Mayor Todd opened the Public Hearing at 10:06 pm. Objections to this rezone were stated by Darlene West and Pat VanDoren. Mrs. Cathrine Harris also noted her desenting vote on the Planning Commission. Gary Mix of Puget Western, spoke in favor of the rezone. He noted that taxes have been paid on the property, - zoned as R -4, and felt that this would be a proper L/ place for apartments. Public Hearing was closed at 10:20 pm. Mr. Barney Hagelund, Seattle, City Light, spoke in favor of the rezone, with the exception of the third stipulation as set forth in the proposed Ordinance, that being, that Seattle City Light enter into a contractual developers agreement to run with the land, and certifying agreement to these conditions. He felt this stipulation was not necessary. Councilman Hill read a letter from Seattle City Light, Gordon Vickery, further explaining Seattle City Lights proposal. Public Hearing closed at 10:40 pm. Res. #352 Metro Transit Final Acceptance Andover Park Lift Station Public Hearing.Date Rezones • OLD BUSINESS Bid Award: Street Mower Agreement for Engineering Services f•t cl Court and be settled so that the City will not have the same situation next year. Councilman Sterling stated he feels the Renton Chronicle is more the City paper as it has more news covering this area. Councilman Gardner questioned whether or not the City had to go out on bid. Mr. Tierney,of the Renton Chronicle, stated that he had talked with the City Clerk and told her the paper would prefer to publish on Friday, however, if it was necessary they would publish on Wed. Councilman Traynor asked if Renton was ever involved in any cases regarding bidding. Attorney Parkerstated that in the case of Edwards vs Renton, the City did not follow the bid statute and could not recover under the contract. Councilman Johanson again noted that he feels the Highline Times is irresponsible as the legal publisher because they did not always print the legals in the point type specifies. He also stated that he feels Council action has already been taken. MOVED BY STERLING, SECONDED BY CRAIN, TO AMEND THE AGENDA TO INCLUDE PROPOSED RESOLUTION. CARRIED. MOVED BY CRAIN, SECONDED BY TRAYNOR, THAT THE PROPOSED RESOLUTION BE READ. CARRIED. Attorney Parker read a Resolution authorizing the Mayor to negotiate a contract with officials of Metro Transit for a self funded suburban area bus service for the City of Tukwila. Discussion followed after which it was MOVED BY CRAIN, SECONDED BY HILL, TO PASS RESOLUTION #352 AS READ. A Roll Call Vote brought 4.\Ayes: Hill, Stevens, Traynor, Crain. 3 Nos: Gardner, Johanson, Sterling. The motion CARRIED. Public Works Director, Steve Hall read a letter he/ / / , — wrote to Councilman Gardner. The letter stated that the "Operation and Maintenance Manual" is complete and copies are available in his office. It further stated that all work on the Lift Station has been completed in accordance with the plans and specifications and to his satisfaction. He then recommended acceptance of this project. MOVED BY GARDNER, SECONDED BY JOHANSON, TO ACCEPT THE LIFT STATION. Councilman Hill questioned the Attorney in regard to existing law suits. Attorney Parker stated that there are 7 suits pending on this matter. The motion then CARRIED. / Planning Coordinator, Del Moss asked that a Public `' =-'" Hearing be set for July 2nd to consider rezoning of certain property. MOVED BY STEVENS, SECONDED BY TRAYNOR, THAT A PUBLIC HEARING BE HELD ON JULY 2ND, 8 PM TO CONSIDER THIS MATTER. The motion CARRIED with Council- man Johanson voting "no ". The Public Hearing will be held in the Council Chambers at City Hall. Councilman Hill read a letter submitted by Steve Hall. The letter listed the three Companys that bid on this item and recommended that the bid award go to the lowq bidder, Craig Taylor Equipment Company, in sum of $7,371.00. Councilman Stevens asked if this equipment will meet OSHA & WSHA standards. Mr. Hall answered yes. MOVED BY HILL, SECONDED BY STERLING, TO AWARD THE BID T( CRAIG TAYLOR EQUIPMENT CO. IN SUM OF $7,371.00.CARRIED. It was noted that the old equipment will be surplused. Steve Hall stated that the contract is on a time materials basis. Mayor Todd asked if Mr. Hall would .� seek an amendment to this agreement to include an \O additional signal at Andover Park East. Mr. Hall stated that if the Revenue sharing use was authorized, he would recommend the signal. Mr. Hall then noted that the signals would be installed approximately 30 days after the contract was awarded. Gentlemen: Frank Todd, Mayor CITY or TUKWILA 14475 - 59TH AVENUE SOUTH TUKWILA, WASHINGTON 98067 1 June 1973 President, City Council 'City of Tukwila Tukwila, Washington 98067 / t) PLANNING DEPARTMENT The Tukwila Planning Commission, at a meeting held 24 May 1973 to continue the Commission's regular meeting of 17 May 1973, held a Public Hearing to consider Staff's recommendation to rezone Area #4 from R -1 to M -1. Area #4 is described in the enclosure hereto. The hearing revealed several relevant factors for discus- sion by the Commission and they are noted below. 1. This property, after a corporate boundary . survey, was found to be in the City of Tukwila rather than King County and subse- quently officially annexed to the City by King County Resolution #23309 dated 16 October 1961. 2.. Upon annexation the property was auto- matically zoned R -1 in accordance with Section 18.08.020 of the Tukwila Municipal Code. 3. The property owner, probably unaware of the automatic classification, has simply overlooked the need for proper zoning. The property is presently occupied by the offices and shops of the Black River Quarry. 5. A letter from the president of the Black River Quarry requesting the property be zoned M -1 as that is the classification under which the facility has been thought to have been operated. President, City Council 6. The Staff recommendation is in conformance with the Comprehensive Land -Use Plan adopted by the City Council. 7. That the Quarry would be a non - conforming use under M -1 classification. However, by zoning the property M -1, any other heavy industrial uses will be precluded. Upon consideration of the foregoing, it was moved by Mr. Sneva, seconded by Mr. Saul and carried to recommend to the City Council that Area #4 be rezoned from R -1 to M -1 in conformance with the Comprehensive Land -Use Plan. This property was assigned an R -1 -12.0 zoning classification by ordinance number 251 dated December 23, 1957. Sub- sequently disputes as to the exact zoning established by ordinance number 251 resulted in a change in the zoning classification of the subject property from R�1 -12.0 to R -3; however such zoning was not officially established. The property is occupied by four single family residences. The Planning Commission is now asked to consider a rezone for the subject property from R- 1 -12.O to R -3. 8. That property located south of So. 154th St. (Southcenter Boulevard), east of 51st Ave. So., west of 53rd Ave, So, and north of the right -of -way line for the Tukwila Freeway Interchange. This property was annexed to the City by ordinance number 303 dated March 30, 1960 and should have been assigned an R -1 -12.0 zoning classification which would have remained in effect until the installation of sewers under L.I.D. #5 which would have changed the zoning classification of the property east of 52nd Ave. So. (extending southerly) to an R -1 -7.2 classification. The property however was incorrectly classified RMH on the City's zoning map. RMII zoning for the subject property has.never been officially established; therefore the Planning Commission is now asked to consider a rezone for the subject property from R -1 -12.0 and R -1 -7.2 to RMH. 9. That property located south of the Tukwila Freeway Interchange, east of 51st Ave. So. extended, north of the south section line of section 23 township 23 N. range 4 E., and west of 53rd Ave. So. This property was annexed to the City by ordinance number 303 dated March 30, 1960 and should have been assigned an R -1 -12.0 zoning classification at that time. The pro- perty however has been incorrectly classified on the City's zoning map as RMH. This zoning classification has never been officially established; therefore the Planning Commission is now asked to consider a rezone for the subject property from R -1 -12.0 to RMII. .10. That property located north and east of Slade Way and west of 53rd Ave. So. extended northerly. This property was assigned an R -1 -12.0 zoning classification by ordinance number 251 dated December•23,.1957. Subse- quently the zoning was incorrectly changed to R -4 (possibly a mistake at the time the adjacent property was rezoned to R -4), and has been indicated as such on the official • City zoning map. Members present were: Mr. Zepp, Mr. Saul, Mr. Sneva, Mr. Harrison, Mr. Mettler, Mr. Kirsop, Mr. Lamb and Mrs. Harris. Mr. Lamb stepped down from the Commission to address the Commission in regard to a personal request as a citizen. Mr. Lamb explained that he resides within Area #8 (area #8 being one of the ar.e_as discovered to have zoning different from what the zoning map had always denoted) and that he and the other three residents had requested the zoning of the entire area be changed from whatever it presently is to C -2. Further explained that the request for rezone and the discrepancy in zoning had coincidentally occurred simultaneously. As he sees no reason for the Commission to spend time on an action which may or may not be changed only a month from now, he requested the Commission table the Public Hearing scheduled to determine the actual zoning until the regular meeting of June. At that time he will have the property owners present and the Commission may review the rezone request. It was the general concensus of the Commission to table the Public Hearing for Area #8 until the next regular meeting. Mr. Lamb at this time returned to the Commission. AREA #2: Chairman Mettler opened the Public Hearing for Area #2 as described in Staff Comments of 17 May 1973. Dick Hansen, Senior Planner, explained that his research had disclosed an annexation ordinance but the property had never officially been classified by ordinance. The property in question is paved and used as parking for the ARCO station located there. Appears to have been simply over- looked. 