A parcel of property owned by you and located at the
northwest corner of 65th Avenue and Southcenter Boulevard
in Tukwila was rezoned at your request by City of Tukwila
Ordinance #805 in August 1973. Ordinance #812, adopted
1 October 1973, amended Ordinance #805 in that if the
property was not cleared of unsightly debris and vegetation
within sixty (60) days from adoption of the amendment and
kept clear of debris and unsightly vegetation, then the
zoning shall revert back to R -4 zoning.
Due to your failure to comply with said condition, the
zoning of that property legally described in Exhibit "A"
to this letter is hereby reverted to R -4.

It has been drawn to our attention that the Planning Commission
and the City Council are considering a rezone on the property
which is known as the "Foremost Dairy site" on 65th Avenue
South and South 154th Street. The Housing Authority of the
County of King owns the property immediately to the north
of that site. The purpose of this letter is to make a
formal request that the Housing Authority, as property owners
to the north, be permitted to comment on the Environmental
Impact Statement of the property owners at such time as they
develop plans for construction on that site, if the site is
rezoned by the City Council.
Please advise us when the Environmental Impact Statement is
prepared and submitted to the City, so that we may have an
opportunity to comment.

RE: Reconsideration of Recommendation
Huntington Rezone , (Foremost Dairy)
The Tukwila Planning Commission was directed by Council
action on 2 July 1973 to reconsider it's recommendation
to rezone the old Foremost Dairy site to C -1 subject
to several restrictions. It was understood that
Condition #1 was considered too restrictive by the
Council and if recommendation was to remain favorable
suggested that Condition #1 be revised to preclude
retail sales outlets.
PLANNING DEPARTMENT
Upon discussion of Condition #1, including it's possible
future effects, the Commission generally felt the
elimination of retail sales outlets to be appropriate
and reviewed the allowable uses within the C -1 classifi-
cation to compile a list of service- oriented uses.
After discussion of these uses, it was officially moved
to resubmit to the City Council the Planning Commission's
original recommendation as amended by revising Condition
#1 as follows to preclude retail sales outlets:

A. Professional office space
• B. Artist's studios
C. Banks
D. Barber or beauty shops
E., Clinics, for people only
F. Dancing schools
G. Dyeing, dry cleaning or laundry

Continued Regular Meeting, 23 July 1973
HUNTINGTON REZONE RECONSIDERATION
Mr. Moss re- oriented the Commission of this item. The
Commission had held a Public. Hearing at the regular
February meeting and recommended, with conditions, to
the Council that the application be granted. The City
Council, by vote of 4 -3, denied the rezone request and
recommendation of the Commission. Staff, in behalf of
the Commission, requested reasons for denial and those
reasons were stated by the four dissenting Councilmen at
a public meeting of the Council. The reasons were
relayed back to the Commission by. Staff at Council's
request.
The regular meeting of 19 July 1973, having been recessed
until Monday, 23 July 1973, was called to order by
Chairman Mettler at 8:05 p.m. Members present: Mrs.
Harris, Mr. West, Mr. Link, Mr. Mettler, Mr. Kirsop,
Mr. Sneva, Mr. Saul, Mr. Zepp and Mr, Harrison.
Mr. LeRoy Bowen, representing the contract - purchaser
of the property, requested the City Council reconsider
it's action. Upon reconsideration of the matter by the
Council at it's meeting held 2 July 1973, the Council
passed a motion directing the Planning Commission review
the conditions for resubmittal, adding an item to eliminate
retail sales outlets and any other possible changes or
stipulations.
Commission had Staff read portion of Minutes of Meeting,
15 February 1973, including original recommending motion
together with the conditions. Discussed at length exactly
what uses would be appropriate and acceptable to the
Council. Noted in the 15 February 1973 minutes that

Mrs. Huntington, contract - purchaser, had agreed to the
restriction of uses to professional offices with the
exception of the beauty salon which requires the C -1
classification. Commission screened all allowable uses
in C -1 zone for only those which are service - oriented.
Motion by Mr. Sneva to resubmit to the City Council the
Planning Commission's original recommendation as amended
by rewording Condition #1 as follows and precluding
retail sales.

