AN ORDINANCE OF THE CITY OF TUKWILA VACATING A CERTAIN
PORTION OF SOUTH 152ND STREET AS SPECIFICALLY DESCRIBED
HEREIN, SITUATED WITHIN TRACTS 37 AND 38, BROOKVALE GAR-
DEN TRACTS, AS RECORDED IN VOLUME 10 OF PLATS, PAGE 47,
RECORDS OF KING COUNTY, WASHINGTON, SUBJECT TO THE COM-
PLETION OF ONE CONDITION.

WHEREAS, petition has been filed valid in form with the City of
Tukwila and on file in Planning Department file number MF #75 -3 -SV requesting
the vacation of portions of a certain street as hereinafter more specifically
described, and
WHEREAS, by Resolution No. 494 adopted by the City Council of Tukwila
on September 15, 1975, a date was set for public hearing upon the proposed
street vacation,
WHEREAS, due and proper notice of . said hearing was given in accordance
with law, and
WHEREAS, following said public hearing held October 6, 1975,-444.0r

a vote of the council was taken favoring said street vacation
as described in section 1 hereinafter set forth, and
WHEREAS, it appears desireable and to the best interests of the City,
its residents and property owners abutting thereon that said street be vacated,
with such vacation to become effective only upon the filing of a quit claim deed
for a substitute right -of -way as described in section 2 hereinafter set forth.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
DOlga AS FOLLOWS:
Section 1. The following specifically described portion of South 152nd
Street as shown in Exhibit A, located within Tracts 37 and 38, Brookvale Garden
Tracts, as recorded in Volume 10 of Plats, page 47, records of King County, Wash-
ington, shall and hereby is vacated:
Beginning at the SE corner of the NW Quarter of Sec.
23. Twp. 23 N., R. 4 E.W.M., thence northerly 15 feet;
thence at right angles westerly 650 feet, more or less,
to the East margin of 57th Ave. South; thence southerly
30 feet along said margin; thence at right angles east-
erly 650 feet more or less; thence at right angles
northerly 15 feet to true point of beginning, situated
in the City of Tukwila, King County, State of Washington.

Section 2. This ordinance shall not go into effect until such time
as a quit claim deed in favor of the City of Tukwila for a substitute right -of-
way for South 152nd Street, as hereinafter described and shown in Exhibit B, is
filed with the King County Department of Elections and Records and a recorded
copy delivered to the office of the City Clerk of the City of Tukwila.
Section 3. A quit claim deed in favor of the City for an extension
of a 50 foot segment of property from the eastern end of the property described
in exhibit B to the eastern property line, as described and shown in Exhibit C,
attached, is to be held in escrow by the property owner until such time as South
152nd Street construction and connection with 62nd Avenue South is guaranteed to
minimum City standards. If release of the deed is necessary prior to this being
guaranteed in order for an L.I.D. to be undertaken, said release shall be allowed.
Appropriate steps shall be taken through the City Attorney's office to assure the
City title to this property at such time as the conditions stated above are met,
and that said quit claim deed will be properly recorded.
Section 4. Except as provided in Section 2 and 3, this ordinance shall
be in full force and effect five days from and after its passage by the council
and publication as required by law.

SUBJECT: Graydon Smith - Street vacation (portion So. 152nd Streetr)
DATE: Sept. 4, 1975
I talked with City Attorney Parker today regarding the validity of the public
hearing held on the above subject before the Planning Commission on April 11,
1974. He replied that based upon RCW 35.79, that the hearing is invalid since
it must be held before the legislative authority or a committee thereof. The
Planning Commission is not a committee of the City Council.
Because of this, the public hearing process must be redone, and should be
handled as follows:
Step 1: City Council, by resolution, set a hearing date before council
or committee thereof when the petition will be heard. (Must be .
not more than 60 days or less than 20 days from date of passage
of resolution).
Step 2: City Clerk shall give. 20 days notice of the pendency of the peti-
tion by written notice posted in three of the most public places
in the city and a like notice in a conspicuous place near the
street to be vacated.
Step 3: Hearing held before council or committee thereof. If held before
a committee a recommendation on the petition shall be made to the
council which may adopt or reject the recommendation.
Step 4: The ordinance may retain easements for the construction, repair
and maintainance of public utilities, if necessary.
Step 5: Have quit claim deed of newly described right -of -way a condition
of vacating old right -of -way and record quit claim deed.
Step 6: Initiation of L.I.D. should be undertaken.
I see no reason for holding back building permits because of the above.
Issuance could occur with a condition that occupancy not be allowed until Steps
1 -5 have occurred.

During their regular meeting of October 20, 1975, the City Council of Tukwila .
did approve your street vacation application as requested.
Please find attached with this letter the ordinance granting the street vaca-
tion. As you will note, there is a responsibility placed on the developer to
place the proposed easterly five feet of the right -of -way in escrow in favor .
of the City.
I suggest you get in contact with Mr. Wayne Parker, the city attorney, and
work out the details of complying with the terms of this ordinance.

This letter is intended just to clarify the action of the Tukwila City
Council during their regular meeting of October 6, 1975 regarding your
application.
At that meeting the proposed ordinance vacating the right -of -way requested
by you was tabled until their next regular meeting of October 20, 1975.
During that time I will arrange with the City Attorney to have two quit claim
deeds prepared as discussed during the City Council meeting on October 6, 1975,
as well as revising the legal discription in the proposed ordinance and the mention
of the quit claim deed for the easterly five feet of the proposed right -of -way
which is to be placed in escrow.
I will get back in touch with you as soon as I receive these documents back
from the City Attorney.

Attorney Parker stated it is testimony given in the
Davis vs. Todd case and according to his instructions
to the court reporter, if something was ordered by
the opposing counsel, he wished to receive copies of
the documents. He stated he incurred the expense and
he expects to be paid.

MOTION TO WITHHOLD VOUCHER #6751. ROLL CALL VOTE:
3 AYES - GARDNER, HARRIS, JOHANSON; 4 NOS - STERLING,

Mayor Todd opened the public hearing for comments at
7:25 P.M. City Clerk Shirlee Kinney stated the public
hearing notice has been properly posted within the
City according to R.C.W. 35.79. Kjell Stoknes, Plan-
ning Director, reviewed the area of street vacation
on the map. He stated the Planning Commission held
its public hearing in 1974 however it was not consid-
ered a valid hearing; therefore, we are having the
hearing before the City Council tonight. The Planning
Commission:'s recommendation at the time was to approve
the street vacation.
Mr. Rod Esping, 15050 Macadam Rd., asked if this
street vacation affected his property. Mayor Todd
replied no, it did not.
Mr. Alvin B. Harrison, 7415 Woodlawn N. E., Seattle,
stated the street alignment as indicated on the map
is basically satisfactory. He stated he is still an
interested party being a property owner of the
Easterly part. The original alignment proposed in
the arterial plans and rezone petition did show the
street set more to the North. When he first read the
ordinance this evening, without the benefit of the
map, he thought the street was running to the East
and West but looking more closely, it is more to
the North. He stated it appears to be 87 20' more
to the East than the original proposal according to
the map. He stated he would speak in favor of the
alignment.
Mr. Graydon Smith stated there is one thing missing
in the ordinance which is the 5 feet to be held in
escrow until the property is developed to the East.
Steve Hall, Public Works Director, stated in the
legal description, there is included the reservation
of the 5 feet. Kjell Stoknes, Planning Director,
stated the property was rezoned in December, 1968,
and there was a developers agreement attached which
includes the 5 foot stipulation. If the Council so