2 No one was present to speak for or against the action. Motion by Mr. Kirsop, seconded by Mr. Lamb and carried to close the Public Hearing. In consideration of the foregoing, it was moved by Mr. Harrison, seconded by Mr. Zepp and carried to recommend to the City Council that Area #2 be rezoned from R -1 to C -2. AREA #4: Chairman Mettler opened the Public Hearing for Area #4 as described in Staff Comments of 17 May 1973. Mr. Hansen read letter from Black River Quarry, owner of Area #4, which requested the land be zoned M -1 as that is the zoning which was always thought to be applied. Mr. Hansen again explained that it appears, .by research, that the classification ordinance had simply been over - looked after annexation of the property. No one was present to speak against the action. Motion by Mr. Kirsop, seconded by Mr. Saul and carried to close the Public Hearing. In consideration of the foregoing, it was moved by Mr. Sneva, seconded by Mr. Saul and carried to recommend to the City Council that Area #4 be rezoned from R -1 to M -1. AREA #6: Chairman Mettler opened the Public Hearing for Area #6 as described in Staff Comments of 17 May 1973. Mr. Hansen pointed out that Area #6 is a parcel of property . extending down the hill from the Tukwila Park to Interurban Avenue. Further explained that this area had been zoned, by Ordinance #251 (the original zoning ordinance adopted in 1957), as PF.: and had never been purchased by the City. The zoning map mistakenly depicts the property as R -4. Thus, since the owner has paid taxes under R -4 zoning, Staff suggests rezone to R -4. No one was present to speak for or against the action. Motion by Mrs. Harris, seconded by Mr. Lamb and carried to close the Public Hearing. Commission discussed the possibility of any development along the hillside under R -4 zoning. Commission generally felt -.3 - the property too steep to develop and if in fact possible, any development would come under the requirements of the Environmental Policy Act of the State as well as the City's ordinance.. Also discussed the fact that if the property remains PF the City is obligated to purchase the property. In consideration of the foregoing, it was moved by Mr. Harrison, seconded by Mr. Zepp and carried to recommend to the City Council that Area #6 be rezoned from PF to R -4. Mrs. Harris voted NO due to the steep slope of the property., AREA #7: Chairman Mettler noted the Public Hearing of thi s area had been recessed to allow the property owners of the area to discuss the possibility of R -3 zoning as Mr. Carl McDaniel had requested. Mr. Hansen read a letter from Mr. Shawn Sullivan requesting the property be zoned R -3 as he had been under the impression the property was zoned R -3 when he purchased it. Mr. Hansen also noted that all property owners had been notified of tonight's meeting. There was no one present to speak against the action. Motion by Mr. Harrison, seconded by Mr. Zepp and carried to close the Public Hearing. Commission discussed history of the area as shown by staff's research.. The following are relevant facts regarding this matter. 1.. The area was originally zoned R -1.12 by Ordinance #251 in 1957. 2.. The map adopted by Ordinance #251 is of a small scale and difficult to define zoning boundaries, especially in this case. 3. It appears on the zoning map that this area was classified R -3. 4. The only property owner to speak regarding this action requests rezone to R -3. In consideration of the foregoing, it was moved by Mr. Zepp, seconded by Mr. Lamb and carried to recommend to'the City Council that Area #7 be rezoned from R -1 to R -3. - .4 -- This completed the agenda items from the meeting of 17 May 1973. At this time, Mrs. Diane Goodwin, King County Housing Authority requested the Commission review the Authority's site plan and elevations for approval as required under the conditions imposed by the Commission in regard to the Conditional Use Permit granted at the regular February meeting of the Commission. Upon review, the Commission generally felt the plans met the intent of the Commission. However, on Mr. Harrison's suggestion, Mrs. Goodwin was asked to adjust the plans in . some manner so as to allow the rockery shown along the north property line can be set far enough from the driveway to allow adequate landscaping. Chairman Mettler set the date of 14 June 1973 for the next work meeting to continue the Comprehensive Plan Review. Mr. Saul informed Chairman Mettler that he will be on vacation until 8 July 1973. This property was annexed to the City by Tukwila Ordinance #303 dated 30 March 1960. 2. Upon annexation the property automatically was classified R -1 in accordance with Section 18.08.020 of the Tukwila Municipal Code. 3. For some unknown reason, the City's zoning map depicts this area as RMH zoning but is classified so without ordinance. 4. Mr. Frank Alberti, representing some of the property owners of the area, explained that most of the property owners had believed at the time they purchased the property that the area was zoned RMH. 5. Mr. Alberti further explained the logic of RMH zoning in regard to the surrounding zones, existing sewers, access to free - says as well as the noise level. The Tukwila Planning Commission, at it's regular meeting of 17 May 1973, held a Public Hearing to consider Staff's recommendation that Area #9 be rezoned from R -1 to RMH. Area #9 is described in the enclosure hereto. PLANNING DEPARTMENT The hearing revealed the following relevant factors regarding this matter as well as statements by the property owners of the area and these were all discussed by the Commission. President, City Council 6. Mr. John L. Barnes, a property owner in the area, explained that when the State put the freeway in, it had to purchase some of his land for the right -of -way. At that time, and after a court battle, the State was directed to pay for the land under RMH zoning. 7. All of the property owners have been paying taxes on RMH zoning for some years. Page 2 8. OLD BUSINESS Seattle City Light - Rezone Del Moss, Planning Coordinator, gave background of this matter and brought Commission up to date since the Public Hearing for this matter was closed on 21 September 1972. The City and the applicant have been engaged in negotiations regarding the future development of Andover Park West. Mr. Moss also referred to Staff Comments (attached). Mr. Barney Hageland, Seattle City Light, stated that City Light has tentatively agreed•to participate in the L,I.D. for Andover Park West. Also stated that City Light desires to withhold agreement to participate in L.T,D. until they have reviewed distribution of assessments as well as cost ' figures for actual construction of Andover Park West. Discussion among Commissioners as to necessity of withholding action on the request until Seattle City Light has firmly agreed to the L.I,D. Mr. Harrison pointed out that agreement to the L.I.D. is a legal matter to be handled separately from the zoning request in respect to reviewing to insure a fair and equitable assessment. Motion by Mr. Harrison, seconded by Mr. Zepp and carried to recommend to the City Council that this application for rezone to CM be granted subject to the following conditions: Frank Todd, Mayor 1, That Seattle City Light dedicate to 'the City of Tukwila, without cost, necessary street right -of -way as well as adjacent easements for utilities. 2. That Seattle City Light agree to pay its' equitable share of the cost of public improve ment$in connection with the construction' of the street and utilities. 3. That Seattle City Light enter into a con- tractual Developer's Agreement, to run with the land, certifying agreement to these ' conditions. Burlington Northern (Glacier Park) Rezone Mr. Moss informed the'. Commission that staff was still working on zone revisions which is directly related to this request. Thus, staff requested Commission table this matter until the next regular monthly meeting. Upon agreement by the Com- missioners, Chairman Mettler tabled the matter as requested. CM Zone Revisions Mr. Moss reiterated the fact that staff was still in process of completing this task. Thus, upon general consensus of the Commission, this matter was tabled until the next • regular meeting. Slade Way - Rezone Re- advertisement, from R -1 and R -4 to RMH, was read and Chairman Mettler opened the Public Hearing. Gary Mix, Puget Western -, Inc., displayed drawings and pre- liminary site plan of a possible high density apartment complex which included several seventy or eighty foot high buildings. Explained that part of the total site was already zoned RMH and that Puget Western merely requests the remainder of the parcel be zoned the same so as to allow utilization of the total site. Mr. George Leeds, 5207 So. 164th, suggested that if application is granted it should include the requirement for sidewalks along Slade Way due to the anticipated increase in traffic. Mrs. Darlene West, 5212 So. 164th, objected to the request due to historically unstable soils and felt any development would be detrimental to the aesthetic quality of that 3 particular area as well as downgrade the neighborhood. Mrs. Ann Crain, 5605 So. 163rd Place, asked if the property was to be developed by Puget Western or merely sold to someone who will develop it. Mr. Mix stated that Puget Western anticipated selling the property and working very closely with the developer to ensure a development of high quality. Mrs. Pat VanDoren, 5165 So. 160th, also objected to the request and reiterated those reasons stated by Mrs. West. Chairman Mettler asked if there was anyone else who wished to speak in regard to this matter. No one rose. Motion by Mr. Harrison, seconded by Mr Lamb and carried to close the Public Hearing. Discussion among Commission as to slope percentage and extent of construction in regard to retaining walls, etc. Mrs. Harris quoted portions of a report made by the King County Environ- mental Development Commission regarding developments on slopes. Mr. Moss stated that a detailed Environmental Impact Statement would be required prior to any development on this property. Mr. Harrison stated he has heard no solid reason why the request should be granted and that the property is useable as R -4 especially considering the fact that no detailed' plans have been committed for the site. Mr. Harrison out- lined the possible alternatives available to the Commission as follows: A. Grant the request and apply development con- ditions to the total parcel. B. Deny the request. Upon further discussion, the Commission felt the land requested for rezone to RMH is useable as presently zoned, that the existing zone provided a necessary 'buffer zone' between the adjacent single - family residential area and that portion of land already zoned RMH and in light of considerable protest by neighboring property owners the request was not justified. Motion by Mr. Saul, seconded by Mrs. Harris and carried to deny the request by Puget Western to rezone the Slade Way property from R -1 and R -4 to RMH. Chairman Mettler advised the applicant of his right to appeal the Commissions decision to the City Council. Comprehensive Plan Review Mr. Moss briefly brought the Commission up to date on this matter and reminded the Commission that another work meeting should be scheduled. Chairman Mettler agreed to set a date at the end of this meeting. Underground Utilities Comprehensive Plan Mr. Moss referred to Staff comments and the Commission agreed to table this matter until the next regular meeting. Wimmer - Rezone Staff read re- advertisement and Chairman Mettler opened the Public Hearing. Mr. Moss briefly explained request for rezone from RMH to C -1 and drawing showing that the applicant owns two parcels and is contract purchaser on the third. Mr. Tom Wimmer, 7756 Seward Park Avenue South, Seattle, explained drawings and history of zoning. Noted that former F -R -O zone, which included a 150 -foot strip of land along Southcenter Bouelvard extending from Macadam Road to 62nd Avenue South, was rezoned by the City to C -1 some years ago. In connection with construction of the Freeway the State realigned 62nd Avenue South, by placing the intersection farther east. The old 62nd Avenue right -of -way was vacated back to the abutting property owners. Prior to relocation and subsequent vacation of the old right -of -way, the land west of 62nd Avenue was zoned C -1 while that land east of 62nd Avenue was zoned RMH. Upon vacation of the old right -of -way, the west half was returned to the abutting property owner to the west and automatically received same zoning as that land to which it was added. The east half was vacated to the abutting property owner to the east and automatically recieved RMH zoning. This zoning has stayed that way since. Mr. Wimmer now desires to develop his commercially zoned property, but feels with the purchase of additional land, if properly zoned, he could ensure a more