V during their regular meeting of October 6, 1975, denied the above referenced

The council did direct that if you wish to pursue this application that you
should first apply for an amendment to the Comprehensive Plan, which shows
your property as multiple - family as its highest potential, and not commercial
use.

Councilwoman Harris asked if the Committee or the
entire Council should hold the public hearing on this
rezone. Kjell Stoknes, Planning Director, stated State
law requires either the Planning Commission or the City
Council to hold a public hearing. The Planning Commis-
sion held its public hearing September 25. Councilman
Traynor stated the City Council previously held a pub-
lic hearing regarding this application even though it
was for a different classification of zoning in May,
1975. He stated the ordinance should go to committee
for a recommendation. Councilwoman Harris stated the
Council passed Resolution 489 which was passed August 4
and the request was filed by the applicant of August 4.
The proposed policy of the Council was known and did
appear on the Council's agenda more than once and the
Chief Executive Office certainly would have had to be
aware that the item was on the agenda for that night.

Sterling stated nonetheless, the application did come
in prior to the date the resolution became effective.

stated the property under the Comprehensive Plan
indicates multiple use for this property. The C -2
zoning is not consistent with the Comprehensive Plan.
When the Planning Commission held its public hearing,
it never addressed itself to that and staff did not
i cover it in its report. There is a requirement to
amend the Comprehensive Plan and hold a public hearing.
Councilwoman Harris also questioned Ordinance 683 to
which was attached a rough draft agreement. She re-
quested to see the original document.

City Clerk Shirlee Kinney distributed copies of the
original signed agreement in its proper form. It was
noted in the formulation of the agenda packet, a rough
draft copy of the agreement had been inserted.
Councilman Traynor stated there appears to be several
things to consider in this rezone request, but he
hoped the discussion would cover them in the committee
Councilman Sterling stated the committee is overworked
and there are too few Council Members getting in on

He stated this project was started under LID #23 and
was voted down by the people and then re- enacted by
LID #26. Was the construction cost 10% more for LID
#26 than for LID #23 and was any work eliminated from
the contract between the time LID #23 was proposed and
LID #26 was constructed. Steve Hall explained LID #23
was voted down during the preliminary assessment roll
hearing and the project never went to bid. The contract
was the same for the work in LID #23 and in LID #26.
There was an error in publication regarding the line
installed on 151st; the publication stated the line
had been installed under LID #26 when it was actually
installed under ULID #6, King County. Discussion re-
garding the separation of costs between ULID #6 and
LID #26 continued. Steve Hall further explained there
was less than 10% increase in the bids received from
the contractors over the cost of the preliminary assess
ment roll. Due to difficulties encountered during the
construction phase, the amount of the final assessments
is 10.8% more than the amount of the preliminary assess
ments.
Steve Hall recommended an adjustment in the final
assessment for Willis and Joanne Burton, in the amount
of $64S.60. The total assessment roll is now
$192,664.40 and the difference created by the adjustmen'
will be paid out of the sewer general fund. MOVED BY

Parker read proposed resolution establishing policy
for the appointment or re- appointment to boards and
commissions of the City of Tukwila, by title only.
Councilwoman Harris reviewed the sections of the
resolution which were amended by the Community Affairs
Committee. She stated this constituted a statement of
intent for procedures of appointment. She explained
applicants should live within the City, but these
requirements may be waived by the majority of the
City Council. MOVED BY HARRIS, SECONDED BY STERLING,
THAT THE PROPOSED RESOLUTION BE ADOPTED AS AMENDED AND
READ.*
Councilman Traynor stated based upon the criteria in
this resolution, he would not volunteer to serve on
any boards or commissions. Councilwoman Harris stated
in the past, appointments have been based on decisions
which are arbitrary, capricious and discriminatory.
The Council and the Mayor have no guidelines set for
consideration of individuals; these guidelines are
necessary in some cases where it may appear that a
choice or denial has no basis at all. Mayor Todd
stated he felt this resolution is disruptive and would
kill any volunteerism we have now under this criteria.
Councilman Saul agreed. *MOTION FAILED, WITH GARDNER,
DAVIS, AND HARRIS VOTING YES.