CUSTOM FURNITURE RENTAL
Staff informed Commission of Custom's appeal from the Sign
Code to erect building signs. Matter is complicated by
Staff's interpretation of the building's exterior decor
to be a unique sign. Staff displayed slides of building
and read definitions within the Sign Code regarding Sign
and Unique Sign. Also read Staff comments and recom-
mendations.
Chairman Mettler opened the Public Hearing.
Mr. John Richards, Building Official, stated he had
denied the application for building signs because the
requested signs were in excess of the allowable area per
the Sign Code. Also that he denied sign on north
building face because it does not front upon a street.
Displayed and explained some alternatives which would
comply with the Sign Code.

The Tukwila City Council, on Monday, 2 July 1973, heard .
an appeal from Mr. Leroy Bowen requesting reconsideration
of their denial of the requested C -1 rezone of the old
Foremost Dairy site. The City Council, in turn, referred
the application back to the Planning Commission for
reconsideration in regard to the restriction of uses to
be imposed on the requested zone.
The Planning Commission, however, must hold another
Public Hearing for reconsideration of the matter. Due
to publication requirements for Public Hearings, the
matter cannot be reviewed before Thursday, 16 August 1973'.
This letter shall constitute due notice of the Public
Hearing to be held and we respectfully request your
presence at that hearing to assi the Commission in the
review of your request. Any questions you may have may
be directed to this office at 242 -2177.

imposing special requirements on this property by way
of Restrictive Covenants. Such Covenants have been
drafted by the Staff and discussed with Mr. Bowen.
These Covenants require that uses and changes therein
be subject to review and approval by the Planning
Commission, that development or redevelopment of said
land shall be in accordance with plans approved by the
Planning Commission, that no building or structure be
located any nearer to any public right -of -way than a
distance equal to the height of such building or structure,
that landscaping shall be established and maintained
adjacent all property lines except for necessary drive-
ways, and that outside storage of goods or materials be
screened from view. Copies of these Restrictive Covenants
are included for the Commissions review (pink copies).
The subject property is not included in the City's present
Comprehensive Land -Use Plan.
RECONSIDERATION OF HUNTINGTON REZONE RECOMMENDATION
The City Council at their 2 July 1973 Public Hearing
Meeting voted to refer the subject matter back to the
Planning Commission with the request that the Planning
Commission reconsiders the restrictions to land uses
attached to the rezone recommendation that was forwarded
by the Planning Commission to the City Council. The
City Council felt that the subject property should be
restricted in use to allow only service type businesses.
The Council felt that any retail sales of goods or
products should be restricted for the subject site;
therefore, they have referred this matter back to the
Planning Commission for their reconsideration.
CUSTOM FURNITURE RENTAL - SIGN PERMIT APPEAL
Custom Furniture Rental has made application for sign
permits to the Tukwila Building Official. The application
included signs on the west elevation, the south elevation
and the north elevation of the building, the sign on the
west elevation was computed by the Building Official to
be 360 square feet in area, the sign on the south elevation
was computed to be 366 square feet in area and the sign
on the north elevation was computed to be 252 square feet
in area. The allowable sign area on the west elevation
would be a maximum of 150 square feet, the maximum allowable
signing area on the south elevation would be 85 square
feet and the maximum allowable signing area on the
north elevation would be 75.6 square feet according to

On 18 May 1973, this office directed a request, in behalf -
of the Planning Commission, for a definitive response
from the City Council as to it's reasoning for the denial
of a recommendation by the Planning Commission to rezone
the old Foremost Dairy site from R -4 to C -1.
This office, in turn, was instructed to forward the
requested response to the Commission in behalf of the
City Council. Inasmuch each dissenting Councilman
individually aired the reasons for their denial at the
Council Meeting of 21 May 1973, a copy of the minutes of
that meeting is attached for your perusal. The list
below reflects each individual's reason.
Mr. Johanson: Stated he does not believe that the
residential area should encourage
commercial development. Present zoning
allows development more suitable to a
residential area.
Feels the restriction of most C -1 uses
indicates insufficient justification.
Stated this particular parcel of land
has been his favorite site for City
Hall for 15 years and suggested it's
purchase.
Felt commercial uses should be precluded
in that area.