environmentally aesthetic development. Mr. Hammons, co -owner of the property, stated the obvious intent of the Commission years ago was to provide commercial land between Macadam Road andI Avenue South. Since the relocation of 62nd Avenue farther east, leaving a small portion of land zoned RMH between Macadam Road and 62nd Avenue, this request is within the intent of the original zoning and would allow them to enhance the development of the property. Chairman Mettler noted there was no one present to speak against the request. Motion by Mr. Harrison seconded by Mr, Link and carried to close the Public Hearing, Mr. Sneva clarified the fact that the total of all the parcels would be accessible only from 62nd Avenue South, Mr. Harrison asked if there were any specific development plans for a particular development, Mr. Wimmer stated they intend to develop the property as shown in the drawing attached to the application. Discussion by Commission of the facts pertinent to this matter included the relocation and subsequent vacation of 62nd Avenue South creating a small portion of land zoned RMH, that part of the total development site was zoned C -1 and the other part RMH, that the overall development of the total site would be of much better quality, and that by rezoning the RMH portion the Commission could apply the condition of review of all plans. Motion by Mr. Lamb and seconded by Mr. Link to recommend to the City Council that that property legally described within the application and generally located at the northwest corner of the intersection of 62nd Avenue South and Southcenter Boulevard be rezoned from RMH to C -1 subject 'to the following conditions: 1. That no portion of the development have access from Southcenter Boulevard. 2. That no service station of any type be erected. 3. That all plans, to'include site, elevations, grading, landscape and signing, be submitted to the Planning Commission for review and approval, Motion carried with Mr. Saul and Mrs, Harris voting_ no, NEW BUSINESS Zoning Map Discrepancies Mr. Moss explained to the Commission that during research in regard to the Comprehensive Plan Study Review that the Staff had discovered several discrepancies between the zoning map prepared by Hill, Ingman, Chase Engineers, and the ordinances regarding the same parcel of land. Further explained that some parcels, depicted on the zoning map as an R -3 zone or an M -1 zone, had never even been zoned by ordinance. The map, used as an immediate guide to giving helpful zoning information, is erroneous and misleading. Thus, the staff has advertised Public Hearings for all the discrepancies (general discription of each to be attached to these minutes for reference purposes) and all property owners have been notified of the hearings as well as posting each property as such. Explained to the Commission that they are being asked to consider the appro- priateness, in each case, of a rezone from the existing classification for each property to the zoning classification as applied by the erroneous zoning map. PUBLIC HEARINGS Area #1: Staff read advertisement and Chairman Mettler opened the Public Hearing. Mr. K. C. Hoeft, David Jensen Associates, explained that his employer had purchased, the property under the impression of M -1 zoning as depicted on the City's zoning map, Dick Iiansen,Senior Planner, explained that his research revealed that upon annexation of the property in 1967 under Ordinance #478, should have been zoned R -1 -12.0 in accordance with Section 18.08.020 of the Tukwila Municipal Code. In actuality, the property never received any legal zoning; the map was changed at some date after annexation to reflect an M -1 classification. There is no ordinance classifying that parcel of land as such and it is therefore zoned R -1 -12.0 in accordance with Section 18.08.020, unless the Commission desires to recommend reclassification to M -1, This would seem appropriate as this parcel is completely surrounded by M - classified land and is anticipated for that use. However, if the Commission recommends rezone to M -1, it should also apply those conditions applied to the abutting M -1 land under the same ownership. Discussion by Commission. Due to reasons stated by Mr. Hoeft and Mr. Hansen (Staff) motion by Saul, seconded by Mr. Harrison and carried to close the Public Hearing. Motion by Mr. Saul, seconded by Mr. Harrision and carried to recommend to the City Council that Area #1 be rezoned from R -1 -12.0 to M -1 subject to the landowner entering into a contractual Developer's Agreement with the City of Tukwila to include all those conditions* as set forth in Ordinance #743. Area #2: Due to the fact the landowner was not present the Commission agreed to table this matter until 24 May 1973. Area #3: Staff read advertisement and Chairman Mettler opened the Public Hearing. Mr. Tom Kelly, 505 Arctic Building, Seattle, representing Mr. John Strander, owner of the property referred to as Area #3, explained that Ordinance #477 of the City of Tukwila annexed said property.. He also gave the Commission, for it's records, a copy of the Building Permit for the building and the sign, as well as a copy of Ordinance #477 showing that the building and business were established prior to annexation. Due to reasons as stated, motion by Mr, Harrison, seconded by Mr. Lamb and carried to close the Public Hearing. Motion by Mr. Link, seconded by Mr. Harrison and carried to recommend to the City Council that Area #3 be rezoned from R -1 -12.0 to C -2 in conformance with the Comprehensive Land -Use •Plan. Area #4: Due*to the fact the property owner was not present, Commission agreed to postpone the Public Hearing until 24 May 1973. Area #5: Staff read advertisement and Chairman Mettler opened the Public Hearing. Edith Halbert, 14726 Macadam Road, and Mr. Bud Scherler of the Lynden Lea Lodge both stated they had received correspondence, in 1960 or 1961, notifying them that their land had been zoned R -3. Also that they have been paying taxes according to that zone for a number of years. The Tukwila Babtist Church Pastor also recalled that one property owner within this area applied for a rezone from R -3 to RMH a few years back. It was denied and told that it would remain R -3. This would seem rather explicit to the property owner. In addition, the Church must be located within a residential zone. Motion by Mr. Sneva, seconded by Mr. Saul and carried to close the Public Hearing. Area #7: Staff read advertisement and Chairman Mettler opened the Public Hearing. Mr. John Sullivan, 65th Avenue South, stated he bought the property under the impression of R -3 zoning. Staff noted at this time that Mr. Carl McDaniel, 6420 So. 153rd, had contacted the Planning Department on 15 May 1973 and explained that he would not be able to attend the hearing due to previously arranged plans. However, he requested that, if the . other property owners within this particular area desire the R -3 zone as opposed to R -1, the Public Hearing be , recessed until such time as he has had a chance to discuss the zoning with his neighbors. Due to the fact this hearing is not felt to be of a critical nature and need not be acted upon with finality, it was moved by Mr. Zepp, seconded by Mrs. Harris and carried to recess the Public Hearing until 24 May 1973. Area #8: At the request of Mr. Herbert Lamb, speaking for the other three property owners, the Commission tabled this Public Hearing until 21 June 1973. Area #9: Staff read advertisement and Chairman Mettler opened the Public Hearing. Mr. Frank Alberti, representing the property owners, explained that most of the property owners had believed they had RMH zoning and went on to show the logic of RMH for this land due to the surrounding zoning, existing sewers, access to freeways, etc. Mr. John L. Barnes, 51st Avenue South, explained that at the time of annexation he was given the impression of RMH zoning and when the State bought some of his property for the freeway right -of -way they paid for RMH zoning after a court battle. Also stated that he has been paying taxes on RMH zoning. Motion by Mr. Lamb, seconded by Mr. Saul and carried to close the Public Hearing. In consideration of the foregoing, it was moved by Mr. Zepp, seconded by Mr. Harrison and carried to recommend to the City Council that Area #9 be rezoned from R -1 to RMH in compliance with the Comprehensive Land -Use Plan. Area #10: Staff read advertisement and Chairman Mettler opened the Public Hearing. Mr. Gary Mix, Puget Western, stated that Puget Western had always been under the impression the property was zoned R -4. Further stated it made no sense to leave a small portion of their property zoned R -1 and unuseable even for parking. Mrs. Pat VanDoren, an adjacent property owner, objected as she would rather see this land remain in a natural state. Mrs. Darlene West, also an adjacent property owner, reiterated Mrs. VanDoren's comments. Motion by Mr. Zepp, seconded by Mr. Lamb and carried to close the Public Hearing. In consideration of the foregoing and realizing the hazardous condition of 54th Avenue South and Slade Way, it was moved by Mr. Harrison and seconded by Mr. Lamb to recommend to the City Council that Area #10 be rezoned from R -1 to R -4 in compliance with the Comprehensive Land -Use Plan and subject to the condition that no access or egress be provided from Slade Way for any development of this site. Motion carried with Mrs. Harris voting no. Area #11: Staff read advertisement and Chairman Mettler opened the Public Hearing. No one was present to speak for or against the request. It was noted that this identical land area had been recommended for rezone only a few hours earlier and that this hearing is unnecessary. Motion by Mr. Link, seconded by Mr. Saul and carried to close the Public Hearing. Motion by Mr. Sneva, seconded by Mr. Lamb and carried to take no action regarding this matter due to action taken earlier as Item A of Old Business - Seattle City Light Rezone. BOARD OF ARCHITECTURAL REVIEW Sign Review Bon Marche Distribution Center Staff submitted letter from Bon Marche Distribution Center requesting they be allowed to install two signs (40 square feet each) within the landscape strip adjacent to Southcenter - .10 -, Parkway. Staff displayed photographs of the proposed signs and placement of said signs. Staff then displayed slides of existing signing for this facility. Noted that the existing freestanding sign more than adequately identifies the facility not only as the "Bon Marche" but also as their "Retail Warehouse Sales" facility, which is basically what the proposed signs would display. In consideration of the foregoing, it was moved by Mrs. Harris, seconded by Mr. Saul and carried to deny the request. Mr. Harrison abstained from voting on this matter due to business ties. Site Plan Review - Cabot, Cabot & Forbes Building 02 Staff displayed plans for Building #2 and noted that the Andover ACC has approved them. Discussion by Commission led to motion by Mrs. Harris, seconded by Mr. Saul and carried to approve the plans submitted subject to the following: 1. Technical review of all plans by the appro- priate City officials. 2. That final plan for landscaping and signing be submitted for review and approval of.the B.A.R. Landscape Plans - Cabot, Cabot & Forbes Staff displayed a Master Plan generally showing the intention of Cabot, Cabot & Forbes in regard to landscaping of their total land area. Also submitted final plans for Buildings #1 and #2. Motion by Mrs. Harris, seconded by Mr. Saul and carried to approve the Master Plan and final plans for Buildings #1 and #2 subject to the following: 1. That all plans be subject to technical review by appropriate City officials. 