RESOLUTION BE READ. CARRIED. Attorney Parker read
proposed resolution fixing 7:00 P.M. on the 3rd day of
November, 1975, in the Council Chambers of Tukwila Cit:
Hall as the time and place for public hearing before
the City Council of the City of Tukwila to consider a
petition for annexation of a parcel of land located on
the western side of the intersection of Interurban Ave
nue and 52nd Avenue South. City Clerk Shirlee Kinney
explained due to another public hearing set at 7:00
for the revised 6 year Comprehensive Street Program,
this resolution would require an amendment. MOVED

Councilman Gardner referred to the Public Works Commit
tee minutes of October 2 wherein the Committee made
recommendations regarding the proposed resolution.
He stated the resolution has not been prepared. Coun-
cilwoman Harris stated the Council's secretary was
requested to relay the information regarding the pre-
paration of the resolution. Mayor Todd stated the
minutes of the committee meeting were not received
until today after lunch. There was not enough time
to prepare this resolution.

On July 30, 1975, Staff accepted for filing a rezone application from the
above referenced person for a piece of property lying adjacent to Southcenter
Boulevard and Interurban Avenue from its current zoning of R -4 and C -1 to C -2.
This matter was duly published and considered before the Planning Commission
at a regular meeting of September 25, 1975.
After a public hearing on this matter, the Planning Commission did recommend
that the City Council approve this application. This recommendation was made .
with the use of the attached Staff report prepared for the Planning. Commission
and the Environmental Assessment.

Mr. Crutchfield pointed out that the site plan complies with the restrictions
of Chapter 18.32 (TMC) amd that fire and biulding codes are enforced by the
respective municipal department.
Motion by Mr. Kirsop, seconded by Mr. Lamb and carried to approve the site
plan of the proposed addition to the Norton building subject to review of
plans by the appropriate city officials and acceptance of the plan by the
ACC or as revised by that body.
IV B - PUBLIC HEARING - REZONE - Interurban Ave. and Southcenter Blvd. Oldright)
Mr. Crutchfield briefly explained that Mr. R. L. Oldright has applied for a rezone
from R -4 and C -1 to C -2, of that property located at the west side of the inter-
section of Interurban Avenue and Southcenter Boulevard.
Mr. Link arrived at 8:45 P.M.
Chairman Mettler opened the Public Hearing at 8:45 P.M.
Mr. R. L. Oldright, 7502 Eastside Drive N.E. Tacoma, stated the Staff Report
covers all aspects of the proposal well and he will answer any questions.
No one was present to speak against the request. Chairman Mettler closed the
Public Hearing at 8:47 P.M.
Mr. Link asked what grade would the street be.
Mr. Oldright stated that although it varies the slope of the road would be
generally between 7 and 11 percent.
Mr. Link noted the concern of the Public Works Director regarding poor
sight distance and stopping distance at the location proposed in the site .
plan and as outlined in his letter attached to the Environmental Assessment
as Attachment F.
Mr. Oldright stated the problem will be minimized by the widening of•South-
center Boulevard at this point as a result of implementation of the TOPICS
program.
Mr. Zepp asked if the TOPICS program was in fact under way.
Frank Todd, Mayor, explained that the city had recently been awarded an $86,500
grant to perform the first three phases of this program and is a part of the
six -year street program.
Mr. Link asked if the first three phases included this particular area.
Mayor Todd stated it does not but the program is underway.
Mr. Kirsop asked if there would be further condemnation of land in conjunction
with widening of the road.

Mayor Todd stated that it appears no land would need to be acquired from this
particular parcel but some of the state -owned slope would probably be needed.
Mr. Zepp stated the sight distance at the point where topography allows an
entrance to the property is very poor and potentially dangerous.
Mayor Todd stated he was issued a permit some years back when he owned the
property that permitted himself to construct a road at that point and the
permit was signed by Mr. Zepp.
Mr. Zepp asked about additional access via South 153rd Street.
Mr. Oldright stated South 153rd Street would be used strictly for services.
Mr. Sneva stated the property is severely impacted by noise from the freeway
and streets and is too noisy for residential use. On that reason, feels the
proposed use is good.
Mr. Kirsop asked if the property was posted in the normal manner.
Mr. Crutchfield stated he had posted notices at the east end of South 153rd
Street, the corner of Southcenter Boulevard and Interurban Avenue and the
public hearing had been advertised twice in the Renton Record - Chronicle.
Chairman Mettler asked if a left turn lane will be provided on Southcenter
Boulevard to provide ingress to and egress from the site.
Mayor Todd stated the TOPICS program is not unchangeable, the left turn lane
would be extended to accomodate the'ingress /egress point.
Mr. Sneva pointed out the proposed use precludes any.other use of the site.
Mr. Kirsop related several conditions which could be attached to any recommenda-
tion for approval.
Mr. Lamb stated the primary restriction should be the access point.
Motion by Mr. Kirsop, seconded by Mr. Sneva and carried to recommend the City
Council approve the rezone from R -4 and C -1 to C -2 with the following stipulations:
1. Detailed Planning Commission review of all plans for grading, screening
of adjacent uses, landscaping and setbacks.
2. Study of driveway grades and orientation to TOPICS program and existing
streets.
3. No use other than that proposed without Planning Commission approval.
4. Access shall be limited to the two points indicated on the site plan.

