A Comprehensive Park Plan, adopted by City Ordinance in 1969, designated a land area which included your parcel for future public facilities. Whereas it appeared to the Commission that the Park Plan was of a general study nature and should not be construed to bar orderly dev- elopment of the area, the Commission felt the request was consistent with permitted uses within R -4 zoning, as well as Chapter 18.18 of the Tukwila Municipal Code and the majority of the Commission carried a motion to grant said use permit; however, granting of the use permit was to be dependent upon the opinion of the City Attorney as to the legal status of the. Comprehensive Park Plan as it relates to land use. This opinion was received 9 March 1973 and a copy as enclosed;•, enclosed for your perusal is a copy of the minutes of the meeting at which the Public Hearing was held. An informal public meeting of the City Council held last evening led to the concurrence, with the opinion of the Commission and City Attorney, by the Councilmen present that allowable uses within existing zoning should dominate r+,iand?..use :rather . than the Park Plan. PLANNING DEPARTMENT Page 2 King County Housing Authority Further, due to concern regarding the residential prop- erties in close proximity of the proposal site, an Environmental Assessment Summary must be submitted to this office in accordance with City of Tukwila Ordinance #759, enclosed. The official motion of the Commission included the condition of detailed review and approval of preliminary and final development plans by the Commission. This letter constitutes said use permit in accordance with Chapter 18.18 Tukwila Municipal Code and should not be construed to relieve the King County Housing Authority from complying with all other applicable Federal, State and local regulations in regard to this project. Tukwila, Washington 98067 PLANNING DEPARTMENT The Tukwila Planning Commission, at its regular meeting held 15 February 1973, considered, by Public Hearing, a request by King County Housing Authority to construct an office building within an R -4 use district in accord- ance with the provisions of Section 18.18.010 paragraph (8) of the Tukwila Municipal Code, Said section requires approval of the Planning Commission, after Public Hearing, for the specific use. Upon approval of the Commission the applicant may apply for the necessary permits for construction. During consideration of the request it was noted that the Comprehensive Park and Recreational Plan, adopted by Ordinance #546, designated a land area, including and surrounding the parcel under consideration, to be developed for public facilities. Considerable discussion ensued in regard to the Park Plan's effect of land use within the area designated within said Plan. The Commission officially moved to request a ruling from the City Attorney as to the legal status of the Comprehensive Park Plan adopted under Ordinance ##546. Mr. Don Bergen, Epcon Sign Company, stated the average theater marquee has 17" to 24" letters. This sign has 17 "letters. Mr. Bob Coles, Sterling Recreation Organization, stated need of sign for advertising and identification purposes. Also acknowledged that any sign erected must have approval of Southcenter. Mr. Moss informed Commission that Southcenter has dis- approved this sign. Motion by Mr. Sneva and seconded by Mr. Lamb to table this matter to allow Mr. Coles to meet with Southcenter to arrive at a decision amenable to them both. Motion carried with Mrs. Harris abstaining. ►Final Site Plan Review - King County Housing Authority Displayed site plan and read staff comments and recom- mendation. Motion by Mr. Lamb and seconded by Mr. Link to approve the final site plan subject to approval of final landscape plan. Motion carried with Mrs. Harris abstaining. Frederick & Nelsen Truck Wash Mr. Moss read staff comments. Discussion followed regarding landscaping. Mr. Moss read staff comments. Motion by Mr. Link and seconded by Mr. Lamb to approve the plan subject to the provision of appropriate land- scaping to screen the facility and subject to supplying proof of compliance with criteria of the State Flood Control Permit. Motion carried with Mrs. Harris abstaining. Sign Reconsideration - Bon Marche Distribution Center Mr. Glen Irelan, Bon Marche, explained his desire to provide an attractive form of directional and informational signing. City of Tukwila Planning Commission Public Hearing February 15, 1973 Staff Comments Huntington Rezone: Mr. & Mrs. Huntington have applied for rezoning from R -4 to C -1 of the property located at the northwest corner of the intersection of 65th Avenue South with Southcenter Boulevard. (Please review the attached maps.) They have indicated that the proposed use would be a combination of professional offices (professional offices could be allowed under the existing R -4 classification by special use approval of the Planning Commission) and retail businesses. In consideration of this rezone the Planning Commission must first determine whether or not the proposed retail use is appropriate in the area and whether or not it is a necessary use in light of the fact that the largest retail facility in the conterminous United States is located within a few blocks of the subject site. If it is determined by the Planning Commission that the retail use of the property is an appropriate and a necessary one, then the Planning Commission must be ready to impose some very strict controls on the development of the property, since the tendency in major center peripheral development is to over - sign, over - light, under- landscape, and to make the buildings as noticeable (often to the extent of being garish) from the major center as possible. (Recall the peripheral development around the Sears Roebuck main store and around the Northgate Shopping Center.) The plans as submitted by the applicant have several deficiencies: There is no grading plan showing existing and proposed contours; there is no landscaping plan or any indication of screening or protection for the adjacent residential properties to the west and north; there is no indication of signing, exterior lighting, or illumination levels which are very critical concerns in this case; the exit from the upper parking lot can be very detrimental to the adjacent property and therefore should be eliminated or developed jointly with the adjacent property owner; traffic controls would be necessary on Southcenter Boulevard and on 65th Avenue South to prevent traffic back -up from persons waiting to cross center lines to gain access to parking areas; sidewalks, curbs, gutters, catch basins, and sewer and water lines have not been indicated on the plans.. These deficiencies have been pointed out to the applicant; however, he has requested a public hearing on the proposed rezone. If the Planning Commission determines that the proposal is appropriate then their final action should be withheld until the applicant's plans are more definite; the granting of a rezone for this property to allow commercial uses should not be done on the basis of anything but very specific and detailed plans for develop- ment. Development in the valley thus far has been of a comparatively high quality