Minutes of the meeting, 6 November 1975.
The regular November meeting of The Tukwila Board of Adjustment was called
to order at 8:00 P.M. by Vice- Chairperson Altmayer. Members present: Mrs.
Crain, Mr. Bauch and Mrs. Altmayer. Gary Crutchfield, Assistant Planner,
represented the Planning Department.
Vice - Chairperson Altmayer called for approval of the October minutes. Motion
by Mr. Bauch, seconded by Mrs. Crain and carried to approve the minutes of the
October meeting as prepared.
OLD BUSINESS
III A Expiration of Variance - Val -Vue Sewer District
Mr. Crutchfield read the Staff Report briefly stating the background and the
fact the variance granted in November 1974 was about to expire due to the fact
the grantee had not fulfilled the variance stipulations as required by Section
18.72.020 (TMC). Further explained three alternatives for action, one of which
the Board should utilize at this meeting.
Brief discussion among Board members led to general conclusion that simply
extending the original variance would be a fruitless alternative.
Mr. Bauch stated that additional public monies should not be spent for structural
alterations, however, the use of the building should be restricted to housing the
emergency generator only.
Mrs. Altmayer asked if Val -Vue Sewer District had approached the Planning Depart-
ment in any manner since the granting of the original variance to attempt to
comply with any of the original stipulations?
Mr. Crutchfield stated he was not aware of any kind of effort on the part of
Val -Vue Sewer District.
Mr. Bauch pointed out the building was erected to protect the generator and if
the generator is not required to be there then the building does not need to
exist.

Mr. Terry Matelich, Val -Vue Sewer District, explained the generator is
absolutely necessary until some other viable technology can replace it.
Motion by Mr. Bauch to extend the original variance for a period of four
months. Motion was seconded by Mrs. Crain for purpose of discussion.
Board members briefly discussed the intent of the motion. Motion failed for
lack of majority vote.
Motion by Mrs. Altmayer and seconded by Mr. Bauch to extend the variance for
the life of the building with the following stipulations:
1. Obtain a building permit from the Tukwila Building Director to
include any authorized punitive fees.
2. Design a specific landscape plan, to be approved by the Planning
Department, including dense evergreen plantings.
3. That the building only be used for protection and housing of the
emergency generator necessary to protect the lift - station.
Motion by Mrs. Altmayer to amend original motion to require the building
permit be obtained and the landscape plan approved within thirty (30) days.
Motion to amend seconded by Mrs. Crain.
Motion to amend original motion carried.
Original motion, as amended, carried.
III B Board Vacancies
Vice - Chairperson Altmayer pointed out the Mayor had reacted to the Board's
letter by appointing two persons to our Board. The appointments are currently .
in the Council committee for recommendation.
Mrs. Crain asked why the Doce's signs are still in existence if they do not
conform to the Sign Code.
Mr. Crutchfield pointed out the City is currently adhering to all procedures
required by the Sign Code and that the signs must be removed by 14 November
1975 or an application for variance must be filed by 14 November 1975.
IV A PUBLIC HEARING - Variance - Underground Utilities (Seattle City Light)
Mr. Crutchfield read the affidavit of publication and noted the hearing had
been duly posted and property owners notified.

