Dear Mr. Stokeness:
Pursuant to our previous discussion with your offices,
enclosed please find Segale Business Park's application
for revision to it's Shorelines Substantial Development
Master Permit No. 74 -09. Included with this application
are the detailed revisions to the permit's plans as
specified by W.A.C. 173 -14 -064. There are no revisions
included with this application to the permit's text.
The revisions to the plans are made to update our 1974
permit to conform with existing park development, are
minor, and are within the scope and intent of the
original permit.
You may wish to recall that our permit is a master
permit, was the first of its kind, and was an innova-
tion lauded by the state and others. It is our under-
standing that other jurisdictions have now followed
the innovative lead taken by the City of Tukwila and
Segale Business Park and have adopted the master permit
concept. As provided by W.A.C. 173 -14 -064 (4), upon a
finding that the proposed changes are within the scope
and intent of the original permit, the revised permit
is approved and it becomes effective immediately.
Pursuant to W.A.C. 173 -14 -064 (4), within eight (8) days
of approval, the approved revision should be submitted
by certified mail to the D. O. E. Regional office and
Attorney General's Office for completion of their files.

Since to our knowledge no persons have previously
notified your offices of their desire to receive
notice of action pertaining to our permit, we've

SHORELINE MANAGEMENT SUBSTANTIAL DEVELOPMENT
Development shall be undertaken pursuant to the following
terms and conditions:
1. The issuance of a license under the Shoreline Manage-
ment Act of 19 shall not release the applicant from
compliance with federal, state, and other permit require-
ments.
2: This permit may be rescinded pursuant to Section 14.(7)
of the Shoreline Management Act of 1971 in the event the
permittee fails to comply with any condition hereof.
3. A construction permit shall not be issued until forty-
five (45) days _fter approval by the City of Tukwila
Planning Department or until any review proceedings

We whole heartedly congratulate you on your initiative in imple-
menting an innovative approach to resolve some of the problems
inherent in the framework of the Shoreline Management Permit
review requirements. Your diligence has resulted in what we con-
sider to be an effective permit review system compromising to all

As one can see, this particular application and permit
goes a step beyond the traditional single parcel - single
permit framework. Instead, permit #74 -09 reflects the
term 'Master' Permit' which constitutes approval of the
general development concept defined through the applica-
tion materials and drawings. At such time as definitive
construction plans are known, and prior to issuance of a
Building Permit, said definitive construction plans must
be approved by this municipal office in accordance with
the text of this application as well as the Tukwila Shoreline
Management Master Program, thus relieving the applicant of
the burdensome ninety (90) day review periods yet providing
for the necessary review and approval concept dictated by
the Shoreline Management Act. .
This Master Permit application was processed in accordance
with the Shoreline Management Act of 1971 and the permit
granted in accordance with the Shoreline Management Master
Program developed and adopted by this Municipality. We
firmly believe this permit concept to be a viable and
necessary innovation and look forward to learning your
response.

the Segale Shorelines Master Permit to incorporate current plans
on..the.part of Segale:

Area. This permit shall allow devel-
opment of the southwest corner of the
Asphalt, Sand and Gravel area to
include one or two buildings which
may or may not be related to the
Asphalt, Sand and Gravel operation.

of this area shall be in conformance
with the City of Tukwila Shoreline
Master Program insofar as it may be

SUBJECT: SEGALE BUSINESS PARK /REVISION OF SHORELINE MASTER PERMIT
Under WAC 173 -14 -064 it appears that the revisions requested by Mr.
Mario Segale to the Shoreline Master Permit #MF- 75 -2 -SP for the
Segale Business Park are in possible procedural conflict.
Eventhough the project expansion appears to be within the intent and .
scope of the original permit issued, WAC 173- 14- 064(2b) states that
"revisions involving new structures not shown on the original site
plan shall require a new permit ". Therefore, if the City of Tukwila
was to approve the revision it would probably be appealed by the
Department of Ecology to the Shoreline Hearings Board. This could
delay Mr. Segale's plans.

describing the proposed changes in the permit.
(1) If local government determines that the proposed changes are
within the scope and intent of the original permit, local government

SUBJECT: Revision of Shoreline Master Permit for Segale Business Park.
Mr. Mario Segale has requested that the City of Tukwila revise his Shoreline
Master Permit #75 -2 -SMP to show a modified road pattern. If approved, the
revision would limit access and restrict through traffic in the Segale Busi-
ness Park.
At the time of issuance of the original Shorelines Permit it was envisioned

"future" road, designated by dotted lines, would be eliminated. Recently
building 781 has been proposed west of the western most railway spur. It

