That property is generally located at the northwest corner of the intersection of Southcenter Boulevard and 62nd Avenue South and legally described in the application attached hereto. The following relevant factors were pointed out and discussed by the Commission: 1. That Mr. Wimmer is owner of Parcels A and B and is contract - purchaser of Parcels C and D. 2. That prior to relocation of 62nd Avenue a strip of land along Southcenter Boulevard between Macadam Road and 62nd Avenue was rezoned by the City from ERO to C -1. 3. In connection with the construction of the freeway, the State realigned 62nd Avenue by placing the intersection farther east at Southcenter Boulevard. 4. That prior to relocation, that land lying west of 62nd Avenue was zoned C -1 while that land lying east of the roadway was zoned RMH. 5. Upon relocation of 62nd Avenue and subse- quent vacation of the old right -of -way, that land lying west of the old right -of -way President, City Council Page 2 received half of said right -of -way under zoning of C -1; that land lying east of the old right -of -way received half of said right -of -way under zoning of RMH. 6. Completion of the relocation of 62nd Avenue left a small portion of land lying west of 62nd Avenue zoned RMH. 7. Mr. Wimmer stated he felt that a more desireable and environmentally aesthetic development would be possible if the entire property is properly zoned. 8. Mr. Wimmer assured the Commission that no access or egress would be provided to or from Southcenter Boulevard. 9. There was no one present to speak against the request. The Commission discussed the aforementioned factors upon closure of the Public Hearing. Mr. Wimmer stated, upon inquiry, that he plans to develop the property similar to the drawing included in the application for rezone. The Commission also felt that any development on this property should be accessible only from 62nd Avenue South. It was moved by Mr. Lamb that because: 1. The relocation of 62nd Avenue created a small portion of land zoned RMH within an area previously zoned C -1 by the City; 2. The overall development of the total site would be of much better quality; 3. Review of all plans for development can be made a condition to a rezone; 4. The Commission generally feels that the request is within the intent of the Com- mission's action when rezoning the same / general area from ERO to C -1; �/ The Planning Commission recommends to the City Council that the property legally described within the application and generally located at the northwest corner of.the inter- section of 62nd Avenue South and Southcenter Boulevard be President, City, Council rezoned from RMH to C -1 and that the Comprehensive Land - Use Plan be modified accordingly subject to the following conditions: 1. That no portion of the development have access or egress from or to Southcenter Boulevard. 2. That no service station of any type be erected. . That all plans, to include site, elevations, . grading, landscape and signing, be sub - mitted to the Planning Commission for review and approval. The motion was seconded by Mr. Link and carried with Mrs. Harris and Mr. Saul voting NO. The Planning Department hereby forwards the recommendation, together with all relevant factors of discussion and reasoning, of. the Planning Commission to the City Council for consideration and appropriate action. Comprehensive Plan Review Mr. Moss briefly brought the Commission up to date on this matter and reminded the Commission that another work meeting should be scheduled. Chairman Mettler agreed to set a date at the end of this meeting. Underground Utilities Comprehensive Plan Mr. Moss referred to Staff comments and the Commission agreed to table this matter until the next regular meeting. Wimmer - Rezone Staff read re- advertisement and Chairman Mettler opened the Public Hearing. Mr. Moss briefly explained request for rezone from RMH to C -1 and drawing showing that the applicant owns two parcels and is contract purchaser on the third. Mr. Tom Wimmer, 7756 Seward Park Avenue South, Seattle, explained drawings and history of zoning. Noted that former E -R -O zone, which included a 150 -foot strip of land along Southcenter Bouelvard extending from Macadam Road to 62nd Avenue South, was rezoned by the City to C -1 some years ago. In connection with construction of the Freeway the State realigned 62nd Avenue South, by placing the intersection farther east. The old 62nd Avenue right -of -way was vacated back to the abutting property owners. Prior to relocation and subsequent vacation of the old right -of -way, the land west of 62nd Avenue was zoned C -1 while that land east of 62nd Avenue was zoned RMH. Upon vacation of the old right -of -way, the west half was returned to the abutting property owner to the west and automatically received same zoning as that land to which it was added. The east half was vacated to the abutting property owner to the east and automatically recieved RMH zoning. This zoning has stayed that way since. Mr. Wimmer now desires to develop his commercially zoned property, but feels with the purchase of additional land, if properly zoned, he could ensure a more environmentally aesthetic development. Mr. Hammons, co -owner of the property, stated the obvious intent of the Commission years ago was to provide commercial land between Macadam Road and 62nd Avenue South. Since the . relocation of 62nd Avenue farther east, leaving a small portion of land zoned RMH between Macadam Road and 62nd Avenue, this request is within the intent of the original zoning and would allow them to enhance the development of the property. Tract A as shown on our plot plan lays west of the original location of 62nd So., (see dotted line for old 62nd So. location). Tract A was zoned C 1, which is consistant with the zoning farther to the west, as apparently 62nd So. was the dividing line between C 1 zoning to the west and R 4 zoning to the East. In widening the Renton Three Tree Point Road in 1966, the State Highway Dept. took 10,825 sq. ft. of the original 20,625 sq. ft. fro m tract A. By excavating along the south property line to bring the land down to grade, tract A was left with a 17 ft. high bank on the west corner, making it necessary to relocate 62nd So. This was done by turning East across the North back property line of tract C and D, then South to the Renton Three Tree Point Road, where the grade was more adaptable to automobile use. In relocating 62nd So., tract C and D, which are zoned R 4 then became an island by being separated from R 4 zoning to the East, but was then connected to C 1 zoning to the west by the City of Tukwilla, vacating the end of 62nd So. which now has a bank, one half was dedicated to tract A which is C 1 and one half to tract C which is R 4 zoning. It would seem reasonable to request a C 1 zoning for the land west of 62nd So. which includes tracts B,C, and D. This change would be in keeping with the original zoning philosophy of C 1 west of old 62nd So., then this entire tract could be developed in concert and with the highest use made of the land. C 1 classification will enhance the environment of the neighborhood to a greator entent then the present R 4 zoning.