Mr. Smith stated in the original proposal, the City
was to be deeded all of the SO foot right -of -way
except for the last 5 feet which would be saved by
himself until such time as the other property was
developed. Mr. Harrison suggested the solution is
to change the legal description so that it is 5 feet
shorter and to prepare quit claim deeds to the City
for the 5 feet signed by the Smiths and the Harrisons.
At such time as the street goes through, the City
obtains the quit claim deeds.
Mr..Esping stated his father had deeded 15 feet twice

notice and she could not approve it. Also, regarding
Voucher #6751 payable to the City Attorney in the
amount of $60.00 for a court reporter's transcript of
Mayor Todd's testimony in Superior Court in the case
of Davis vs. Todd. She stated this transcript was or-
dered by the Council's attorney Larry Hard but it was
not used in the findings of fact, conclusions of law
and judgment nor was it referred to in the telephone
call with Judge Faris. She stated she did not feel
it was a valid bill of the City. Attorney Parker
stated the original transcript was ordered by Attorney
Hard. He stated he had a standing order with the
court reporter for copies of any transcripts ordered
by Attorney Hard. Mayor Todd defended Attorney Parker
to arm himself with all available documents in the
defense of the City in this case. Councilwoman Harris
stated the transcript was ordered through Attorney
Hard by another attorney for the purpose of another
nature. Attorney Parker stated -he had no way of know-
ing that at the time the transcript was provided by
the court reporter. Councilwoman Harris stated the
City was not charged by Attorney Hard for this and
that she had paid for the transcript herself and has
it in her possession. Mayor Todd asked if the other
attorney referred to is Attorney Sweet. Councilwoman
Harris replied yes. Mayor Todd asked if he were
defending her in a libel and slander action. Council-
woman Harris replied yes, Mr. Todd had filed the law
suit against her in February, 1974, and Mr. Sweet is
her attorney. She stated Mr. Hard billed Mr. Sweet

on the map. Councilman Gardner read a letter from
Steve Hall dated September 29, 1975 recommending the
City to participate in a portion of the funding of
the project in the amount of not more than $3,700.00,
an amount which is not covered by the State or Federa:

a letter from Gary Crutchfield, Assistant Planner,
dated September 30, 1975 which outlined the grant
proposal and requested Council approval of the grant
offer and to augment the program budget to purchase
and plant additional trees to fulfull the goal of the
original proposal of 20 trees. MOVED BY SAUL,

THE $200.00 GRANT FROM THE STATE BICENTENNIAL COMMIS-

Discussion followed regarding funding of the City's
share of expenses. Mrs. Phyllis Pesicka stated the
Bicentennial Committee has $300 in its account.
Mrs. Lutes stated there is $4,300 left of the Revenue
Sharing funds but some has been spent recently for .
lumber and other materials for the cabin. Kjell
Stoknes, Planning Director, stated it is the intent
of the City to provide the labor as an in -house
expense. As an alternative, he offered to pay the
expense from the Planning Department's professional
services account.
Councilman Johanson reviewed a letter to the City
Council from Mr. Donald D. Fleming, LeSourd, Patten,
Fleming $ Hartung, Attorneys at Law, dated September
5, 1975 stating the firm was pleased to enclose a
copy of the letter, findings, conclusions, and judg-
ment signed by Superior Court Judge Philip H. Faris
which achieved all the objectives of the Council in
its lawsuit. Councilman Johanson reviewed the con-
tents of the judgment.
Attorney Parker stated the officials of the City have
filed notice of appeal within the 30 days as required,
principally objecting to some of the wording of the
order that the Council may employ their legal firm
at any time they wish. We are also objecting to the
$13,000 total fees, of which $9,000 was added after
the date of trial. Mayor Todd stated for the benefit
of audience members, this situation arose out of a
board of arbitration decision to award increased
salaries to three employees in the City Clerk's
Department. Councilman Traynor stated the board of
arbitration was stricly on discrimination and not on
salaries.
Mrs. Elanor McLester asked to know the amount of legal
fees for the City of Tukwila which the taxpayers will
also have to pay in the court case on behalf of Mayor
Todd and the defendants. Attorney Parker replied his
fees for the case amount to $2,800 or $2,900.

AGENDA TO INCLUDE ITEM 7.e., MAYOR TODD'S LETTER
REGARDING SENIOR CITIZENS CENTER AND LARGER BUS.
CARRIED. Councilwoman Harris stated this item was
discussed in the Community Affairs Committee and at
the last Park Board meeting. Mr. Bill Moore, Chairman
of the Park Board, sent memos to the Council including
recommendations. Councilwoman Harris read the memo
regarding the additional large bus which stated the
Park Board feels a larger bus is not economically
desirable, but an additional bus the size of our
present van would provide 100% more flexibility and
capacity to accommodate the growth in recreational

1. Review the proposed ordinance attached that I have amended to see
if it is consistant with the intent of the application and if it
is legal as to form.
2. Prepare a quit claim deed for the entire new right -of -way with the
exception of the easterly five feet.
3 . Prepare a separate quit claim deed for the easterly five feet of the
proposed right -of -way to be quit claimed in favor of the city. It is
my understanding that this quit claim deed is to be placed in escrow
by Mr. Harrison. This quit claim deed is to be released to the City
at such time as a road improvement is guaranteed between the easterly
terminus of South 152nd Street and South 151st Street at the corner
of 62nd Avenue South.
Wayne, I don't know the legal ramifications or the necessary pocedural steps
needed to be taken to make all this workable. I am going to have to depend on
you totally to come up with the right paperwork that you think will do the

HEREIN, SITUATED WITHIN TRACTS 37 AND 38, BROOKVALE GAR-
DEN TRACTS, AS RECORDED IN,,VOLUME 10 OF PLATS, PAGE 47,
RECORDS OF KING COUNTY, WASHINGTON, SUBJECT TO THE COM-
PLETION OF ONE CONDITION.
WHEREAS, petition has been filed valid in form with the City of
Tukwila and on file in Planning Department file number MF #75 -3 -SV requesting
the vacation of portions of a certain street as hereinafter more specifically
described, and
WHEREAS, by Resolution No. 494 adopted by the City Council of Tukwila
on September 15, 1975, a date was set for public hearing upon the proposed
street vacation,
WHEREAS, due and proper notice of said hearing was given in accordance
with law, and
WHEREAS, following said public hearing held October 6, 1975, which
was placed in committee and brought back to a regular city council meeting on
October 20, 1975, a vote of the council was taken favoring said street vacation
as described in section 1 hereinafter set forth, and

with such vacation to become effective only upon the filing of a quit claim deed

DO RESOLVE AS FOLLOWS:
Section 1. The following specifically described portion of South 152nd
Street as shown in Exhibit A, located within Tracts 37 and 38, Brookvale Garden
Tracts, as recorded in Volume 10 of Plats, page 47, records of King County, Wash-
ington, shall and hereby is vacated:
Beginning at the SE corner of the NW Quarter of Sec.
23. Twp. 23 N., R. 4 E.W.M., thence northerly 15 feet;
thence at right angles westerly 650 feet, more or less,
to the East margin of 57th Ave. South; thence southerly
30 feet along said margin; thence at right angles east-
erly 650 feet more or less; thence at right angles
northerly 15 feet to true point of beginning, situated
in the City of Tukwila, King County, State of Washington.
Section 2. This ordinance shall not go into effect until such time
as a quit claim deed in favor of the City of Tukwila.for a substitute right -of-
way for South 152nd Street, as hereinafter described and shown in Exhibit B, is
filed with the King County Department of Elections and Records and a recorded
copy delivered to the office of the City Clerk of the City of Tukwila.
Section 3. A quit claim deed in favor of the City for an extension
of a 50 foot segment of property from the eastern end of the property described
in exhibit B to the eastern property line, as described and shown in. Exhibit C,
attached, is to be held in escrow by the property owner until such time as South
152nd Street construction and connection with 62nd Avenue South is guaranteed to
minimum City standards. If release of the deed is necessary prior to this being
guaranteed in order for an L.I.D. to be undertaken, said release shall be allowed.
Appropriate steps shall be taken through the City Attorney's office to assure the
City title to this property at such time as the conditions stated above are met,
and that said quit claim deed will be properly recorded.
Section 4. Except as provided in Section 2 and 3, this ordinance shall
be in full force and effect five days from and after its passage by the council
and publication as required by law.