Mr. Tom Pace, 15215 - 51st Avenue South, stated that although he lived outside
the City he was curious as to what effect the additional overhead facilities
would have primarily on ameteur radio reception?
Mr. Tom O'Brien, Seattle City Light, stated technology has improved the insul-
ation of electrical lines considerably over the past few years and this addi-
tional line should have no noticeable effect. However, any problems would be
solved by Seattle City Light.
Mr. O'Brien further pointed out that Seattle City Light has been considering
for several years the trading of this service area to Puget Power in exchange
for another service area of Puget Power.
Mr. Pace asked why three -phase service is needed?
Mr. O'Brien stated three -phase service is necessary to provide adequate service
to the commercial property south of Southcenter Boulevard between 51st Avenue
and I -5.
Mr. Crutchfield read the Staff Report in its entirety including Findings,
Conclusions and Recommendation. Also noted the method of financing the under-
ground installation of the electrical service apparently has not been throughly
examined by either the utility company or the property owners as Chapter 13.08
specifically requires such undergrounding costs to be worked out between the
property owner and the utility company.
Mr. Bauch asked what the cost would be to provide service to the residences
existing on the commercially -zoned property?
Mr. O'Brien estimated the cost to be in excess of $500.each.
Mrs. Altmayer pointed out that if the variance is granted and three -phase
service is provided overhead along Southcenter Boulevard, then Seattle City
Light would never have to locate the lines underground as they could simply
provide three -phase service to future commercial developments in the vicinity
without any additional rebuild or relocation which would necessitate undergrouding.
There being no further comments from the audience, Vice- Chairperson Altmayer
closed the Public Hearing at 9:25 P.M.
Motion by Mr. Bauch that variance be denied based on the findings and conclu-
sions of the Staff Report. Motion seconded by Mrs. Crain and carried unani-
mously.
Motion by Mrs. Crain, seconded by Mr. Bauch and carried to adjourn the regular
November meeting.

AGENDA ITEM III A Val -Vue Sewer District Variance
As most of the Board members will recall, Val -Vue Sewer District was granted a
variance from Section 18.76.050 (setbacks for public utility buildings) with
several stipulations which were to be conformed to and without any specification
as to the time period for which the variance would be effective. Val -Vue Sewer
District has not applied for a building permit in accordance with the plans for
which the variance was authorized and neither has the District complied with
any of the stipulations of the variance granted it.
Section 18.72.020 (TMC) explicitly voids a variance upon the expiration of one
year (unless specified otherwise) if no building permit has been issued in
accordance with the plans and conditions upon which the variance was granted.
The Board may, however, extend the authorization period of such variance upon
the finding of the Board that there has been no basic change in the pertinent
conditions surrounding the property since original approval of the variance.
The Planning Department offers the following alternatives for the Board's
consideration of this matter.
ALTERNATIVE #1:

The Board may extend the original variance and stipulations
for a specified period of time.
The Board may extend the original variance for a specified
period of time and alter the stipulations of the variance as
appropriate.
Upon expiration of the original variance and non - compliance
by Val -Vue Sewer District, the Board may pursue legal action
to bring about compliance with the original variance stipulations.
The City Attorney has assured the Planning Department of the legal validity of
these alternatives and has also suggested the Board conduct a Public Hearing if
Alternative #2 is considered as the best course of action.

Minutes of the Meeting, 2 October 1975.
The regular October meeting of the Tukwila Board of Adjustment was called to
order at 8:07 P.M. by Vice - Chairperson Altmayer. Members present were: Mrs.
Altmayer, Mr. Bauch and Mrs. Crain. Mr. Gary Crutchfield, Assistant Planner,
represented the Planning Department.
Vice - Chairperson Altmayer noted the resignation of Chairman Rogers Brown and
the fact that two (2) members have resigned in as many months. This leaves
three members on the Board and all three must be present to attain a quorum, .
in accordance with the By -laws.
Motion by Mrs. Crain, seconded by Mr. Bauch and carried to direct a letter to
the Mayor reminding him of the two vacancies now existing on the Board.
Vice - Chairperson Altmayer called for approval of minutes.
Motion by Mr. Bauch, seconded by Mrs. Crain and carried to approve the minutes
of 21 August 1975 as prepared.
Motion by Mr. Bauch, seconded by Mrs. Crain and carried to approve the minutes
of the Special Meeting held 30 September 1975 at the site of the Val -Vue Sewer
District lift station on 53rd Avenue South.
A. Val -Vue Sewer District - Com•liance with stipulations of variance.
Vice - chairperson Altmayer read aloud the stipulations of the variance granted
in November 1974.
Mr. Bauch stated he feels no more public monies should be spent. However, feels
the building was built for convenience and the use of such buildings should be
restricted to protection of emergency generator buildings only and at time
as the generator is not needed or the use of the building changes to other than
that, it should be removed.

