MEMORANDUM
TO: Larry Hard, City Attorney

SUBJECT: Potential Building Site at 53rd Ave. and So. 140th St.
The purpose of this memorandum is to summarize the principal points of
concern about this matter, and your advice on each as emerged from our
conversation this afternoon.
A) Issue: Is the documentation provided by Homeco Realtors sufficient
to confirm the boundaries of the subject site as a legally -
divided entity?
B) Your Response: It seems that the lot was sold in its present con-
figuration at least as for back as 1957, therefore confirming
it's division from the remainder of Lot 3, Colgrove's Acre
Tracts, prior to enactment of the subdivision statute.
A) Issue: Can zoning setbacks be used to make a defacto reservation for
future roadway widening?
B) Your Response: So. 140th Street, adjoining the north boundary of the
site, is twenty feet wide. This is a substandard public
street width which might someday be increased. However,

setback required for sideyard purposes beyond that prescribed
in TMC 18.12.090(b) ttui4 constitute a taking of land without

- Buildability
A) Issue: TMC 18.60.160 states that "A one - family dwelling may be erected
on any area of land vacant and in separate ownership on December
23, 1957, and containing less area than required to house one
family in the district in which it is located; provided the

The lot was not vacant at the time the ordinance came into
affect. Therefore, the lot became a legal non - conforming lot .
because of the use of the structure as a residence,. which was .
an allowed use.
In 1973, when the house was demolished, the lot, because it
was substandard in size, became a non - conforming lot and non-
buildable. The use of the lot was tied to the functi :on of
the building. If the house would have not been demolished,
but remodeled, the status of the lot would have remained
the same. Section 19.60.160 does not apply because the lot
was not vacant on either December 23, 1957 or November 2, 1961
when the property was annexed to Tukwila.
The Planning Commission recommended to the City Council that
the subject property be reclassified to. "R -1 -7.2 in the event
that the provisions of Section 18.60.160 cannot be employed."
Your Response: The vacancy issue, I understand, is critical in your
opinion as to the developability of the lot today. It
seems that Kjell's letter of 19 March 1979 is in error and that
Brad is not obligated by it. However, should the City declare
the lot substandard and unbuildable, a potential legal challenge

Thank you for submitting the King County Assessor's records regarding the above
referenced lot. The information clearly shows that the property has been in its
present size and configuration since 1952.
Because of this, I read section 18.04.020 of the Tukwila Municipal Code as intending
that lots such as this be classified legal nonconforming and therefore having all
the rights as though it were a legal lot in the zoning district. Section 18.04.020
relates to rights of properties prior to the adoption of the zoning code, which is
December 23, 1957.
Based upon this, as well as Tukwila Municipal Code section 18.60.160, relating to
required setbacks, this letter is to inform you that you do have a legal building
site which can be built on as long as all setbacks and height restrictions are
complied with. In addition, all other City codes of the city must be complied
with.
I'm sorry that this intire process has taken as long as it has. Please feel
assured that the City Administration will do whatever possible to assist you
in processing the building permit for this property.

The location of a residence on the above property should be setback as
follows:
(1) FRONT YARD: (53rd Avenue South)
The front yard must be 25% of the depth of the lot and at least
50 feet from the centerline of the street. Since 53rd Avenue
South is only 40 feet wide the house will have to be setback
30 feet from the property line.
(2) SIDE YARDS: (Southern Property Line)
The side yard of interior lots has to be 10% of the width of
the lot. Since the lot is 90 feet wide the sideyard should
be 9 feet; however, the ordinance imposes a maximum 8 foot
sideyard. Setback required is 8 feet.
(South 140th Street)
There is the possibility of widening of the street. Only 20
feet of right -of -way is presently available. Therefore anti-
cipating the possible widening, the required setback is 35 feet
from the present centerline of the street or 25 feet from the
present property line.
(3) REAR YARD:
All rear yards in the R -1 Districts must be 25% of the depth of
the lot, but not more than 30 feet. Since the lot is 100 feet
deep, a 25 foot setback would be required.
This provides you with a building area of approximately 2500 square feet. If

