant complex as approved. Although it is
possible for us to meet the deadline of January 11, 1979
it would put an undue hardship on us to stop all other
projects and concentrate on that one as of this date.
Therefore, we would sincerely appreciate your consideration
of the extension of our permit approval.

and low Impact Zone shall be treated in accordance with the Tukwila Shoreline Master
Program and plans for same shall be subject to approval of the Planning Division.
This permit is granted pursuant to the Shoreline Management Act
of 1971 and nothing in this permit shall excuse the applicant from
compliance with any other federal, state or local statutes, ordi-
nances or regulations applicable to this project, but not incon-
sistent with the Shoreline Management Act (Chapter 90.58 RCW).
This permit may be rescinded pursuant to RCW 90.58.140 (7) in the
event the permittee fails to comply with the terms or conditions
hereof.
CONSTRUCTION PURSUANT TO THIS PERMIT WILL NOT BEGIN OR IS.
NOT AUTHORIZED UNTIL.THIRTY (30) DAYS FROM THE DATE OF FILING

Below are answers requested on pages 1 and 2 of the "Application
Instructions."
A. PROJECT DIAGRAMS:
1. SITE PLAN. Include on the Plan:
K. At this time it is not anticipated that there will
be any substantial need for fill material.
I. No materials will be extracted from the site.
O. The Shoreline designation according to the
Master Plan is Green River South.
P. Our interpretation of the Master Plan indicates
the entire site is "a shoreline of statewide
significance."

The area within a 1, 000 foot circle to the East,
South and West of the site is without exception new
light industry, industrial office development and
two new restaurants. East to the Burlington
Northern railroad tracks and the Longacres Race
Track, represent land improvements over 30 years
old. To the North there are two private residences
and a cattle farm which have been in existence for
15 -30 years. These developments cover both sides
of the Green River. (see attached Appendix "A ")