Mrs. Crain stated she felt the Board could not restrict the use of the
building in relation to the variance.
Dwayne Traynor commented from the audience that there are so many instances
of incompatible land uses in residential areas that the Board should hold
their ground.
Mrs. Crain expressed frustration in terms of granting variances that are not
enforced.
Vice - Chairperson Altmayer expressed some disagreement with Val -Vue's estimate
of compliance costs in relation to the Staff's estimate.
Mr. Bauch expressed the opinion that any costs would come out of the operating
expenses of the District which is funded by the residents within the District's
service area.
Mrs. Crain moved to reaffirm the stipulations of the original variance. Motion
died for lack of a second.
Mr. Bauch moved the original variance be amended to allow the building to exist
as constructed with the use of such building being limited to the storage of the
emergency generator only and no other use of the building allowed; in the event
the emergency generator is no longer stored there, the building shall be removed.
Motion died for lack of a second.
Mr. Crutchfield suggested the Board defer action on this matter for one month
due to the fact Chapter 18.72 restricts variances to one year unless the Board
stipulates otherwise; they have not in this case.
Motion by Mr. Bauch, seconded by Mrs. Crain and carried to defer action on this
matter until the next regular meeting.
NEW BUSINESS:
A. PUBLIC HEARING - Variance - Midway Wholesale Distribution.
Mr. Crutchfield described the proposed action and variance request by Midway_
Wholesale, located at 13140 - 56th Avenue South in that a variance has been
requested from Section 18.56.055 (TMC).
Vice- Chairperson Altmayer opened the Public Hearing at 8:45 P.M.
Mr. Crutchfield read the findings of the Staff Report and explained the
conclusions contained therein.
Mr. Gary Uderitz, 13140 - 56th Avenue South, stated the new truck doors would
be for loading only. Expressed disagreement with conclusions #1, 4 and 6 of
the Staff Report. Stated the cost of his proposal to provide tall screening

The Tukwila Board of Adjustment, at its regular meeting conducted 6 November
1975, reviewed the variance granted to Val -Vue Sewer District in November 1974
and which was to expire this date.
In accordance with and as authorized by Section 18.72.020 of the Tukwila Munici-
pal Code, the Board voted to extend the variance.for the life of the building
with the following stipulations:
1. Obtain within thirty (30) days a building permit from the Tukwila
Building Director to include any punitive fees.
2. Design a specific landscape plan, to be approved by the Planning
Department within thirty (30) days, to include dense evergreen
plantings.
3: That the building only be used for protection and housing of the
emergency generator necessary to protect the lift- station.
These stipulations replace those of the original variance granted in November
1974. Moreover, the variance is now valid for the life of the building . as long
as the building is being utilized as emergency generator housing. Any other use
of the building will invalidate the variance unless approved by the Board of
Adjustment upon your request. Finally, the building permit must be obtained
within thirty (30) days from this date as well as approval of a landscape plan
which includes densely planted evergreen plantings.
This office looks forward to your expeditious fulfillment of those stipulations
in order to resolve the longstanding problem. Should you have any questions

Variance granted Val -Vue Sewer District
DATE: 15 Oct. 1975
A variance was granted to Val -Vue Sewer District, with conditions, on 7
November 1974 by the Tukwila Board of Adjustment without specifying an
expiration date. Section 18.72.020 voids a variance if after one (1) year
a building permit has not been issued in accordance with the plans and
conditions of the variance, unless the expiration period is stated in the
granting of the variance. To date a building permit has not been issued Val -
Vue Sewer District with respect to that variance.
The Board of Adjustment should take some action on this matter at their
regular November meeting scheduled for 6 November 1975. I have listed
alternatives below and would like your concurrance or clarification
regarding them or any other alternatives in a legal sense.
I. Extend the variance for a specified period of time with the same
conditions previously attached.
2. Extend the variance for a specified period of time with altered
conditions attached.
3. Upon expiration of the variance, pursue legal action to bring about
compliance with conditions of the variance.
Beyond the legal validity of these and any other alternatives you may see, do
any of the above actions require another Public Hearing? Please indicate any
response in writing as soon as possible that I may take appropriate steps.

