Council Chambers
Mayor Van Dusen called the Regular Meeting of the Tukwila
City Council to order and led the audience in the Pledge
of Allegiance.

Alan Doerschel (Finance Director), John Colgrove (City Attorney),
Ross Earnst (Public Works Director), John McFarland (City
Administrator), Ron Waldner (Police Chief).
Police Chief Waldner introduced S. Ann Hallam to Mayor Van
Dusen and the City Councilmembers. Mayor Van Dusen swore
Police Officer Hallam in as a Tukwila Police Officer.

COUNCILMEMBER DUFFIE ARRIVED AT THE MEETING AT 7:15 P.M.
Alan Pachucki, 3735 South 150th, Seattle, stated he was
speaking in behalf of his aunt, Ms. Audrey Bullock, 4011 South
139th Street, Seattle, stated the property had been zoned as
RM 1800 prior to the annexation. His aunt has lived at this
property for twenty plus years and paid the higher taxes
required for property zoned RM 1800. At the annexation
hearings it was brought out that the intent of the City Council
was to down zone this parcel to R -1. At the meeting he
requested the Council re- evaluate and change it back to R -3
or R -4, the equivalent of the King County RM 1800. He stated
he was told the property would be returned to the King County
RM 1800 rating equivalent to Tukwila's R -3 or R -4. He stated
he made the same request for his own property and the request
was complied with.
His aunt had a sale for her property and when the prospective
buyer found it was zoned R -1 he immediately dropped the price
offered by $35,000. The property had been bought as RM 1800.
Mr. Pachucki stated the property lies directly behind the
Airport Motor Inn and to the back is a laundromat. As you
walk out the front you see the back of the motel. Frequently
police make final arrests in her driveway. This is hardly
the area for a single family residence.
Councilmember Robertson stated this is not the place to present
the request for the rezone. There is a form used to request
a rezone and the question is whether or not you should pay
the $700 fee. The policy has been established that the City
should charge all people the fee. Unless the policy is changed
there is not much that can be done. The City has tried to
treat all people the same.
Mr. Pachucki stated he would then have to turn the matter over
to his attorney.
Mr. Steve Lawrence, 4461 S. 144th Street, stated he was
requesting the City Council to reduce the speed limit on
South 144th Street between I -5 and Pacific Highway South from
30 mph to 25 mph. The area is predominantly residential with
two schools, a County swimming pool, and a fire station.

The schools require a lower speed limit during part of the
weekday which is largely ignored. The playfields and
swimming pool attract many pedestrians at all hours of the
day and evening. The current speed limit of 30 mph is
exceeded at all times. Lowering the speed limit to 25 mph would
result in the actual speeds being closer to 30 mph.
Ross Earnst, Public Works Director, stated the speed limit for
the City is 25 mph. There would be no problem in lowering the
speed limit but he would like to look at the area before it
is recommended.

City Attorney Colgrove read an ordinance of the City of Tukwila,
Washington, adopting a Central Business District Sidewalk
Plan as a component of the Tukwila Comprehensive Plan pursuant
to Chap. 35A.63 RCW and amending Chap. 11.64 and Chap. 18.70
of the T.M.C. by title only.
MOVED BY HARRIS, SECONDED BY DUFFIE, THAT ORDINANCE #1516 BE
ADOPTED AS READ.
Bill Arthur, representing the Segale Business Park, stated the
Segale family wants the sidewalk ordinance adopted. There are
a couple of items they would like changed. They feel it should
be the responsibility of the City to maintain the sidewalks
with tax money.
Councilmember Harris stated in Exhibit 2, Policy 14 it seems
it would be easier for the property owner to look at the side-
walks and determine the maintenance. Also, who replaces the
sidewalk?
MOVED BY HARRIS, SECONDED BY DUFFIE, THAT POLICY 14 BE PUT BACK
THE WAY IT WAS.
Councilmember Duffie said if the City tears up the sidewalk they
should put it back in good condition.
Councilmember Robertson stated it is the property owner's
responsibility to maintain the sidewalks except where the City
might have to tear it up for a utility, etc. They would have
to repair it. When sidewalks deteriorate the property owner
is responsible.