2. That a six (6) foot wide sidewalk be provided along all public streets. Don Koll Phase TT Mr. Byron Sneva stepped down from the Commission as he is employed by Don Koll and would like to present•the plans, 11 - Displayed site plan which reflected the changes recommended by the Planning Commission during the initial review. Mr. Lamb stepped down from the Commission to address the Commission in regard to a personal request as a citizen. Mr. Lamb explained that he resides within Area #8 (area #8 being one of the areas discovered to have zoning different from what the zoning map had always denoted) and that he and the other three residents had requested the zoning of the entire area be changed from whatever it presently is to C -2. Further explained that the request for rezone and the discrepancy in zoning had coincidentally occurred simultaneously. As he sees no reason for the Commission to spend time on an action which may or may not be changed only a month from now, he requested the Commission table the Public Hearing scheduled to determine the actual zoning until the regular meeting of June. It was the general concensus of the Commission to table the Public Hearing for Area #8 until the next regular meeting. Mr. Lamb at this time returned to the Commission. AREA #2: Chairman Mettler opened the Public Hearing for Area #2 as described in Staff Comments of 17 May 1973. Dick Hansen, Senior Planner, explained that his research had disclosed an annexation ordinance but the property had never officially been classified -by ordinance. The property in question is paved and used as parking for the ARCO station located there. Appears to have been . simply over- looked. 2 No one was present to speak for or against the action. Motion by Mr. Kirsop, seconded. by Mr. Lamb and carried to close the Public Hearing. In consideration of the foregoing, it was moved by Mr. Harrison, seconded by Mr. Zepp and carried to recommend to the City Council that Area #2 be rezoned from R -1 to C -2. AREA #4: Chairman Mettler opened the Public Hearing for Area #4 as described in Staff Comments of 17 May 1973. Mr. Hansen read letter from Black River Quarry, owner of Area #4, which requested the land be zoned M -1 as that is the zoning which was always thought to be applied. Mr. Hansen again explained that it appears,. by research, that the classification ordinance had simply been over- looked after annexation of the property. No one was present to speak against the action. Motion by Mr. Kirsop, seconded by Mr.. Saul and carried to close the Public Hearing. In consideration of the foregoing, it was moved by Mr. Sneva, seconded by Mr. Saul and carried to recommend to the City Council that Area #4 be rezoned from R -1 to M -1. AREA #6: Chairman Mettler opened the Public Hearing for Area #6 as described in Staff Comments of 17 May 1973. Mr. Hansen pointed out that Area #6 is a parcel of property extending down the hill from the Tukwila Park to Interurban Avenue. Further explained that this area had been zoned, by Ordinance #251 (the original zoning ordinance adopted in 1957), as PF. and had never been purchased by the City. The zoning map mistakenly depicts the property as R -4. Thus, since the owner has paid taxes under R -4 zoning, Staff suggests rezone to R -4. No one was present to speak for or against the action. Motion by Mrs. Harris, seconded by Mr. Lamb and carried to 'close the Public Hearing. Commission discussed the possibility of any development along the hillside under R -4 zoning. Commission generally felt the property too steep to develop and if in fact possible, any development would come under the requirements of the Environmental Policy Act of the State as well as the City's ordinance.. Also discussed the fact that if the property remains PF the City is obligated to purchase the property. In consideration of the foregoing, it was moved by Mr. Harrison, seconded by Mr. Zepp and carried to recommend to the City Council that Area #6 be rezoned from PF to R -4. Mrs. Harris voted NO due to the steep slope of the property., AREA 07: Chairman Mettler noted the Public Hearing of this area had been recessed to allow the property owners of the area to discuss the possibility of R -3 zoning as Mr. Carl McDaniel had requested. Mr. Hansen read a letter from Mr. Shawn Sullivan requesting the property be zoned R -3 as he had been under the impression the property was zoned R -3 when he purchased it. Mr. Hansen also noted that all property owners had been notified of tonight's meeting. There was no one present to speak against the action. Motion by Mr. Harrison, seconded by Mr. Zepp and carried to close the Public Hearing. Commission discussed history of the area as shown by staff's research.. The following are relevant facts regarding this matter. .1. The area was originally zoned R - 1.12 by Ordinance #251 in 1957. 2.. The map adopted by Ordinance #251 is of a small scale and difficult to define zoning boundaries, especially in this case. 3. It appears on the zoning map that this area was classified R -3. 4. The only property owner to speak regarding this action requests rezone to R -3. In consideration of the foregoing, it was moved by Mr. Zepp, seconded by Mr. Lamb and carried to recommend to' the City Council that Area #7 be rezoned from R-1 to R -3. - ..4 - This completed the agenda items from the meeting of 17 May 1973.. At this time, Mrs. Diane Goodwin, King County Housing Authority requested the Commission review the Authority's site plan and elevations for approval as required under the conditions imposed by the Commission in regard to the Conditional Use Permit granted at the regular February meeting of the Commission. Upon review, the Commission generally felt the plans met the intent of the Commission. However, on Mr. Harrison's suggestion, Mrs. Goodwin was asked to adjust the plans in some manner so as to allow rockery shown along the north property line can be set far enough from the driveway to allow adequate landscaping. Chairman Mettler set the date of 14 June 1973 for the next work meeting to continue the Comprehensive Plan Review. Mr. Saul informed Chairman Mettler that he will be on vacation until 8 July 1973. Motion by Mr. Saul, seconded by Mrs. Harris and carried to adjourn the continued meeting. The hearing revealed several relevant factors for by the Commission and they are noted as follows: 1. The property was classified R -1 by Ordinance #251 dated 1957. 2. For some unknown reason the zoning map was subsequently changed to show the property as R -3 although an Ordinance was never adopted to legally classify the land as such. 3. Mr. Shawn Sullivan, one of the four property owners of Area #7, was present for the hearing and stated that he purchased his property under the impression of R -3 zoning. Further stated that his home occupation of ceramics would not be allowed under R -1 zoning. 4. Staff related a telephone message from Mr. Carl McDaniel, another of the pro- perty owners, which stated his opposition to multiple- family zoning unless a majority of the property owners desired so, in which case he would like final action . tabled to allow him to discuss the matter with the other property owners. - President, City Council Page 2 In consideration of Mr. McDanield's request, it was moved by Mr. Zepp, seconded by Mrs. Harris and carried to recess the Public Hearing until 24 May 1973. At the meeting held 24 May 1973, the Public Hearing for Area #7 was continued. The continued hearing brought out the following outline of pertinent factors. 1. Mr. Shawn Sullivan, unable to this meeting, submitted a letter through the Planning Department to the Commission requesting rezone to R -3. 2. Staff noted that Mr. McDaniel had been informed of this meeting and had registered . no objection to the rezone. 3. Sub- sequently disputes as to the exact zoning established by ordinance number 251 resulted in a change in the zoning classification of the subject property from R -1 -12.0 to • R -3; however such zoning was not officially established. The property is occupied by four single family residences. The Planning Commission is now asked to consider a rezone for the subject property from R -1 -12.0 to R -3. 8. That property located south of So. 154th St. (Southcenter Boulevard), east of 51st Ave. So., west of 53rd Ave. So, and north of the right -of -way line for the Tukwila Freeway Interchange. This property was annexed to the City by ordinance number 303 dated March 30, 1960 and should have been assigned an R -1 -12:0 zoning classification which would have remained in effect until the installation of sewers under L.I.D. T#5 which would have changed the zoning classification of the property east of 52nd Ave. So. (extending southerly) to an R -1 -7.2 classification. The property however was incorrectly classified RMH on the City's zoning map. 'RMH zoning for the subject property has never been officially established; therefore the Planning Commission is now ' asked to consider a rezone for the subject property from R -1 -12.0 and R -1 -7.2 to RMH. 9. That property located south of the Tukwila Freeway Interchange, east of 51st Ave. So. extended, north of the south section line of section 23 township 23 N. range 4 E., and west of 53rd Ave. So. This property was annexed to the City by ordinance number 303 dated March 30, 1960 and should have been assigned an R -1 -12.0 zoning classification at that time. The pro- perty however has been incorrectly classified on the City's zoning map as RMFI. This zoning classification has never been officially established; therefore the Planning Commission is now asked to consider a rezone for the subject property from R -1 -12.0 to RMH. 10 That property located north and east of Slade Way and west of 53rd Ave. So. extended northerly. This property was assigned an R -1 -12.0 zoning classification by ordinance number 251 dated December 23, 1957. Subse- quently the zoning was incorrectly changed to R -4 (possibly a mistake at the time the adjacent property was rezoned to R -4), and has been indicated as such on the official City zoning map. However, the R -4 zoning classification has never been officially established; therefore the Planning Commission is now asked to consider a rezone for'the subject property from R -I -12.0 to R -4. 11. That property extending south of Strander Boulevard ,approximately 1400 feet, west of Andover Park West (extended southerly) approximately 1300 feet and east of Andover Park West (extended southerly) to the existing drainage ditch. This property was assigned an R -A zoning classification by ordinance number 251 dated December 23, 1957. Since .that time a P -F zoning classification was incorrectly assigned to the property. The P - F zoning designation was never officially assigned; therefore the •Planning Commission.is now asked to consider the °appropriateness of such a'rezone. Frank Todd, Mayor C QTY r "U KW 11 LA 14475 - 59TH AVENUE SOUTH TUKWILA,WASHINGTON 98067 Minutes of the Meeting, 17 May 1973 The regular monthly meeting of the Tukwila Planning Commission was called to order at 8;02 p.m, Members present were; Mr. Zepp, Mr. Sneva, Mr. Lamb, Mr. Link, Mrs. Harris, Mr. Mettler, Mr. Saul and Mr. Harrison, Chairman Mettler called for approval of the minutes of the last regular meeting, Motion by Mr. Sneva, seconded by Mrs. Harris and carried to approve the minutes of 19 April 1973 as prepared. OLD BUSINESS Seattle City Light - Rezone Del Moss, Planning Coordinator, gave background of this matter and brought Commission up to date since the Public Hearing for this matter was closed on 21 September 1972. The City and the applicant have been engaged in negotiations regarding the future development of Andover Park West. Mr. Moss also referred to Staff Comments (attached). Mr. Barney Hageland, Seattle City Light, stated that City Light has tentatively agreed to participate in the L,I.D. for Andover Park West. Also stated that City Light desires to withhold agreement to participate in L.I,D„ until they have reviewed distribution of assessments as well as cost figures for actual construction of Andover Park West. Discussion among Commissioners as to necessity of withholding action on the request until Seattle City Light has firmly agreed to the L.T.D. Mr. Harrison pointed out that agreement to the L.I.D. is a legal matter to be handled separately from the zoning request in respect to reviewing to insure a fair and equitable assessment. Motion by Mr. Harrison, seconded by Mr. Zepp and carried to recommend to the City Council that this application for rezone to CM be granted subject to the following conditions: • 1, That Seattle City Light dedicate to the City of Tukwila, without cost, necessary street right -of -way as well as adjacent easements for utilities. 