CONSIDERATION FOR THE WORK: The amount of the Contract shall include all work set out in the Contrect Documents, and compllaect with all applicable•codes and permits. COMPLIANCE WITH CODES AND PERMITS: Thb Contractor shall conform to the provisions of all state. local, and national building, sanitary, electrical, handicapped and safety codes, laws, ordinances and regulations, as well as to all guidelines, rules and regulations set forth by the Landlord of the project. Approval of these Drawings and Specifications by the Landlord and /or by Governmental Authorities does not release the Contractor from his obligation to comly with all applicable codes and standards. 1!4+05 TAXES: The Contractor shall pay all sales taxes, social security taxes, use taxes and any other tax for which he is liable to local, state or federal governments, and shall guarantee to hold harmless the Owner and the site Landlord of the project in every respect against same. IA-06 I UTtAIi?CCE: The Contractor, and all subcontractors, shall provide, as a minimum.'the insurance Coverages described below and shall deliver to the Owner (and to the Landlord's representatives when so instructed) certificates which evidence the existence of such insurance coverage prior to commencing work. The required insurance shall be maintained throughout the work: A. Workmen's Compensation Insurance in accordance with the laws of the state in which the work is done, including Employer's Liability Insurance to the limit of $100,000. B, Comprehensive General Liability' Insurance, excluding automobile liability, against personal injury, including death resulting therefrom, to the limit of $1.000,000 for any one person and $3,000,000 for more than one person in any one accident and against property damage to the limit of $100,000. C. Automobile insurance, including non -owner or non-owned automobiles, against personal injury, including death resulting therefrom. to the limit of $500,000 for any one person and $3,000,000 for more than one person in any one accident, and against property damage to limits of $300,000. D. The Contractor shall provide, at his expense. Builder's Risk Insurance. E. The Contractor shall have noted on all certificates the names of the project Landlord (and others as so instructed) as additional insureds. • IA -07 HOLD HARMLESS AGREEMENT: The Contractor hereby agrees to protect. defend and idemnify and save harmless the Owner and and the site Landlord against all losses. costs or damage on account of. any injury to persons or property in the performance of this Contract. IA -08 BONDS: The Contractor shall secure and pay for a Labor and Material Payment Bond and a. Performance Bond, each in the amount of 1001 of the Contract Sum, each on forms provided by or approved by the Owner. All such bonds shall be issued.by a surety acceptable to the Owner. Include cost for such bonds in the Contract Amount. Bonds are required before payment of any amounts under the Contract. 1A -09 PAYMENT OF WORK: The Owner shall intake payment on account of the Contract, upon requisition by the Contractor, as follows: Ninety percent (90%) of the amount in place monthly, provided: A. Contractor shall submit with his application• for payment, on approved form, all those lien releases, waivers, affidavits, and other documents as from time to time may be required by the Owner or the Landlord of the site, covering the General Contractor, subcontractos and materials suppliers. B. With his application for final payment, Contractor shall include all those items mentioned in "A" above. plus the Final Certificate of Occupancy, final list of contractors who performed work at the project, a list or copy of permits and inspections, any special affidavits and /or waivers required by the landlord of the site, and a signed -off final inspection punch list, If applicable. Final payment will not be made until all the above is received by the Owner. The necessary special forms mill be issued to the Contractor by the Owner prior to completion of work. - 1A -10 , DRAWINGS AND SPECIFICATIONS: k The drawings are presumably correct, but the Contractor shall check all figures and notify' the Architect or Owner if any errors are discovered therein. If any ed4sputes arise as to the tKue intent and meaning of the drawings and /or specifications, same shall be referred to the Architect, whose decision shall be final on such points. It Is the intent of the Contract Documents to include all labor, materials, services and equipment, and associated items of work as necessary for the proper execution of the work of the Contract. A. Measurements for all w e shall be taken at the project site by the contractor for each branch of the work before commencement of any work. 8. Contractor shall keep at least specifications, addenda and change be made ayatlabie to the Owner or job visits. f one complete and up -to -date set of all drawings, orders related to the project at the site. These shall