In response to your letter of January 15, 1979 :oi,cerning the
action of the Tukwila Planning Commission on the above -
referenced rezone application. The Planning Commission recom-
mended to the City Council that the subject property be reclass-
ified to "R -1 -7.2 in the event that the rrovisions of Section
18.60.160 cannot be employed."
The information that you have provided frcn the King County
Assessor's Office clearly shows that a building occupied the
site from 1956 to 1973. TMC 18.60.160 states that "A one -
family dwelling may be erected on any area of land vacant and
in separate ownership on December 23, 1957, and containing less
area than required to house one family in the district in which
it is located; provided the front, side and rear yard require-
ments of this title are met." The lot was not vacant at the time
the ordinance came into affect. Therefore, the lot became a
legal non - conforming lot because of the use of the structure as
a residence, which was an allowed use.
In 1973, when the house was demolished, the lot, because it was,

The Tukwila Planning Commission, at its regular meeting of 18 November 1976,
conducted a public hearing to consider your request to classify the parcel
of property located at 14004 - 53rd Avenue South in Tukwila as R -1 -7.2 (Single -
family residential, 7200 minimum lot size).
The Commission, after public hearing and deliberation, recommended the City
Council classify the parcel as R -1 -7.2 only if the provisions of Section
18.60.160 cannot be employed. Section 18.60.160 states "A one family dwelling
may be erected on any area of land vacant and separate ownership on December
23, 1957, and containing less area than required to house one family in the
district in which it is located; Provided the front, side and rear yard require-
ments of this title are met". In your case, the effective date should read
November 2, 1961 due to this date being the first official date of record that
the property was located within the corporate limits of Tukwila.
The Commission's recommendation will be held in abeyance until a written state-
ment from you is received by this office which indicates your ability to comply
with Section 18.60.160. Please contact me if you have any questions . regarding

COMPREHENSIVE PLAN: Single - family Residential
FINDINGS:
1. The subject site is approximately 9000 square feet situated at the southeast
corner of the Intersection of South 140th Street and 53rd Avenue South.
2. The centerline of 53rd Avenue South is the western corporate limits of Tukwila.
3. The unincorporated area lying west of the city limits and east of the I -5
freeway is currently being considered for annexation to the City of Tukwila
and an election by the residents of that area is scheduled for February 1977.
4. The current King County zoning classification in the unincorporated area is
SR (Suburban Residential) which requires 5 acre lot sizes unless within an
approved subdivision. Much of that land area was subdivided quite some time
ago. Hence, lots are considerably smaller than 5 acres.
5. The land area shown in Exhibit "A" as being classified R -1 -12.0 was declared
to be a part of the City of Tukwila in 1961 under King County Resolution #23309.
6. A search of Planning Commission and City Council records between 1960 and 1963
only provide the knowledge that the city boundaries at that time were unclear
and that, in 1961, King County officially acknowledged that this area was, in
fact, within the corporate limits of Tukwila. There is no ordinance or other
official action on record which established a land use classification for this
land area after becoming a part of the city.
7. Section 18.08.020 states, in part, "All lands not classyied...shall be
considered unclassified and, pending future classification, shall be subject
to the restrictions and regulations of single- family residence districts."