The unimproved portion of South 152nd Street
lying east of 57th Avenue South.
1. A petition was properly filed with the Planning Department in March
1974 requesting vacation of the platted unimproved portion of South
152nd Street lying within Tracts 37 & 38, Brookvale Garden Tracts.
2. Resolution #416, passed by the City Council on 18 March 1974, fixed
the 11th day of April 1974, at 8:00 P.M., in the council chambers of
Tukwila city hall as the time and place for a public hearing before the
Planning Commission of the City of Tukwila to consider said petition.
3. Said public hearing was duly advertised and conducted by the Tukwila
Planning Commission as set forth in Resolution #416.
4. The findings of the Planning Commission upon conducting the public
hearing were as follows:
a. The presently platted thirty (30) foot right -of -way would be
repladed by a dedicated fifty (50) foot right -of -way at no cost
to the City of Tukwila.
b. The proposed alignment is the most reasonable one to allow
improvement to minimum city standards and also be compatible
with development allowed under existing zoning. Also noted the
proposed alignment reflects the alignment of the proposed
right -of -way shown on the city's Comprehensive Street and
Arterial Plan as prepared by John Graham and Company in 1961.

c. The proposed right -of -way will be a dead -end street until such .
time as the property owners to the east extend it to connect
with South 151st Street and there is no . provision for a turn-
around area required for dead -end streets.
d. Development of this property will significantly increase the
use of South 152nd Street easterly from Macadam Road.and that
portion of South 152nd Street is only a thirty (30) foot right -
of -way.
5. The conclusions arrived at by the Planning Commission, based upon
their findings as outlined in 4 above, were as follows:
a: That dedication of a new fifty (50) foot right -of -way be
accomplished, the detailed alignment of which should be agreed
upon by the Director of Public Works and the property owner.•
b. That the dedication include a means to turn vehicles and that
such land is to be returned to the property owners when the
street is extended easterly.
c. That the City Council adopt a Resolution ordering the widening
and improvement of South 152nd Street from Macadam Road to 57th
Avenue South.
6. No action resulted from that public hearing and recommendation due to
lack of the necessary legal description of the new fifty (50) foot
right -of -way to be dedicated in replacement of the thirty (30) foot
right -of -way to be vacated.
7. The City Attorney has advised that the public hearing be conducted
by the City Council or a committee thereof, rather than the Planning
Commission, to comply with RCW•35.79 and Resolution #494 adopted 15
September 1975 fixed the 6th day of October 1975 in the council
chambers of the city hall•as the time and place for a public hearing
before the City Council to consider the same petition and said public
hearing has been duly advertised and posted.
8. Section 17.08.010, subparagraph (1), (TMC), requires a minimum fifty
(50) foot right -of -way to serve residential areas.
9. The petitioner owns Tracts 37 and 38, Brookvale Garden Tracts which
abut 100% of that portion of the unimproved right -of -way of South 152nd
Street petitioned for vacation.
10. The property owner has petitioned for vacation to allow dedication of
a fifty (50) foot right -of -way which better conforms to the topography
of the site and which would accomodate development allowed under the
existing zone classifications of the property.

11. Development allowed under current zoning of the property would
significantly increase the use of South 152nd Street easterly from
Macadam Road.
12. The proposed right -of -way would be a dead -end street with provisions
for turn - around until such time as the property to the east develops
and South 152nd Street is extended easterly to connect with South
151st Street. At such time, the turn- around provision would revert
back to the abutting property owners.
13. The proposed alignment has been reviewed and approved by the Director
of Public Works as being the best possible location for it.
CONCLUSIONS:
1. All procedures required by RCW 35.79 for consideration of street vaca-
tion petition have been fulfilled.
2. The petitioner should dedicate a new realigned right -of -way to meet
minimum city standards.
3. No other property owner will be adversely affected as a direct result
of granting the requested street vacation.
4. The granting of the street vacation dependent upon dedication of a new
right -of -way would further the implementation of the Comprehensive Land
Use Plan.
RECOMMENDATION:
Based on the findings and conclusions enumerated above, the Planning Department
recommends the petition for street vacation be granted with the following stipu-
lations:
1. That the actual vacation of the existing right -of -way not take place
until such time as a substitute right -of -way, which meets minimun •
city standards and the approval of the Director. of Public Works, has
been deeded to the City of Tukwila, without cost or reservation, and
which has been filed for record with the Department of Records and
Elections of King County and a copy submitted to the office of the
City Clerk of Tukwila.
2. That the new right -of -way be a dead -end to include adequate turn-
around provisions. Said turn- around provisions shall be approved by
the Director of Public Works and revert, at such time as the right -of-
way is extended in an easterly direction, to the property owner of
that portion of Tract 38 which abuts said turn- around area.

I talked with City Attorney Parker today regarding the validity of the public
hearing held on the above subject before the Planning Commission on April 11,
1974. He replied that based upon RCW 35.79, that the hearing is invalid since
it must be held before the legislative authority or a committee thereof. The.
Planning Commission is not a committee of the City Council.
Because of this, the public hearing process must be redone, and should . be
handled as follows:
Step 1: City Council, by resolution, set a hearing date before council
dons or committee thereof when the petition will be heard. (Must be
Des,g9'1 not more than 60 days or less than 20 days from date of passage
et/474 of resolution).
Step 2: City Clerk shall give•20 days notice of the pendency of the peti-
danc, tion by written notice posted in three of the most public places
� in the city and a like notice in a conspicuous place near the
street to be vacated.
Step 3: Hearing held before council or committee thereof. If held before
0 c,6 << 05 a committee a recommendation on the petition shall be made to the
council which may adopt or reject the recommendation.
Step 4: The ordinance may.retain easements for the construction, repair
no+ mdnj P3 and maintainance of public utilities, if necessary.

of vacating old right -of -way and record quit claim deed.' •

Finally, it is requested that the Resolution of Intent for the
LID improving South 152nd Street and 57th Ave. South be reactivated
with the legal description as attached for the relocated South
152nd Street and the existing portions of South 152nd Street from
Macadam Road to 57th Ave. So. and 57th Ave. So. from So. 152nd
Street to its present Southerly terminus.
At the same time, a Resolution should be drawn up designating a
Professional Engineering Firm for the Local Improvement Project so
that all items could be culminated as soon as possible. I have no
specific recommendation as to a consultant for this project, however .
the use of the firms in the past has proven satisfactory and I
would recommend any of the following:

I talked with City Attorney Parker today regarding the validity of the public
hearing held on the above subject before the Planning Commission on April 11,
1974. He replied that based upon RCW 35.79, that the hearing is invalid since
it must be held before the legislative authority or a committee thereof. The
Planning Commission is not a committee of the City Council.
Because of this, the public hearing process must be redone, and should be
handled as follows:
Step 1: City Council, by resolution, set a hearing date before council
or committee thereof when the petition will be heard. (Must be
not more than 60 days or less than 20 days from date of passage
of resolution).
Step 2: City Clerk shall give 20 days notice of the pendency of the peti-
tion by written notice posted in three of the most public places
in the city and a like notice in a conspicuous place near the
street to be vacated.
Step 3: Hearing held before council or committee thereof. If held before
a committee a recommendation on the petition shall be made to the
council which may adopt or reject the recommendation.
Step 4: The ordinance may retain easements for the construction, repair
and maintainance of public utilities, if necessary.
Step 5: Have quit claim deed of newly described right -of -way a condition
of vacating old right -of -way and record quit claim deed.
'Step 6: Initiation of L.I.D. should be undertaken.
I see no reason for holding back building permits because of the above.
Issuance could occur with a condition that occupancy not be allowed until Steps
1 -5 have occurred.

At the present time, Mr. Smith is having a registered land
surveyor locate the proposed center line as he would wish it to
be. At such time as he has developed this center line and has
it staked in the field, this office will review and concur or
make recommendations as to revisions so that it may be acceptable
to the City.. At that time, a legal description will be available
for the rededication of relocated South 152nd Street.

Finally, it is requested that the Resolution of Intent for the
LID improving South 152nd Street and 57th Ave. South be reactivated
with the legal description as attached for the relocated South
152nd Street and the existing portions of South 152nd Street from
Macadam Road to 57th Ave. So. and 57th Ave. So. from So. 152nd
Street to its present Southerly terminus.
At the same time, a Resolution should be drawn up designating a
Professional Engineering Firm for the Local Improvement Project so
that all items could be culminated as soon as possible. I have no
specific recommendation as to a consultant for this project, however
the use of the firms in the past has proven satisfactory and I
would recommend any of the following:
1. Jones and Associates
Bellevue, Washington
2. Harstad and Associates
Seattle, Washington
3. URS Company
Seattle, Washington
4. Stevens, Thompson and Runyan, Inc.
Seattle, Washington
If all of these items could be referred to the Public Works Committee
at the regular council meeting of 2 September 1975, Mr. Parker could
prepare the necessary documentation and furnish it to the Committee
as designated by the Council for review so that the Committee can
make recommendation back to the Council as to the next step required
by them.
Thank you for your assistance in this matter. I feel that timing is
of the utmost importance in this project, and we should proceed with
these items with the utmost in dispatch.

