A. VARIANCE - International - Harvester.
International- Harvester, a truck slaes and service company,
has applied for a variance (from Section 17.08.010, right -
of -way requirement) to allow the construction of a facility
to be located on 48th Avenue South.
Historical background is essential to the consideration of
factors in this case. The improvement of 48th Avenue South
was initiated on September 24, 1969 when the City Council,
in response to a request by the property owners involved,
passed a motion that the City of Tukwila enter into an
agreement with the property owners for a 50 -foot street in
line with presentations by Hill, Ingman & Chase, the City
Engineers at the time, and at the same time granting a
10 -foot variance from the minimum 60 -foot standard. More
recently, an identical' variance application was granted by
the Planning Commission to the Hertz Corporation to allow
the construction of a similar facility on 48th Avenue South.
FINDINGS & CONCLUSIONS
Application of variance criteria:
A. The granting of this variance will not constitute
a grant of special privelege inconsistent , with the
limitation upon uses of other properties in the
vicinity and in the same zone. (Due to the variance
previously granted by the Planning Commission to a
similar land use in the immediate vicinity.)

B. The variance is necessary because of the
location and surrounding of the subject
property. (Due to the existing sub - standard
right -of -way which serves all properties
fronting on 48th Avenue South.)
C. The special conditions and circumstances
do not result from the actions of the
applicant. (The City Council approved
the construction, by ordinance, of the
sub - standard right -of -way.)
D. The granting of such variance will not be
materially detrimental to the public welfare
or injurious to the property or improvements
in the vicinity.
E. The granting of the variance will not adversely
affect the implementation of the comprehensive
land use plan.
F. The granting of the variance is necessary for
the preservation and enjoyment of a substantial
property right of the applicant possessed by the
owners of other properties in the same zone
and vicinity.
Conditions to granting of the variance:
Section 17.08.010 requires a minimum right -of -way width
of 60 feet to serve all commercial and industrial land
4uses: It also requires 10 foot utility easements•on
both sides of the right -of -way. This utility easement
would contain utilities such as water, electricity and
telephone as the sanitary and storm sewers are already .
located within the street.
STAFF RECOMMENDATION
The literal enforcement of the minimum right -of -way
requirement would place an unnecessary hardship on
the applicant and, moreover, would not improve the
overall right -of -way to any degree in light of the
recent variance granted to another parcel for a very
similar use on the opposite side of 48th Avenue. In
consideration of the aforementioned history, facts
and conclusions, Staff recommends the.variance_

Section 17.08.010 be granted indefinitely with the
stipulation the property owner dedicate a 10 foot
utility easement along the north line of 48th Avenue
South.
Due to the rather permanent nature of 48th Avenue South
as a sub - standard right -of -way and the granting of
previous variances, Staff further recommends the Board
of Adjustment direct an advisory statement to the
Planning Director that all property owners fronting on
48th Avenue South be informed of the merit of a joint
application for variance from Section 17.08.010
(minimum right -of -way) in preference to the piece -meal
manner of the recent past.
B. VARIANCE - Val -Vue Sewer District
Val -Vue Sewer District has applied for a variance
from Section 18.72.050 (setback requirement for
public utilities) on an irregular- shaped parcel
of property located on 53rd Avenue South, south
of the intersection of South 170th Street.
STAFF FINDINGS
The parcel of property was purchased by Val -Vue
Sewer District, in connection with their U.L.I.D. #6,
to accomodate the construction of a sewage lift
station. The parcel is bounded by the I -5 Freeway
aright -of -way on the east and 53rd Avenue South on .
the west. The north property line is 54 feet while
the south property line narrows to 28 feet. Running
easterly just north of the center of the property
and toward the 1 -5 Freeway is an 18" storm drain line.
The thick dark line running easterly at the north
end of the property indicates the Olympic Pipeline,
while the gray area on either side designates the 20
foot easement to protect the pipeline (This easement'
cannot be used for construction). Due to the unbuild-
able nature of the easement, the buildable property is
reduced to that area located south of the easement, as
there is not adequate area north of the easement for
construction.
