The Tukwila Planning Commission, at its adjourned
regular meeting of 9 May 1974, reviewed the revised
site plan for project #734. The revised plan was
approved with the stipulation that the Planning
Commission approve a Master Landscape Plan prior
to issuance of an occupancy permit.

Adjourned Regular Meeting, 9 May 1974
5. Replace the word 'boxcars' with the
term "railcars" in the definitions of
both Lead Track and Spur Track.
Following a brief discussion regarding the overall .
revisions made by the Planning Commission, a motion was
made by Mr. Kirsop that the Tukwila Planning Commission
recommends to the City Council adoption of the Shore-
line Master Program, including the amendments incorporated
by the Planning Commission. These amendments were adopted
after lengthy Public Hearings and following review of
the Environmental Impact Assessment Summary, performed
for 'the City by Wilsey & Ham, and do take into account
the major objections to the Program. It is further,'
recommended that the City Council amend the Comprehensive.
Plan of the City to reflect this Shoreline Master Program.
The motion was seconded by Mr. Lamb and carried unanimously.
The second item of consideration was the revised site plan
for Project #734 of the Segale Business Park. Mr.
Crutchfield presented the plan, explaining the revision
and noting the area of land lying between the building
and the River would be dealt with through the Shoreline
Management Permit application, now at the State level.
Motion by Mr. Link, seconded by Mr. Lamb and carried to
approve the site plan as revised subject to approval of a
Master Landscape Plan prior to issuance of occupancy permit.
A committee meeting was agreed upon and scheduled for
7:30 p.m. Thursday, 16 May 1974, at the Council Chambers.
Committee members are Mr. Sneva, Mr. Link and Mr. West.
Motion by Mr. Kirsop, seconded by Mr. Link and carried
to adjourn this adjourned regular meeting.
Chairman Mettler adjourned at 9:40 p.m.

would•be in the area of $5,000 and that it is only used
from May through September to irrigate the grass of the
golf course. The overhead lines are screened by large
trees as well as the house and wouldn't be visible except
to those using the golf course in that immediate vicinity.
No one was present to speak against the request and
Chairman Mettler closed the Public Hearing at 9:02 p.m.
Motion by Mr. Zepp, seconded by Mr. West and carried to
grant the variance with the acknowledgement that these
as well as other overhead facilities will be undergrounded
at such time any .future comprehensive plan' for such
undergrounding dictates.
BOARD OF ARCHITECTURAL REVIEW:
Site Plan Review - #734 Segale Business Park
Gary Crutchfield explained site plan noting the inclusion
of the trackage to the east of the building, omission of
elevations, lack of tenancy identification and landscape
plans.
Discussion by Commission led to motion by Mr. Kirsop to
reject the site plan and suggest the applicant revise
the plan to include the following points.
1. Eliminate one lead track.
2. Setback far enough so the spur track is
outside what is termed, by the proposed
Master Program, as the River Zone.
3. Include landscaped berm between the lead
and spur tracks.
4. Indicate additional parking area to accom-
modate indicated expansion area.
5. Include elevations and indicate type of
tenancy as well as area of office space.
6. Preliminary landscape plans.
Mr. Zepp seconded the motion.
Mr. Peter Buck, attorney representing Segale Business Park
stated the applicant is not requesting approval of the