8. Section 18.04.010 authorizes the interpretation of all Zoning Code provi-
sions which is the basis upon which the administrative interpretation has
been made to apply the most restrictive of the R -1 classifications to
unclassified lands, specifically R- 1.12.0.
9. Section 18.60.160 states "A one family dwelling may be erected on any area
of land vacant and in separate ownership on December 23, 1957, and containing
less area than required to house one family in the district in which it is
located; Provided the front, side and rear yard requirements of this title are met."
10. Application of zoning code restrictions could not be made until 1961, the
effective date of the land area's incorporation.
11. The subject property was issued a Demolition Permit in June 1974 to demolish
a residence.
12. Several houses within this unclassified area are located on lots considerably
smaller than 12,000 square feet. However, most appear to have been constructed
prior to the 1961 'incorporation' date..
13. The parcel of property located immediately south of the subject parcel is
6100 square feet in size according to the most recent information obtainable
from the King County assessor.
14. Topography in the general vicinity varies from 0 - 15 %. The west half of the
subject site is relatively flat while the east half is an approximate 10% slope.
15. Sanitary sewer service was installed in this area under LID #18 in 1973 and
is available to the subject site.
16. Water service is provided by Water District #38.
17. Storm drainage is accomodated by an open ditch on the east side of 53rd Avenue.
CONCLUSIONS:
1. All necessary utilities are available and adequate to support a single - family
home.
2. The interpretation of Section 18.08.010 to allow application of 12,000
minimum lot size requirements pending classification is necessary to avoid
"defacto" commitment to 7,200 lot sizes.
3. The subject site apparently fails to meet the requirements of Section.
18.60.160 in that the property was not vacant.
4. The 6100 square foot lot located immediately south of the subject parcel
may be an illegal non - conforming lot as a result of segregation subsequent
to 1961. The classification of 7200 density on the subject site would
perpetuate that.

5. The fact that the city, after acknowledging the inclusion of this entire
land area as a part of the city, apparently failed to properly classify the
same land area is justification for an action being initiated by the Planning
Commission and refund the applicant's fee.
6. The potential annexation of the unincorporated area, coupled with the varying
lot sizes existing throughout the area, lead to the conclusion that the incor-
porated and unincorporated areas should be studied as a whole to determine the
appropriate density classifications.
RECOMMENDATION:
Staff recommends the Planning Commission, based on the findings and conclusions
discussed above, deny the application for rezone and direct Staff to refund the
application fee and to initiate a land classification action for the entire
unclassified area.

The purpose of this meeting was to report to the residents 'of .
an area which were included within the boundaries of TUkwila when
it had been incorporated in 1903, but which had been omitted on
maps later in use.. A good representation of these residents were
present.
i.Iayor Baker reviewed the boundaries which have been accepted
and a.op roved by the King County ComAlissioners, after a very thorough
search and survey. re reported that the Prosecuting Attorney also
agreed with the County Commissioners that the present boundaries
are correct.,
There was some discussion, those present taking part. ;
Baker promising that questions he could not answer would be referred
to the Town Attorney or the Town Engineer.

Mr. Crutchfield read the Staff Report on this request and noted the matter
had been carried over several Commission agendas due to the applicant's
absence. Noted Mr. Farrell is present tonight.
Chairman Mettler opened the public hearing at 9:20 P.M.
Mr. Gene Farrell, 12721 Renton Avenue South, stated the property is bounded
on 2 sides by public right -of -way and on the other 2 sides by platted lots.
Property owner has paid all the LID costs assessed for sewer under LID #18
and is far more than 7200 square feet.
Mr. Bowen noted this residential area appears to be heading downhill in
terms of stability and appearance and asked what kind of improvements are
anticipated.
Mr. Farrell stated a 3- bedroom home approximately 1,080 square feet with
attached•garage, all of an approximate value of $30,000. Noted the house
to the south is approximately 25 years old and the one to the east about
10 years old. Also noted that H.U.D. had demolished a 35 year old house
a few years ago.
Mr. Albert Dowsing, 22675 - 26th South, Des Moines, stated his family once
owned all that property and most of the homes were moved in around 1950.
There being no further audience comments, Chairman Mettler closed the
public hearing at 9:35 P.M.
Commissioners discussed the allowances of Section 18.60.160.
Motion by Mr. Kirsop, seconded by Mr. Bohrer and carried to recommend the
City Council classify the subject site R -1 -7.2 only in the event that the
provisions of Section 18.60.160 cannot be employed.
Site Plan - Curley -Bates Building
Commissioner Link dismissed himself from participation due to a conflict
of interest.
Mr. Crutchfield read the Staff Report explaining the proposed truck door
addition and the associated displacement of parking.
Considerable discussion ensued with respect to the manner in which the code
requirement for parking would be provided. Also focused on current actual
need for parking.
Motion by Mr. Bowen and seconded by Mr. Kirsop that since the new truck door
and loading /unloading area is needed that the site plan be approved subject
to provision of additional parking if needed by present or future tenants and
in the manner indicated in the site plan revised 9 November 1976 by Bittman,
Sanders, Hasson and Associates.