COMPREHENSIVE PLAN: Multiple- family residential
FINDINGS:
1. Application for rezone was filed prior to effective date of Resolution #489.
2. Property was originally zoned R -1..
3. Ordinance #484, 1967, designated all lands lying between Southcenter
Boulevard and South 151st Street as ultimate multiple - family use area,
with the exception of the Tukwila Park being designated as Public Facility.
4. Ordinance #683, 1971, rezoned the west 125 feet to R -4 and the remainder
C -1, dependent upon execution of Concomitant Zoning Agreement between the
City of Tukwila "and property owner. (Copy of Ordinance and Agreement are
attached to Environmental Assessment.)
5. Some of the land west of the subject property is developed oris zoned for
multiple- family use while the balance of the land bordering the west prop-
erty line is zoned for Public Facility and developed as the Tukwila Park.
6. Four (4) occupied single- family homes are located south of the subject .
property in an R -1 zone.
7. The north and east property lines are bordered by Interurban Avenue and
Southcenter Boulevard, respectively.
8. Geologically, the subject site has good seismic, foundation, and slope stabil
ities but may become unstable when modified. (SEE, Environmental Assessment)
9. The soil types found on the subject property are subject to erosion,
especially when found on steep slopes. Vegetation helps to stabilize
the soils and retard erosion. (SEE, Environmental Assessment)

10. The entire site is sloping, ranging from elevation 60 at Southcenter
Boulevard to elevation 170 at the west property line. The gradient of
slopes on the site ranges generally between 25 to 40 percent while several
extreme slopes exist particularly on the northeastern facing bluff.
11. No streams exist on the site but because of the nature of the under-
lying geology, soils become saturated during periods of peak rainfall
and surface runoff is subsequently high. Again, vegetation serves to
retard surface runoff and mitigate erosion. (SEE, Environmental Assessment)
12. The entire site is .densely wooded with such tree species as douglas fir,
western hemlock, red cedar, maples, alder, dogwood and willow. Numerous
types of shrubs constitute a concentrated understory of vegetation.
13. Access to public right -of -way is limited to Southcenter Boulevard and
South 153rd Street. Southcenter Boulevard, according to the 1973 TOPICS
study, carries approximately 11,000 vehicles per day and South 153rd Street
is a 40 foot wide dead -end right -of -way serving residential land uses.
14. A 12" water line exists along the west side of Southcenter Boulevard.
15. The nearest sanitary sewer line is located 145 feet south of this site
but is only a 6" line. An 8" line is located an additional 30 feet from
the 6" line.
CONCLUSIONS:
1. The requested zone (C -2) does not conform to the current Comprehensive
Land Use. Plan Map, as amended by Ordinance #484.
2. The subject property is associated, due to its location and elevation,
with the residential land area adjacent its west and south property lines.
3. Access to the site could be provided by South 153rd Street, a residential
street with a 40 foot right -of -way, which is substandard for commercial
use (Section 17.08.010 TMC). Moreover, the residential land uses located
adjacent to and served by South 153rd Street would be adversely affected
by the traffic generated by a commercial land use.
4. Access provided from Southcenter Boulevard would not impact the existing
residential land uses but the only logical location (due to steep grades)
for such access is at a point where the Public Works Department is concerned
about restricted sight distance for turning movements on and off of South -
center Boulevard which carries such a high volume of vehicular traffic.
5. Existing utilities are adequate to service a commercial development.
RECOMMENDATION:
Staff recommends the Commission adopt the findings and conclusions of the Staff
Report, or as revised by the Commission, as the basis for and as part of the
Commission's recommendation to the City Council.

