73-40-R 14057 INTERURBAN AVENUE SOUTH 7-ELEVEN SOUTHLAND CORP 7-ELEVEN REZONE COMPREHENSIVE LAND USE PLAN COMPREHENSIVE PLAN Gentlemen: Frank Todd, Mayor CITY of TUKWILA 14475 - 59TH AVENUE SOUTH TUKWILA, WASHINGTON 98067 28 August 1973 President, City Council City of Tukwila Tukwila, Washington 98067 The Tukwila Planning Commission, at it's regular meeting of 16 August 1973, held a Public Hearing to consider a request to rezone a portion of a parcel of property generally located at the southeast cor- ner of the intersection of Interurban Avenue with 57th Avenue South extended. The Public Hearing brought out the following factors of consideration: 1. The parcel of property is 100 feet square presently zoned C -2; however a corner of the parcel is zoned R -1 as a result of the vacation of the 57th Avenue South right -of -way. 2. The request for rezone to C -2 is to allow the commercial use of the total parcel of property. 3. The request is in conformance with the Comprehensive Land -Use Plan. Upon consideration of the above and in order to correct an obvious non - conformity of previous zoning, the Commission recommends the City Council rezone that property. legally described in the attached appli- cation from R -1 to C -2. Mrs. Harris pointed out that an ordinance would have to be amended if the regular meeting date is established by ordinance. Staff stated the regular meeting date was not set by ordinance and that no amendments would be necessary to implement the proposed procedures. Mr. Lamb requested Staff use good judgement in enforcing the cut -off date included in the procedures. Motion by Mr. Saul, seconded by Mr. Kirsop and carried to accept the proposed procedures with the exception of the Andover ACC materials. NEW BUSINESS: Rezone - 7 -11 Interurban Avenue Staff read advertisement, explained site map of the site, and read Staff Comments. Chairman Mettler opened the Public Hearing of this matter. Staff explained the vacation of 57th Avenue South created a parcel of property zoned C -2 with a corner of it zoned R -1 since the zoning line had followed the centerline of the old 57th Avenue right -of -way. The property owner is asking for a rezone of the entire 10,000 square foot parcel to C -2. Mr. Curt Jacobsen, architect for Southland Corporation, (7 -11 Stores), explained the boundaries of the property and stated the best use for the property was commercial and that commercial zoning was obviously intended for the property. Mr. Lawrence Ash, property owner, reiterated Mr. Jacobsen's comments. No one was present to speak against the request. Chairman Mettler closed the Public Hearing. Motion by Mr. Kirsop and seconded by Mr. Saul to recommend to the City Council the rezoning of this parcel of property to C -2 in order to correct an obvious non - conformity of previous zoning. Motion carried. F. REVIEW OF PROCEDURE PROPOSAL: The Department is recommending to the Planning Commission that the regular Public Hearing meeting each month be held on the fourth Thursday of the month rather than on the third Thursday as is the present policy, and that an administrative meeting be held on the second Thursday of each month. The closing date for all business to be reviewed by the Planning Commission at their Public Hearing meeting would be 5 p.m. on the first Thursday of each month. Under this system all items which would be reviewed by the Planning Commission for any particular month would be reviewed at an adminis- trative meeting on the second Thursday of each month, and all pertinent information would be given to the Planning Commission at that administrative meeting; the Planning Commission would then have two weeks between the administrative meeting and the regularly scheduled Public Hearing meeting in which to consider the various proposals, thereby expediting matters at the Public Hearing meeting. The reason for the proposed change in procedure is that the Planning Commission at each Public Hearing meeting is asked to consider and make decisions on a large number of proposals, many of which are being reviewed for the first time; under the new system the Planning Commission would be familiar with all of the items on the agenda at the Public Hearing meeting and would have had two weeks to consider each of the items and organized their thoughts and thereby expediting the Public Hearing meeting and possibly alleviate the need to continue many items. A. REZONE - PROPOSED 7 -11 STORE: Lawrence Ash, contract purchaser for the subject property, has applied for a rezone from a single family zoning classification to a C -2 local retail zoning classification for the westerly most corner of the subject property. The total area of the subject site is 10,000 square feet; 8,760 square feet currently are zoned C -2 local retail clas- sification, 1,240 square feet of the subject site are zoned R -1 -7.2 single family residential clas- sification. The Comprehensive Land -Use Plan indicates the subject property as C -2 local retail property. The subject site is relatively flat 3 5 Amyl t(,) frt o1.3 4 B. VARIANCE - PROPOSED 7 -11 STORE: land, is undeveloped, and is located just northerly . of the Hazelnut Restaurant on Interurban Avenue South. The proposed rezone is consistent with the Comprehensive Land -Use Plan and is consistent with existing.zoning. along the southwesterly side of terurban Avenue South. 7 -11 Store, a division.of .the.