It has come to our attention that the City Council, at it's
regular meeting of 7 May 1973, voted to deny the request
for rezone, from R4 to Cl, by Mr. James Huntington, contract
purchaser of the old Foremost Dairy site.
The Planning Commission, at it's regular meeting of 15 Feb-
ruary 1973, held a public hearing complete with considerable
citizen input as well as extensive discussion with the
contract - purchasers and their representatives regarding this
particular request. Because of some doubt as to the effect
that the Comprehensive Park Plan should legally have on the
request, an opinion was requested from the City Attorney.
Upon receipt of the Attorney's response, the official recom-
mendation of the Commission was forwarded to the City Council
together with the reasoning behind the recommendation.
Upon learning of the Council's action taken 7 May 1973 in
regard to the Huntington rezone request and further acknowl-
edging that no reasoning or rationale was stated for such
action, the Planning Commission by general concensus directed
this department to address a request that the reasoning
behind the Council's action'be stated so as to satisfy the
recurring question of "Why ? ".
Thus, in behalf of the Planning Commission, this department
respectfully requests a response to the question of why the
recommendation of the Planning Commission was denied.

Public Hearing was taped for detailed reference should
this be needed. Enclosed herewith is a copy of the Minutes
of the Meeting held 15 February 1973 as well as a copy of
the Minutes of the Meeting held 15 March 1973 which amended
those minutes prepared for the 15 February 1973 meeting.
The relevant facts developed at the hearing were:
1. The property under petition is located at .
the northwest corner of the intersection of
65th Avenue South and Southcenter Boulevard.
2. The petitioners desire to construct a two or
three story building in which one floor will
house their existing beauty salon located at
'James Boutique' in Southcenter. Additional
tenants would be desired to utilize the re-
maining floor(s).

3. Preliminary development plans show the building
and parking lots to be constructed so as to
conform, as much as possible, to the natural
terrain of the property.
4. Due to the broad spectrum of allowable uses
within the Cl district, this site would require
strict limitations regarding uses so as not
to detract from the residential character of
the surrounding properties. Such limitations
should preclude high - volume, traffic - generating
retail services or convenience services.
5. The future widening of Southcenter Boulevard
necessitates provision, at this time, that
land be available for said future widening.
Mr. Steve Hall, Director of Public Works,
related the possibility of using land adjacent
to the south line of Southcenter Boulevard
rather than taking all the land necessary ,
from the north side. A determination has not
as yet been made in regard to this possibility.
6. Mr. Reid Johanson, 6425 South 153rd, objected
to the request as he feels it does not fit
in with the surrounding residential uses and
the Comprehensive Plan designates this area
as R4.
7. Mr. Dwayne Traynor, 14910 - 58th Avenue South,
objected to the request due to the allowable
uses under p1 zoning. Further stated that
any land required for street improvements
should be dedicated to the City, as has been
done in the past by other developments.
8. King County Housing Authority intends to
erect an office building on'the property
directly north of this site.
9. It was noted that Ordinance #546 adopted a
Comprehensive Park and Recreational Plan for
the City and designated a land area, extending

easterly along Southcenter Boulevard from
62nd Avenue to 65th Avenue, for public facil-
ities. However, it is the general concensus
of the Commission that the Park Plan appears
to be of a general study nature, rather than
an actual plan complete with time frames for
acquisition of land and implementation of
the plan, and should not be construed to bar
orderly development of privately owned property.
10. Petitioner agreed to comply with detailed
review of plans by the Commission to include
but not be limited to signing, architecture,
landscaping, circulation and parking.
Upon consideration of the foregoing basic facts, it was the
concensus of the Planning Commission that the request for
commercial zoning was in order. Further, the commercial
classification would be appropriate considering the com-
mercial and industrial land uses as well as Interstate
405 Freeway to the south, the remaining multi - family re-
sidential district to the north, and the fact the property
was used commercially for a number of years as the site for
the old Foremost Dairy.
Nine commissioners attended the Public Hearing regarding this
matter. Two commissioners dissented, feeling the Park Plan
should be adhered to as it was adopted by Ordinance.
Official action of the Commission in regard to this request
was as follows:
Motion by Mr. Lamb, seconded by Mr. Kirsop to recommend to
the City Council, dependent upon the City Attorney's ruling
in regard to the Comprehensive Park Plan, approval of
the request for rezone to Cl subject, to the following
conditions:
That the landowners enter into a contract agreement with
the City of Tukwila to include, but not be limited..to,:
following conditions:
1. Restriction of land uses to the following
types:

space.,
B. Beauty salon and men's hairstyling
salon.
C. Pick -up station for drycleaning ser-
vice, not to include any other food
or convenience service uses.
2. That preliminary and final design drawings and
criteria of the development be subject to
approval by the Planning Commission to include,
but not be limited to, the following points:
A. Signing and identification
B. Access and egress for parking areas
C. Landscaping
D. Parking
3. That a sidewalk be developed along Southcenter
Boulevard subject to alignment of grade and
location being approved by Director of Public
Works.
4. That sufficient land be available for future
widening of Southcenter Boulevard (not to be
more than 50% of total additional land required
for said widening.)
5. That the landowner agree to participate in any
future L.I.D. for said widening of Southcenter
Boulevard and other street improvements.
The phrase ' .., dependent upon the City Attorney's ruling
in regard to the Comprehensive Park Plan ... ' refers to a
motion passed by the Commission requesting a ruling from the
City Council