Architect and their representatives for their use. during 1A -12 EXTRAS: No claims for extra work (extras) will be allowed unless a price for same has been agreed upon beforehand and said extra work shall hove been ordered in writing by the Owner or the Architect. The price for extras shall be calculated at the Contractor's cost, plus overhead and profit at the some percentage as in the original contract cost breakdown. A. The Contractor shall carefully compare and study all drawings, specifications and other instructions. He shall visit the site of the work and fully inform himself, prior to bidding, as to all existing conditions and !imitations under which the work is to be performed, and he shall include in his bid all costs of all items necessary to perform the work at set forth in the Documents. 8. ' 8. Any legal fees or payments required and passed after the date for receipt of bids for the project shall be reimbursed to the Contractor by the owner as set forth in "EXTRAS" above. C. Before making any variations from th drawings and specifications that may be necessary to conform to requirements of codes or pe ts, the Contractor shall give to the Owner written notice specifying the reason for nerd of variation, the variation proposed to be made, the Contract Amount change therefor, and shall apply for instruction thereon. Extra payments therefor shall be made to the Contractor by the Owner as set forth in "EXTRAS" above. 1A -15 PROTECTION OF PU$L,}C AND ADJOINING PROPERTY: Contractor shall continuously maintain adequate protection of all his work from damage and shall protect the Owner's property. adjacent property and public property from injury arising in connection with the Contract and shall make good any such damage or injury at no additional cost to the Owner. A. Contractors assumes and bears all risk of damage to or failure of the work and all risks of accident or happening or happenings from whatsoever cause arising until the work shall have beers` fully completed by Contractor and accepted by the Owner. B. No trespassing is to be allowed on adjoining property without permission of the Owner of such property. 1A -16 PRODUCT HANDLING MID PROTECTION OF THE WORK: Use all means necessary to protect the materials and work of the project before, during and after installation, and to protect the work and materials of all other trades and contractors. In the event of damage, immediately make all repairs and replacemer . necessary at no additional cost to the Owner or Landlord. A. Fa lure of any contractor to make good any damage to the work of others shall in no way excpsa such ethers from finishing and fura':hing complete to the Owner the work they agreed to do. 1A -17 PROTECTION OF PERSONS: Contractor shall be responsible for, comply with, and insure that all equipment procedures conform fully with sbfety and health regule ! ons and restrictions set forth to implement the Occupational Safety and Health Act of 1970 and any anunendments thereto. 1A -18 JOB LOCATION AND DIMENSIONS: Refore doing any such work or ordering materials- dependent for proper location or size of installation upon coordination with building conditions, the Contractor shall verify all dimensions and locations by tak',ig lines and measurements at the site and shall he responsible for correctness of same. No consideration will be given any claim based on differ- ences between actual locations and dimensions and those shown on the drawings IA -19 GUARANTEES: A. Contractor guarantees that all materials shall be of the type and grade suitable for its use and that all labor will be of suitable skill and that all work will be performed in a workmanlike manner and shall be in good ,and usable condition at dote of completion and acceptance. D. The Contractor guarantees all work for a period of one (1) year after completion and acceptance by the Owner, including immediate repair. The Contractor agrees to correct all defects which may appear in his work within one year, or other times specifiedtherein, after its completion, arising from defective or improper materials or workmanship, including, without additional charge, all expenses and damages in connection with removal, replacement or repair of any work which may be damaged or disturbed thereby. C. A manufacturer's warranty on any item shall not relieve Contractor and /or his subcontractors from full responsibility under all guarantees and /or warranties called for in the Contract Documents. 0. All warranties and /or guarantees of materials and /or workmanship shall be written to the benefit of both Owner and Landlord of the site, as their respective interests appear, and shall permit enforcement by either. 