trackage and crossed that off the site plan. Felt this
takes care of the first three points. Also noted no
request has been made for approval of the indicated
expansion, thus no parking should be provided. Mr. Buck
then produced a copy of the elevation drawing and Mr.
Solly, Segale Business Park, informed the Commission the
building would be single tenancy with some office space
at the north end of the building. Mr. Solly further
indicated the landscape plans would be forthcoming. Mr.
Buck requested approval of the site plan as amended by
this conversation.
Motion by Mr. Kirsop to rephrase his previous motion to
return the plan to the Segale Business Park representatives
Lommi
for rework and consideration at the continuation of
meeting on 9 May 1974. Motion seconded by Mr. Z.epp and
carried.
Chairman Mettler read a letter (attached) from the Tukwila
Industrial Council requesting the Planning Commission use
its authority to take whatever action necessary to require
the telephone cables described in the letter be placed
underground and that no further variances for those
particular facilities be granted.
Motion by Mr. Sneva, seconded by Mr. Link and carried to
direct the Planning Department to contact Pacific North-
west Bell Telephone Company, in writing, regarding this
matter. Mr. Saul further indicated a copy of such
correspondence should be sent to the Tukwila Industrial
Council.
This completed the business of the agenda with the exception
of the Shoreline Master Program and Segale Business Park.
Motion by Mr. Zepp, seconded by Mr. Link and carried to
recess this meeting to 8:00 p.m. Thursday, 9 May 1974 and
to hold a work meeting at 8:00 p.m. Tuesday, 7 May 1974

Site Plan Review - #734 - Segale Business Park
Segale Business Park proposes to construct a.22,000
square foot warehouse at the south end of the private
extension of Andover Park West. The site plan is not
accompanied by an elevation drawing and indicates two (2)
lead tracks; no explanation for the need of both'leads.
Further, location of loading doors is not noted. Parking
is sufficient to meet minimum requirements. A landscape
plan has not materialized since the Commissions approval
of the first building within this park; this being the
third such 'building.
Staff recommends approval subject to:
1. Approval of elevations.
2. Clarification of need for two (2) lead
tracks and location of rail loading doors.
3. Approval of landscape plan prior to
issuance of occupancy permit.
4. All construction must conform to the
Shoreline Master Program as adopted.

In response to concern expressed at your regular meeting
on April 25, 1974 Manson Bennett and Associates is submdtting
revised plans for a project number 734. Railroad tracks are
not reflected on these plans. Placement of railroad tracks
between the building and the river will require a future Shore-
lines Management Act Permit. The Department of Ecology has
recently agreed to permit construction of project number 734.
under the Shorelines Act. One condition of such approval was
that Segale Business Park develop a Master Plan for its entire
shorelines area within the next six months. Placement of rail-
road tracks will be subject to review by the City of Tukwila
and the Department of Ecology at that time.

Comes now the State of Washington Department of Ecology and
Slade Gorton, Attorney General, and withdraw their request for review
of the substantial development permit granted to Mario A. Segale
by the City of Tukwila pursuant to the following stipulation and
proposed order.
STIPULATION
1. Respondent agrees that building 734 will be located more than
50 feet from the mean high water line.
2. Appellant and respondents agree that respondent, Segale Business
Park, shall locate railroad lead tracks and /or spur tracks a minimum
of 50 feet from that line constituting the mean high water line of the
Green River, or such other distance as specified in a substantial de-
velopment permit covering the entire industrial park within the juris-

diction of the Shoreline Management Act. At no time shall respondent,
Segale Business Park, be compelled to locate said railroad tracks at
a distance in excess of 50 feet of the mean high water line of the
Green River in the vicinity of building 734. This provision shall
not be construed so as to deny respondent the opportunity to apply
for a variance to the above condition pursuant to WAC 173 -16 -070.
3. Respondent agrees that placement and construction of this
particular building 734 will not be used as an argument for placing
lead and /or spur tracks closer than 50 feet to the mean high water
line. If such placement or construction does not leave room for
placement of tracks, respondent will have only one lead track or no
lead tracks.
4. The respondent agrees that building 734 will be under 35 feet
in height.
5. Respondent agrees that railroad lines shown on map A -1, dated
March 11, 1974, are not part of this permit.
6. The approved substantial development permit shall consist solely
of those documents attached hereto and descriptions herein made.
7. Respondent agrees to submit within six months to the City of
Tukwila a substantial development application covering the entire indus-
trial park within the jurisdiction of the Shoreline Management Act; ap-
pellant agrees to use their best efforts to provide that information
and criteria necessary for a design acceptable to appellants.
8. The Attorney General and the Department of Ecology may, if
any part of this stipulation is violated, or if it is totally violated,
reinstate an appeal, collectively or individually.

made a part hereof. Copies of the attached permit and documents were
filed with the Department of Ecology on April 1, 1974; no copies have
been filed with the Attorney General by the city.