Minutes of Special Meeting, 11 April 1974
This Special Meeting was called to consider, by Public
Hearing, a request to vacate a portion of South 152nd
Street lying east of 57th Avenue South. Members present:
Mr. Mettler, Mr. Zepp, Mr. Sneva, Mr. Lamb, Mr. Kirsop,
Mr. Link and Mr. West. Chairman Mettler called the
meeting to order at 8:30 p.m.
Staff read public notice and outlined the request. Chair-
man Mettler opened the Public Hearing at 8:35 p.m. noting
the absence of Mr. Graydon Smith, the petitioner, and the
Staff Report was read.
Mr. Al Harrison, 7415 Woodlawn Avenue Northeast, Seattle,
spoke in behalf of the request as the co- signer of the
petition. Mr. Harrison noted the proposed realignment of
South 152nd coincides with the City's Comprehensive
Street Plan. Also noted that any requirement for dedication
of turn - around area should not be restricted to cul -de -sac
method and that in the event South 152nd is completed
and extends through the property the land dedicated for
the turn - around would not be needed and should be returned
to the property owner. Mr. Harrison stated Ordinance #536
and the associated Developer's Agreement includes all
the restrictions necessary for the proper development of
this. property.
Staff noted that Public Works Director has informally
approved the proposed alignment although dedication of
the right -of -way should include a turn - around area. Also
explained that South 152nd, between Macadam Road and 57th
Avenue, is only 30 foot right -of -way. The City Attorney
recommends the City Council be urged to order the widening
and improvement of South 152nd easterly from Macadam
Road by L.T.D. Also read Environmental Assessment Summary.
There being no further comments Chairman Mettler closed
the Public Hearing at 9:08 p.m.

Discussion ensued regarding turn - around requirement,
alignment of proposed right -of -way, and routes to achieve
the widening and improvement of South 152nd.
Motion by Mr. Kirsop, seconded by Mr. Link and carried
to recommend the City Council vacate the presently platted
right -of -way of South 152nd Street lying east of 57th
Avenue South subject to compliance with the following
conditions:
1. That dedication of a new fifty foot right-
of -way be accomplished, the detailed align-
ment of which to be agreed upon the the
Public Works Director and property owner.
2. That the dedication include a means to
turn vehicles and that such land is to be
returned to the property owner when the
street is extended easterly.
3. That the City Council adopt a Resolution
ordering the widening and improvement of
South 152nd Street from Macadam to 57th
Avenue.
This completed action to be taken by the Commission regarding
the request.
Mr. Lamb noted he will be absent for the next two weeks.
Motion by Mr. Lamb, seconded by Mr. West and carried to
adjourn the Special Meeting. Chairman Mettler adjourned

STAFF REPORT
11 April 1974
Mr. Smith, in conjunction with developing his proposal,
has requested that that portion of South 152nd Street
lying east of 57th Avenue South be vacated to allow him
to dedicate an improvable right -of -way in accordance
with the drawings presented. While Staff considers the
proposed realignment of South 152nd to be generally the
most reasonable and effective design, we do have some
reservations regarding the effect of this proposal on •
existing developments.
Mr. Graydon Smith has purchased Lots 37 and 38 lying'
immediately east of 57th Avenue South and abutting South
152nd Street, both lots formerly owned by Mr. Alvin
Harrison, a past Planning Commissioner. Mr. Smith
proposes to initiate an apartment development as allowed
under the existing zoning of RMH and R -4. The property
was rezoned in 1968 by Ordinance #536 in conjunction
with a Developer's Agreement, a copy of which is attached.
The basic problem, as we see it, somewhat exists now;
however, the situation will certainly worsen with every
phase of the completion of this project. South 152nd
Street, from Macadam Road to 57th Avenue, is only a 30
foot right -of -way and provides the only access for two
existing apartment developments as well as the proposed
project. The thirty foot right -of -way is inadequate
now and the potential increase in burden will only serve
to emphasize the fact.
Secondly, dedication of any right -of -way should include, at
the most easterly extreme end of such right-of-way,

3. That the required dedication include, at
the most easterly end, an eighty -foot
diameter cul -de -sac.
4. That the City Council adopt a Resolution
ordering the formation of an L.I.D. for
widening and improving that portion of
South 152nd Street lying between Macadam
Road and 57th Avenue South.

a cul -de -sac area of 80 foot diameter. This will allow
emergency vehicle maneuvering as well as a public turn-
around area since the street will be a dead end.
In consideration of the aforementioned reservations
directly related to this request, Staff recommends
that the vacation of South 152nd Street be granted
dependent upon compliance with the following stipulations:
1. That a 50 foot right -of -way be dedicated,
without cost or reservation, to the City.
2. That the location of the required right-
of-way be agreed upon between the property.
owner and the Public Works Director.

herein, would be within the public health, safety and gen-
eral welfare, and agreed to establish the property use dis-
tricts.
5. Owner, in consideration thereof and for so long
as the property remains so classified, hereby covenants, bar-
gains, and agrees to the following conditions on behalf of
himself, his heirs, successors and assigns:.
(a) In lieu of present 30 foot right-of-way
for South 152nd Street east of 57th Avenue South,
to deed to the City of Tukwila a 50 foot right-of-
way, aligned to conform with the City Arterial
Plan, without cost and no reservation except that
5 feet at the easterly property line to, be held •
in escrow by the City until such time as South
152nd Street is continued to the east and connec-
ted with 62nd Avenue South; to improve street to
minimum City standards for a 50 foot. wide street,
including but not limited to grading, drainage
and paving.
(b) To deed to the City, without cost and
without reservation and restriction, a 5 foot
strip of land along the easterly side of 57th
Avenue, providing Owner's share of a standard 50
foot right -of -way.
(c) To equitably participate in any L.I.D. for
widening and improving 152nd Street from Macadam to
57th Avenue South.
(0.) To widen the easterly half of 57th Avenue
South to minimum standards for a 50 foot street,
including but not limited to grading; drainage and
paving, as adjacent parts of the property are
developed.
.(e) To provide water mains with fire hydrants,
adequate for fire protection and domestic water
uses, connecting to 8" main being installed by Owner.

(f) To place power telephone wiring under-
ground on 152nd Street.
(g) To provide adequate sewers.
(h) To provide parking in excess of 3 spaces
for 2 dwelling units.
. (i) To inaintain a 30 foot buffer at the north-
west corner of the property adjacent to a proposed
single family dwelling.-
(j) To provide a screening fence along boundary
bordering on school property.
(k) To comply with the above conditions, as
buildings and improvements are made on the property,
starting from 57th Avenue South and proceeding east,
with each segment of the street and utilities being
completed as properties using the public improve-
nents are'completed.
6. This•Agreement shall be recorded in the records of
King County Auditor and the covenants herein shall be deemed to
attach to and run with the land and shall be binding upon the
Covenantor, his successors xnd assigns.
7. The City may institute and prosecute any proceedings
at law 'or equity to enforce this Agreement and Owner agrees to
pay reasonable attorney's fees expended by the City for such
enforcement proceedings.
8. In the event any covenant, condition or restriction
hereinabove contained or any partition thereof is invalid or
void, such invalidity or voidness shall in no way affect any
other covenants, conditions or restrictions herein contained.