1A -20 OWNER'S RIGHT TO TERMINATE THE CONTRACT: Should the Contractor neglect to prosecute the work properly, or fail to perform any provisions of the Contract, after seventy -two (72) hours written notice to the Contractor, or by posting written notice in a conspicious place on the job site, without prejudice to any other rei►edy it may have, the Owner may make good any deficiencies and may deduct the cost thereof from the payments then or thereafter due the Contractor, or, at its option, .may terminate the Contract and take possession of all materials, tools and applicances and finish the work by such means as it sees fits, and if the unpaid balance of the Contract price exceeds the expense of finishing the work, such expense shall be paid to the Contractor; but, if such expense exceeds such unpaid balance. the Contractor shall pay the difference to the Owner. 1A -21 COMPLETE CLEAN -UP: The building must be kept free from all surplus materiels, dirt, rubbish and debris at all times. On completion of the work. the Contractor shall remove all his tools. scaffolding, debris, etc., from the building, and shall leave the premises perfectly clean. A. Clean shall be defined, for the purpose of this Article, as meaning the level of cleanliness generally provided by skilled cleaners using commercial quality building maintenance equip- ment and materials. B. For cleaning, use only materials and equipment specified as compatible with the materials being cleaned by the manufacturer of such materials. SECTION 1 -8 - SM1A1. CONDITIONS 18 -01 MATERIALS: All materials used for this work shall be new and of best quality. When materials or work are described in words having a commonly accepted technical or trade meaning. these words shall be understood to refer to the recognized national and industry standards which shall be in accord with applicable code requirements, 18 -02 SEPARATE CONTRACTS: The 'Owner shall have the right to perform certain operations and installations and install certain items of work during the various stages of construction, Such as installation of materials, finishes, equ'pment, fixtures and merchandise. this work may be contracted to other's by the Owner. The Contractor and all his subcontractors shall cooperate fully with those performing such installations or operations so that all may be made in a timely manner and be coordinated with the other construction work. The introduction of Owner's materials and /or fixtures during construction shall not be construed as final acceptance of the building or project. A. All surfaces to accept items furnished and installed by Neer under separate contracts shall be prepared by Contractor to receive such items and materials the same as if being furnished and /or installed by the Contractor and to the approval of the Architect. 18 -03 WORK COORDINATION: Each contractor shall coordinate his work with adjacent work and cooperate with other trades so as to facilitate general progress of the wore.. A Bar Graph is acceptable. 18 -12 TEMPORARY FACILITIES: During the construction period, the Contractor shall provide and pay for temporary heat, water, electric, telephone and toilet services and facilities, if required, in accordance with local laws, rules and regulations and in accord with the directions and requirements of the site Landlord. 181.13 LAYING OUT OF THE WORK: Before commencing any work, the Contractor shall verify all grades, lines, levels and dimensions at indicated on the drawings. He shall report port any errors of incon- sistencies in them before beginning any work. See Articles IA -10 through 1A -12 above. A. Contractor shall be responsible for establishing all construction lines, level and grades, and dimensions as indicated on the drawings, and for otherwise fully and completely laying Out all work under the Contract. 18 -14 CONSTRUCTION REGULATIONS: The regulations included herein are general in nature and shall not be assumed to include all regulations which may be imposed by the Landlord of the site and /or the authorities•with jurisdiction. Wood door casings shall be narrow line standard, or as noted. D. Nails, bolts and screws shall meet the standards of the trade and the needs of the work. Edging strips shall be provided where the floor rQYering terminates or transitions from one material to another. 9D -02 INSTALLATION: Where floor tile is railed for. it shall be !aid in all four directions from the center so as to finish uniformly at walls. Edges shall he one -half material width or greater. Flooring and bases shall be cleaned and protected after laying to provide a perfectly clean, unmarred, finished floor at completion of work. SECTION 9--E - PAINTING 9E -01 MATERIALS: Paint shall be the products as described in t'le drawings. Substitutes must be approved in writing before being used. Primer shall be provided and applied where required by the work. 9E -02 APPLICATIONS: A. All work to be painted, unless noted otherwise, shall be given not less than (2) coats of the specified paint. SECTION 10-A - SIGNS 10A -01 Storefcont sign(s) shall be furnished and installed by Owner under separate contract. The 7.G.C. shall receive,same -when shipped by Tenant, protecting 111 such items in accordance with requirements