This environmental assessment has been prepared to report the potential
impact of a proposed rezoning of certain property located near the inter-
section of Interurban Avenue and Renton -Three Tree Point Road from C -1
and R -4 to C -2, (SEE, Attachment A). The applicant has submitted a site
plan with the application showing plans for a restaurant- cocktail lounge
with 190 parking spaces, (SEE, Attachment 13).
A negative declaration of environmental impact for this rezone request is
included with this assessment as Attachment G.
The proposed rezone has been applied for in accordance with the require-
ments of the City of Tukwila zoning ordinance, Title 18.
The subject property is located on the west side of and adjacent to the
intersection of Interurban Avenue (S.R. 181) and Renton -Three Tree Point
Road. The legal description of the subject property is as follows:
"That portion of Tract 28, Interurban Addition to Seattle, according to
plat recorded in Volume 10 of Plats, page 55,' in King County, Washington,
lying southwesterly of the River Street (Secondary State Highway No. 5 -M)
and westerly of the Renton -Three Tree Point Road (Secondary State Highway
No. 1 -L.).
EXCEPT that portion lying between the westerly junction of said roads and
a line drawn parallel to the west line of said Tract 28, through a point
100 feet due west of the most easterly point in the westerly line of said
junction; and
EXCEPT Railroad right -of -way, if any;
AND EXCEPT that portion conveyed to State of Washington Auditor's File No.
5528323.
The best information available indicates that prior to September 1971 the
subject property was zoned R -1, single family residential. On September 7, 1971,
the eastern portion of the site was rezoned by Ordinance 11633 to C -1 (Neighbor-
hood Retail Business) and the western portion to R -4 (Apartments),. conditioned
upon a Concomitant Zoning Agreement with the City of Tukwila. According to
Ordinance #683, included herewith as Attachment D, this agreement was executed.

