The Board, based upon the conclusions of the Staff Report, unanimously moved to grant the variance from Chapter 13.08 with the stipulation that Puget Power place the entire overhead distribution system along South 144th Street underground in conjunction with any L.I.D. or other defini- tive plan for improvement of South 144th Street. The execution of a permit from the City of Tukwila to install the additional electrical service overhead based on this variance shall constitute irrevo- cable agreement on the part of Puget Power with the condition attached to said variance. AGENDA ITEM' 11 : PUBLIC HEARING - VARIANCE from Underground Utilities (Puget Power) REQUEST: VARIANCE from Chapter 13.08 (Underground Utilities) APPLICANT: Puget Sound Power & Light LOCATION: Along South 144th Street eastward from Interurban Avenue ZONING: M -1 (Light Industry) Bertwell Industries is completing construction of a building on South 144th Street which will require 3 -phase electrical service. Electrical service is currently comprised of overhead lines spanning four poles extending eastward from Interurban Avenue as depicted in Exhibit "B ". The new building would be served underground from the termination pole travelling under the street and to the building. Thus, Puget Power has requested a variance from Chapter 13.08 to allow the installation of additional electrical service to the existing overhead distribution system located along the north margin of South 144th Street. (SEE, Vicinity Map, Exhibit "A ") FINDINGS 1. Puget Power desires to install three -phase electrical service (two additional lines) along South 144th Street using the existing overhead distribution system. (SEE, Exhibit "B ") 2. Section 13.08.060 (2) states "All extensions, rebuilds, or duplica- tions of existing overhead electric and communication facilities shall be installed underground... ". 3. There is no knowledge of any plan to underground the existing overhead distribution system along South 144th Street or the vicinity. 4. South 144th Street is substandard and at some future time (dependent upon rate and character of adjacent development) will be widened and improved to accomodate industrial development forecast by the Compre- hensive Land Use Plan. None of the existing electrical service in the vicinity of South 143 and 144th Streets lying east of Interurban Avenue are under- ground. CONCLUSIONS The variance criteria of Section 18.72.010, as well as the additional criteria of Section 13.08.100 (b), are applied to the FINDINGS of this request and CONCLUSIONS drawn as stated below. 1. The variance shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the .vicinity and in the zone which the property on behalf of which the application was filed is located; COMMENT: Since all existing electrical service in the vicinity is overhead, the granting of this variance would constitute a grant of special privelege only if the remaining over head electrical service was required to be undergrounded. 2. That such variance is necessary because of special circumstances relating to the size, shape, topography, location or surrounding of the subject property, to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located; COMMENT: The only special circumstance perceivable is the fact that South 144th Street is substandard and assumingly must be improved to facilitate additional development; thus, the undergrounding should logically take place in conjunction with the street improvement. (SEE, Exhibit "C ") 3. That the special conditions and circumstances do not result from the actions of the applicant; COMMENT: The only special circumstance, as described in #2 above, is not a result of the applicant's actions. 4. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and in the zone in which the subject property is situated; COMMENT: The granting of the variance will be neither materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. The authorization of such variance will not adversely affect the implementation of the comprehensive land use plan; COMMENT: The granting of the variance will not adversely affect implementation of the comprehensive land use plan. 6. That the granting of such a variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, possessed by the owners of other properties in the same zone or vicinity. COMMENT: The variance is not necessary forth preservation and enjoyment of a substantial property right. 7. That the utility owner or user or any other affected party can • demonstrate that it would work an undue hardship to place the facil- ities concerned underground. By undue hardship is meant a technolo- gical difficulty associated with the particular facility, or with the particular real property involved, or a cost of undergrounding such facility, which outweigh the general welfare considerations implicit in underground installation COMMENT: As explained in Exhibit "C ", it is impractical to place the overhead system underground at this time in light of the present lack of knowledge with respect to the location, elevation and extent of the future improvement to South 144th Street. Placing the facility underground without such knowledge would most likely lead to additional unnecessary costs. These factors lead to the conclusion that to require the undergrounding of the system now would create an undue hardship in terms of technological difficul- ties which lead to excessive costs, both of which can be logically avoided by placing the electrical system underground at such time as the street is improved. RECOMMENDATION To avoid the imposition of technological difficulties and excessive costs and to facilitate practicable and orderly improvement of South 144th Street, Staff recommends the Board of Adjustment grant the variance from Chapter 13.08, based on the FINDINGS and CONCLUSIONS contained in the. Staff. Hall, Public Works Director SUBJECT: Variance Request by Puget.Power /South. 144th St. At this point in time, I see no reason for placing the requested three phase power to the new Burtwell Industries Development underground. At the present time, this office does not know what the exact development of this road will be as to alignment, geometric cross section or elevation. Therefore, I would recommend the granting of the variance until such time that a Local Improvement District or other definitive plan is established to develop South 144th Street from Interurban Avenue east to the Green River. Without knowing the location of future storm drainage or other utilities it seem rather futile to require undergrounding of this three phase request. SMH /ma Steven M. MEMORANDUM CITY of TUKVh/ILA PLANNING DEPARTMENT TO: Steve Hall, Publi Works Director FROM: Gary Crutchfield istant Planner SUBJECT: VARIANCE Request by Puget Power in vicinity of So. 144th St. DATE: 9 Dec. 1975 In order to assure all aspects of consideration are included in my Staff Report to the Board of Adjustment regarding the referenced variance application, I would greatly appreciate a written explanation (in memo) of the probable future improvement of South 144th Street and why the underground installation of electrical service prior to the street improvement would be a hardship (i.e., would the installation have to be moved over? Should easements be obtained first ?, etc.) Since the Board will be considering this matter on 17 December 1975, I would appreciate a response by 12 December 1975. The Tukwila Board of Adjustment conducts one regular public meeting on the first Thursday of each month at 8:00 P.M. in the City Council Chambers located at 14475 - 59th Avenue South. Applications to be considered at the regular monthly meeting must be accepted for filing by the Planning Department prior to 5:00 P.M. on the second Thursday of the month preceding the monthly meeting at which consideration is to take place and, when required, all environmental information submitted must be adequate. 2.
