Harvey Anderson Dear Mr. Anderson: Please be advised that your request for a waiver from the City Council to apply for a rezone was on the Council agenda for action during their regular meeting of January 5, 1976. Due to the heavy agenda that night your request and several other items were tabled until their next regular meeting of January 19, 1976. At this meeting your waiver to apply for a rezone was granted. Please contact our office as soon as possible to make sure we have needed so we can place your rezone application before the Planning Commission in a public hearing during their regular meeting of February 26, 1976. Anderson CITY OF TUKWILA PLANNING DEPARTMENT CITY COUNCIL STAFF REPORT West side of Southcenter Parkway just south of Strander Blvd. The applicant is requesting a waiver to resolution 489 allowing him to apply for a rezone on the referenced property from R -1 -7.2 (Single - Family) to C -2 (Community Commercial). This requires council action waiving both sub - sections 4.A. and 4.D.2.(b) of resolution 489. The proceedures of resolution 489 requires staff analysis of four items. They are as follows: 1. Is the proposed action consistent with the presently emerging Land Use Policy Plan? STAFF COMMENTS: Since the Land Use part of the Comprehensive Plan has not been worked on yet by staff, this question is difficult to answer. However, the property will probably not be recommended for a use to a less intensive use than commercial. It is consis- tent with the present Comprehensive Land Use Map. 2. Does the proposed action represent a unique condition which is insignificant in scale and to which no other apparent alternatives are reasonable? STAFF COMMENTS: Although the property cannot be said to have a unique condition, the proposal does seem to be insignificant in scale. Although there are always alternative actions, the one proposed here seems reasonable. • • • • 3. If the request for waivers involves grading, excavation, filling or development in geographical areas identified as having potential natural limitations for development, are mitigating measures provided? STAFF COMMENTS: The waiver does involve property which has been identified as having potential natural limitations to development if the steep slopes are disturbed. 4. Do the requirements contained in Resolution No. 489 impose a special hardship to a site for which a waiver of the provisions would not necessitate a major policy committment prior to the adoption of. the Land Use Policy Plan? Staff Report RECOMMENDATION: Attachments: City Council Page 2 November 26, 1975 STAFF COMMENTS: It does not appear that a waiver in this case would necessitate a major policy commitment prior to the adoption of the Land Use Policy Plan for the following reasons. A. Property is isolated between a freeway and Southcenter Parkway a high traffic volume street and not desireable for single - family use. B. Property is in present Comprehensive Plan Map as potential Industrial zonign (M -1). C. Conditions could be placed on any excavation which would ensure user safety. It is the recommendation of the Staff that this waiver request be granted with the following stipulation: 1. If the slope on the west portion of the property is to be disturbed, a specialist in soils or geology must be used to maximize the proba- bility of maintaining the stability of the slope. This should be . handled with a grading permit under the review of the Tukwila Building Director. 2. Cuts into the hillside should be minimized and every attempt should be made to maintain the wooded character of this slope. For approximately a quarter mile along the east side of Southcenter Parkway retail establishments have flurished. The amoeboid actions of retail outlets both North and South of the location have produced a quasi residential area1zk best in this vicinity and therefore will not necessitate a major policy cornmittment.
