DEDICATION OF PORTION OF SHORT PLAT
REAL PROPERTY FOR STREET PURPOSE
HODGSON-SHEEHAN VENTURE, a joint venture composed of
two venturers, (i) CALIFORNIA VENTURE COMPANY, a Washington
general partnership, the partners of which are ROBERT J.
SHEEHAN and PAULINE L. SHEEHAN, husband and wife, PAUL E.
SHEEHAN and VERLEN P. SHEEHAN, husband and wife and (ii)
EDGAR J. HODGSON and MAUDE B. HODGSON, husband and wife,
being the Owner ( "Owner ") in fee simple of the land des-
cribed in the Short Plat ( "this Short Plat ") to which this
Dedication is attached, made a part of and incorporated by
the reference therein, DOES HEREBY FOREVER DEDICATE to the
use of the public for the purpose of a street, more parti-
cularly an extension in width of the existing South 134th
Street of the City of Tukwila, Washington, the following des-
cribed portion of the land described in this Short Plat:
The southwesterly fifteen (15) feet of Lot 4,
City of Tukwila Short Plat No. 81- 39 -SS, recorded
under King County Recording No. 8204280545, adja-
cent to and measured northerly along South 134th
Street of the City of Tukwila a distance of 220.0
feet from the southeasterly boundary of said Lot
4.
This Dedication is made with the understanding of the
Owner that:
1. In the event such extension in width of South
134th Street should be ordered by the City of Tukwila pur-
suant to the creation of a local improvement district, then
the determination of benefit received and calculation of the
assessment for the real property described in this Short
Plat shall be adjusted to account for the real property
herein dedicated for such extension.
2. In the event such extension should be so ordered,
the Owner shall defend and save harmless the City of Tukwila
as to any loss, damage or delay suffered by the City as a
result of any protest to the formulation of such improvement
district, filed by or on behalf of the then owner of the
real property described in this Short Plat.
3. Nothing herein shall be considered as limiting the
right of the Owner, pursuant to the provisions and proce-
dures of RCW 35.44.080, to object to the amount of the assess-
ment then proposed to be levied against the real property
described in this Short Plat.
4. Nothing herein shall be considered as in any way
limiting the authority of the City of Tukwila to determine
the necessity for public improvements nor the manner or
method of providing the cost of their construction.
5. Should the existing improvements, as displayed on
Lot 2 of the short subdivision made pursuant to this Short
Plat, be razed during the five year period subsequent to the
filing of the Short Plat with the King County Department of
Records and Elections, and should a new improvement there-
after be constructed on said Lot within the same period, the
required front yard set back of the new improvement shall be
the lesser of (i) the distance as measured to the present
location of the southwesterly wall of such existing improve-
ment, or (ii) the distance as measured pursuant to the
front yard set back requirement of the ordinance in effect
at the time of such construction.