Segale Business Park
The revisions to the original permit issued to Mario Segale on November 13,
1974 for the Segale Business Park are within the scope and intent of the origi-
nal permit. However, it should be noted that the new drawing is more detailed
than the original one in 1974 and that a conflict exists. The text of the origi-
nal permit allows five rows of buildings. Project 781 is the fifth row, but there
is enough area for another (sixth) row.along Southcenter Parkway. The original
permit requires that any, buildings in the sand and gravel areas would require a
new shoreline application. This should be corrected in the drawing to show that
area adjacent to Southcenter Parkway is used for sand and gravel storage.
W.A.C. 173 -14 -064 (4) requires that a formal decision be reach by the local
government, no time period is set. However, within eight (8) days after the
decision, if favorable, it must be forwarded to the Attorney General and
Department of Ecology.

Board Order of Dismissal in SHB 135, application of Mario A.
Segale, was that the respondent submit plans covering the entire
business park. These plans and accompanying text have been
developed and are now in final form. Through the applicant's
conscientious efforts a complete master application covering
the entire Segale business park has been developed.
For the past few weeks the Department and this office have
been working with the applicant on the master application. We
have, as a result, an application that has the support of both
the Attorney General's office and the Department of Ecology.
This application should be, or may already have been, transmitted
to you by Peter Buck.
While we recognize that the decision is in the hands of the
City, should the master application as developed be approved, we
would, upon receipt of the master permit form, transmit our letter
of approval. Inasmuch as this is the first time an applicant has
agreed to an integrated project concept and participated in an
integrated application process, we would appreciate your keeping

EXHIBIT B
1. Applicant declares this to be a master application for a
single master permit covering the entire Segale Business Park.
2. The business park shall consist of that area depicted in
page 2 of the attached site plans.
3. For purposes of this permit, which is pursuant to the Shore-
line Management Act and the State Environmental Policy Act, the entire
park depicted in the attached eight pages of site plans and sketches
shall be considered to be an integrated project, that is, the juris-
diction of the Shoreline, Management Act shall extend to all points
of the "Backland Area," "Shoreland Area," and "Asphalt, Sand and
Gravel" areas shown on page 4 of the attached site plans.
4. In the event of a conflict between the attached site plans
and this text, the written text shall control.
5. As applicant desires to develop construction or works within
the park, he will bring to the City of Tukwila site plans for each
specific project, which shall then be attached to the master permit
and become a part of that permit. Said site plans shall be in detail
as is required for an original application. If it shall be determined
that an individual project is not within the scope of the business
park as herein described, then said project shall not be a part of
the master permit and separate application for a substantial develop-
ment permit must be made for that project.
6. Regardless of the construction or works mentioned anywhere in
this application, there shall be no development anywhere within forty
feet of the mean high water mark of the Green River, for the entire

distance of the business park, except for those aspects of the existing
sand, gravel, and asphalt operation which are within forty feet of the .
mean high water mark.
7. Specific segments of the business park shall be developed as
follows:
A. Development of Backland Area
Page 4 of the attached site plans shows an area identified as a
"Backland Area." Development of this area shall be in conformance
with the City of Tukwila Shoreline Master Program, insofar as it
may be ascertained, and City of Tukwila zoning; the more restric-
tive regulation shall apply in the event of a conflict.\ Even -.
tual development shall involve five rows of buildings served by
rail on one side and a road on the other side. One set of
buildings may be in an east -west row facing South 180th Street.
A second set of buildings may be in a north -south row along the
west side of Andover Park West "A ". A third set of buildings
may be in a north -south row along the east side of Andover Park
East "C ". A fourth set of buildings may be in a north -south
row along the west side of Andover Park West "C ". A fifth set
of buildings may be in a north -south row along the Southcenter
1 Parkway.
B. Development of Shoreland Area
Page 4 of the attached site plans depicts an area identified
as a "Shoreland Area." Development of this area shall be in
conformance with the City of Tukwila Shoreline Master Program,
insofar as it may be ascertained, and the City of Tukwila
zoning; the most restrictive regulation shall control where

between Andover Park West "A" and the Green River. Two rail -

road tracks and additional spurs to most of the structures
will run between the buildings and the dike along the Green
River.+ The track, including any extension, shall be no closer
than forty feet to the mean high water mark of the Green River.
Railroad spurs will serve various businesses within the park,
and may be on the river side of the buildings. The railroad
tracks shall be landscaped from the river edge of the track
to the top of the dike with large, hardy shade trees at a
maximum of thirty feet on center. Natural ground cover shall
be used from the edge of the track to the top of the dike.