Although the application for rezoning in 1971 was for rezoning the eastern
portion of the site to C -1, and the subsequent official action of the City
through Ordinance 11683 was to grant the rezoning of the eastern portion to
C -1, the zoning designation which erroneously found its way onto the city
zoning map was C -2. Thus, the eastern portion of the subject site is shown
to be C -2 on the city zoning map in Attachment C when in fact . the actual
zoning is C -1. This mistake has been corrected on the vicinity map in
Attachment A.
E. PUBLIC PARTICIPATION:
Application for the rezoning from C-1 and R -4 to C -2 classification was
made with the Tukwila Planning Department on July 30, 1975. A public
hearing before the Tukwila Planning Commission was advertised in the Renton
Record- Chronicle and scheduled for September 25, 1975. If the Planning
Commission's response is favorable to the rezone request, the rezone will
go before the Tukwila City Council.
F. RELATIONSHIP TO EXISTING LAWS, POLICIES, AND PLANS:
At the present time the subject property and the general vicinity of the
rezone is identified on the Tukwila Comprehensive Plan Map as multiple
family, (SEE, Attachment E). A multiple family designation logically
includes the R -2, R -3, R -4 and RMH zoning classifications, but the comprehensive
plan makes no reference as to the density of this multiple family development.
Though the subject property falls within 200 feet of the ordinary high water
mark of the Green River, the act of rezoning property does not require a
shoreline development permit. However, at such time that the subject property
would be developed, a shoreline development permit would likely be required.
G. ACTION REMAINING FOR IMPLEMENTATION:
The rezone application must go before the Tukwila Planning Commission
at an advertised public hearing on September 25, 1975. If approved by
the Planning Commission, the rezone request will go before the Tukwila
City Council for final disposition. If denied by the Commission, the
applicant may appeal the decision to the City Council.
H. EXISTING CONDITIONS:
1 Zoning and Land Use. The existing zoning on the subject property is R -4
and C -1. The R -4 zoned portion of property is located uphill from the C -1
portion. Allowed uses in the R -4 zone include apartments, offices, conval-
escent homes, clinics, and boarding and lodging homes. Allowed uses in
the C -1 zone include neighborhood retail businesses like banks, restaurants,
drug stores, grocery markets, meat, hardware, and jewelry stores, and other
similar commercial uses which cater to the local community.
Zoning on the west side of the subject property is for residential and
public use. Several parcels of multiple family zoning, namely R -3, R -4
and RMH zoning, are located here and apartment buildings have been con-
structed on each of these multiple family zoned sites. The Tukwila City
Park, which consists of 6.5 acres of public tennis courts, picnic grounds,
and natural stands of tall fir trees, borders the subject property
for over 525 feet on the latter's west side. Also, a piece of R -1.
property borders the subject property's south boundary. Four occupied
single family homes are located in this R -1 zone.
The eastern side of the subject property is bordered by roads,
namely the Renton -Three Tree Point Road and Interurban Avenue.
Beyond these roads to the east is the Green River. Zoning on
the eastern side of the Green River is entirely M -1, light industry.
2. Natural Conditions.
a. Geology. Geologically, the subject site is composed of
basaltic type rocks and sedimentary rocks (shale and
sandstone). According to the U.S. Geological Survey,
these types of rocks have good seismic, foundation, and
slope stabilities but may become unstable when modified.
b. Soils. According to the 1952 King County Soil Survey, the
soils on this site are classified as Cathcart soils. These
soils have formed over shale and sandstone and include some
glacial debris. Cathcart soils are subject to erosion,
especially when found on steep slopes. Vegetation on the.
subject site helps to stabilize the soil and mitigate erosion.
c. Topography. Basically, the subject site is the easternmost
part of a basaltic knoll which juts out into the Green River
Lowland. The gradient of slopes on the site ranges generally
between 25 and 40 percent. Several areas on the site reach
over 50 percent slope, and the northeastern facing bluff is a
100 percent slope (or a 45 degree angle).
d. Drainage. There are no streams on the subject property.
Because of the impermeable nature of the underlying geology -
basalt, shale, and sandstone—soils become readily saturated
during periods of peak rainfall and surface runoff is high.
Dense vegetation on the site serves. to intercept a portion
of this rainfall and mitigate surface runoff.
e. Vegetation. The subject site is densely wooded with a
typical second - growth forest understory. Coniferous tree
species (evergreens) located on the site include grand .
fir, Douglas fir, western hemlock, and red cedar. Deciduous
varieties include broadleaf maple, vine maple, red alder,
dogwood, and willow. Understory vegetation includes swordfern,
Oregongrape, salal, and numerous shrubs.
f. Wildlife. Bird and animal species which use or inhabit
the subject property are typical of those generally found
in the Tukwila area. Although no field studies have been
done, it is assumed that such birds as robins, sparrows,
crows, quail and possibly hawks use this area for nesting
or foraging. Small mammals like skunk, weasel, raccoon,
and rabbit are assumed to use this area also.
3. Circulation. Access to the subject property is possible from two
streets, South 153rd Street and Renton -Three Tree Point Road (also
called Southcenter Boulevard). South 153rd Street, a 40' -wide