A meeting of Val -Vue Sewer District representatives and Board of Adjustment
members was conducted at the site of the lift station on 53rd Avenue South
for which a variance had been granted by the Board in late 1974. The purpose
of the meeting was to discuss the conditions imposed by the Board in granting
the variance and the reasons Val -Vue had not complied with those conditions
as yet.
Board members present were Mr. Bauch, Mrs. Altmayer and Mrs. Crain. Represent-
atives of Val -Vue Sewer District were Mr. Terry Matelich and Mr. Butters. Gary
Crutchfield represented the Planning Department and Mayor Todd was also present.
Mr Crutchfield explained the background of the variance and how it came about
as documented in the public hearing minutes and Staff Report on the matter.
Mr. Matelich explained that he had sent a plan of the proposed lift station
to the Public Works Department for approval. They had received no objection
to the plan after several months and assumed approval.
Mr. Crutchfield pointed out the City Staff was somewhat at fault due to the
fact the Planning Department had never seen the site plan prior to erection
of the building.
Mr. Bauch asked why Val -Vue had made no effort to comply with the conditions
of the variance granted for the building.
Mr. Matelich stated the estimated cost of compliance was in excess of $10,000.
Mr. Crutchfield stated the city planning and building departments had estimated
the total cost would not exceed $3,000.
Mr. Butters indicated that whatever the cost the LID participants would have to
assume the burden. Also indicated that the residents across the street were
pleased with the project.
Mr. Bauch indicated he had spoken to at least one person who had expressed
some dislike.
Mr. Bauch, Mrs. Altmayer, Mrs. Crain and Mr. Matelich proceeded in a group
to seek the opinion of the surrounding residents. The meeting concluded at
5:00 P.M.

Pursuant to the suggestion made by you and related to this office by Mayor

setback requirements granted by the Tukwila Board of Adjustment for the lift

It is anticipated that the Board members will travel to the actual site
accompanied by Planning Department staff and possibly Mayor Todd. If it all
possible, it is suggested that a representative of Val -Vue Sewer District who
is also knowledgable of the facts surrounding this matter be present at that
time to explain the reasoning behind the position that Val -Vue Sewer District
appears to have assumed.

Dear Mayor Todd:
The Tukwila Board of Adjustment, at a special meeting conducted 21 August
1975, discussed as an item of old business, the failure of Val -Vue Sewer
District to comply with the stipulations of the variance granted at their
request.
The Board voted unanimously to direct the Board secretary to remind you of
this matter in writing and request that you direct the Building Director to
address a written order to Val -Vue Sewer District to comply with the variance
stipulations.
The Board feels the matter should be resolved one way or the other and
respectfully requests the matter be pursued in the direction indicated in
Mr. Parker's letter.of 9 April 1975.

The Tukwila Board of Adjustment, at a special meeting conducted 21 August
1975, discussed as an item of old business, the failure of Val -Vue Sewer
District to comply with the stipulations of the variance granted at their
request.
The Board voted unanimously to direct the Board secretary to remind you of
this matter in writing and request that you direct the Building Director to
address a written order to Va1 -Vue Sewer District to comply with the variance
stipulations.
The Board feels the matter should be resolved one way or the other and
respectfully requests the matter be pursued in the direction indicated in
Mr. Parker's .letter of 9 April 1975.

RE: VARIANCE - Val -Vue Sewer District
The Board of Adjustment granted a variance to Val -Vue Sewer District in
November of 1974. The variance was granted to allow a building which
. was already constructed to be located closer to the public right-of
than dictated by the Tukwila Municipal Code. In the Board's. review of•
the matter, however, it was discovered that the building could be moved
so as to keep the building and landscape on private property rather than:
in the public right -of -way. Attached is a copy of the letter addressed .
to Val -Vue Sewer District informing them of the stipulations of the
variance.
To the best of the Board's knowledge, Val-Vue, to this date, continues
to ignore the matter and has not fulfilled any of the conditions of the
variance. The attached letter from Mr. Wayne Parker, City Attorney, de-
scribes a method which should be followed to take action on the matter.
Although the Board of Adjustment sits as a quasi.- judicial body whose de-
cisions can only be appealed to a court of law, the Board does not main-
tain any degree of enforcement. The Board must rely on the expertise of
the administration for such important tools and hereby requests that the
administration take appropriate action in this matter with Val -Vue Sewer
District. Certainly you must agree that the Board would be performing
nothing but an exercise in futility should its decisions go unrecognized.