2. That Seattle City Light agree to pay its' equitable share of the cost of public improvev mentsin connection with the construction' of the street and utilities. 3. That Seattle City Light enter into a con- tractual Developer's Agreement, to run with the land, certifying agreement to these conditions. Burlington Northern (Glacier Park) - Rezone Mr. Moss informed,the,Commission that staff was still working on zone revisions which is directly related to this request. Thus, staff requested Commission table this matter until the next regular monthly meeting. Upon agreement by the Com- missioners, Chairman Mettler tabled the matter as requested. CM Zone Revisions Mr. Moss reiterated the fact that staff was still in process of completing this task. Thus, upon general consensus of the Commission, this matter was tabled until the next regular meeting. Slade Way - Rezone Re- advertisement, from R -1 and R -4 to RMH, was read'and Chairman Mettler opened the Public Hearing. Gary Mix, Puget Western Inc., displayed drawings and pre- liminary site plan of a possible high density apartment complex which included several seventy or eighty foot high buildings. Explained that part of the total site was already zoned RMH and that Puget Western merely requests the remainder of the parcel be zoned the same so as to allow utilization of the total site. Mr. George Leeds, 5207 So. 164th, suggested that if application is granted it should include the requirement for sidewalks along Slade Way due to the anticipated increase in traffic, Mrs. Darlene West, 5212 So. 164th, objected to the request due to historically unstable soils and felt any development would be detrimental to the aesthetic quality of that particular area as well as downgrade the neighborhood. Mrs. Ann Crain, 5605 So. 163rd Place, asked if the property was to be developed by Puget Western or merely sold to someone who will develop it. Mr. Mix stated that Puget Western anticipated selling the property and working very closely with the developer to ensure a development of high quality.' Mrs. Pat VanDoren, 5165 So. 160th, also objected to the request and reiterated those reasons stated by Mrs. West. Chairman Mettler asked if there was anyone else who wished to speak in regard to this matter. No one rose. Motion by Mr. Harrison, seconded by Mr Lamb and carried to close the Public Hearing. Discussion among Commission as to slope percentage and extent of construction in regard to retaining walls, etc, Mrs. Harris quoted portions of a report made by the King County Environ- mental Development Commission regarding developments on slopes.. Mr. Moss stated that a detailed Environmental Impact Statement would be required prior to any development on this property. Mr. Harrison stated he has heard no solid reason why the request should be granted and that the property is useable as R -4 especially considering the fact that no detailed plans have been committed for the site. Mr. Harrison out- lined the possible alternatives available to the•Commission as follows; A. Grant the request and apply development con- ditions to the total parcel. B. Deny the request. Upon further discussion, the Commission felt the land requested for rezone to RMH is useable as presently zoned, that the existing zone provided a necessary 'buffer zone' between the adjacent single- family residential area and that portion of land already zoned RMH and in light of considerable protest by neighboring property owners the request was not justified. Motion by Mr. Saul, seconded by Mrs. Harris and carried to deny the request by Puget Western to rezone the Slade Way property from R -1 and R -4 to RMH. Chairman Mettler advised the applicant of his right to appeal the Commissions decision to the City Council. •4 Chairman Mettler noted there was no one present to speak against the request. Comprehensive Plan Review Mr. Moss briefly brought the Commission up to date on this matter and reminded the Commission that another work meeting should. be scheduled. Chairman Mettler agreed to set a date at the end of this meeting. Underground Utilities Comprehensive Plan Mr. Moss referred to Staff comments and the Commission agreed to table this matter until the next regular meeting. Wimmer - Rezone Staff read re- advertisement and Chairman Mettler opened the Public Hearing. Mr. Moss briefly explained request for rezone from RMH to C -1 and drawing showing that the applicant owns two parcels and is contract purchaser on the third. Mr. Tom Wimmer, 7756 Seward Park Avenue South, Seattle, explained drawings and history of zoning. Noted that former E -R -O zone, which included a 150 -foot strip of land along Southcenter Bouelvard extending from Macadam Road to 62nd Avenue South, was rezoned by the City to C -1 some years ago. In connection with construction of the Freeway the State realigned 62nd Avenue South, by placing the intersection farther east. The old 62nd Avenue right -of -way was vacated back to the abutting property owners. Prior to relocation and subsequent vacation of the old right -of -way, the land west of 62nd Avenue was zoned C -1 while that land east of 62nd Avenue was zoned RMH. Upon vacation of the old right -of -way, the west half was returned to the abutting property owner to the west and automatically received same zoning as that land to which it was added. The east half was vacated to the abutting property owner to the east and automatically recieved RMH zoning. This zoning has stayed that way since. Mr. Wimmer now desires to develop his commercially zoned property, but feels with the purchase of additional land, if properly zoned, he could ensure a more environmentally aesthetic development. Mr. Hammons, co -owner of the property, stated the obvious intent of the Commission years ago was to provide commercial land between Macadam Road and•162nd Avenue South. Since the relocation of 62nd Avenue farther east, leaving a small portion of land zoned RMH between Macadam Road and 62nd Avenue, this request is within the intent of the original zoning and would allow them to enhance the development of the property. Motion by Mr. Harrison seconded by Mr, Link and carried to close the Public Hearing, Mr. Sneva clarified the fact that the total of all the parcels would be accessible only from 62nd Avenue South, Mr. Harrison asked if there were any specific development plans for a particular development, Mr. Wimmer stated they intend to develop the property as shown in the drawing attached to the application. Discussion by Commission of the facts pertinent to this matter included the relocation and subsequent vacation of 62nd Avenue South creating a small portion of land zoned RMH, that part of the total development site was zoned C -1 and the other part RMH, that the overall development of the total site would be of much better quality, and that by rezoning the RMH portion the Commission could apply the condition of review of all plans. Motion by Mr. Lamb and seconded by Mr. Link to recommend to the City Council that that property legally described within the application and generally located at the northwest corner of the intersection of 62nd Avenue South and Southcenter Boulevard be rezoned from RMH to C -1 subject'to the following conditions: 1. That no portion of the development have access.from Southcenter Boulevard. 2. That no service station of any type be erected. 3. That all plans, to include site, elevations, grading, landscape and signing, be submitted to the Planning Commission for review and approval, Motion carried with Mr. Saul and Mrs, Harris voting no, NEW BUSINESS Zoning Map Discrepancies Mr. Moss explained to the Commission that during research in regard to the Comprehensive Plan Study Review that the Staff had discovered several discrepancies between the zoning map prepared by Hill, Ingman, Chase Engineers, and the ordinances regarding the same parcel of land. Further explained that some parcels, depicted on the zoning map as an R -3 zone or an M - zone, had never even been zoned by ordinance. The map, used as an immediate guide to giving helpful zoning information, is erroneous and misleading. Thus, the staff has advertised Public Hearings for all the discrepancies (general discription of each to be attached to these minutes for reference purposes) and all property owners have been notified of the hearings as well as posting each property as such. Explained to the Commission that they are being asked to consider the appro- priateness, in each case, of a rezone from the existing classification for each property to the zoning classification as applied by the erroneous zoning map. PUBLIC HEARINGS Area #1: Staff read advertisement and Chairman Mettler opened the Public Hearing. Mr. K. C. Hoeft, David Jensen Associates, explained that his employer had purchased.the property under the impression of M -1 zoning as depicted on the City's zoning map. Dick Hansen, Senior Planner, explained that his research revealed that upon annexation of the property in 1967 under Ordinance #478, should have been zoned R -1 -12.0 in accordance with Section 18.08.020 of the Tukwila Municipal Code. In actuality, the property never received any legal zoning; the map was changed at some date after annexation to reflect an M -1 classification. There is no ordinance classifying that parcel of land as such and it is therefore zoned R -1 -12.0 in accordance with Section 18,08.020, unless the Commission desires to recommend reclassification to M -1. This would seem appropriate as this parcel is completely surrounded by M -1 classified land and is anticipated for that use. However, if the Commission recommends rezone to M -1, it should also apply those conditions applied to the abutting M -1 land under the same ownership. Discussion by Commission. Due to reasons stated by Mr. Hoeft and Mr. Hansen (Staff) motion by Saul, seconded by Mr. Harrison and carried to close the Public Hearing. Motion by Mr. Saul, seconded by Mr. Harrision and carried to recommend to the City Council that Area #1 be rezoned from R -1 -12.0 to M -1 subject to the landowner entering into a contractual Developer's Agreement with the City of Tukwila to include all those conditions as set forth in Ordinance #743, Area #2: Due to the fact the landowner was not present the Commission agreed to table this matter until 24 May 1973', 7 - Area #3: Staff read advertisement and Chairman Mettler opened the Public Hearing. Mr. Tom Kelly, 505 Arctic Building, Seattle, representing