residential street, extends to within 100 feet of the subject property's
west boundary; the final 100 feet is in an unimproved condition due
to the fact that the properties on both sides of the right -of -way
are undeveloped. The other point of access to the site is from
Southcenter Boulevard. Average daily traffic volumes on Southcenter
Boulevard, according to a TOPICS study completed in 1973, is in
excess of 11,000 vehicles.
4. Utilities. A 12" water line extends along the west side of South-
center Boulevard and is sufficient to serve any proposed development
on the site. According to the Public Works Department, there is
sufficient pressure within this line to force water up the hillside
to future buildings.
Sanitary sewer service is not available adjacent to the subject prop-
erty. The nearest line is 145 feet south of the site, and the size of
this line is only 6- inch, which would preclude any large -scale devel-
opment from connecting to it. A larger 8 -inch sewer line is located
an additional 30 -feet south of the 6 -inch line or about 175 feet from
the subject property.
I. ENVIRONMENTAL IMPACT OF THE PROPOSED LEGISLATION:
As mentioned, the subject site has two zoning classifications: R -4 and
C -1. The C -1 or commercial zoning occupies the "lower" portion of the
subject site while the R -4 or multiple family residential zoning occupies
the "upper" portion of the site. Allowed'uses in the R -4 or upper portion
of the subject site include apartments, parks, certain types of office
buildings and boarding and lodging houses. These types of uses are
characteristic of and compatible with the existing uses found in the
upland area adjacent to the subject site.
The proposed rezoning would classify the "upper" portion of the subject
site as C -2, Local Retail Business. A C -2 classification allows such
uses as auto and trailer sales, restaurants (with cocktail lounges),
drive-in restaurants, taverns, offices, gas stations, tire stores, in
addition to those uses allowed in the C -1 zone (e.g., bakeries, banks,
barber and beauty shops, clothing, drug, and hardware stores, restaurants
with no liquor facilities, and grocery markets). Based upon the existing
land use bordering the subject property on the Tukwila hill, it seems that
such commercial uses as those mentioned would be incongruous with the
nature or character of the surrounding area. In addition, access to the
"upper" portion of the subject property would be via South 153rd Street
which has a 40 -foot right -of -way. The minimum width of streets serving
commercial areas should be 60 -foot right -of -way, as stated in the municipal
code (17.08.010). If the "upper" portion of the subject site is developed
commercially, it is expected that vehicular movements to and from the site
will have an adverse effect on South 153rd Street.
The most logical ingress- egress point to the subject property from South-
center Boulevard is at the southeast corner of the site where the gradient
of the slope is least. however, the sight distance at this point is
restricted and the Public Works Department has expressed concern over the
practicality of ingress - ogress at this point, (SEE, attached letter from
Tukwila Public Works Director, Attachment F).
The present natural condition of the subject site is a heavily wooded
hillside, geologically composed of basalt and sedimentary rocks with thin
overlying soils, which generally ranges between 25 and 40 percent slopes.
Commercial buildings which are allowed under C -2 zoning, along with their
associated parking and service areas, would require dramatic alterations to
the natural condition of the property. Because of the steepness of the
slope, cuts would have to be made for building sites, parking lots, and
access roads, effectively eliminating much of the natural vegetation which
presently serves to reduce erosion on the steep hillside.
J. ANY UNAVOIDABLE ADVERSE ENVIRONMENTAL EFFECTS:
Approval of C -2 zoning on the subject property with subsequent develop -
ment.of a commercial establishment will result in the removal of the
greater portion of the natural vegetation and reduce the wildlife habitat
to nil. Soil erosion on the steep hillside will be severe during the
construction phase. As a result of devegetation and construction of
roads, parking lots and buildings, increased storm water runoff will result.
An increase in auto traffic onto South 153rd Street and Southcenter Boulevard
will also occur, with potential traffic hazards due to restricted sight dis-
tance on Southcenter Boulevard and inadequate right -of -way on 153rd.
K. ALTERNATIVES TO THE PROPOSED ACTION:
Since the proposed action is one of rezoning the property to permit other
uses than its present zoning allows, there are only two alternatives: to
either grant or deny the rezone request. Granting the rezone request would
allow the subject property to be used for commercial uses which would be
either local or regional in nature. Denying the rezone request would
restrict the use of the R -4 property to office or residential use, and the
C -1 property to local retail business uses.
L. RELATIONSHIP BETWEEN LOCAL SHORT TERM ENVIRONMENTAL USES AND THE MAINTENANCE
AND ENHANCEMENT OF LONG TERM PRODUCTIVITY:
The steep hillside on which the subject property is located is neither
a suitable nor a desireable environment for agriculture, nor are any
significant deposits of mineral resources known to be located on the,site.
The proposed rezoning of the property, coupled with its subsequent
development, would constitute a long -term use of the land. As such, the
subject property would generate revenue for the City of Tukwila, the South
Central School District No. 406, and other taxing entities. Development
to C -2 use would allow residents of the City as well as others to obtain
commercial services from the subject site.