The regular monthly meeting of the Tukwila Planning Commission
was called to order by Chairman Mettler at 8:35 p.m. Members
present were: Mr. Lamb, Mr. Harrison, Mr. West, Mr. Kirsop,
Mr. Mettler, Mr. Link, Mr. Sneva, Mr. Saul and Mr. Zepp.
Chairman Mettler called for approval of the Minutes prepared
for the regular February meeting as well as the Special
Meetings held 22 February and 5 March 1973.
1. Change Minutes of 15 February 1973 to include
in statement of members present: Mr. Link.
2. Change Minutes of 22 February 1973, Page 2,
paragraph 5 to read: Mr. Kirsop revised the
definition of Animated Sign and Commission
directed Staff to further implement definition
in the body of the Sign Code with regard to
levels of illumination as well as rates and
intervals of flashing lights and backgrounds.
Mr. Moss explained again the dependency of items A, B, and C
on outcome of item E for which work meetings have been
scheduled. Also reminded Commission the Slade Way Rezone
has been tabled until the regular April meeting. Thus,
Mr. Moss suggested setting a date for the next work meeting
for review of the Comprehensive Plan.

NEW BUSINESS:
A. Underground Utilities Comprehensive Plan
Mr. Moss explained that all variances from Ordinance #486,
Underground Utilities, granted the past year required sub-
mittal of Comprehensive Plans for undergrounding of utilities
by all variance recipients before the third Thursday of
March 1973. Staff has scheduled a meeting with all utilities
concerned to insure a coordinated effort prior to review by
Planning Commission. Meeting is scheduled for 16 March and
plans as required should be prepared before the next regular
meeting.
Motion by Mr. Sneva, seconded by Mr. Harrison and carried to
extend the 15 March deadline for submission of Comprehensive
Plans for the undergrounding of utilities to 19 April 1973.
B. Temporary Use Permit - Schankel
Chairman Mettler read letter from Mr. Leon Schankel,
5436 South 1'50th, requesting renewal of the Temporary Use
Permit granted 17 March 1972 for construction and operation
of a greenhouse within a residential zone. Chairman also
read Staff recommendation regarding this matter (attached).
Staff presented slides depicting present conditions of the
greenhouse.
Motion by Mr. Saul, seconded by Mr. Zepp and carried to renew
the Temporary Use Permit subject to review by Staff upon
completion of the project and annual review by Staff there-
after to insure compliance with all City codes,
BOARD OF ARCHITECTURAL REVIEW
Benaroya South Addition - Temporary Sign
Mr. Moss displayed a rendering of a sign which the Benaroya
Company desires to erect on the site for new construction.
Dimensions were stated as 8' x 16'.
Motion by Mr. Harrison, seconded by Mr. Saul and carried
to approve the temporary sign as submitted for a maximum
period of 180 days, at which time an extension may be
granted.
Firestone T.. B. A. Proposal
Chairman Mettler read Andover A.C.C. Minutes which denied
this proposal on the basis that the intent of land use was
clearly identified at the time of purchase as industrial
rather than retail. Noted at this time that the plans
for this proposal should not have been forwarded to the
City by the Andover A.C.C General concensus of the
Commission to table this matter until such time as Fire-
stone makes application to the City for a building permit.
Don Koll Phase II
Mr. Sneva requested at this time he be allowed to step down
from the Commission so as to present the plans in behalf
of the Don Koll Company. Chairman Mettler granted the
request.
Chairman Mettler read Andover A.C.C. Minutes regarding this
project. Also read letters regarding the proposal from
Director of Public Works and Fire Department (attached).
Mr. Moss reiterated other department's comments regarding
the substandard extension of Industry Drive through the
project site and the problems related to it.
Motion by Mr. Kirsop, seconded by Mr. Harrison and carried
to approve the preliminary plot and elevation plans for the
Don Koll Andover Development Phase II, as submitted for
review and subject to the following conditions:
1. That water and sewer lines within the pro-
perty shall be privately owned and maintained
with all metering to be located at the
project property line.
2. Private hydrant and fire main layout to
meet approval of the Tukwila Fire Department.
3. That there be no regular vehicular access to
Christianson Road.
4. Detailed review and approval of final develop-
ment plans at such time they are developed.
5. Installation of a gateway on Industry Drive
at the property line with adequate signing
so as to clearly indicate the extension of
Industry Drive is private property.
6. Parking be adjusted East of Building #2 and
Southwest of Building #5 to improve vehicular
safety and fire access.
Chairman Mettler reminded those present of the Special
Meeting scheduled for next Thursday, 22 February 1973 at
8:00 p.m. to continue the Public Hearing for review of the
Proposed Sign Code.
Motion at this time by Mr. Saul, seconded by Mr. Link and
carried to adjourn the regular monthly meeting.