Mr. John Strander, owner of the property referred to as Area #3, explained that Ordinance #477 of the City of Tukwila annexed said property. He also gave the Commission, for it's records, a copy of the Building Permit for the building and the sign, as well as a copy of Ordinance #477 showing that the building and business were established prior to annexation. Due to reasons as stated, motion by Mr, Harrison, seconded by Mr. Lamb and carried to close the Public Hearing. Motion by Mr. Link, seconded by Mr. Harrison and carried to recommend to the City Council that Area #3 be rezoned from R -1 -12.0 to C -2 in conformance with the Comprehensive Land -Use Plan. Area #4: Due to the fact the property owner was not present, Commission agreed to postpone the Public Hearing until 24 May 1973. Area #5: Staff read advertisement and Chairman Mettler opened the Public Hearing. • Edith Halbert, 14726 Macadam Road, and Mr. Bud Scherler of the Lynden Lea Lodge both stated they had received correspondence, in 1960 or 1961, notifying them that their land had been zoned R -3. Also that they have been .paying taxes according to that zone for a number of years. The Tukwila Babtist Church Pastor also recalled that one property owner within this area applied for a rezone from R -3 to RMH a few years back. It was denied and told that it would remain R -3. This would seem rather explicit to the property owner. In addition, the Church must be located within a residential zone. Motion by Mr. Sneva, seconded by Mr. Saul and carried to close the Public Hearing. In consideration of the foregoing statements by the property owners, it was moved by Mr. Sneva, seconded by Mr. Harrison and carried to recommend to the City Council that Area #5 be rezoned from R -1 -7.2 to R -3 in conformance with the Compre- hansive Land -Use Plan. Area #6: Due to the fact the property owner was not present, the Commission agreed to postpone this item until 24 May 1973. Area #7: Staff read advertisement and Chairman Mettler opened the Public Hearing. Mr. John Sullivan, 65th Avenue South, stated he bought the property under the impression of R -3 zoning. Staff noted at this time that Mr. Carl McDaniel, 6420 So. 153rd, had contacted the Planning Department on 15 May 1973 and explained that he would not be able to attend the hearing due to previously arranged plans, However, he requested that, if the other property owners within this particular area desire the R -3 zone as opposed to R -1, the Public Hearing be recessed until such time as he has had a chance to discuss the zoning with his neighbors, Due to the fact this hearing is not felt to be of a critical nature and need not be acted upon with finality, it was moved by Mr. Zepp, seconded by Mrs. Harris and carried to recess the Public Hearing until 24 May 1973, Area #8: At the request of Mr. Herbert Lamb, speaking for the other three property owners, the Commission tabled this Public Hearing until 21 June 1973. Area #9: Staff read advertisement and Chairman Mettler opened the Public Hearing. Mr. Frank Alberti, representing the property owners, explained that most of the property owners had believed they had RMH zoning and went on to show the logic,of RMH for this land due to the surrounding zoning, existing sewers, access to freeways, etc. Mr. John L. Barnes, 51st Avenue South, explained that at the time of annexation he was given the impression of RMH zoning and when the State bought some of his property for the freeway right -of -way they paid for RMH zoning after a court battle. Also stated that he has been paying taxes on RMH zoning. Motion by Mr. Lamb, seconded by Mr. Saul and carried to close the Public Hearing, In consideration of the foregoing, it was moved by Mr. Zepp, seconded by Mr, Harrison and carried to recommend to the City Council that Area #9 be rezoned from R -1 to RMH in compliance with the Comprehensive Land -Use Plan. Area #10: Staff read advertisement and Chairman Mettler opened the Public Hearing. Mr. Gary Mix, Puget Western, stated that Puget Western had always been under the impression the property was zoned R -4. Further stated it made no sense to leave a small portion of their property zoned R -1 and unuseable even for parking. Mrs. Pat VanDoren, an adjacent property owner, objected as she would rather see this land remain in a natural state. Mrs. Darlene West, also an adjacent Mrs. VanDoren's comments. property owner, reiterated Lamb and carried to close Motion by Mr. Zepp, seconded by Mr. the Public Hearing. In consideration of the foregoing and realizing the hazardous condition of 54th Avenue South and Slade Way, it was moved by Mr. Harrison and seconded by Mr. Lamb to recommend to the City Council that Area #10 be rezoned from R -1 to R -4 in compliance with the Comprehensive Land -Use Plan and subject to the condition that no access or egress be provided from Slade Way for any development of this site. Motion carried with Mrs. Harris voting no. Area #k11: Staff read advertisement and Chairman Mettler opened the Public Hearing. No one was present to speak for or against the request. It was noted that this identical land area had been recommended for rezone only a few hours earlier and that this hearing is unnecessary. Motion by Mr. Link, seconded by Mr. Saul and carried to close the Public Hearing. Motion by Mr. Sneva, seconded by Mr. Lamb and carried to take no action regarding this matter due to action taken earlier as Item A of Old Business - Seattle City Light Rezone. BOARD OF ARCHITECTURAL REVIEW Sign Review - Bon Marche Distribution Center Staff submitted. letter from Bon Marche Distribution Center requesting they be allowed to install two signs (40 square feet each) within the landscape strip adjacent to Southcenter - 10 - Parkway. Staff displayed photographs of the proposed signs and placement of said signs. Staff then displayed slides of existing signing for this • facility. Noted that the existing freestanding sign more than adequately identifies the facility not only as the "Bon Marche" but also as their "Retail Warehouse Sales" facility, which is basically what the proposed signs would display. In consideration of the foregoing, it was moved by Mrs. Harris, seconded by Mr. Saul and carried to'deny the request. Mr. Harrison abstained from voting on this matter due to business ties. Site Plan Review - Cabot, Cabot & Forbes Building #2 Staff displayed plans for Building #2 and noted that the Andover ACC has approved them. Discussion by Commission led to motion by Mrs. Harris, seconded by Mr. Saul and carried to approve the plans submitted subject to the following: 1. Technical review of all plans by the appro- priate City officials. 2.• That final plan for landscaping and signing be submitted for review and approval of the B.A.R. Landscape Plans.- Cabot, Cabot & Forbes Staff displayed a Master Plan generally showing the intention of Cabot, Cabot & Forbes in regard to landscaping of their total land area. Also submitted final plans for Buildings #1 'and #2, Motion by Mrs. Harris, seconded by Mr. Saul and carried to approve the Master Plan and final plans for Buildings #1 and #2 subject to the following: 1. That all plans be subject to technical review by appropriate City officials. 2. That a six (6) foot wide sidewalk be provided along all public streets. Don Koll Phase II Mr. Byron Sneva stepped down from the Commission as he is employed by Don, Koll and would like to present the plans, Displayed site plan which reflected the changes recommended by the Planning Commission during the initial review. Motion by Mr. Link, seconded by Mrs. Harris and carried to approve the plans subject to technical review by appropriate City officials and that detailed landscape and landscape maintenance plans be submitted for review and approval by the B.A.R. Members present were: Mr. Zepp, Mr. Saul, Mr. Sneva, Mr. Harrison, Mr. Mettler, Mr. Kirsop, Mr. Lamb and Mrs. Harris. • It was the general concensus of the Commission to table the Public Hearing for Area #8 until the next regular meeting. Mr. Lamb at this time returned to the Commission. Mr. Lamb stepped down from the Commission to address the Commission in regard to a personal request as a citizen. Mr. Lamb explained that he resides within Area #8 (area #8 being one of the areas discovered to have zoning different from what the zoning map had always denoted) and that he and the other three residents had requested the zoning of the entire area be changed from whatever it presently is to C -2. Further explained that the request for rezone and the discrepancy in zoning had coincidentally occurred simultaneously. As he sees no reason for the Commission to spend time on an action which may or may not be changed only a month "from now, he requested the Commission table the Public Hearing scheduled to determine the actual zoning until the regular meeting of June. At that time he will have the property owners present and the Commission may review the rezone request. AREA #2: Chairman Mettler opened the Public Hearing for Area #2 as described in Staff Comments of 17 May 1973. Dick Hansen, Senior Planner, explained that his research had disclosed an annexation ordinance but the property had never officially been classified by ordinance. The property . in question is paved and used as parking for the ARCO station located there. Appears to have been . simply over- looked. No one was present to speak for or against the action. Motion by Mr. Kirsop, seconded. by Mr. Lamb and carried to close the Public Hearing. In consideration of the foregoing, it was moved by Mr. Harrison, seconded by Mr. Zepp and carried to recommend to the City Council that Area #2 be rezoned from R -1 to C -2. AREA #4: Chairman Mettler opened the Public Hearing for Area #4 as described in Staff Comments of 17 May 1973. Mr. Hansen read letter from Black River Quarry, owner of Area #4, which requested the land be zoned M -1 as that is the zoning which was always thought to be applied. Mr. Hansen again explained that it appears, by research, that the classification ordinance had simply been over- looked after annexation of the property. No one was present to speak against the action. Motion by Mr. Kirsop, seconded by Mr. Saul and carried to close the Public Hearing. In consideration of the foregoing, it was moved by Mr. Sneva, seconded by Mr. Saul and carried to recommend to the City Council that Area #4 be rezoned from R -1 to M - AREA #6: Chairman Mettler opened the Public Hearing for Area #6 as described in Staff Comments of 17 May 1973. Mr. Hansen pointed out that Area #6 is a parcel of property extending down the hill from the Tukwila Park to Interurban Avenue. Further explained that this area had been zoned, by Ordinance #251 (the original zoning ordinance adopted in 1957), as PF. and had never been purchased by the City. The zoning map mistakenly depicts the property as R -4. Thus, since the owner has paid taxes under R - zoning, Staff suggests rezone to R - 4. No one was present to speak for or against the action. Motion by Mrs. Harris, seconded by Mr. Lamb and carried to close the Public Hearing. Commission discussed the possibility of any development along the hillside under R -4 zoning. Commission generally felt the property too steep to develop and if in fact possible, any development would come under the requirements of the Environmental Policy Act of the State as well as the City's ordinance., Also discussed the fact that if the property remains PF the City is obligated to purchase the property. In consideration of the foregoing, it was moved by Mr. Harrison, seconded by Mr. Zepp and carried to recommend to the City Council that Area #6 be rezoned from PF to R -4. Mrs. Harris voted NO due to the steep slope of the property. AREA #7: Chairman Mettler noted. the Public Hearing of this area had been recessed to allow the property owners of the area to discuss the possibility of R -3 zoning as Mr. Carl McDaniel had requested. Mr. Hansen read a letter from Mr. Shawn Sullivan requesting the property be zoned R -3 as he had been under the impression the property was zoned R -3 when he purchased it. Mr: Hansen also noted that all property owners had been notified of tonight's meeting. There was no one present to speak against the action. Motion by Mr. Harrison, seconded by Mr. Zepp and carried to close the Public Hearing. Commission discussed history of the area as shown by staff's research.. The following are relevant facts regarding this matter. 