MOTION CARRIED. 0 3 03 Mayor Van Dusen called the Special Meeting of the Tukwila City Council to order and led the audience in the Pledge of Allegiance. MABEL J. HARRIS, JOE H. DUFFIE, MARILYN G. STOKNES (COUNCIL PRESIDENT), JOAN HERNANDEZ, DENNIS L. ROBERTSON, CLARENCE B. MORIWAKI. John Colgrove (City Attorney), Ross Earnst (Public Works Director), Ron Cameron (City Engineer), John McFarland (City Administrator), Ron Waldner (Police Chief), Viki Witschger (Personnel Officer). MOVED BY DUFFIE, SECONDED BY STOKNES, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Colgrove read by title only a resolution of the City Council of the City of Tukwila, Washington, adopting a six -year Transportation Improvement Program, and directing the same to be filed with the State Secretary of Transportation and the Urban Arterial Board. MOVED BY HARRIS, SECONDED BY DUFFIE, THAT RESOLUTION NO. 1108 BE ADOPTED AS READ. MOTION CARRIED. MOVED BY HARRIS, SECONDED BY HERNANDEZ, THAT COUNCIL APPROVE AND AUTHORIZE THE MAYOR TO ENTER INTO THE AGREEMENT WITH SPIEKER PARTNERS, DEVELOPERS OF SOUTHCENTER PLAZA (TUKWILA POND). Ross Earnst, Public Works Director, stated the City has been asked to sign off on the building permit which allows two buildings. The site plan will be submitted tomorrow (Tuesday). The site plan implements into the developer's agreement. Councilmember Robertson stated in the sixth paragraph on page 1 the word "extended" in the second line should be "extend." He stated if legal issues are pending the Council should move cautiously. Mayor Van Dusen stated he knew of no legal suits that are pending. City Attorney Colgrove stated he was not aware of any legal problems with the agreement. Ross Earnst, Public Works Director, stated it appears that everything is in order in the agreement. MOVED BY ROBERTSON, SECONDED BY DUFFIE, TO AMEND THE MOTION AND AUTHORIZE THE MAYOR TO SIGN IF HE IS CERTAIN THERE ARE NO LEGAL ACTIONS PENDING. Ross Earnst, Public Works Director, stated the letter sent to him by the developer had reference to holding up the building permit and the fact they would have to discuss the matter with their attorney if that happened. MOTION CARRIED. MOTION CARRIED, AS AMENDED, WITH MORIWAKI VOTING NO. Councilmember Moriwaki stated he would have liked to see the area developed as an open space area and that is the reason for his "no" vote on the motion.