Former actions on the above property have been taken which will require
certain things to be done prior to the issuance of building permits, unless
released by the city attorney in some other way while guaranteeing completion.
Item 1: Ordinance No. 536, as passed by the City Council on December 2, 1968,
did rezone certain portions of the above property to R -4 and RMH classifica-
tions, subject to a PROPERTY USE AND DEVELOPMENT AGREEMENT. (Both are attached).
The property agreement specifically required the following things to be done:
a. In lieu of present 30 foot right -of -way for South 152nd Street
east of 57th Avenue South, to deed to the City of Tukwila a 50
foot right -of -way, aligned to conform with the City Arterial Plan,
without cost and no reservation except that 5 feet at the easterly

I suggest we meet with the City Attorney, Mr. Hall, and Mr. Ruppert as soon
as possible to determine how we can expediate the completion of the above
conditions so we can issue your building permit.
I have also attached the ENVIRONMENTAL ASSESSMENT SUMMARY which gives a
negative declaration on the environmental impacts of your project.
The requirements of this letter are related only to former requirements
which go with this particular property. Other current requirements of the
City will be considered by each respective department upon review of a
building permit application.
Steve Hall will be out of town both Thursday and Friday (August 21 and 22).
A meeting any other time is acceptable. Perhaps the busiest person is

3. The City's Planning Commission, after a detailed
review of the location, isolation, and orientation of the
Owner's property and of the physical problems of achieving
the development of South 152nd Street as projected by the
City's Arterial Plan as adopted 11 December 1961, and cogni-
zant that the proposed land uses were compatible with those
shown on the City's land use map for horizon development as
adopted by the City on 15 May 1967, recommended to the City
Council on 22 March 1968, after public hearings, that such
land use districts be established, but only upon execution of
a Property Use and Development Agreement, substantially in

pay reasonable attorney's fees expended by the City for such
enforcement proceedings. •
8. In the event any covenant, condition or restriction
hereinabove contained or any partition thereof is invalid or
void, such invalidity or voidness shall in no way affect any

I. Location and Description of Project
The proposed project will be located on Tracts 37
and 38 of the Brookvale Garden Tracts situated in the
west half of Section' 23, Township 23, Range 4E. The
site is approximately 10 acres in size with varying
topography.
Ultimate development of the site will consist of
approximately 200 apartment townhouse and single -
floor units. In conjunction with this development,
the conditions stipulated within City of Tukwila
Ordinance #536, dated 3 December 1968 and titled
'Property Use and Development Agreement', will be
complied with.
Also included within project will be the improvement
of South 152nd Street from 57th Avenue South extending
easterly across the property. The platted thirty -
foot right -of -way must be vacated and replatted as
a fifty foot right -of -way conforming to the varying
topography.
II. Purpose
The purpose of this project is to provide an economical
use of the property, as it has been zoned for multiple -
family use since 1968.
III. Environmental Impact of the Proposed Project
The project site is adjacent to one of the last few

remaining relatively pristeen areas within the City.
Care should be taken in adequately buffering the
easterly and northerly portions of the site. While
much of the existing scrub vegetation will be removed,
subsequently causing a minor displacement of wildlife,
approximately 20 acres of comparatively virgin land
lies to the east of the project site and will ade-
quately absorb any displaced wildlife from the project
area. Inclusion of dense landscaping within the
project area will further minimize this unavoidable
but insignificant effect.
While the project is residential in nature, the density
associated with it must be considered the most
significant impact. Effects of this factor will
include increased demand on local utilities. The
existing sanitary sewer facilities will be adequate
if the existing ten inch line is extended to the
intersection of South 152nd Street and 57th Avenue
South. A major water loop must be completed to provide
adequate water service. This would include the
extension of an eight inch main from the intersection
of South 152nd Street and 57th Avenue South to the
intersection of South 151st Street and 62nd Avenue
South. It should also be noted the Comprehensive
Water Plan of the City indicates proposed water storage
tanks located in this area. However, the legislative
body of the City has made no firm committment to
enact that plan. Storm drainage of the site could be
adequately accomplished by including storm sewers in
the improvement of South 152nd Street.
While traffic circulation within the site will be
adequatley accomplished, the increased burden on the
existing semi - improved portion of South 152nd Street
bying between Macadam Road and 57th Avenue South will
create the need for a fully- improved right -of -way
meeting City standards. The increase in suspended
particulates and noise levels are not considered to
be of significance.
IV. Alternatives
Alternatives to the propsoed project include A) do
nothing, and B) single- family subdivision. Alternative
A would not allow for reasonable economic use of the
land and Alternative B is economically unfeasible
in light of the existing zoning and topography. Other
alternatives such as public open space and school

grounds cannot be considered as the City has made no
firm committment to purchase the site, not is it
included on any Capital Improvement Program of the
City.
The improvement of South 152nd Street is the most
crucial element of the development. The feasibility
of improving this street between Macadam Road and
62nd Avenue South should be considered as a viable
alternative to alleviating the associated problems
of both traffic and public safety.
V. Long -Term Productivity and Irreversible Resource
Committments
Long -term productivity includes the provision of
approximately 200 residential units in an employment
area of regional significance. Irreversible resource .
committments are confined to the construction materials
and land incidental to implementation of the project.
VI. Summary
While this project will have some noticeable impacts,
none are considered by the City of Tukwila to be of
significance. It•is imperative, however, that all
necessary precautions, as noted hereinabove, but not
necessarily . limited to those, be taken during imple-
mentation of the proposed project to prevent any
significant impacts on public utilities and rights-
of -way.

The Proposed Action
The proposed action is the first phase of approximately 200
apartment townhouse and single floor units on lots 37 and 38,
Brookvale Garden Tracts, plus the adjoining unplatted strip to the
east, comprising approximately 10.2 acres. The subject site is
bounded on the west by 57th Ave. South and on the, south by South-
west 152nd Place. The first phase of this action will involve the
construction of 68 units on the west 390 feet of tract 37.
It will also include the execution of the covenants of the
agreement spelled out in Tukwila City Ordinance.# 536, titled,
Property Use and Development Agreement, dated, December 3, 1968,
as they apply.
Legislative action requested, though not necessarily concur -
ant with the proposed action, would be the :relocation of that por-
tion of South 152nd that bisects the subject property.
There will be no public financing required for this action.
Private financing has been arranged and construction of the first
phase could begin this spring.
A. Environmental Impact of the Proposed Action
(1) Changes in natural characteristics
Much of the environmental impact relating to changes in
natural characteristics had already taken place some 30 years ago
when the subject site was cleared for grazing and farming. The '
construction of the proposed development would, obviously, have an
additional environmental impact in that buildings and roadways would
permanently eliminate rejuvenation of plant life in portions of the
area. Much of the remaining open space would rejuvenate understory
species and many species of trees. Landscaping associated with the
proposed development would lend to that rejuvenation, although it
would be safe to assume that most rejuvenation would be controlled
to create more usable open space. Natural plant life would therefore
not attain its density prior to clearing.
B. Unavoidable Adverse Effect
Possible adverse effects that would result from the proposed
development include; (1) some restriction of wildlife, (2) alter-
ation of natural ground cover, (3) increased storm water drainage
problems, (4) increased load on sanitary sewer system, (5) more
vehicles and traffic than presently exists, and (6) increased density.
1. Wildlife will, of course, be disturbed by the building
activity and proximity of people, We have no accurate count or
ventory of wildlife. It is impossible to estimate the exact degree
of disruption and relocation of wildlife. A major portion of the
site is to be devoted to common area for recreational purposes and a
portion of that space is proposed as "open space ". This will con-
tribute some to the protection of wildlife but undoubtedly those
species that are not people oriented will retreat to the natural area
to the east.
2. The alteration of groundcover has already occurred by pre-
vious clearing operations. The installation of landscaping, the
planting of trees and the erosion control that will be required will
result in renewal of ground cover and a certain amount of rejuven-
ation of natural growth.
3. The storm water runoff was anticipated by the city and
adjacent landowners prior to the zoning of the subject site and can
be adequately controlled.
4. Increased sanitary sewer loads are unavoidable when popul-
ation in any area is increased. The system in the area is adequate
to handle this increased load.
5. The traffic and number of vehicles will increase. to con-
formation with City Ordinance #536 para. 5 Sections (A.), (B.), (C).
(4.), and (K.), applicant will comply in every respect.
Applicant can further see the need for the extention of South
152nd from the easterly portion subject property to 62nd Avenue South.
and is therefore attempting to gain the support of property owners
who will benifit to initiate an L.I.D. to (A.) widen and improve
South 152nd from MacAdam Road to subject property, and (B.) dedicate
a 50 foot Right of Way and improve same from the easterly boundry
subject property to 62nd Avenue South.
This action, though not totally a pact of City Ordinance # 536.
is deemed by the applicant as a further step towards completing the
comprehensive road system for the City of Tukwila.
6. The increased density may be viewed as having an adverse
effect, however; in the case at hand the density will not be increased
beyond that allowed by zoning, will not be injurious to mental or
physical health and well - being, and does not overcrowd the land.
The number of units permitted by zoning on this site would be
about 180 2 bedroom units on the R.M.H. portion, and 312 on the bal-
ance, which is zoned R4, making a total of 492 units.. The prelim-
inary plat submitted to the Planning Department would reduce the
allowable number of units by about 60%; or a total of approximately
200 units on the entire site.
C. Alternatives to the Proposed Action
There are two possible alternatives to the proposed action;
(1) no development, (2) single family subdivision. Other alterna-
tives such.as park, public open space and school grounds were dis-
missed because the City has no plans to purchase the area, nor is
it part of the park and open space plan. The site is unusable and
poorly located for schools and not part of the school plan.
1. No developments is not considered to be practical as this
denies the owners the reasonable use of their property.
2. The property does not lend itself to single family dwellings
as was forseen by the City's comprehensive plan and excessive devel-
opment costs due primarily to the solid rock base.
D. Relationship Between Local Short Term Environmental Uses and
The Maintenance and Enhancement of Long -Term Productivity.
This aspect does not apply to the proposal being discussed as
no short term use are.being contemplated.
E. Any Irreversible and Irretrievable Resource Commitments with
the Proposed Action.
Other than building materials and labor there is no resource
commitment. The proposal does not require more resources than would
be required for any other residential development.