1. The area was originally zoned R -1.12 by Ordinance #251 in 1957. 2. The map adopted by Ordinance #251 is of a small scale and difficult to define zoning boundaries, especially in this case. 3. It appears on the zoning map that this area was classified R -3. 4. The only property owner to speak regarding this action requests rezone to R -3. In consideration of the foregoing, it was moved by Mr. Zepp, seconded by Mr. Lamb and carried to recommend to City Council that Area #7 be rezoned froma-1.tO R-3. - .4 - This completed the agenda items from the meeting of 17 May 1973. At this time, Mrs. Diane Goodwin, King County, Housing Authority requested the Commission review the Authority's site plan and elevations for approval as required under the conditions imposed by the Commission in regard to the Conditional Use Permit granted at the regular February meeting of the Commission. Upon review, the Commission generally felt the plans met the intent of the Commission. However, on Mr. Harrison's suggestion, Mrs. Goodwin was asked to adjust the plans in some manner so as to allow the rockery shown along the north property line can be set far enough from the driveway to allow adequate landscaping. Chairman Mettler set the date of 14 June 1973 for the next work meeting to continue the Comprehensive Plan. Review. Mr. Saul informed Chairman Mettler that he will be on vacation until 8 July 1973. Motion by Mr. Saul, seconded by Mrs. Harris and carried to adjourn the continued meeting. Area #10 is described in the enclosure hereto. The hearing revealed several relevant factors of discussion by the Commission and they are noted below. 1. Ordinance #251 dated 23 December 1957 assigned this property an R -1 classifi- cation. 2. Ordinance #316 dated 16 January 1961 , rezoned the abutting property to the east R -4. 3. At the time the zoning map was changed to reflect the rezone of Ordinance #316 Area #10 was also changed to R -4. 4. However, Ordinance #316 does not legally describe Area #10. 5. Mr. Gary Mix, representing Puget Western . the property owner, stated that Puget Western had always been under the impres- sion the property was zoned R -4 because the City's zoning map showed the entire parcel as R -4. Mr. Mix further stated that if the portion of property already zoned R -4 were to be developed, the property presently zoned R -1 (Area #10) would not be useable, even for parking. 7. Mrs. Pat VanDoren, a nearby property owner, objected to any rezone of the property as she would rather see it remain in a natural state. 9. Mrs. Darlene West, a nearby property owner, reiterated Mrs. VanDoren's statement. 10. That 54th Avenue South as well as Slade Way are of a hazardous nature and their use should be limited. Upon consideration of the foregoing it was moved by Mr. Harrison, seconded by Mr. Lamb and carried to recommend to the City Council that Area #10 be rezoned from R -1 to R -4 in compliance with the Comprehensive Land -Use Plan, subject to the condition that no access or egress be provided to or from Slade Way for any development of . this site. Mrs. Harris voted no due to the steep.slope of the property. Copies of all pertinent information related to this matter are attached for your consideration and appropriate action. Motion by Mr. Sneva, seconded by Mrs. Harris and,carried to approve the, minutes of 19 April 1973 as prepared. OLD BUSINESS Seattle City Light - Rezone Del Moss, Planning Coordinator, gave background of this matter and brought Commission up to date since the Public Hearing for this matter was closed on 21 September 1972. The City and the applicant have been engaged in negotiations regarding the future development of Andover Park West. Mr. Moss also referred to Staff Comments (attached). Mr. Barney Hageland, Seattle City Light, stated that City Light has tentatively agreed to participate in the L.I.D. for Andover Park West. Also stated that City Light desires to withhold agreement to participate in L.I.D. until they have reviewed distribution of assessments as well as cost figures for actual construction of Andover Park West. Discussion among Commissioners as to necessity of withholding action on the request until Seattle City Light has firmly agreed to the L.I.D. Mr. Harrison pointed out that agreement to the L.I.D. is a legal matter to be handled separately from the zoning request in respect to reviewing to insure a fair and equitable assessment. Motion by Mr. Harrison, seconded by Mr. Zepp and carried to recommend to the City Council that this application for ' rezone to CM be granted subject to the following conditions: 2 ,. 1, That Seattle City Light dedicate to the City of Tukwila, without cost, necessary street right -of -way as well as adjacent easements for utilities. 2. That Seattle City Light agree to pay its' equitable share of the cost of public improver mentsin connection with the construction' of the street and utilities. 3. That Seattle City Light enter into a con- tractual Developer's Agreement, to run with the land, certifying agreement to these conditions. Burlington Northern (Glacier Park) - Rezone Mr. Moss informed the,Commission that staff was still working on zone revisions which is directly related to this request. Thus, staff requested Commission table this matter until the next regular monthly meeting. Upon agreement by the Com- missioners, Chairman Mettler tabled the matter as requested. CM Zone Revisions Mr. Moss reiterated the fact that staff was still in process of completing this task. Thus, upon general consensus of the Commission, this matter was tabled until the next regular meeting. Slade Way - Rezone Re- advertisement, from R -1 and R -4 to RMH, was read and. Chairman Mettler opened the Public Hearing. Gary Mix, Puget Western, Inc., displayed drawings and pre- liminary site plan of a possible high density apartment complex which included several seventy or eighty foot high buildings. Explained that part of the total site was already zoned RMH and that Puget Western merely requests the remainder of the parcel be zoned the same so as to allow utilization of the total site. Mr. George Leeds, 5207 So. 164th, suggested that if application is granted it should include the requirement for sidewalks along Slade Way due to the anticipated increase in traffic, Mrs. Darlene West, 5212 So. 164th, objected to the request ,due to historically unstable soils and felt any development would be detrimental to the aesthetic quality of that particular area as well as downgrade the neighborhood. Mrs. Ann Crain,' 5605 So. 163rd Place, asked if the property was to be developed by Puget Western or merely sold to someone who will develop it. Mr. Mix stated that Puget Western anticipated selling the property and working very closely with the developer to ensure a development of high quality.' Mrs. Pat VanDoren, 5165 So. 160th, also objected to the request and reiterated those reasons stated by Mrs. West. Chairman Mettler asked if there was anyone else who wished to speak in regard to this matter. No one rose. Motion by Mr. Harrison, seconded by Mr'. Lamb and carried to close the Public Hearing. Discussion among Commission as to slope percentage and extent of construction in regard to retaining walls, etc. Mrs. Harris quoted portions of a report made by the King County Environ- mental Development Commission regarding developments on slopes. Mr. Moss stated that a detailed Environmental Impact Statement would be required prior to any development on this property. Mr. Harrison stated he has heard no solid reason why the request should be granted and that the property is useable as R -4 especially considering the fact that no detailed plans have been committed for the site. Mr. Harrison out- lined the possible alternatives available to the Commission as follows: A. Grant the request and apply development con- ditions to the total parcel. B. Deny the request. Upon further discussion, the Commission felt the land . requested for rezone to RMH is useable as presently zoned, that the existing zone provided a necessary 'buffer zone' between the adjacent single - family residential area and that portion of land already zoned RMH and in light of considerable protest by neighboring property owners the request was not justified. Motion by Mr. Saul, seconded by Mrs. Harris and carried to deny the request by Puget Western to rezone the Slade Way property from R -1 and R -4 to RMH. Chairman Mettler advised the applicant of his right to appeal the Commissions decision to the City Council..' Comprehensive Plan Review Mr. Moss briefly brought the Commission up to date on this matter and reminded the Commission that another work meeting should be scheduled. Chairman Mettler agreed to set a date at the end of this meeting. Underground Utilities Comprehensive Plan Mr. Moss referred to Staff comments and the Commission agreed to table this matter until the next regular meeting. Wimmer - Rezone Staff read re- advertisement and Chairman Mettler opened the Public Hearing. Mr. Moss briefly explained request for rezone from RMH to C -1 and drawing showing that the applicant owns two parcels and is contract purchaser on the third. Mr. Tom Wimmer, 7756 Seward Park Avenue South, Seattle, explained drawings and history of zoning. Noted that former E -R -O zone, which included a 150 -foot strip of land along Southcenter Bouelvard extending from Macadam Road to 62nd Avenue South, was rezoned by the City to C -1 some years ago. In connection with construction of the Freeway the State realigned 62nd Avenue South, by placing the intersection farther east. The old 62nd Avenue right -of -way was vacated back to the abutting property owners. Prior to relocation and subsequent vacation of the .old right -of -way, the land west of 62nd Avenue was zoned C -1 while that land east of 62nd Avenue was zoned RMI-I. Upon vacation of the old right -of -way, the west half was returned to the abutting property owner to the west and automatically received same zoning as that land to which it was added. The east half was vacated to the abutting property owner to the east and automatically recieved RMH zoning. This zoning has stayed that way since. Mr. Wimmer now desires to develop his commercially zoned property, but feels with the purchase of additional land, if properly zoned, he could ensure a more environmentally aesthetic development. Mr. Hammons, co -owner of the property, stated the obvious intent of the Commission years ago was to provide commercial land between Macadam Road and I.62nd Avenue South. Since the relocation of 62nd Avenue farther east, leaving a small portion of land zoned RMH between Macadam Road and 62nd Avenue, this request is within the intent of the original zoning and would allow them to enhance the development of the property. Chairman Mettler noted there was no one present.to speak against the request. • 5 IMO Motion by Mr. Harrison seconded by Mr, Link and carried to close the Public Hearing, Mr. Sneva clarified the fact that the total of all the parcels would be accessible only from 62nd Avenue South, Mr. Harrison asked if there were•any specific development plans for a particular development, Mr. Wimmer stated they intend to develop the property as shown in the drawing attached to the application. Discussion by Commission of the facts pertinent to this matter included the relocation and subsequent vacation of 62nd Avenue South creating a small portion of land zoned RMH, that part of the total development site was zoned C -1 and the other part RMH, that the overall development of • the total site would be of better quality, and that • by rezoning the RMH portion the Commission could apply the condition of review of all plans. Motion by Mr. Lamb and seconded by Mr. Link to recommend to the City Council that that property legally described within the application and generally located at the northwest corner • of the intersection of 62nd Avenue South and Southcenter Boulevard be rezoned from RMH to C -1 subject to the following conditions: 1. That no portion of the development have access from Southcenter Boulevard. 