Renewal of Temporary Use Permit
The Planning Commission has been requested to review a
Temporary Use Permit that was granted to Leon K. Schankel,
5436 So. 150th Street on March 17th, 1972. When the
original permit was granted the following conditions
were placed upon the use:
1. Storage of all materials shall be adequately
screened from all adjacent residential pro -
perty.
2. Any sign or•means of signing shall comform
to the Sign Ordinance of the City of Tukwila.
3. Provisions be made for adequate off - street
parking subject to approval by appropriate.
City officials.
Upon inspection of Schankel's greenhouse on March 8, 1973
it was found that the screening and parking as required
have not yet been provided. Mr. Schankel indicated that
he was still in the process of completing the greenhouse
and that he intended to comply with all of the conditions as
set forth by the Planning Commission.
The Staff recommendation is for approval of the temporary
use permit renewal subject to review by the Staff upon
completion of the project.and annual review thereafter to
insure compliance with all City codes,

Andover Phase 1I
Dear Del;
The present portion of Industry Drive, which is completed, is approximately
540 feet in length which would place the terminus at the centerline of the
railroad easement as indicated on the plan lay out sheet as center line of
railroad for Andover Phase II. This road is developed to City standards
with a 60 feet right -of -way and with 1.5 foot utility easements located each
side of the right -of -way. The road cross section consists of 48 feet of
paved roadway plus curb and gutter sections. This is a standard City design
for this type of street within an Industrial or Commercial area. The
projected right -of -way within this portion of the development is 40 feet in
width, the development plans do not indicate a roadway section so that one
may be able to determine the true width of paving. Also, no utility corridors
are specified.
The parking in the radius portion of the property, which would be basically
the West, Northwest and North 12 feet of the parking space within the railroad
easement. In the City files is a map of property segregation for Puget Western
Inc. prepared by Robert B. Meriwether and Assoc. of Bellevue, Washington
indicating proposed roads and boundaries. The proposed 40 foot right -of -way
extending Industry Drive into the Andover Phase II Development is shown of
this drawing as being a 60 foot right -of -way and projected South to M.;nkler
Blvd. intersecting at the most Westerly boundary of the entrance road to the
City Shop Site. It is my recommendation that this plan be basically adhered to,
that Industry Drive be continued with a 60 foot right -of -way width with a minimum
of 10 foot utility corridors each side and preferably 15 foot corridors.
It ''further recommended that these streets be continued on the same cross section
as the existing portion of Industry Drive. As this development moves further
to the South Fire Protection and Police Protection will become even more difficult
because of the long distance on a dead end street.
Also, within this development the parking locations seem to be extremely
heavy at several buildings while practically nonexistent at others, examples
are buildings V and VI which would have adequate parking whereas building VII
has a minimum amount of parking available to this particular structure.
I have similar comments on other properties that develop along this proposed
line with basically substandard right —of —ways. My question is "At such time
as a development Corporation phases out what happens to the maintenance, the
upkeep and the responsibility of said private roads and utilities ? ". Also,
the control of these utilities becomes a problem. 1 recommend that the
Planning Commission and Staff take a. long hard look at this first phase of
the development to.be - sure we are not taking a step'in the wrong direction.