of Section 1 -A of these Specifications, and place at do proper position in the :fork at the proper time. B. Surfaces to receive items furnished by the Tenant and installed by the Contractor shall be prepared such that they will accept the Items to be installed in the same manner as if they were to receive items furnished by the T.G.C. C. Once delivered to the jobsite and accepted by the Contractor, all items furnished by the Tenant for installation by the Contractor shall be covered by Contracto;'s insurance the same as materials furnished by the Contractor. D. Contractor shall be responsible for any damages to materials furnished by the Tenant for Contractor installation after Contractor accepts delivery of same, and Contractor shall provide any necessary repairs and finish touch -ups as required to leave the installed emterials in new and first class condition. 1. Contractor shall inspect all materials received from the Tenant upon receipt. Any materials received in damaged or unacceptable condition shall be reported to the Tenant immediately. Damaged items not reported within thrse (3) days after receipt shall become the sole responsibility of the Contractor as pertains to necessary repairs. SECTION 15-A PLUMING 1SA -01 GENERAL: All plumbing work, when required, shall comply with the National Plumbing Code and with all plumbing ordinances of the governing authority of the work. A. Contractor shall determine the location of existing water supply and drain lines and make proper connections, thereto, including vents. B. It is intended that thetontractor shall provide a complete, finished and functional system, connecting all fixtures as recommended by the manufacturer. `C. Contractor shall secure all permits, inspection certificates, etc., and pay all charges connected therewith. D. All materials shall be new and shall fit the space available. Verify all dimensions at the site. E. All valves. cleanouts, etc., shall be so located and installed to permit access for service without damage to building or finished materials. 15A -02 MATERIALS: A. Water piping shall be copper water tubing, Type "L" above ground and Type 'K" below ground. Fittings shall be wrought copper, solder pressure type. Solder shall be 95/5. B. Adapters shall be cast bronze. C. Valves shall be provided where required for proper function. D. Soil pipe and fittings under ground shall be extra heavy cast iron coated with aspha Ytum; above ground they shall be service weight cast iron coated with asphaltum. E. Waste and vent piping above ground shall be service weight cast iron or galvanized steel with recessed cast iron drainage fittings coated with asphaltum. F. Each toilet room shall have a 16" X 20" framed mirror over the lavatory, roll paper holder adjacent to each water closet, and coat hook on the door. G. All fixtures shall be as scheduled on the Drawings or as required by codes. H. SECT Io94 16-A - ELECTRICAL 16A -01 GENERAL: The complete electrical system and installation shall comply and conform to all applicable rules and regulations of the National Electrical Code as well as to all local laws and codes. A. Refer to all project drawings and fit all work accordingly with the drawings indicating the relation of wiring and connections and not intended to be scaled for exact locations. B. All apparatus, materials and equipment shall be new and shall bear the Underwriter's Seal. C. The complete installation shall be free from grounds, short circuits and open circuits. D. The system of distribution for bower and lighting shall be arranged as indicated on the Drawings or as required for a 60-cycle service voltage. E. Furnish and install all power wiring to motors, heaters and mechanical equipment as indicated on the Drawings. Wiring into motor or equipment terminals shall be complete with connections through associated motor starters and disconnect switches. F. Outlets shall be provided in the wiring system wherever required for pulling of wires, making connections, raking transitions from one wiring system to another, and for mounting wiring devices or lighting fixtures. G. All exposed non- current carrying metallic parts of electrical equipment, conduit systems and neutral conductor of the wiring system shall be grounded. H. All conduits and electrical metallic tubing shall be steel galvanized, concealed above ceilings, in building walls, or in floor construction, except as otherwise noted on Drawings. Conduits installed underground or in on - grade concretufloor slabs shall be thick -well rigid conduit with threaded couplings. Conduits installed underground outside building fouadationu shall be a minimum of 24" below finished grade and shall be coated with asphaltic paint. Conduit installed in ground floor concrete floor slabs shall be covered top and bottom with a minimum of 2" of concrete. I. Conductors shall be 600 volt rubber or thermoplastic insulated copper of 981 conductivity. All conductors shall be installed in conduit.