2. That no service station of any type be erected. 3. That all plans, to include site, elevations, grading, landscape and signing, be submitted . to the Planning Commission for review and Motion carried with Mr. Saul and Mrs, Harris voting. no, NEW BUSINESS Zoning Map Discrepancies Mr. Moss explained to the Commission that during research in regard to the Comprehensive Plan Study Review that the Staff had discovered several discrepancies between the zoning map prepared by Hill, Ingman, Chase Engineers, and the ordinances regarding the same parcel of land. Further explained that some parcels, depicted on the zoning map as an R -3 zone or an M -1 zone, had never even been zoned by ordinance. The map, used as an immediate guide to giving helpful zoning information, is erroneous and misleading. Thus, the staff has advertised Public Hearings for all the discrepancies (general discription of each to be attached to these minutes for reference purposes) and all property owners have been notified of the hearings as well as posting each property as such. Explained to the Commission that they are being asked to consider the appro- priateness, in each case, of a rezone from the existing classification for each property to the zoning classification as applied by the erroneous zoning map. PUBLIC HEARINGS Area 41: Staff read advertisement and Chairman Mettler opened the Public Hearing. Mr. K. C. Hoeft, David Jensen Associates,, explained that his employer had purchased the property under the impression of M -1 zoning as depicted on the City's zoning map, Dick Hansen, Senior Planner, explained that his research revealed that upon annexation of the property in 1967 under Ordinance #478, should have been zoned R -1 -12.0 in accordance with Section 18.08.020 of the Tukwila Municipal Code. In actuality, the property never received any legal zoning; the map was changed at some date after annexation to reflect an M -1 classification. There is no ordinance classifying that parcel of land as such and it is therefore zoned R -1 -12.0 in accordance with Section 18.08.020, unless the Commission desires to recommend reclassification to M -1. This would seem appropriate as this parcel is completely surrounded by M -1 classified land and is anticipated for that use. However, if the Commission recommends rezone to M -1, it should also apply those conditions applied to the abutting M - land under the same ownership. Discussion by Commission. Due to reasons stated by Mr. Hoeft and Mr. Hansen (Staff) motion by Saul, seconded by Mr. Harrison and carried to close the Public Hearing. Motion by Mr. Saul, seconded by Mr. Harrision and carried to recommend to the City Council that Area #1 be rezoned from R -1 -12.0 to M -1 subject to the landowner entering into a contractual Developer's Agreement with the City of Tukwila to include all those conditions as set forth in Ordinance #743. Area #2: Due to the fact the landowner was not present the Commission agreed to table this matter until 24 May 1973'. Area #5: Staff read advertisement and Chairman Mettler opened the Public Hearing. Motion by Mr. Sneva, seconded by Mr. Saul and carried to close the Public Hearing. Area #3: Staff read advertisement and Chairman Mettler opened the Public Hearing. Mr. Tom Kelly, 505 Arctic Building, Seattle, representing Mr. John Strander, owner of the property referred to as Area #3, explained that Ordinance #477 of the City of Tukwila annexed said property.. He also gave the Commission, for it's records, a copy of the Building Permit for the building and the sign, as well as a copy of Ordinance #477 showing that the building and business were established prior to annexation. Due to reasons as stated, motion by Mr, Harrison, seconded by Mr. Lamb and carried to close the Public Hearing. Motion by Mr. Link, seconded by Mr. Harrison and carried to recommend to the City Council that Area #3 be rezoned from R -1 -12.0 to C -2 in conformance with the Comprehensive Land -Use Plan, • Area #4: Due to the fact the property owner was not present, Commission agreed to postpone the Public Hearing until • 24 May 1973. Edith Halbert, 14726 Macadam Road, and Mr. Bud Scherler of the Lynden Lea Lodge both stated they had received correspondence, in 1960 or 1961, notifying them that their land had been zoned R -3. Also that they have been paying taxes according to that zone for a number of years. The Tukwila Babtist Church Pastor also recalled that one property owner within this area applied for a rezone from R -3 to RMH a few years back. It was denied and told that it would remain R -3. This would seem rather explicit to the property owner. In addition, the Church must be located within a residential zone. In consideration of the foregoing statements by the property owners, it was moved by Mr. Sneva, seconded by Mr. Harrison and carried to recommend to the City Council that Area #5 be rezoned from R -1 -7.2 to R -3 in conformance with the Compre- hansive Land -Use Plan. Area #6: Due to the fact the property owner was not present, the Commission agreed to postpone this item until 24 May 1973. Area #7: Staff read advertisement and Chairman Mettler opened the Public Hearing. Mr. John Sullivan, 65th Avenue South, stated he bought the property under the impression of R -3 zoning. Staff noted at this time that Mr. Carl McDaniel, 6420 So. 153rd, had contacted the Planning Department on 15 May 1973 and explained that he would not be able to attend the hearing due to previously arranged plans. However, he requested that, if the other property owners within this particular area desire the R -3 zone as opposed to R -1, the Public Hearing be recessed until such time as he has had a chance to discuss the zoning with his neighbors. Due to the fact this hearing is not felt to be of a critical nature and need not be acted upon with finality, it was moved by Mr. Zepp, seconded by Mrs. Harris and carried to recess the Public Hearing until 24 May 1973. Area #8: At the request of Mr. Herbert Lamb, speaking for the other three property owners, the Commission tabled this Public Hearing until 21 June 1973. Area #9: Staff read advertisement and Chairman Mettler opened the Public Hearing. Mr. Frank Alberti, representing the property owners, explained that most of the property owners had believed they had RMH zoning and went on to show the logic of RMH for this land due to the surrounding zoning, existing sewers, access to freeways, etc. Mr. John L. Barnes, 51st Avenue South, explained that at the time of annexation he was given the impression of RMH zoning and when the State bought some of his property for the freeway right -of -way they paid for RMH zoning after a court battle. Also stated that he has been paying taxes on RMH zoning. Motion by Mr. Lamb, seconded by Mr. Saul and carried to close the Public Hearing. In consideration of the foregoing, it was moved by Mr, Zepp, seconded by Mr, Harrison and carried to recommend to the City . Council that Area #9 be rezoned from R -1 to RMH in compliance with the Comprehensive Land -Use Plan. 9• Area #10: Staff read advertisement and Chairman Mettler opened the Public Hearing. Mr. Gary Mix, Puget Western, stated that Puget Western had always been under the impression the property was zoned R -4. Further stated it made no sense to leave a small portion of their property zoned R -1 and unuseable even for parking. Mrs. Pat VanDoren, an adjacent property owner, objected as she would rather see this land remain in a natural state. Mrs. Darlene West, also an adjacent property owner, reiterated Mrs. VanDoren's comments. Motion by Mr. Zepp, seconded by Mr. Lamb and carried to close the Public Hearing. In consideration of the foregoing and realizing the hazardous condition of 54th Avenue South and Slade Way, it was moved by Mr. Harrison and seconded by Mr. Lamb.to recommend to the City Council that Area #10 be rezoned from R -1 to R -4 in with the Comprehensive Land -Use Plan and subject to the condition that no access or egress be provided from Slade Way for any development of this site. Motion carried with Mrs. Harris voting no. Area #11: Staff read advertisement and Chairman Mettler opened the Public Hearing. No one was present to speak for or against the request. It was noted that this identical land area had been recommended for rezone only a few hours earlier and that this hearing is unnecessary. Motion by Mr. :Link, seconded by Mr. Saul and carried to close the Public Hearing. Motion by Mr. Sneva, seconded by Mr. Lamb and carried to take no action regarding this matter due to action taken earlier as Item A of Old Business - Seattle City Light Rezone. BOARD OF ARCHITECTURAL REVIEW Sign Review - Bon Marche Distribution Center Staff submitted from Bon Marche Distribution Center requesting they be allowed to install two signs (4 - 0 square feet each) within the landscape strip adjacent to Southcenter -..10 , Parkway. Staff displayed photographs of the proposed signs and placement of said signs. Staff then displayed slides of existing signing for this facility. Noted that the existing freestanding sign more than adequately identifies the facility not only as the "Bon Marche" but also as their "Retail Warehouse Sales" facility, which is basically what the proposed signs would display. In consideration of the foregoing, it was moved by Mrs. Harris, seconded by Mr. Saul and carried to deny the request. Mr. Harrison abstained from voting on this matter due to business ties. Site Plan Review - Cabot, Cabot & Forbes Building #2 Staff displayed plans for Building #2 and noted that the Andover ACC has approved them. • Discussion by Commission led to motion by Mrs. Harris, seconded by Mr. Saul and carried to approve the plans submitted subject to the following: 1. Technical review of all plans by the appro- priate City officials. 2. That final plan for landscaping and signing be submitted for review and approval of the B .A.R. Landscape Plans - Cabot, Cabot & Forbes Staff displayed a•Master Plan generally showing the •intention of Cabot, Cabot & Forbes in regard to landscaping of their total land area. Also submitted final plans for Buildings #1 and #2. Motion by Mrs. Harris, seconded by Mr. Saul and carried to approve the Master Plan and final plans for Buildings #1 and #2 subject to the following: 1. That all plans be subject to technical review by appropriate City officials. 2. That a six (6) foot wide sidewalk be provided along all public streets.