Re: Comprehensive Park Plan
I have previously forwarded a letter to the Mayor of
Tukwila advising him that in my opinion the adoption of
the Comprehensive Park Plan by Ordinance No. 546 is not.
valid.
There are a number of deficiencies in this Ordinance,
including the following:
1. There was no public hearing held by the Planning
Commission.

2. There was no recommendation by the Planning Commission
that it be adopted.
3. There is no timetable for acquisition or development
of the land, designated as park sites.
Under the circumstances the City cannot state in a general
way that it is going to use certain property in the City
for park or public purposes and make no provision for
acquiring the property.
In my opinion the courts will not construe this Ordinance in
such a manner as to bar orderly development of private land.
I have prepared an ordinance repealing Ordinance 546, but
at the last Council meeting this was tabled. Whether. the
Ordinance is repealed or not in my opinion should make very
little difference. The invalidity of the Ordinance is

1. The driveways are too narrow. The probability of
delivery trucks and cars parking next to the build—
ings will compound the access problem by narrowing
the driveways even more. They must accomodate
vehicles $ ft. wide x 40 ft. long with a minimum
turning radius of 38ft. (.76ft. turning circle) .
2. The 40 foot wide street through the complex should
maintain the 60 ft. width of Industry Drive.
3. Building #3 will be fully sprinklered per City Ordin—

/Public Hearing - Huntington Rezone
Chairman Harrison opened the Public Hearing of this
matter and Mr. Moss outlined request in that the pro-
perty owners desire to locate a beauty salon within a
two or three story building to be located on the old
Foremost Dairy property at the corner of Southcenter
Boulevard and 65th Avenue South. This development,
more particularly the use involved, would require C -1
zoning. Preliminary plans were displayed of the pro-
posal and numerous deficiencies in the plan were
pointed out by Mr. Moss, particularly traffic circulation,
actual building size and portions devoted to what actual
use, landscaping required for protection of surrounding
residential uses and other deficiencies.
Chairman Harrison asked for speakers in behalf of the
request.
Mr. Leroy Bowen, Bowen Real Estate, pointed out the
building would be constructed so as to conform as much
as possible to the natural terrain of property, thereby
eliminating any extensive grading or filling.
Mrs. Huntington, contract - purchaser of the property,
stated her husband was unavailable due to illness.
Stated they are presently in business at Southcenter
and operate the James Boutique which includes a beauty
salon. They desire to develop a building in which they
may operate a hairstyling salon with additional tenants
to occupy the remainder of the facility. Agreed that .
uses should be limited to those which would not detract

from the residential character such as high - volume,
traffic- generating retail services or convenient
services.
Chairman Harrison explained the broad spectrum of
allowable uses in C -1 zone; thus the Commission would
have to restrict the uses to preserve the residential
districts.
Mr. Link asked about future widening of Southcenter
Boulevard in relation to this proposal.
Mrs. Huntington stated they anticipate approximately
ten feet .of land could be purchased at the same appraisal
price (under R -4 zoning) they have paid if the City
does widen the road in the future.
Mr. Steve Hall', Director of Public Works for City of
Tukwila, stated an approximate 72 foot right -of -way
would be required to widen the road according to pre-
liminary plans. Also related the possibility of using
land adjacent to the south line of the street (between
Southcenter Boulevard and 1 -405) rather than the north
side. This determination has as yet not been made.
Chairman Harrison asked for speakers in objection to the
request.
Mr. Reid Johanson, 6425 So. 153rd, stated he objects
to the request as he feels it does not fit in with the
surrounding residential uses. Also the traffic generated
by the proposal would inhibit the residential character
of the area. Further stated the Comprehensive Plan
calls for R -4 zoning on that property.
Mr. Dwayne Traynor, 14910 - 58th Ave. So., stated he
objects to the request due to the possible uses allowed
under C -1 which would be detrimental to the residential
area as well as traffic generated by the proposal.
Further stated he felt that any land required for
future widening of Southcenter Boulevard should be
dedicated t'o: the City, as has been done in' the past
by other developments.
At this time it was moved by Mrs. Harris, seconded by
Mr. Link and carried to close the Public Hearing of this
matter, "