The City of Tukwila has no ordinance controlling on site storm
drainage, however control of sedimentation and increased flows
through adjacent properties are under our jurisdiction. This
would include any crossing of public right -of -ways also. Where
ever Mr. Smith's utilities will be used in conjunction with other
existing private utilities, documentation will be required as per
the Tukwila Municipal Code on common use utilities.
This office will not approve the proposed water plans until written
approval is received from the Tukwila Fire Marshal as to adequacy
of flow in this area and his appropriate comments as to adequacy for
fire protection of the proposed project.

All files and minutes have been reviewed with respect to the above- refer-
enced action and the following synopsis of events is provided for your
information.
Tracts 37 and 38 of Brookvale Garden Tracts were rezoned to R -4 and RMH in
1968 by Ordinance #536 which included a Property Use and Development Agree-
ment entered into between the City and the former property owners, Mr. and
Mrs. Alvin Harrison.
Mr. Graydon Smith, in 1973, purchased the property from the Harrisons with
the intent to develop an apartment complex using the entire ten (10) acres.
In February of 1974 the Harrisons and Smiths petitioned the City Council to
vacate that portion of South 152nd Street right -of -way existing within their
property with the intention of dedicating a new fifty (50) foot right -of -way
which would conform to the varying topography of the property as well as
compliment the proposed development.
The Planning Commission conducted a Public Hearing on 11 April 1974 and
recommended the City Council vacate said right -of -way upon compliance with
the following stipulations:
1. That dedication of a new fifty (50) foot right -of -way be
accomplished, the detailed alignment of which to be agreed
upon by the Public Works Director and property owner.
2. That the dedication include a means to turn vehicles and that
such land be returned to the property owner when the street is
extended easterly.
3. That the City Council adopt a Resolution ordering the widening
and improvement of South 152nd Street from Macadam to 57th Avenue
South.
DATE: 13 August 197
A letter conveying this recommendation was forwarded to the City Council
on 15 April 1974. The Council minutes of 22 April 1974 show that the Council
directed the City Attorney draw up the appropriate ordinance and resolution
per the Commission's recommendation. In attempting to draw up the appropriate
documents, the City Attorney requested a legal description of the new right -
of -way as well as a complete description of the work to be accomplished by .
the recommended L.I.D.

to allow further groundwork. The Council_ so tabled both the ordinance
and resolution at their 6 May 1974 meeting.
Mr. Smith provided the City in late summer 1974 a legal description of the
right -of -way proposed to be dedicated in place of the right -of -way to be
vacated. However, the work to be accomplished by L.I.D. was never deter -
mined in detail and the matter has been dormant until now.

Avenue South to allow dedication of a new right -of -way
conforming to the City's Comprehensive Street Plan and
one which conforms to the varying topography of the site.
Findings of the Public Hearing were as follows:

stated there is an agreement with Metro that as soon as the line is

There is no City money involved. Councilwoman Harris asked why the
easement is necessary. Mayor Todd stated it is the only way Val
Vue can come through the City and hook into the Metro line with
ULID #6. Councilwoman Harris stated she would like to see more
identification on the documents -- such as a map. Duncan Sturrock
pointed out the area on the City map. Mayor Todd then explained
the contract signed with Val Vue for the rights of way. *CARRIED.

Councilwoman Harris read a letter from Anne Altmayer thanking the
Mayor, City Council and City staff for aid and support during her
term_of office on the Park Board. The letter reviewed the success•
ful programs of the past and expressed hope for the recreational
programs of the City for the future.
Mayor Todd read the letter announcing Tukwila as winner of the
Award of Honor for 1973 to Tukwila and read his letter of congratu•
lations to Steve Hall, Gene Isler and all the Public Works Depart-
ment employees.
Mayor Todd stated there is a tentative agreement for the Police
Guild with the City. He requested an executive session with the
Council at the May 13 regular meeting. The agreement with the
Public Works employees should be ready by then also. He stated
he has not met yet with U.S.T.M.E.
Mayor Todd read.a letter from City Attorney Wayne Parker regarding
legal fees and monthly retainer, dated April 29. Councilwoman
Davis stated she did request of the administration what Mr. Parker
made in 1973 and was given a slip of paper which read $21,000
including LIDs. The breakdown figures out to about $14,000 and
she is wondering what is missing. Mayor Todd suggested Council-

areas. Attorney Parker stated it might be advantageous to delay
until 1975 so that more development may qualify for the subsidized
rates. Mr. Hammersmith stated that would be fine except that by
July 1, 1974 flood hazard boundary maps will be available for floc
hazard areas for the purpose of identifying those areas which may
then not be eligible for F.H.A. or S.B.A. loans. Councilman Saul
asked why the government feels these controls are necessary. Mr.
Hammersmith stated it is an attempt to enforce wise land use and t
reduce the increasing expense of flood damage. Councilman Saul
stated the City of Tukwila is using wise land controls at this tin
in its development. Mr. Hammersmith stated the City is the excep-
tion rather than the rule. If the City is adequately controlling
land use then ideally there is no need for the flood insurance,
but this insurance program will eventually phase out the Disaster
Relief funding. Councilman Sterling stated he would like to see
the complete list of land use requirements. Mr. Hammersmith state
such a booklet has been issued to the City. City Clerk Shirlee
Kinney stated the booklet is available in her office for anyone tc
study. Mr. Bill Moore asked how one would be affected if he did
not live in the flood zone. Mr. Hammersmith stated he would not
be required to purchase the insurance. Councilman Saul was con-
cerned about the development in the Andover Park and Southcenter
area. Councilwoman Harris stated it would be better to make a
decision based on the flood hazard area maps once they are issued.
Mr. Hammersmith stated the Fireman's Fund Insurance Company was
authorized by the Federal government to handle the insurance for
the State of Washington although the insurance will be available
from any licensed agent. Councilman Gardner stated this will
affect the building schedule for the City regarding the amount of
fill required. He stated he thought the City was following a plat
based on a 100 year flood. Mr. Hammersmith stated if the City is
complying with King County, this is probably adequate for the Floc
Program. He stated if the damage due to flood is half or more of
the value of the building, then the owner is not allowed to rebui:
under the former flood zone requirements, but those adopted to
meet the requirements of the flood insurance. If the damages are
less than 50%, the owner is able to collect and rebuild as it is.
Councilwoman Harris thanked Mr. Hammersmith for coming to the Cow
cii meeting and informing everyone about the new Flood Insurance
Program. Councilman Johanson stated it might be worthwhile to
have a representative from the Fireman's Fund speak to the Counci:

Dear Councilpersons:
Findings of the Public Hearing were as follows:
1. The presently platted thirty foot right -
of -way would be replaced by a dedicated
fifty foot right -of -way at no cost to
the City.
The Tukwila Planning Commission, pursuant to Tukwila
Resolution #416, conducted a Public Hearing on 11 April
1974 to consider a request by Mr. Graydon Smith and
Mr. Alvin Harrison, joint property owners, to vacate
that portion of South 152nd Street lying east of 57th
Avenue South to allow dedication of a new right -of -way
conforming to the City's Comprehensive Street Plan and
one which conforms to the varying topography of the site.
2. The proposed alignment is the most reason-
able one to allow improvement to minimum
City standards and also be compatible with
development allowed under existing zoning.
Also noted the proposed alignment reflects
the alignment of the proposed right -of-
way shown on the City's Comprehensive
Street and Arterial Plan as prepared by
John Graham and Company in 1961.
3. The proposed right -of -way will be a dead -
end street until such time as the property
owners to the east extend it to connect

provision for a turn - around area required
for dead -end streets.
4. Development of this property will signif-
icantly increase the use of South 152nd
Street easterly from Macadam Road and that
portion of South 152nd Street is only a
thirty foot right -of -way.
In consideration of the facts and findings as outlined
hereinabove, the Planning Commission recommends that the
City Council grant the vacation of that portion of South
152nd Street lying east of 57th Avenue South subject to
compliance of the following stipulations:
1.' That dedication of a new fifty foot right -
of -way be accomplished, the detailed align-
ment of which to be agreed upon by the
Public Works Director and property owner.

turn vehicles and that such land is to be
returned to the property owners when the

This recommendation is forwarded in behalf of the Planning
Commission and this office must reiterate the integrity
of the restrictions enumerated above as well as those

review of the location, isolation, and orientation of the
Owner's property and of the physical problems of achieving
the development of South 152nd Street as projected by the
City's Arterial Plan as adopted 11 December 1961, and cogni-
zant that the proposed land uses were compatible with those
shown on the City's land use map for horizon development as
adopted by the City on 15 May 1967,. recommended to the City
Council on 22 March 1968, after public hearings, that such
land use districts be established, but only upon execution of
a Property Use and Development Agreement, substantially in
the for;; hereof, herein called "Agreement."
4. The City Council at a public hearing on'6 May
1968, reviewed the recommendations of the Planning Commission,
and found that the establishment of the requested property
•
uses, if developed in accord with certain conditions listed
herein, would be within the public health, safety and gen-
, eral welfare, and agreed to establish the property use dis-
tricts.

5. Owner, in consideration thereof and for so long
as the property remains so classified, hereby covenants, bar-
gains, and agrees to the following conditions on behalf of
himself, his heirs, successors and assigns:
(a) In lieu of present 30 foot right -of --way
for South 152nd Street east of 57th Avenue South,
to deed to the City of Tukwila a 50 foot right-of-
way, aligned to conform with the City Arterial
Plan, without cost and no reservation except that
5 feet at the easterly property line to be held
in escrow by the City until such time as South
152nd Street is continued to the east and connec-
ted with 62nd Avenue South; to improve street to
minimum City standards for a 50 foot wide street,
including but not limited to grading, drainage
and paving.
(b) To deed to the City, without cost and
without reservation and restriction, a 5 foot
strip of land along the easterly side of 57th
Avenue, providing Owner's share of a standard 50
foot right -of -way.
(c) To equitably participate in any L.I.D. for
widening and improving 152nd Street from Macadam to
57th Avenue South.
(d) To widen the easterly half of 57th Avenue
South to minimum standards for a 50 foot street,
including but not limited to grading, drainage and
paving, as adjacent parts of the property are
developed.
(e) To provide water mains with fire hydrants,
adequate for fire protection and domestic water
uses, connecting to 8" main being installed by Owner
in 57th Avenue South as a participant in L.I.U.
(f) To place power telephone wiring under-
ground on 152nd Street.
(g) To provide adequate sewers.
(h) To provide parking in excess of 3 spaces
for 2 dwelling units.
(i) To maintain a 30 foot buffer at the north-
west corner of the property adjacent to a proposed
single family dwelling.
(j) To provide a screening fence along boundary
bordering on school property.
(k) To comply with the above conditions, as
buildings and improvements are made on the property,
starting from 57th Avenue South and proceeding east,
with each segment of the street and utilities being
completed as properties using the public improve-
ments are completed.
6. This Agreement shall be recorded in the records of
'King County Auditor and the covenants herein shall be deemed to
attach to and run with the land and shall be binding upon the
Covenantor, his successors and assigns.
7. The City may institute and prosecute any proceedings
at law or equity to enforce this Agreement and Owner agrees to
pay reasonable attorney's fees expended by the City for such
enforcement proceedings.
8. In the event any covenant, condition or restriction
hereinabove contained or any partition thereof is invalid or
void, such invalidity or voidness shall in no way affect any
other covenants, conditions or restrictions herein contained.

TRACTS 37 AND 38
BROOKVALE GARDEN TRACTS
I. Location and Description of Project
The proposed project will be located on Tracts 37
and 38 of the Brookvale Garden Tracts situated in the
west half of Section 23, Township 23, Range 4E. The
site is approximately 10 acres in size with varying
topography.
Ultimate development of the site will consist of
approximately 200 apartment townhouse and single
floor units. In conjunction with this development,
the conditions stipulated within City of Tukwila
Ordinance #536, dated 3 December 1968 and titled
'Property Use and Development Agreement', will be
complied with.
Also included within project will be the improvement
of South 152nd Street from 57th Avenue South extending
easterly across the property. The platted thirty-
foot right -of -way must be vacated and replatted as
a fifty foot right -of -way conforming to the varying
topography.
II. Purpose
The purpose of this project is to provide an economical
use of the property, as it has been zoned for multiple-
family use since 1968.
III. Environmental Impact of the Proposed Project
The project site is adjacent to one of the last few

remaining relatively pristeen areas within the City.
Care should be taken in adequately buffering the
easterly and northerly portions of the site. While
much of the existing scrub vegetation will be removed,
subsequently causing a minor displacement of wildlife,
approximately 20 acres of comparatively virgin land
lies to the east of the project site and will ade-
quately absorb any displaced wildlife from the project
area. Inclusion of dense landscaping within the
project area will further minimize this unavoidable
but insignificant effect.
While the project is residential in nature, the density
associated with it must be considered the most
significant impact. Effects of this factor will
include increased demand on local utilities. The
existing sanitary sewer facilities will be adequate
if the existing ten inch line is extended to the
intersection of South 152nd Street and 57th Avenue
South. A major water loop must be completed to provide
adequate water service. This would include the
extension of an eight inch main from the intersection
of South 152nd Street and 57th Avenue South to the
intersection of South 151st Street and 62nd Avenue
South. It should also be noted the Comprehensive
Water Plan of the City indicates proposed water storage
tanks located in this area. However, the legislative
body of the City has made no firm committment to
enact that plan. Storm drainage of the site could be
adequately accomplished by including storm sewers in
the improvement of South 152nd Street.
While traffic circulation within the site will be
adequatley accomplished, the increased burden on the
existing semi - improved portion of South 152nd Street
bying between Macadam Road and 57th Avenue South will
create the need for a fully- improved right -of -way
meeting City standards. The increase in suspended
particulates and noise levels are not considered to
be of significance.
IV. Alternatives
Alternatives to the propsoed project include A) do
nothing, and B) single - family subdivision. Alternative
A would not allow for reasonable economic use of the
land and Alternative B is economically unfeasible
in light of the existing zoning and topography. Other
alternatives such as public open space and school

grounds cannot be considered as the City has made no
firm committment to purchase the site, not is it
included on any Capital Improvement Program of the
City.
The improvement of South 152nd Street is the most
crucial element of the development. The feasibility
of improving this street between Macadam Road and
62nd Avenue South should be considered as a viable
alternative to alleviating the associated problems .
of both traffic and public safety.
V. Long -Term Productivity and Irreversible Resource
Committments
Long -term productivity includes the provision of
approximately. 200 residential units in an employment
area of regional significance. Irreversible resource
committments are confined to the construction materials
and land incidental to implementation of the project.
VI. Summary
While this project will have some noticeable impacts,
none are considered by the City of Tukwila to be of
significance. It is imperative, however, that all
necessary precautions, as noted hereinabove, but not
necessarily limited to those, be taken during imple-
mentation of the proposed project to prevent any
significant impacts on public utilities and rights-
of-way.