The proposed substantial development, an industrial park, comes
within the policies of chapter 90.58 RCW . (the Shoreline Management
Act of 1971). It is located on a shoreline of state -wide signifi-
cance in that it falls within the definition of RCW 90.58.030(e)(v).
Although'required by RCW 90.58.020, there is no indication in the
documents received by appellants that the city considered that the
interest of all the people should be paramount or that the city gave
preference to uses in the following required order of preference:
(1) Recognize and protect the state -wide interest over lor-.l
interest;
(2) Preserve the natural character of the shoreline;
(3) Result in long -term over short -term benefit;
(4) Protect the resources and ecology of the shoreline;
(5) Increase public access to publicly owned areas of the
shorelines;
(6) Increase recreational opportunities for the public in
the shoreline;
(7) Provide for any other element as defined in section 10
of the Act.

The proposed substantial development is inconsistent with the
general policies of chapter 90.58 RCW in that:
(1) It does not protect against adverse effects to the public
health, the land and its vegetation and wildlife, and the waters
of the state and their aquatic life, while protecting generally
public rights of navigation and corollary rights incidental thereto.
(2) It is not designed in a manner to minimize, insofar as
practical, any resultant damage to the ecology and environment of
the shoreline area,• or to promote and enhance the public interest,
and does not required a shoreline location.
(3) There is no indication that the requirements of RCW 90-
.58.020, paragraph 4, were met: "In the implementaion of this
policy the public's opportunity to enjoy the physical and aesthetic
qualities of natural shorelines of the state shall be preserved to
the greatest extent feasible consistent with the overall best
interest of the state and the people generally."

The permit is defective in that it violates the City of Tukwila
Master Program, insofar as it may presently be ascertained.

The permit is defective in that WAC 173 -14 -110, items 11(a) and
11(b), have not been complied with, for the permit and application as
VIII.
The permit is in conflict with the final guidelines to local
government adopted pursuant to chapter 90.58. RCW in that:
(1) The proposed development is contrary to WAC 173 -16- 060(4),
dealing with commercial development, in that the following sub-
sections of said regulation are violated:
(2) The proposed development is contrary to WAC 173 -16- 060(18),
dealing with road and railroad design and construction, in that the
following subsections of said regulation are violated:
(a) Whenever feasible, major highways,
freeways, and railways should be located
away from shorelands, except in port and
heavy industrial areas, so that shoreland
roads may be reserved for slow- moving
recreational traffic;

(a) . . . priority should be given to those
commercial developments which are
particularly dependent on their location
and /or use of the shorelines of the
state.
(b) New commercial developments on shorelines
should be encouraged to locate in those
areas where current commercial uses exist.
(d) Road locations should be planned to fit
the topography so that minimum alterations
of natural conditions will be necessary.

WHEREFORE, appellants request a formal hearing and at the
conclusion thereof that the substantial development permit issued
by the City of Tukwila to Mario Segale be declared null and void.

Dear Mr. Solly:
The Tukwila Board of Architectural Review, at its regular
meeting held 25 April 1974, reviewed the site plan sub-
mitted for Project #734, Segale Business Park.
The Board elected to return the plan for revisions to
include landscaping to the rear of the building, elimi-
nation of railroad trackage and expansion area, type of
tenancy and area of office space and preliminary land-
scape plans.
As you are aware, the Planning Commission recessed the
regular meeting until 8:00 p.m. Thursday, 9 May 1974,
and indicated the revised plan could be reviewed at that
time.

a Shoreline Management Permit has not been issued and,
in accordance with the Shoreline Management Act of 1971, �
a Building Permit . cannot be issued until that require-
ment is fully satisfied. .
