73-49-v 53rd avenue south southcenter boulevard richard hall Minutes of Regular Meeting Mr. Sneva noted the Commission is presently without a Secretary since Mrs. Harris is no longer a Commissioner. Motion by Mr. Sneva, seconded by Mr. Kirsop and carried to appoint Mr. Lamb as the.Commission's secretary until formal elections are held. Comprehensive Plan Review Mr. Hansen read Staff comments and Commission discussed suggested priorities. Chairman Mettler appointed Mr. Zepp, Mr. Saul and Mr. Kirsop to Committee #1 to review the Comprehensive Land -Use Map as it relates to the Tukwila hill area. Zone Revisions Commission concurred with Staff. comments. Burlington Northern Rezone Commission concurred with Staff comments. Page 2 Political Signs Mr. Hansen read Staff comments and recommendation. Motion by Mr. Sneva, seconded by Mr. Kirsop and carried to direct Staff to draft an ordinance and identify typical restrictions of election signs. By -Law Amendments Mr. Crutchfield read amendments as previously proposed by the By -Law Committee. Mr. Harrison, from audience, suggested deleting item 6 e. Chairman Mettler directed Staff to mail updated drafts to Commissioners for next regular meeting. Public Hearing - Variance - Hall Staff noted this Public Hearing has been continued from 29 November 1973 to allow the applicant to revise his plans. Minutes of Regular Meeting Page 3 Chairman Mettler asked if anyone was present to speak for or against the request. No one responded. Chair- man. Mettler closed, the Public Hearing. Motion by Mr. Kirsop, seconded by Mr. Sneva and carried to grant the variance from Chapter 18.56.040 subject to arrangement of a developer's agreement suitable to the Director of Public Works. ARCO Sign Review Mr. Hansen read Staff comments explaining that the proposed sign does not conform with the Sign Code. Mr. Kenneth Flynn, ARCO, withdrew his request for approval as he did not wish to create controversy. Public Hearing - Rezone - King County Transfer Station Mr. Hansen reminded Commission the Public Hearing for this matter has been readvertised for 31 January 1974, next Thursday. Public Hearing - Variance - Hall Mr. Hansen read Staff comments and advertisement. Chairman Mettler opened the Public Hearing at 9:02 p.m. No one was present to speak for or against the request. Chairman Mettler closed the Public Hearing at 9:04 p.m. Mr. Lamb noted the condition of the existing facility and regarding the proposed development as a vast improvement over the present operation. Motion by Mr. Lamb, seconded by Mr. Link and carried to grant the variance from Chapter 18.56.040 as the shape of the property prohibits dedication of additional right -of -way and the nature of the proposed facility will not generate a burdensome amount of traffic. Public Hearing - Variance - Woodtape Mr. Hansen read Staff comments and advertisement. ( Minutes, 29 November 1973 Page 4 Chairman Mettler closed the Public Hearing at 9:18 p.m. Staff noted the Comprehensive Land -Use Plan map depicts no designation of land -use for the entire old Interurban Avenue right -of -way. Mr. Todd stated that Puget Power has declared the entire right -of -way surplus. Mrs. Harris noted it was a shame the City didn't receive first refusal. Mr. Kirsop stated he felt the entire flatlands area should be studied to determine if a change in the Comprehensive Plan for the area is appropriate. Motion by Mr. Lamb and seconded by Mr. Zepp to recommend, to the City Council, the Comprehensive Land -Use Plan be amended to designate the legally described property within the application as Industrial. Motion by Mr. Kirsop and seconded by Mr. Sneva that the original motion be amended to include the phrase 'because the adjacent properties have been designated as industrial.' Chairman Mettler called for vote on amendment of original motion. CARRIED. Chairman Mettler called for vote on original motion as amended. CARRIED. PUBLIC HEARING - Rezone - Todd Mr. Hansen read staff comments. Chairman Mettler opened the Public Hearing at 9:40 p.m. Mr. Frank Todd, 14446 - 59th Avenue South, reiterated reasons given during immediately previous Public Hearing. No one was present to speak against the request. Chairman Mettler closed the Public Hearing. Motion by Mr. Zepp and seconded by Mr. Link that because the surrounding properties are zoned M -1, in keeping with the intent of the Comprehensive Land -Use Plan, the Com- mission recommends to the City Council that the property legally described within the application be rezoned to M -l. Motion carried. PUBLIC HEARING - Variance - Hall Mr. Hansen read staff comments. Chairman Mettler opened the Public Hearing at 9:48 p.m. Minutes, 29 November 1973 Page 5 Mr. Alex Sasanoff, 2201 S.W. 152nd, stated the applicant desires as many parking spaces as possible and a registered landscape architect will be doing the landscaping which will be quite extensive. Mayor Todd stated City ordinances require a fifty -foot right -of -way be developed'for commercial developments. Mr. Lamb disqualified himself from this matter as he owns property directly across the street and he took a seat in the audience. At this time Mr. Lamb asked who would provide the land needed for the proposed 80 foot diameter cul -de -sac. Commission resolved that the applicant/hould apply for a variance from the required 50 foot setback and that this • Public Hearing be continued until such time that application has been reviewed. Motion by Mr. Kirsop, seconded by Mr. Link and carried to continue this Public Hearing until the applicant has applied for a variance from the required street width. Letter from By -Law Committee Mr. Hansen read letter from Mr. Zepp, Mrs. Harris and Mr. Saul urging the Commission recommend to the Council . the reduction of members of the Planning Commission to seven and the establishment of a Board of Adjustment. Chairman Mettler read ::.similar letter from Mayor Todd addressed to Council. Motion by Mrs. Harris, seconded by Mr. Lamb and carried to recommend to the City Council the establishment of a Board of Adjustment and reduction of the Planning Com- mission members to seven. Sign Review - ADEN Corporation Mr. Hansen read staff comments noting the sign may not exceed 50 square feet each face and not be more than 12 feet high. Also that the base be adequately landscaped. Motion by Mr. Sneva, seconded by Mr. Zepp and carried to approve the sign on the condition it not exceed fifty square feet per face and twelve feet high and that the sign meet Code requirements regarding landscaped base. VARIANCE from 60' R/W width: Due to length of 53rd Avenue, Steve wanted 50' R/W with 80' (diameter) cul -de -sac. Planning Commission, in rezoning parcel lying west of 53rd Avenue, obtained agreement to provide 10' additional R/W along west side of 53rd, hence gaining 50' total R/W when it develops. Based on this assurance of 50' R /W, Commission granted variance from 60' R/W requirement with the stipulation that a Developer's Agreement be executed between Colonial and City to establish street development requirements as Steve sees fit. 2. VARIANCE from setback of parking surface edge: This one is simple enough — allows parking stalls to be closer to edge of road than required by code — no conditions. Both variances were granted in January 1974. A variance becomes void after one (1) year if a permit for the variance - approved plans is rt.cot' obtained within that year.