Subject: Enviromental Assessment Tract 37 and 38
Brookvale Garden Tracts
Tukwila, Washington
The Proposed Action
The proposed action is the first phase of approximately 200
apartment townhouse and single floor units on lots 37 and 38,
Brookvale Garden Tracts, plus the adjoining unplatted strip to the
east, comprising approximately 10.2 acres. The subject site is
bounded on the west by 57th Ave. South and on the south by South-
west 152nd Place. The first phase of this action will involve the
construction of 68 units on the west 390 feet of tract 37.
It will also include the execution of the covenants of the
agreement spelled out in Tukwila City Ordinance # 536, titled,
Property Use and Development Agreement, dated, December 3. 1968,
as they apply.
Legislative action requested, though not necessarily concur -
ant with the proposed action, would be the relocation of that por-
tion of South 152nd that bisects the subject property.
There will be no public financing required for this action.
Private financing has been arranged and construction of the first
phase could begin this spring.
A. Environmental ImRact of the Proposed Action
(1) Changes in natural characteristics
Much of the environmental impact relating to changes in
natural characteristics had already taken place some 30 years ago
when the subject site was cleared for grazing and farming. The `
construction of the proposed development would, obviously, have an
additional environmental impact in that buildings and roadways would
permanently eliminate rejuvenation of plant life in portions of the
area. Much of the remaining open space would rejuvenate understory
species and many species of trees. Landscaping associated with the
proposed development would lend to that rejuvenation, although it
would be safe to assume that most rejuvenation would be controlled
to create more usable open space. Natural plant life would therefore
not attain its density prior to clearing.
B. Unavoidable Adverse Effect
Possible adverse effects that would result from the proposed
development includes (1) some restriction of wildlife, (2) alter-
ation of natural ground cover, (3) increased storm water drainage
problems, (4) increased load on sanitary sewer system, (5) more
vehicles and traffic than presently exists, and (6) increased density.
1. Wildlife will, of course, be disturbed by the building
activity and proximity of people. We have no accurate count or in-
ventory of wildlife. It is impossible to estimate the exact degree
of disruption and relocation of wildlife. A major portion of the
site is to be devoted to common area for recreational purposes and a
portion of that space is proposed as "open space ". This will con-
tribute some to the protection of wildlife but undoubtedly those
species that are not people oriented will retreat to the natural area
to the east.
2. The alteration of groundcover has already occurred by pre-
vious clearing operations. The installation of landscaping, the
planting of trees and the erosion control that will be required will
result in renewal of ground cover and a certain amount of rejuven-
ation of natural growth.
3. The storm water runoff was anticipated by the city and
adjacent landowners prior to the zoning of the subject site and can
be adequately controlled.
4. Increased sanitary sewer loads are unavoidable when popul-
ation in any area is increased. The system in the area is adequate
to handle this increased load.
5. The traffic and number of vehicles will increase. In con-
formation with City Ordinance #536 para. 5.. Sections (A.). (B.), (C).
(D.), and (K.), applicant will comply in every respect.
Applicant can further see the need for the extention of South
152nd from the easterly portion subject property to 62nd Avenue South.
and is therefore attempting to gain the support of property owners
who will benifit to initiate an L.I.D. to (A.) widen and improve
South 152nd from MacAdam Road to subject property, and (B.) dedicate
a 50 foot Right of Way and improve same from the easterly boundry
subject property to 62nd Avenue South.
This action, though not totally a pact of City Ordinance # 536,
is deemed by the applicant as a further step towards completing the
comprehensive road system for the City of Tukwila.
6. The increased density may be viewed as having an adverse
effect, however; in the case at hand the density will not be increased
beyond that allowed by zoning, will not be injurious to mental or
physical health and well- being, and does not overcrowd the land.
The number of units permitted by zoning on this site would be
about 180 2 bedroom units on the R.M.H. portion, and 312 on the bal-
ance, which is zoned R4, making a total of 492 units. The prelim-
inary plat submitted to the Planning Department would reduce the
allowable number of units by about 60 %; or a total of approximately
200 units on the entire site.
C. Alternatives to the Pro
osed Action
There are two .passible alternatives to the proposed action;
(1) no development, (2) single family subdivision. Other alterna-
tives such-as park, public open spice and school grounds were dis-
missed because the City has no plans to purchase the area, nor is
it part of the park and open space plan. The site is unusable and
poorly located for schools and not part of the school plan.
1, No 'development; is not considered to be practical as this
denies the owners the reasonable use of their property.
2. The property does not lend itself to single family dwellings
as was forseen by the City's comprehensive plan, and excessive devel-
opment costs due primarily to the solid rock base.
D. Relationship. Between Local Short Term Environmental Uses and
The Maintenance and Enhancement of Lana-Term Productivity.,
This . aspect does not apply to the proposal being diScussed:as
no short term uses are being, contemplated.
E. Any Irreversible and Irretrievable Resource Commitments with
the Proposed Action.
Other than building materials and labor there is no resource
commitment. The proposal does not require more resources than would
be required for any other residential development.

THIS AGREEMENT is between the CITY OF TUKWILA, a
municipal corporation (called "City "), and ALVIN B. and
BETTY J. HARRISON (called "Owner "). They agree:

3. The City's Planning Commission, after a detailed
review of the location, isolation, and orientation of the
Owner's property and of the physical problems of achieving •
the development of South 152nd Street as projected by the
City's Arterial Plan as adopted 11 December 1961, and cogni-
zant that the proposed land uses were compatible with those
shown on the City's land use map for horizon development as
adopted by the City on 15 May 1967, recommended to the City
Council on 22 March 1968, after public hearings, that such
land use districts be established, but only upon execution of
a Property Use and Development Agreement, substantially in
the form hereof, herein called "Agreement."
4. The City Council at a public hearing on 6 May
1968, reviewed the recommendations of the Planning Commission,
and found that the establishment of the requested property

uses, if developed in accord with certain conditions listed
herein, would be within the public health, safety and gen-
eral welfare, and agreed to establish the property use dis-
tricts.
5. Owner, in consideration thereof and for so long
as the property remains so classified, hereby covenants, bar-
gains, and agrees to the following conditions on behalf of
himself, his heirs, successors and assigns:
(a) In lieu of present 30 . foot right-of-way
for South 152nd Street east of 57th Avenue South,
to deed to the City of Tukwila a 50 foot right-of-
way, aligned to conform with the City Arterial
Plan, without cost and no reservation except that
5 feet at the easterly property line to be held
in escrow by the City until such time as South
152nd Street is continued to the east and connec-
ted with 62nd Avenue South; to improve street to
minimum City standards for a 50 foot wide street,
including but not limited to grading, drainage
and paving.
(b) To deed to the City, without cost and
without reservation and restriction, a 5 foot
strip of land along the easterly side of 57th
Avenue, providing Owner's share of a standard 50
foot right -of -way.
(c) To equitably participate in any L.I.D. for
widening and improving 152nd Street from Macadam to
57th Avenue South.
(a) To widen the easterly half of 57th Avenue
South to minimum standards for a 50 foot street,
including but not limited to grading, drainage and
paving, as adjacent parts of the property are
developed.
(e) To provide water mains with fire hydrants,
adequate for fire protection and domestic water
uses, connecting to 8" main being installed by Owner
in 57th Avenue South as a participant in L.I.D.
(f) To place power telephone wiring under-
ground on 152nd Street.
(g) To provide adequate sewers.
(h) To provide parking in excess of 3 spaces
for 2 dwelling units.
(i) To maintain a 30 foot buffer at the north-
west corner of the property adjacent to a proposed
single family dwelling.
(j) To provide a screening fence along boundary
bordering on school property.
(k) To comply with the above conditions, as
buildings and improvements are made on the property,
starting from 57th Avenue South and proceeding east, .
with each segment of the street and utilities being
completed as properties using the public improve - -•
ments are completed.
6. This Agreement shall be recorded in the records of
'King County Auditor and the covenants herein shall be deemed to
attach to and run with the land and shall be binding upon the
Covenantor, his successors and assigns.
7. The City may institute and prosecute any proceedings
at law or equity to enforce this Agreement and Owner agrees to
pay reasonable attorney's fees expended by the City for such
enforcement proceedings.
8. In the event any covenant, condition or restriction
hereinabove contained or any partition thereof is invalid or
void, such invalidity or voidness shall in no way affect any
other covenants, conditions or restrictions herein contained.