Minutes of the Meeting, 23 September 1976.
The regular September meeting of the Tukwila Planning Commission was called
to order at 8:10 P.M. by Chairman Mettler with Commissioners Richards, Bowen,
Link, West and Kirsop present. The Planning Division was represented by
Kiel' Stoknes, Fred Satterstrom and Gary Crutchfield.
Motion by Mr. Bowen, seconded by Mr. Link and carried to approve the minutes
of the regular August meeting as prepared.
III. City Council Actions
Mr. Crutchfield read the Staff Report informing the Commission of recent City
Council actions regarding planning related matters.
IV. OLD BUSINESS
Comprehensive Plan Review
Mr. Satterstrom noted the progress to date on the mapping process and suggested
the next work meeting be conducted Thursday, 30 September 1976. Distributed a
memorandum listing the land use classifications established by the Commission in
recent work meetings. Commission agreed to meet on 30 September 1976.
LIC HEARING - REZONE: Unclassified to R -1 -7.2 (Farrell)
Chairman Mettler, noting this matter has been carried on the agenda for several
months, asked if the applicant had again been notified and requested to attend.
Mr. Crutchfield stated he had written to Mr. Farrell and Mr. Satterstrom stated
he had recently contacted Mr. Farrell by telephone and the applicant had assured
him he would attend the meeting this evening. Mr. Crutchfield noted that Mr.
Farrell was not present.

Motion by Mr. Link, seconded by Mr. Kirsop and carried to place this matter at
the end of the agenda to allow time for Mr. Farrell to arrive.
V. SIGNS - Parkway Plaza North
Mr. Crutchfield read the Staff Report explaining the nature of the proposed
signing scheme.
Mr. Link asked if any signing was proposed for the north elevation.
Mr. Ken Long, architect for Benaroya Company, stated there is no signing proposed
for the north elevation.
Mr. Kirsop questioned the need to be able to read the wall signs of each tenant
from Southcenter Parkway since there will be a freestanding sign identifying the
shopping complex.
Mr. Long explained the nature of the complex and noted the ability of small
business to locate in small portions of the building but the sign restrictions
would inhibit reasonable identification. Noted that Parkway Plaza South is a
taller building and thereby allows larger sign areas for the small tenant who
may have the same floor area or store front width as a tenant in Parkway Plaza
North since the North complex is considerably shorter. This fact coupled with
the setback distance is the primary impetus for the signing plan proposed.
Stated the plan will allow adequate signing for small tenants while improving
the results by strictly regulating the uniformity of all wall signs in the develop-
ment. Signs on the 10 foot fascia will be 4 feet high and on the 6 foot fascia
will be 3 feet high.
Motion by Mr. Link, seconded by Mr. Bowen and carried to approve the signing
plan as presented by Mr. Long.
VI. BOARDOFARCHITECTURAL REVIEW
Site Plan - Carriage House Furniture Store
Mr. Crutchfield read the Staff Report on this matter explaining the site layout
and proposed construction.
Mr. Richards questioned the lack of pavement along the south edge of the driving
lane. Also discussed with Mr. Long, of the Benaroya Company, the possibility of
providing 90 parking in the front of the building as suggested in the Staff Report.
Motion by Mr. Bowen, seconded by Mr. Kirsop and carried to approve the site plan
with the following stipulations:
1. The parking spaces located in the front of the building be placed at
90 to the building if physically possible. This condition to be
reviewed and an appropriate determination made by Staff.
2. The covered walkway along east and south elevation be mandatory.

