The Colonial House Development, to be located at Southcenter Boulevard and 53rd Avenue, was granted two (2) variances in early 1974. 1. VARIANCE from 60' R/W width: Due to length of 53rd Avenue, Steve wanted 50' R/W with 80' (diameter) cul -de -sac. Planning Commission, in rezoning parcel lying west of 53rd Avenue, obtained agreement to provide 10' additional R/W along west side of 53rd, hence gaining 50' total R/W when it develops. Based on this assurance of 50' R /W, Commission granted variance from 60' R/W requirement with the stipulation that a Developer's. Agreement be executed between Colonial and City to establish street development requirements as Steve sees fit. 2. VARIANCE from setback of parking surface edge: This one is simple enough — allows parking stalls to be closer to edge of road than required by code — no conditions. Both variances were granted in January 1974. A variance becomes void after one (1) year if a permit for the variance - approved plans is ta't obtained within that year. To the best of my knowledge, no permit has been issued since either variance was granted; HENCE, neither variance. is valid. Motion by Mr. Kirsop, seconded by Mr. Sneva and carried to grant the variance from Chapter 18.56.040 subject to arrangement of a developer's agreement suitable to the Director of Public Works. ARCO Sign Review Mr. Hansen read Staff comments explaining that the proposed sign does not conform with the Sign Code. Mr. Kenneth Flynn, ARCO, withdrew his request for approval as.he did not wish to create controversy. Public Hearing - Rezone —King County Transfer Station Mr. Hansen reminded Commission the Public Hearing for this matter has been readvertised for 31 January 1974, next Thursday. Public Hearing - Variance - Hall. Mr. Hansen read Staff comments and advertisement. Chairman Mettler opened the Public Hearing at 9:02 p.m. No one was present to speak for or against the request. Chairman Mettler closed the Public Hearing at 9:04 p.m. Mr. Lamb noted the condition of the existing facility and regarding the proposed develdpment as a vast improvement . over the present operation. Motion by Mr. Lamb, seconded by Mr. Link and carried to grant the variance from Chapter 18.56.040 as the shape of the property prohibits dedication of additional right -of -way and the nature of the proposed facility will not generate a burdensome amount of traffic. What hardship exists making this variance necessary? _a eve 1 opment sue, nter. sit S, n a very awkward narrowing triangle making it extreme ty di fficult for any kind of development, especially a reasonable parking arrangement. This burden which is unique to this piece of land causes an extreme hardship to exist. Requiring the owner to give an additional 10' of property for Right of Way would render the property unuseable to the owner for the use proposed and would probably mean that the landscape people leasing the property would continue their occupancy. The area of the horizontal projection of this space is 6,468 square feet. ANSWER TO QUESTION #2: Required street widths for cul -de -sacs less than 500 feet is 50' right of way. In recent action adopted by Planning Comm. additional 10' R/W as obtained from property on west, making the street a 50' right of way. However, the additional 10' of Right of Way to the west will not be available until the property to the west of 53rd is developed. Therefore, technically the right of way will be only 40'. The cul -de -sac as it presently exists will be a little over 300' long. Our total impact of cars on this 40' right of way is only 29 cars which we have provided parking for. This will be less of an impact than what already exists.
