Washington 98067 The Tukwila Planning Commission, at it's regular meeting of 16 August 1973, held a Public Hearing to consider the rezoning of City property located at 6230 Southcenter Boulevard from RMH to P -F. This hearing was held subse- quent to the request by Council to properly zone the property to conform with the present use of the land, specifically a'. portion of the administrative offices of the City. After holding the Public hearing the Commission discussed in length the reason for the request as well as the allowable uses under RMH zoning. The Commission officially passed a motion stating that it is the majority opinion of the Planning Commission that the current use of the property as a professional of- fice is in conformance with allowable uses in RMH._ The Commission subsequently passed a motion' to deny the rezone to P -F on the basis that the current se is legal under the present zoning thus P -F zoning is ufi ec se sary. Builcting as a part of the SoUtlic'.'.Tit - ShopJ'_ng,C.cnt .r Minutes, 16 August 1973 Page 5 Rezone - 6230 Southcenter Boulevard Staff explained site map, read advertisement and explained that the City Council has requested the Commission to properly zone this parcel of property to legalize the existing use, specifically some administrative offices . of the City. Chairman Mettler opened the Public Hearing on this matter.. .No one was present to speak for the proposed change in zoning. Mr. Frank Todd, Mayor, stated P -F zoning would be inappropriate inasmuch this parcel has not been legally designated for public facilities. Suggested, rather, C -1 or C -2 zoning. Chairman Mettler closed the Public Hearing. Mr. Link pointed out that property both on the east and west were zoned C -1 already and that this use is allowed in a C -1 zone. Mrs. Harris .stated a separate hearing should be held first to amend the Comprehensive Land -Use Plan to follow proper procedures. Motion by Mr. Lamb and seconded by Mr. Link to table this. item and readvertise for an amendment to the Comprehensive Plan and obtain an opinion from the City Attorney regarding the legality of existing use under present zoning. Mr..Kirsop objected to the motion because he felt the motion would appear to the City Council as a delaying tactic. Also because he felt the Commission can and should decide.on the legality of the existing use under the present zoning. Mr. Lamb felt the Commission should seek a qualified professional opinion regarding the question of legality Mr. Moss stated the Planning Commission should be able to decide the question of legality. Chairman Mettler called roll -call vote on the motion by Mr. Lamb. YES - Mr. Lamb, Mr. Link. NO - Mrs. Harris, Mr. West, Mr. Kirsop and Mr. Saul. MOTION FAILED. Discussion followed regarding the legality of existing use under the present zoning. Minutes, 16 August 1973 Page 6 Motion by Mr. Kirsop and seconded by Mr. Saul that it is the majority opinion of the Planning Commission that the current use of the property as a professional office is in conformance with allowable uses in RMH. Motion carried. Motion by Mrs. Harris and seconded by Mr. West to advertise a Public Hearing to consider an amendment to the Comprehensive Plan to zone this property P -F. MOTION FAILED. Mr. Kirsop suggested a review of this particular area in relation to the Comprehensive Plan due to the changing character of uses along Southcenter Boulevard. Staff pointed out that no direct formal action has been taken regarding the rezone. Motion by Mr. Link and seconded by Mr. Kirsop to deny the rezone to P -F on the basis that the current use is legal under the present zoning thus P -F zoning is unnecessary. Motion carried with Mrs. Harris voting NO. McCann Plat - SR 181 and South 180th Staff briefly displayed preliminary plan of plat and asked Commission .to set date for Public Hearing. Motion by Mr. Saul and seconded by Mr. Lamb to reschedule the Comprehensive Park Program Public Hearing to 20 September 1973 and to schedule a Public Hearing on this matter for 27 September 1973. Signing _ Don Koll . Mr.. John Richards, Building Official, explained how Don Koll is identifying tenants of the multi - tenant buildings. The signs are termed "Directional Signs" by Don Koll; however Mr. Richards feels the presence of the. company's name and /or logo in addition to.the address constitutes a "Sign ". After some discussion of the matter, Chairman Mettler amended the agenda in order to hear item V. (A) due. to the late hour. Landscape Review - J. W. Phillips' Mr. Tom Berger, landscape architect, displayed 'and explained drawings. 5 D. PRELIMINARY PLAT REVIEW - McCANN: of the applicant possessed by the owners of other properties in the same zone or vicinity.' SaF 4pe r-1 k• Avw41-6 i9 73 The proposed variance would constitute the granting of a special privilege which is inconsistent with the limitations upon the uses of other properties in the same area and there seems to be no special circum- stance relating to the size, shape, topography or location of the subject property. Therefore, it seems to the Staff that the granting of this variance would not be in keeping with the provisions and requirements for the granting of the variance as defined by section 18.72.010 of the zoning code. C. REZONE - 6230 SOUTHCENTER BOULEVARD (CITY HALL SITE): The Planning Department has been requested by the City Council to make application to the Planning Commission for the rezoning of the City owned pro- perty on Southcenter Boulevard from an RMH zoning classification to a P -F (Public Facilities) zoning classification. The subject site is 2.4 acres in area, and is under consideration as a potential site for Public Facilities. The Planning Commission is familiar with the subject site, the present City Hall annex is located on the subject site and the Commis- sion is now asked to consider the appropriateness of a rezone for the subject site to a P -F classification. McCann Construction Company has submitted pre- liminary plans for a proposed subdivision located at the southeasterly most corner of the City. The plans indicate a proposed steet layout system, proposed open areas, and a proposed bicycle path along the crest of the Green River dyke. They have also submitted a draft of proposed protective covenants for the Southcenter South Industrial Park. A consultant has been hired and an Environmental Impact Statement for the proposed development is being prepared. Title 17 of the Tukwila Municipal Code requires that a Public Hearing be held by the Planning Commission and the City Council on both the preliminary plat and the final plat drawings; therfore, this evenings meeting is only a preliminary review by the Planning Commission of the proposed development. Representatives of the McCann Construction The subject property is an RMH zoned site located on the Renton Three Tree Point Road, due north of the Southcenter shopping center and Tukwila, Washington. This is an irregular shaped site having a land area of approximately 108,173 square feet, which is presently improved with a single family residence and a small cabin. The legal description is as follows: That portion of Tract 15 Interurban Addition to Seattle, according to the Plat recorded in Volume 10 of Plats, page 55 in King. County, Washington, described as follows: Beginning at a point on the south line of Section'23, Town ship 23 North, Range 4, East,. W.M., in King County, Washington;.. 1,836.78 feet westerly of the southeast corner thereof; thence North 1,501.5 feet to the true point of beginning;. thence East 350 feet; thence. South 488.8 feet more or less, to the northerly line of county road number 622; thence westerly along said northerly line to a point South of the true point of beginning; thence North to the true point of, beginning; EXCEPT that portion :thereof conveyed,to King County for road by deed recorded under Auditor's' File No. 2685205; Except that portion conveyed to the State of: Washington for primary State.Highway No. 1.