OLD BUSINESS
COMPREHENSIVE PLAN REVIEW
Mr. Crutchfield read the Staff Report reminding the Commission and public of the
next working on this subject is scheduled for 8:00 P.M. Thursday, 2 September 1976
at the main fire station located at 444 Andover Park East.
PUBLIC HEARING - REZONE: R -1 -12 to R -1 -7.2 (Farrell)
Mr. Crutchfield noted this matter had been tabled from the regular July meeting
due to the absence of the applicant. Stated he had addressed a letter to the
applicant informing him of the Commission's action in July and urging his attendance
at the regular August meeting. Noted that Mr. Farrell (applicant) was, again, not
present.

Motion by Mr. Bowen, seconded by Mr. Kirsop and carried to table this rezone
request until the regular September meeting to allow the applicant to be present.
Commission agreed to hear Agenda Item V A before IV C.
PUBLIC HEARING - Preliminary Plat (Sky -View Acres)
Mr. Crutchfield read the Staff Report on this matter and generally explained
the location and proposed division of 3.25 acres into eleven 9600 square foot lots.
Chairman Mettler opened the public hearing at 8:40 P.M.
Mr. R. P. McKiddy, 27060 - 164th S.E. Kent, representing the applicant, stated
the maximum gradient of the road is 12% - not excessive. Explained he is well
aware of the groundwater problem inasmuch as his firm has done considerable work
with our State Highway Department in this general and immediate vicinity. This
plat is several hundred feet from the area characterized by underground springs
and feels the groundwater will present no problem to development but will conduct
a study of such to the satisfaction of the Public Works Department. Stated the
area of each lot is at least 9600 square feet and explained that only one sidewalk
is necessary, if any, in a subdivision this small and in consideration of the cul-
de -sac.
Mr. Richard Small, 16254 - 52nd Avenue, asked what the anticipated price of homes
would be and what the city's undergrounding program would provide in terms of
sidewalks.
Mr. Stoknes stated the undergrounding in this vicinity will be accomplished within
a matter of 4 - 6 years and street improvements are programmed for the year following
undergrounding. The number of sidewalks will not be determined until that time.
Mr. Gordon Kloppel, applicant, stated the average price of homes is anticipated to
be about $42,000.
Considerable discussion ensued regarding materials for sidewalks with the applicant
proposing asphaltic concrete in lieu of concrete. Discussion also focused on street
lighting and concluded it should compliment that which will be used by the city in
its undergrounding program.
Mr. McKiddy indicated the minimum roadway standards in Title 17. of the TMC are
poor and the applicant wants to do something better than that. Discussion followed
regarding adequacy of typical street sections in residential areas.
There being no further audience comments, Chairman Mettler closed the public hearing
at 9:15 P.M.
Motion by Mr. Richards, seconded by Mr. Link and carried to recommend the City Council
approve the preliminary plat with the following stipulations:

1. A study be completed by the applicant regarding ultimate storm water
run -off within the subdivision and the capacity of the existing system
on 54th Avenue South to adequately absorb it. This study must be
completed prior to approval of the final plat.
2. All utilities be undergrounded and designed in accordance with Title
17 (TMC) or the appropriate utility district standards.
3. Design of the final plat include one (1) five -foot wide sidewalk of
concrete or other material acceptable to Public Works Director and
that street lighting conform to the standards established by the city's
underground utility program.
4. The accuracy of the survey and area of each lot be confirmed through
computer print -out.
5. Design of roadway section within the 50 -foot right -of -way be 31 feet
(28 feet of pavement and 12 feet of standard or depressed curb and
gutter each side and exclusive of sidewalk) and appropriate sub -base.
PUBLIC HEARING - Community Development Plan (H &CD)
Mr. Crutchfield explained the nature and purpose of the proposed Plan.
Chairman Mettler opened the public hearing at 9:30 P.M.
Mr. Crutchfield, as directed by the Commission, read the Introduction section
of the Plan explaining the purpose, area to be affected, and funding process of
the Plan. Briefly explained the Objectives section. Read the Needs Assessment
section, explaining the 1970 Census information and the conclusions arrived at
and the two questionnaires used as the initial form of citizen input in terms of
identification and priority. Described in detail the proposed program, priorities
and projects. Displayed slides depicting the three areas recommended for walkway
improvements.
There being no audience comments, Chairman Mettler closed the public hearing at
10:10 P.M.
Commission agreed that based on the identification and prioritization of needs
and projects that the Target Area be contracted to encompass the McMicken Heights
and Tukwila Hill residential areas and to include that area lying between Interur-
ban Avenue and the Duwamish River.
Motion by Mr. Link to recommend the City Council adopt the proposed Community
Development Plan and Program, as revised by the Planning Commission, and that
the City of Tukwila participate in the King County Housing Assistance Plan.
Motion seconded by Mr. Richards and carried.
SIGNS
Off- Premise Directional Sign - B -W Van & Paint
Mr. Crutchfield read the Staff Report on this matter explaining the location of
the sign as it relates to the business. Displayed slides of the area.