Gene Elfstrom, audience, stated the sidewalks in the residential
area are the responsibility of the City. It seems building
sidewalks in the business area should not be different.
Mayor Van Dusen stated the sidewalks in the residential area
are on the right -of -way therefore they are repaired by the
City.
Ross Earnst, Public Works Director, stated most of the sidewalks
in the City are on City right -of -way. There are rare cases
where this is not the case. In general, where the right -of -way
is wide enough the sidewalks are on the right -of -way.
Bill Arthur, representing the Segale family, stated it is
easement vs. right -of -way it is still a public thoroughfare.
Councilmember Moriwaki stated the right -of -way gives the City
the property whereas easement gives the City right to use the
property.
Councilmember Robertson stated this plan is for the CBD only.
If we said sidewalks were not the responsibility of the property
owner we would have to go through the City and consider each
one.
Jim Haggerton, audience, stated there is no question about the
short term maintenance, it is up to the property owner. Long
term care is different there are acts of nature, runaway
vehicles, etc., that cause damage.
Councilmember Robertson stated that would be a case -by -case
basis depending on the cause of the damage. He stated he
would suggest the ordinance be left as it is and it be taken
for consideration to the Transportation Committee.

David Thomas, Manager, NC Engine Power, distributed a letter
dated May 15, 1989 to the City Council stating they support
the CBD Sidewalk Plan except it is their opinion that as far
as liability and maintenance is concerned the responsibility
should be the same as for City streets the responsibility
of the City.
City Attorney Colgrove stated there are a few typographical
errors in the ordinance that will be corrected.

POLICY #14 BE PUT IN THE TRANSORTATION COMMITTEE AND ACTED
ON AS SOON AS POSSIBLE. MOTION CARRIED.

City Attorney Colgrove read an ordinance of the City of Tukwila,
Washington, amending the 1989 budget, adopted by Ord. #1493, to
add unanticipated estimated beginning fund balance and provide
contracted police service expenditures to the general fund
for the Foster, Riverton and Thorndyke annexation areas; and
establishing an effective date by title only.

reserve,equipment rental, and firemen's pension funds; and
establishing an effective date by title only.

City Attorney Colgrove read an ordinance of the City of Tukwila,

Councilmember Robertson stated he was concerned about Section
2
City Attorney Colgrove stated this is adoption of the State
law. The purpose of Section 2 is to make it so it is not the
personal responsibility of a driver or employee.

THIRD LINES OF SECTION 2 READ: "CAUSING THE HAZARDOUS MATERIALS

ADJOURNMENT
9:05 P.M.
Mayor Van Dusen reported a public notice letter advising
citizens that a public meeting will be held on May 22 regarding
the closing of Fire Station #52 is being mailed so public
input can be received.
The Suburban Cities will present their slate of officers on
June 10, 1989.
Mayor Van Dusen asked for a motion to approve the purchase
of a new amplification system for the Council Chambers.
MOVED BY DUFFIE, SECONDED BY HERNANDEZ, THAT THE COUNCIL
AUTHORIZE THE MAYOR TO OBTAIN A NEW AMPLIFICATION SYSTEM FOR
THE COUNCIL CHAMBERS. MOTION CARRIED.
City Council Councilmember Duffie stated the Tukwila Police and the King
County Police are working together very well.
The Council has discussed adding two people to the Commissions
and Boards. It is necessary to get the list of people who have
volunteered and the ordinance will need to be changed.
Councilmember Hernandez stated she was glad the Council adopted
the Tukwila 2000 resolution. All of the volunteers who served
should be sent a letter of appreciation.
City Attorney Colgrove stated the Worldwide Video case was
tried and is under advisement. It is set to be heard on
May 26.

INTO EXECUTIVE SESSION TO DISCUSS A LAWSUIT. MOTION CARRIED.

OUT OF EXECUTIVE SESSION. MOTION CARRIED.