At the suggestion of Mr. Kirsop the Commission agreed
to hear the next Public Hearing regarding the property
immediately adjacent to this parcel before any action
is taken.
Special Use Review - King County Housing Authority
Chairman Harrison opened the Public Hearing of this
matter and Mr. Moss read letter from King County
Housing Authority requesting permission to develop an
office building within an R-4 district on that property
immediately north of the'old dairy site on 65th Avenue
South.
Chairman Harrison asked for speakers in behalf of the
request.
Mr. John Callies, Controller for King County Housing
Authority, was present to represent the Authority.
Mr. Callies read paragraph 8, Chapter 18.18 of the
Tukwila Municipal Code which states the requirements
that must be met to allow the development of an office
building within an R -4 zone. He stated the office
building will be used exclusively for the administrative
functions of the King County Housing Authority, will be
totally owned by King County Housing Authority, adjoins
or abuts a business or industrial district within the
same block and borders or fronts upon a street which is
the continuation of a street in the business or
industrial zone bordering the same block; the occupancy
will have no contact with the general public; and there
will be no merchandise handled or merchandising services
will be rendered on said premises. Also stated the
minimum parking requirements will be met.
Mr. Lamb asked who, in particular, would utilize this
office.
Mr. Callies stated the facility will be used as the
Central Administrative Office for the entire King County
Housing Authority. This location was chosen for its
ready accessability to freeways and due to high land
costs in the commercial and industrial area of the City
cannot afford to locate elsewhere. Particularly, HUD
officials associated with the Authority will be using the
facility, Further pointed out that possible cutbacks
in HUD funding may affect this project if delays are
involved. As of now, the Authority has a 'verbal agreement
with HUD to fund the project, therefore desire to get
this final action completed to facilitate funding
commencement.
Chairman Harrison asked for speakers in.-objection to
the request.
Mr. Reid Johanson, 6425 So. 153rd, stated he objects
to the request due to the commercial effect of the
proposal.
Mr. Sneva questioned whether the property met the
requirement of 'adjoins or abuts a business or industrial
district within the same block and borders or fronts
upon a street which is the continuation of a street in
the business or industrial zone' bordering the same
block.'
Lengthy discussion by Commission of this requirement.
Conclusion was made that (1) it may be interpreted to
meet this requirement due to portion of old Macadam
Road still being public street and (2) the requirement
would be met to the letter if the Huntington rezone
were granted. •
At this point, Mr..Kirsop moved and Mr. Saul seconded
to close the Public Hearing. Motion carried.
Mayor Todd, at this point, stated that a Park Plan,
adopted by City ordinance, designates both of these
properties to be used as public facilities. Therefore,
does the rezone require a change in the Park Plan as '
it relates to this land?
Mr. Moss pointed out that the ordinance which•adopted
the Park. Plan did not, in any way, supercede or repeal
or amend the City's Comprehensive Land Use Plan.
Further, the Park Plan, as referred to, does not include
any form of time frames for acquisition land and
implementation of the plan. Thus, it appears to the
staff, the Park Plan is . more in the line of a. general
study, not a plan, and should not bar orderly development
of privately owned property,
Discussion by Commission led to the concensus that an
opinion will have to be rendered by the City Attorney
in regard to the question posed by Mayor Todd.
Motion by Mr. Kirsop and seconded by Mr. Link that
whereas it appears to the Planning Commission the
Comprehensive Park Plan adopted by Ordinance #546 is
a general study and should not be construed to bar
orderly development of the area, the office building
proposed by the King County Housing Authority is
consistent with permitted uses within R -4 zoning and
the use permit is granted subject to detailed review
and approval of preliminary and final development plans
by the Planning Commission.
Motion carried with Mrs. Harris voting no on the basis
the Park Plan was adopted by City Ordinance and therefore
should be adhered to.
Motion by Mr. Link, seconded by Mr. Saul to request a
ruling from the City Attorney as to the legal status of
the Comprehensive Park Plan adopted under Ordinance #546.
Motion carried.
Staff directed to proceed accordingly upon receipt of
City Attorney's ruling as the granting of the use permit
is dependent upon this ruling.
This completed . action in regard to the request by King
County Housing Authority. The Commission then continued
discussion of the Huntington rezone request.
-- Mrs. Huntington stated the boutique portion of her
present operation would not be moved to this facility.
Stated possibly a travel agency, insurance office and an
accountant has tentatively agreed to locate here. More
in the line of professional offices with the exception
of a possible dry - cleaning pick -up station. Mrs.
Huntington agreed to comply with review of plans
regarding signing, architecture, landscaping, parking,
circulation, etc.
Motion by Mr. Lamb and seconded by Mr. Kirsop to recommend,
dependent upon the City Attorney's ruling in regard to
the Comprehensive Park Plan, to the City Council approval
of the request for rezone to C -1 subject to the following
condition:
That the landowners enter into 'a contract agreement with
the City of Tukwila to include, but not be limited to,
the following conditions:
1. Restriction of land uses to the following
types:
A. Professional and commercial '
office space
B. Beauty salon and men's hair-
styling salon.
C. Pick -up station for drycleaning
service, not to include any
• other food or convenience
service uses.
2. That preliminary and final design drawings and
criteria of the development be subject to
approval by the Planning Commission to include,
but not be limited to, the following points:
A. Signing and identification
B. Access and egress for parking
areas
C. Landscaping
D. Parking
3. That a sidewalk be developed along Southcenter
Boulevard subject to alignment of grade and
location being approved by Director of Public
Works.
That sufficient land be available for future
. .widening of Southcenter Boulevard (not to be
more than 50% of total additional land required
for widening) .
5. That the landowner agree to participate in any
future L.I.D. for said widening of Southcenter
Boulevard and other street improvements.
Motion carried with Mrs. Harris and Mr. Saul voting no.
Mr. Moss presented to each Commission member a copy of
the 6 -Year Park Program for acquisition and development
of parks and playgrounds. Commission directed staff to
establish a map depicting all parcels of property and
to mail a copy of the map to each Commissioner as soon
as possible.
The next group of.items on the agenda was BAR reviews.
Due to the late hour and the fact the majority'of the
remaining audience were waiting to hear item 0, the
Commission Agreed to review item]) first.
Concrete Wall in CM Zone
Mr. Moss informed Commission that Sammamish Commercial,
land development company, had erected a concrete wall
extending easterly from the southeast corner of the
Penney's Support Warehouse located at the southeast
corner of the intersection of Andover Park West and
South 180th Street.
The wall is four feet high, one foot thick and extends
53 feet across the railroad and lead tracks ending
within the property lines of the G.E. Office Building
located immediately east of the railroad right -of -way
between it and the Penney's Support Warehouse. Mr. Moss
informed the Commission the wall had been erected
without approval the Planning Commission as required
under Chapter 18.32 (CM District) as well as not
receiving a Building Permit from the. City.
Mr. Richard Black, Union Pacific Railroad, and Mr. Warren H.
Ploeger, Milwaukee Railroad, informed the Commission of
an agreement between the railroads and Puget Western
dated 1961.
Mr. Paul Iverson, representing Sammamish Commercial,
stated the wall had been erected to protect three parking
stalls from possible damage by a loose freight car.
Lengthy discussion by. Commission regarding the effects
of the wall, such as circulation, fire'protection and
future railroad crossing at that point.