AFFIDAVIT
I, A. J. Pieper, Tukwila Building Inspector, being
first duly sworn, on his oath says the subject building is
located on the east side of 53rd Ave. So., approximately 200
feet south of South 170th.
On August 27, 1974, while on a routine trip past the above
location, I observed work progressing on a building.
On August 28, 1974, the building was substantially completed.
I posted a correction notice, (copy attached) which notified
all parties that the subject building was in violation of the
building codes, namely Section 301 (copy attached).
In order to assure that all concerned parties were aware of
the violation, I called Terry Matelich of the Val Vue Sewer
District, Frank Coluccio, and Bob Stanton of Ken Yoshida's
office. I requested that anyone who was responsible for the
violation contact either Barney Ruppert or myself to start
proceedings to correct the violation.
We were not contacted. On or about September 20, on another
of my routine trips, I observed a workman preparing to install
electric service. The correction notice was still posted. I
informed the workman that the correction notice should not be
violated and the workman left.
I called Bob Stanton again and informed him that any work on
this building would be in further violation. He stated that
everything was all taken care of and that the correction notice
was lifted. Since I would be the one to "lift" the notice,
I knew this had not happened.
Mr. Stanton asked what the trouble was, and I replied that the
building did not meet the setback requirements and no permit
had been issued or applied for. Mr. Stanton stated that the
plans had been accepted by Duncan Sturrock, the Tukwila Office
Engineer, and that everything had been approved. I stated that
Duncan Sturrock was not the Building Director and could not
approve the erection of a building without a building permit.
I also stated that I had left a request to contact either
Barney Ruppert or my self and that we had not been contacted.
Therefore, my request had been ignored.
After the preceding telephone conversation, Mr. Stanton did
come to the office of the Building Director to discuss a permit.
It was agreed that we would permit the interchange of the two
ends of the building, but they would still need a permit. We
informed him that we could not issue a permit when the building
did not meet the setback requirements.
On September 30, the two ends of the building were interchanged.
Since then, the building has been wired with underground service.
On November 1, 1974, a fence was installed.
These items have been done even though there still is no permit
for the building. As of this date, a permit has not been
applied for and, further, everybody connected with this building
has been aware that the building may not be permitted to exist
in its present location.

(b) Plan- checking Pecs. When the valuation of the proposed

Inspections
Sec. 304. (a) General. All construction or work for which a permit
is required shall be subject to inspection by the Building Official, and
certain types of construction shall have continuous inspection by spe-
cial inspectors, as specified in Section 305.
A survey of the lot may be required by the Building Official to verify
compliance of the structure with approved plans.
(b) Inspection Record Card. Work requiring a building permit shall
not be commenced until the permit holder or his agent shall have
posted an inspection record card in a conspicuous place on the front
premises and in such position as to allow the Building Official conven-
iently to make the required entries thereon regarding inspection of the
work. This card shall be maintained in such position by the permit
holder until the Certificate of Occupancy has been issued.
(c) Approvals Required. No work shall be done on any part of the
building or structure beyond the point indicated in each successive
inspection without first obtaining the written approval of the Building
Official. Such written approval shall be given only after an inspection
shall have been made of each successive step in the construction as
indicated by each of the inspections required in Subsection (d).
There shall be a final inspection and approval on all buildings when
completed and ready for occupancy.
(d) Required Inspections. Reinforcing steel or structural frame-
work of any part of any building or structure shall not be covered or
concealed without first obtaining the approval of the Building Official.
The Building Official, upon notification from the permit holder or
his agent, shall make the following inspections and shall either approve
that portion of the construction as completed or shall notify the permit
holder or his agent wherein the same tails to comply with this Code.
1. FOUNDATION INSPECTION: To be made after trenches are
excavated and forms erected and when all materials for the foun-
dation are delivered on the job. Where concrete from a central
mixing plant (commonly termed "transit mixed ") is to be used,
materials need not be on the job.
2. FRAME INSPECTION: To be made after the roof, all framing,
fire - blocking, and bracing are in place and all pipes, chimneys,
and vents are complete.
3. LA'T'H AND /OR WALLBOARD INSPECTION: To be made
after all lathing and/or wallboard, interior and exterior, is in
place; but before any plastering is applied or before wallboard
joints and fasteners are taped and finished.
4. FINAL INSPECTION: To be made after building is completed
and ready for occupancy.
(c) Other Inspections. In addition to the called inspections spec-
ified above, the Building Official may make or require any other
inspections of any construction work to ascertain compliance with the