and to allow anything less on this site would detract from the development in the Valley and would not be in the best interest of the City of Tukwila. King County Housing Authority Special Use Review: The King County Housing Authority has requested permission to locate their administrative offices, for South King County operations, on R -4 residentially zoned property near the intersection of 65th Avenue South with Southcenter Boulevard (please review the attached maps). The Housing Authority has not prepared plans for the pro- posed facility since they did not want to expend architectural and consulting fees if the Planning Commission did not . concur with their proposed use of the subject property. If after due consideration it is the Planning Commission's opinion that the proposed use is appropriate and compatible with adjacent and surrounding properties then only a tentative approval should be granted, pending submittal of detailed building and site plans. E. near the corner of Renton -Three Tree Point Road. The legal description for this property is attached as Exhibit A. The property is currently zoned R -4 and according to Chapter 18.18•of the City Zoning Ordinance, office buildings may be constructed in this zone if they are "to be used exclusively for administrative functions of a single organization, or by a single professional organization or society, after public notice hearing and approval by the Planning Commission...." A sketch of the site is enclosed. It consists of approximately 45,000 square feet and the intention of the Housing Authority is to construct a one story building with a partial basement, encompassing a first floor area of approximately 6500 square feet. Parking would be provided in accordance with Chapter 18.56.160 of the Zoning Ordinance. The Housing Authority intends to use this building as the Central office for the Housing Authority activities; it will encompass administrative and accounting functions only and will house approximately 30 employees. There shall be no sales activity or merchandising services rendered on the premises. The building will be occupied by the Housing Authority only and no other tenants. (b) The term "Taxing Body" shall mean the state or any political subdivision or taxing unit thereof in which the office building is situated and which would have authority to assess or levy real or personal pro- perty taxes or to certify such taxes to a taxing body or public officer to be levied for its use and benefit with respect to the office building if it were not exempt from taxation. (c) The term "Shelter Rent" shall mean the total of all charges to all tenants of the office building for dwelling rents and nondwailing rents (=chiding all other incoree ibr such Development) , less the cost to the Local Authority of all dwelling and nondwelling utilities. 2. The Local Authority shall endeavor (a) to secure a contract or contracts with HUD for loans and annual contributions covering one Development comprising one Central Office Building and necessary related appurtenances, (b) to devel- op and administer such Development which shall be located within the corporate limits of the local government. The obligations of the parties hereto shall apply only to the Development named in paragraph 2(a). 3. Under the constitution and statutes of the State of Wash- ington, all Developments are exempt from all real and per- sonal property taxes and special assessments levied or imposed by any taxing body. With respect to any Develop- ment, so long as either (i) such Development is owned by a public body or governmental agency and is used for low rent housing purposes, including the purpose of directing and administering the low -rent housing program or other • Federally- Assisted housing progrem(s), or (ii). any con- tract between the Local Authority and the HUD for loans' or annual contricutions, or both, in connection with such Development remains in force and effect, or (iii) any . bonds issued in connection with such Development or any monies due to the HUD in connection with such Develo rent • remain unpaid, whichever period is the longest, the local government agrees that it will not levy or• impose any real or personal taxes or special assessments upon such Development or upon the Local Authority with respect thereto. COOPERATION AGREEMENT PAGE TWO (c) Accept grants of easements necessary for the development of such Development. 4.' The City of Tukwila, Washington and the Housing Author- ity of the County of King agree that provisions of equiv- alent elimination shall be null and void because no dwel- ling units are to be provided in the Development. 5. During the period commencing with the date of the acqui- sition of any part of the site or sites of any Develop- ment and continuing so long as either (i) such Develop- ment is owned by a public body or governmental agency and is used'for low rent housing purposes, or (ii) any contract between the Local Authority and the HUD for loans or annual contributions, or both, in connection with such development remains in force and effect, or (iii) any bonds issued in connection with such Develop- ment or any monies due to the HUD in'connection with such Development remain unpaid, whichever period is the longest, the local government without cost or charge to the Local Authority or the tenants of such Development shall: (a) Furnish or cause to be furnished to the Local Authority public services and facilities of the same . character and to the same extent as are furnished from time to time without cost or charge to other businesses and inhabitants in the local government. (b) Insofar as the local government may lawfully do so, (i) grant such deviations from the building code of the local government as are reasonable and necessary to promote economy and efficiency in the development and administration of such Development, and at the same time safeguard health and safety. (d) Cooperate with the Local Authority by such other lawful action or ways as the local government and the Local Authority may find necessary in connection with the development and administration of such Development. 6. No Cooperation Agreement heretofore entered into between the Local Government and the Local Authority shall be con- strued to apply to any:'Development covered by this Agree- ment. 7. So long as any contract between the Local Authority and HUD for loans (including preliminary loans) or annual contributions, or both, in connection with the office building remains in force and effect, or so long as any bonds issued in connection with the office building or any monies due to the HUD in connection with the office building remain unpaid, this Agreement shall not be ab- rogated, changed or modified without the consent of HUD. The privileges and obligations of the Local Government hereunder shall remain in full force and effect with respect to the office building so long as the beneficial title to such Development is held by the Local Authority or by any other public body or governmental agency, in- cluding the HUD, authorized by law to engage in the :`. , ATTEST: Secretary 'COOPERATION AGREEMENT RAGE THREE development or administration of low rent housing developments. .