denial. Mr. Pellegreni, of Foremost Properties,
requested that the rezone denial be reconsidered also.

Mayor Todd requested of Council, the expenditure of
Revenue Sharing Funds for contracting with Metro for
Bus Service within the City of Tukwila. There being
varying comments from Cuuncilmen on citizen need of a
Metro Bus Service within the City, it was MOVED BY
CRAIN, SECONDED BY STEVENS, THAT THIS MAYOR ANI) CITY
ATTORNEY BE AUTHORIZED TO ENTER INTO A CONTRACT
AGREEMENT WITH METRO FOR BUS SERVICE. Roll call vote
brought 3 AYES: Crain, Stevens, Hill. 3 NOS: Traynor,
Johanson and Gardner. Councilman. Traynor noted, at thi:
time, that he was for bus service but felt the City
should have a way to get "out" of the contract.
Councilman Johanson felt that the contract is too open
toward Metro Council and didn't feel that the people
wanted bt.is service. Councilman Gardner stated that he
would agree with Councilman Johanson's reasons. Mayor
Todd then stated that National Public Opinion Polls
show that money spent for Public Transportation is
considered to be well spent by the public and therefor(
voted for Metro Transit. The motion CARRIED.
Councilman Crain asked that the Mayor work towards
an agreement with METRO, that at the end of (i month::
could be terminated if seen to be non•fe;tsible. The
Mayor stating that if possible he would do !;o.

That Sec. 6 of Ordinance No. 805 be amended to read
as follows:.
Section 6. That if the above conditions have not been
met within four years of the effective date of this ordinance and
if the property is not cleared of unsightly debris and vegetation
within sixty days and kept clear of debris and unsightly vegetation
then zoning shall revert back to R -4 zoning,