Board of Appeals
See. 204. In order to determine the suitability of alternate materials
and methods of construction and to provide for reasonable interpreta-
tions of the provisions of this Code, there shall be and is hereby created
a I3oard of Appeals, consisting of five members who are qualified by
experience and training to pass upon matters pertaining to building
construction. The Building Official shall be an ex officio member and
shall act as Secretary of the Board. The Board of Appeals shall be
appointed by the Mayor and shall hold office at his pleasure. The Board
shall adopt reasonable rules and regulations for conducting its investi-
gations and shall render all decisions and findings in writing to the
Building Official with a duplicate copy to the appellant and may
recommend to the City Council such new legislation as is consistent
therewith.
Violations and Penalties
Sec. 205. It shall be unlawful for any person, firin, or corporation to
erect, construct, enlarge, alter, repair, move, improve, remove, convert
or demolish, equip, use, occupy, or maintain any building or structure
in the city, or cause the same to be done, contrary to or in violation of
any of the provisions of this Code.
Any person, firm, or corporation violating any of the provisions of
this Code shall be deemed guilty of a misdemeanor, and each such
person shall be deemed guilty of a separate offense for each and every
day or portion thereof during which any violation of any of the provi-
sions of this Code is committed, continued, or permitted, and upon
conviction of any such violation such person shall be punishable by a
fine of not more than $300 or by imprisonment for not more than 90
days, or by both such fine and imprisonment.

Chapter 3
PERMITS AND INSPECTIONS
Application for Permits
Sec. 301. (a) Permits Required: No person, firm, or corporation shall
erect, construct, enlarge, alter, repair, move, improve, remove, con-
vert, or demolish any building or structure in the city, or cause the same
to be done, without first obtaining a separate builcling:permit for each
such building or structure from the Building Official.
(b) Application. To obtain a permit the applicant shall first file an
application therefor in writing on a form furnished for that purpose.
Every such application shall:
1. identify and describe the work to be covered by the permit for
which application is made; •
2. Describe the land on which the proposed work is to be done, by
lot, block, tract. and house and street address, or similar descrip-
tion that will readily identify and definitely locate the proposed
building or work;
3. Indicate the use or occupancy for which the proposed work is
intended;
4. Be accompanied by plans and specifications as required in Sub-
section (c) of this Section;
5. State the valuation of the proposed work;
6. Be signed by the permitter, or his authorized agent, who may be
required to submit evidence to indicate such authority;
7. Give such other information as reasonably may be required by
the Building Official.
(c) Plans and Specifications. With each application for a building
permit, and when required by the Building Official for enforcement of
any provisions of this Code, two sets of plans and specifications shall
be submitted. The Building Official may require plans and specifica-
tions to be prepared and designed by an engineer or architect licensed
by the state to practice as such.
EXCEPTION: When authorized by the Building Official plans and
specifications need not.be submitted for the following:
I. One-story buildings of Type V conventional woodstud construc-
tion with an area not exceeding 600 square feet.
2. Group 1, Division 1, Occupancies of Type V conventional Nyood-
stucl construction.
3. Small and unimportant work.
(d) Information on Plans and Specifications. Plans and specifica-
tions shall be drawn to scale upon substantial paper or cloth and shall
be of sufficient clarity to indicate the nature and extent of the :work
proposed and show in detail that it Nvill conform to the provisions of
this Code and all relevant laws, ordinances, rules, and regulations. The