C. Development of Asphalt, Sand and Gravel Area
Page 4 of the attached site plans depicts an area identified
as an "Asphalt, Sand and Gravel" operation. This area is
currently being used for manufacturing, storing, and transpor-
ting of sand, gravel, crushed rock and asphalt, and for storage
and repair of construction equipment as well as related uses.
This permit shall include this operation as described. This
permit shall also include improvements to the asphalt, sand
and gravel operation so long as these improvements do not change
the nature of this operation as an asphalt, sand and gravel
operation. Any improvements shall be in conformance with the
City of Tukwila Shoreline Master Program, insofar as it may
be ascertained, and City of Tukwila zoning; the more restric-
tive regulation shall apply in the event of a conflict. Should
any significant change in the use of this area be made, such
llas conversion to a business park or other type of industrial

use or such as conversion to a cement batching plant or mining
operation, a new shorelines substantial development permit, apart

from this master permit, would be required. Railroad lines will
not be extended into the Asphalt, Sand and Gravel area until there
is a need for them to service the asphalt, sand and gravel opera-
tion, such need to be determined in the sole discretion of the
applicant.
8. Grading. The site will generally be leveled. The entire
property will be regraded to contours ranging from the existing
elevation of 22 feet on the north end of the property to 26.5 feet
at the south end of the property. There will be some local varia-
tion. A typical yard grade will be 22 feet, with some variation.
The earth grade along the river will run from the existing elevation
of 22 feet at the north to 26.5 feet at the south.

9. Utilities. Utilities will include storm sewer lines,
water lines, sanitary sewer lines, gas lines, electrical lines,
and telephone systems. All utilities will be placed underground
except for those serving the Asphalt, Sand and Gravel area; no
utility will be placed within that territory forty feet from the
mean high water line of the Green River, except for those servin
the Asphalt, Sand and Gravel area. All utilities will conform
to the City of Tukwila Shoreline Master Program, insofar as it
may be ascertained, and the City of Tukwila zoning; the more
restrictive regulation to control in the event of a conflict.

11. Uses. This permit does not allow heavy industrial struc-
tures such as steel mills, aluminum foundries or oil refineries.
In the event the applicant desires such development, it will apply
for a subsequent permit if the area falls within those areas governed
by the Shorelines Management Act. Nothing in this permit shall
preclude a future application for heavy industrial structures such
as steel mills, aluminum foundries or oil refineries.
12. Development of Southwest Corner of Asphalt, Sand and
Gravel Operation Area. This permit shall allow development of the
southwest corner of Asphalt, Sand and Gravel area to include one
building which will be unrelated to the asphalt, sand and gravel
operation. This building shall be directly to the east of the
existing Associated Sand and Gravel office building. The building
will be approximately 24 feet high, approximately 60 feet wide,
and approximately 170 feet long. Ingress and egress will be to
the north of the building along the existing blacktop road from
Southcenter Parkway (57th Avenue South). Development will be in
,Exhibit B.

Managment Substantial Development Permit pursuant to
the Shoreline Management Act of 1971. This application
has been approved and forwarded with great reservation
and with the confidence that the appropriate State
agencies will utilize their expertise in their review.
We will attempt to outline the reasons for our expressed
reservations.
To begin with, the written application was received on
7 August 1973 and the Notice of Application was published
on 18 and 25 September 1973. However, the site plans
now attached to the application were not received until
the third week of March 1974. This action did not
necessarily preclude due process since no response from
the general public was recorded. However, it did limit
this department's review to less than ten days.
Further, you are probably aware that the Tukwila Citizen's
Advisory Committee has recommended that the City Council
adopt the Shoreline Master Program as proposed by the
Committee. The City Council has referred the document
to the Planning. Commission' for an additional Public
Hearing. That hearing was opened on 21 March 1974 and
will be continued on 3 April 1974. Within the proposed
Program, a fifty -foot "River Zone" is designated. This
zone restricts the use of that fifty -foot area to land-