4 As per our discussions, I have several grave questions and concerns
0. as to the proposed access as indicated on the preliminary site plan
for this project.
W The first and major one is the sight distance as dictated by normal
highway design. In the case of this proposed project, minimum sight
ili distance would be considered two hundred and fifty feet (250'). I
N am enclosing a page from the AASHO Manual and the accompanying
• calculations for 35 miles per hour on wet pavement.
'.'. Secondarily, with the anticipated future widening of Southcenter
Boulevard, it would be a requirement of this. Department that the
access road from Southcenter Boulevard as proposed to this site be
at road elevation at the property line. This would simplify future
widening of the road, and not cause a problem in the future with a
possible discrepancy in grades at that point.
Also, as per Tukwila Municipal Code, maximum grade allowed is 15 %.

Braking Distance
The approximate braking distance of a vehicle on level roadway may be
determined by the use of the standard formula:

In this formula for braking distance the f factor is used as an overall
or a single value that is representative for the whole of the speed change.
Measurements show that f is not the same for all speeds. It decreases as
the initial speed increases. It varies considerably due to many physical
elements such as air pressure of tires, type of tires, amount of tire tread,
type and condition of the pavement surface, the presence of moisture,
mud, snow or ice, etc. Further, and of greater significance, in stops from
high speeds the actual braking distance is dependent upon the vehicle
braking system rather than the skidding of tire on pavement. In stops from

The following is a Statement of Declaration by the undersigned
as the Responsible Official pursuant to Title 18.98 of the •
Tukwila Municipal Code and the Washington State Environmental
Policy Act of 1971.
An Environmental Assessment has been completed on the proposed
legislation and has been taken into consideration in this
Declaration.
Based upon the Environmental Assessment as prepared, Section
18.98 of the Tukwila Municipal Code dealing with environmental
policy and the guidelines issued by the Washington State Depart-
ment of Ecology for the implementation of the State Environmental
Policy Act, I find that the proposed rezone application from R -4
and C -1 to C -2 will not have a significant effect upon the envir-
onment and therefore a complete Environmental Impact Statement is
not required.
The City reserves the right to require an additional environmental
review, and full Environmental Impact Statement if deemed necessary,
at such time as a building permit is applied for on the property.

WHEREAS, R. L. Oldright, the owner of the following described property
having petitioned the Planning Commission, requesting re- classification of said
property from R -4 and C -1 to C -2 zoning, and
WHEREAS, On September 25, 1975, a public hearing on said petition was
held before the Planning Commission of the City of Tukwila and the City Council
having received a favorable recommendation from the Planning Commission with
respect to the aforementioned petition, as contained in Planning Department file
No. MF- 75 -14 -R, and
WHEREAS, The City Council finds the requested classification to be in
the best interests and general welfare of the City.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
DO ORDAIN AS FOLLOWS:
That the real property generally located in the northwest corner of
Interurban Avenue and Southcenter Boulevard as herein described is hereby class-
ified to C -2 in accordance with Ordinance No. 251 of the City of Tukwila, as
amended, and the City Council.hereby adopts the map attached hereto as Exhibit

ENVIRONMENTAL INFORMATION WORKSHEET EXPLANATIONS:
18. (f) View of river valley without obstructing view from adjacent
property.
19. Economic benefits in employment and tax revenue is obvious. There
is need for another quality restaurant because present facilities
cannot meet the demand. The restaurant will serve all segments of
the community and adjacent areas.
22. Water will be supplied from existing mains, and sanitary sewer
connections will be made to existing sewer system.
23. The site contains many, beautiful trees which will be preserved to
maintain the natural beauty of the site.
24. There are little animal life systems on the site and preservation of
a large part of the site vegetation will minimize interference with
nature's fowl species that may exist.
25. The present noise levels are generated by the adjacent arterial and
State Highway. The project will not increase these noise levels.

Dear Mr. Oldright:
This office received your application for rezone of Block 28, Interurban
Addition to Seattle on 30 June 1975. Received together with the appli-
cation was an environmental worksheet completed to a brief degree.
A cursory review of the information received yesterday leads to the
following request for additional information. Upon receipt of such
information, this office will acknowledge the filing of a complete
application for rezone.
1. A filing fee of $100.00 must accompany the application at
time of filing.
2. The provision of a conceptual site plan depicting the proposed
project at a useable scale may be of value to both the review-
ing;bodies and the applicant.
3. A vicinity map must be submitted which accurately reflects
the surrounding properties.
4. The legal description submitted has been found by our engineering
department to be unuseable in terms of physically locating the .
property. A concise but accurate and . useable legal description
must be provided.
5. An Environmental Assessment Summary must be completed in
sufficient detail to accurately describe the impact or
effect of the project, especially in terms of the following:
A. Ingress and egress.
B. Storm water runoff associated with impervious surfaces.
C.. Aesthetic impact.
