Aiton and Robert Lennart and Patricia Lenhart, his wife, as Beneficiaries, the beneficial interest in which was partially assigned by Thomas S. Acton and Robert and Patricia Lenhart under an Assignment recorded under Auditor's File No. 8204010525. Chicago Title Insurance Company as Trustee, has resigned as Trustee ther.::n(1.r and John E. Sloan has l.avu appointee Trustee under said Deed of Trust. No action commenced by the Beneficiary of the Deed of Trust or the Beneficiary's successor is now pending to seek satisfaction of the obligation in any Court by reason of the Grantor's default on the obligations secured by the Deed of Trust. III The default(s) for which this foreclosure is made is /are as follow: Two Promissory Notes are secured by the above Deed of Trust. A. As of July 15, 1985, all principal and accrued interest became due and payable on the Promissory Note executed by Qestar Development Corporation in favor of Thomas S. Aiton and Robert Lennart and Patricia Lennart, his wife, which Promissory Note is secured by the above Deed of Trust. At present, the principal balance of the Promissory Mote is $178,511.75, plus interest from February 1, 1985, at 12% per annum. B. As of July 1, 1985, all principal and accrued interest became due and payable on the Promissory Note executed by Robert M. Lennart and Patricia L. Lenhart and Thomas S. Aiton to Daniel N. Cook and Nancy L. Cook, Davis M. Seiwerath and Mary Ann Seiwerath, Michael J. Rubel and Trine N. Rubel, Morris A. McCollum. Ferdy J. Kollar and Phyllis A. Kollar, and George B. Jay, which promissory Note is secured by the above Deed of Trust. At present, the principal balance of the Promissory Note is S70,406.02, plus interest from February 1, 1985. at 12%. IV The sum now owing on the obligation in favor of Thomas S. Alton and Robert Lenhart and Patricia Lenhart, his wife, secured by the Deed of Trust is: Principal 8178.511.75, together with interest as provided in the note or Ether instrument secured, from the 1st day of February, 1985, any advances as set forth in Paragraph III above, and such other costs and fees as are due under the note or other instrument secured and as are provir■d by statute. The sum now owing on the obligation in favor of Daniel H. Cook and Nancy L. Cook, Davis M. Seiwerath and Mary Ann Seiwerath, Michael J. Rubel and Trine M. Rubel, Morris A. McCollum, Ferdy J. Kollar and Phyllis A. Kollar. and George B. Jay, secured by the Deed of Trust is: Principal $70,406.02, together with interest as provided in the note or other instrument secured, from the 1st day of February, 1985, any advances Fihnlisep forth in Paragraph III above, and such other costs and fees as are due under tl:e'tnote or ot1jPr instrument secured and as are provided by statute. ' • : The above described real property will be sold to satisfy the expense of sale and the obligation secured by the Deed of Trust as provided by statute. The sale will be made without warranty, express or implied, regarding title, po ion or encumbrances on the 10th day of January, 1986. Since the principal balance is due and payable in full, the sale only may be terminated before the sale by the Grantor or the Grantor's successor -in- interest or the holder of any recorded junior lien or encumbrance, paying the entire principal and inte secured by the Deed of Trust, plus costs, fees, and advances, if any, made pursuant to the terms of the obligation and /or Deed of Trust and curing all other defaults. The Trustee whose name and address are set forth below will provide in writing to any- one requesting it, a statement of all costs and fees due at any tire prior to the sale. The effect of the *ale will he to deprive the Grantor and all those who hold by, through or under the Grantor of all their interest in the above described property. Anyone having any objection to the sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections if they bring a lawsuit to restrain the sale pursuant to RCw 61.24.130.