scaping with the possibility of constructing an access
road not to exceed twenty -four feet.
According to the plans included within the enclosed
application, the proposed building will be dependent
upon rail service. This service is indicated on the site .
plan in the form of two rail lead tracks together with a
rail spur track. All of these rail tracks are proposed
between the rear of the building and the dike slope.
Only two of the three rail tracks, specifically the spur
and it's closest lead track, are located outside the
fifty -foot River Zone promulgated by the proposed Master
Program. There is no indication within the application
for the need of two rail lead tracks. If the rail lead
track proposed to be located at the toe of the dike
slope were deleted, the plan would comply with the pro-
posed Master Program.
Moreover, if both lead tracks were determined necessary
for support of the proposed building, and subsequently
permitted, it seems quite apparent that an explicit
precedent will be established to allow the 'remainder
of the undeveloped site to construct a rail lead track
within the fifty foot River Zone; even though the
remainder of the total development will not require
Shoreline Management Permits until after the Master
Program has been adopted by the City. Thus, in relation
to the overall development, the conditions of the permit
for this particular building will prove to be dictatorial
of future permits for the remaining undeveloped portions
of the overall development.
In addition, the proposed Master Program also restricts
building heights to a maximum of thirty -five feet for
buildings proposed to be located within the "Low Impact
Zone" or more specifically the second fifty foot area
measured inland from the river. The enclosed plans .
include no elevations of the proposed building.
It is anticipated by this department that the proposed
Shoreline Master Program, however revised, will be
formally adopted by the City Council prior to 20 May 1974.
The Segale Business Park appears concerned over possible
economic losses if this Shoreline Permit is not processed
expeditiously. Thus, this department has confined it's
review of the site plan to ten days. In view of these
factors, as well as the proposed Master Program and the
effect of this particular permit on the remaining
development, we have explained our reservations in

track proposed to be located at the the of the dike
slope were deleted, the plan would comply with the pro-
posed Master Program.
Moreover, if both lead tracks were determined necessary
for support of the proposed.building, and subsequently
permitted, it seems quite apparent that an explicit
precedent will be established to allow the remainder
of the undeveloped site to construct a rail lead track
within the fifty foot River Zone; even though the
remainder of the total development will not require
Shoreline Management Permits until after the Master
Program has been adopted by the City. Thus, in relation
to the overall development, the conditions of the permit
for this particular building will prove to be dictatorial
of future permits for the remaining undeveloped portions
of the overall development.
In addition, the proposed Master Program also restricts
building heights to a maximum of thirty -five feet for
buildings proposed to be located within the "Low Impact
Zone" or more specifically the second fifty foot area
measured inland from the river. The enclosed plans
include no elevations of the proposed building.
It is anticipated by this department that the proposed
Shoreline Master Program, however revised, will be
formally adopted by the City Council prior to 20 May 1974.
The Segale Business Park appears concerned over possible
economic losses if this Shoreline Permit is not processed
expeditiously. Thus, this department has confined it's

review of the site plan to ten days. In view of these
factors, as well as the proposed Master Program and the
effect of this particular permit on the remaining
development, we have explained our reservations in
granting the'enclosed permit. In light of the appeals
of approved Shoreline Permits in the recent past by
the Department of Ecology, we trust you will similarly
view this application.

Dear Mr. Mettler:
Upon behalf of our client, Segale Business Park, at your
hearing on March 21, 1974 we recommended several changes to
the Tukwila Shorelines Master Program. Following are the
minimum changes we would recommend.

1. Scope of River Zone
The .River Zone should extend inland from the mean high
water line 30 feet rather than 50.feet. .The definitions of
the management zones on pages 3.13 and 3.15 should read as
follows:
Figure 3.7 would appear as in the attached figure.
River Zone: An impact buffer area which provides
for resource protection, flood control
maintenance, pollution control and land-
scape enhancement. This zone includes
the first 30 feet from the mean high
water mark.
Low Impact Zone: A transition area intended to
minimize physical and visual impact
on the river zone while accommodating
shoreline development. This includes
the second 50 feet from the • mean high
water mark. .
High Impact Zone: An area to provide for more inten-
sive use of the shoreline resource.
This zone includes the area from 80'
to 200' from the mean high water mark.

2. Allowance of Additional Support Activities within the
River Zone
Under shoreline uses allowed in River Zone on page 6.2
the sentence which currently reads: "1. Access roads not to
exceed two (2) lanes or twenty -four (24) feet in width" should
be amended to read as follows:
1. Access roads and other support activities
and improvements such as parking and loading
areas, railways, and utilities.-
Under River Zone standards on page 6.2 the sentence which
currently reads:. "1. Access roads shall be located no closer'.

be amended to read as follows:

should be modified to read as follows:
1. Structures not to exceed the existing height
restrictions under the Tukwila ,zoning code..
4. Other Chancres
It was suggested at the public hearing that a noncon-
forming use clause should he added to the Tukwila Master.
Program. It is our understanding that such a clause is being
prepared by Mr. Gary Crutchfield.
As was reflected at the last public hearing, there is a
great deal of dissatisfaction with the proposed Tukwila Master
Program. Some citizens in Tukwila have suggested the need for
a total revision of goals and policies to reflect the actual
goals and policies of Tukwila and a total revision of the use
regulations. Our client, Segale Business Park, and, we under-
stand, a substantial number of other landowners feel that it
would be acceptable to modify the program in the above described
manner rather than making major revisions in the program.