Commission acknowledged the potential precedent of every business in this vicinity
placing a freestanding sign along Interurban Avenue and the effect of such action
as it relates to the purpose of the Sign Code. Also discussed the "shared direc-
tional sign" provisions of the Sign Code.
Mr. Robert Burke, applicant, indicated he was replacing a sign which was erected
in 1966 but disappeared a few years ago. Stated he needs the sign to direct
traffic to his business at end of South 144th Street.
Motion by Mr. Kirsop and seconded by Mr. Bowen to table this matter until the
regular September meeting to allow property owners and Staff to resolve this
problem.
Mr. Lloyd Hartung, owner of Jean's Ceramics located at the corner of Maule Avenue
and South 144th Street, stated he has a business on South 144th and does not feel
a row of off - premise signs along Interurban Avenue will benefit the appearance of
the area. Stated he would certainly be able to put up such a sign if this one is
allowed; however, he feels on- premise signing is quite adequate. Noted that Hertz
Truck Rentals, located at the east end of 48th Avenue South and nearly 1000 feet
from Interurban Avenue, has one freestanding on- premise sign.
Motion and second were respectively withdrawn.
Motion by Mr. Kirsop, seconded by Mr. Richards to deny the request for off - premise
signing due to the fact it is in direct conflict with the Sign Code and the 'shared
directional sign' provisions have not been employed. Motion carried unanimously.
BOARD OF ARCHITECTURAL REVIEW
Site Plan - McCann Project #293
Chairman Mettler excused Mr. Richards from participation in this matter.
Mr. Crutchfield read the Staff Report on this matter explaining the drawings and
associated problems.
Motion by Mr. Link, seconded by Mr. Kirsop and carried to approve the plans for
#293 with the following stipulations:
1. Truck doors not be located at ends of building.
2. Extension of the north access road to provide adequate circulation and
access to north parking area as well as truck doors on the west portion
of the building.
3. Parking be provided for not less than 52 vehicles along west building front.
4. Approval of detailed landscape plan, to include typical plantings along
west building front, prior to occupancy.
5. Screening of any rooftop equipment.

Motion by Mr. Bowen, seconded by Mr. Link and carried to approve the plans for
Project #763 with the following stipulations:
1. Approval of exterior architectural treatment, including screening of
roof- mounted equipment, prior to issuance of Occupancy Permit.
2. Approval of "interior" landscape plan to include effective "break -up"
points along the west elevation, prior to issuance of Occupancy Permit.
3. Exterior landscape conform to Master Landscape Plan previously approved
by the Commission.
OTHER BUSINESS
1977 Budget Review
Mr. Stoknes distributed and explained copy of proposed Planning Commission budget
for 1977. Commission generally agreed with revisions as .proposed.

COMPREHENSIVE PLAN: Single- family Residential

FINDINGS:
1. The subject site is approximately 9000 square feet situated the southeast
corner of the Intersection of South 140th Street and 53rd Avenue South.
2. The centerline of 53rd Avenue South is the western corporate limits of Tukwila.
3. The unincorporated area lying west of the city limitsrand east of the I -5_
freeway is currently being considered for annexation to the City of Tukwila.
4. The current King County zoning classification in the unincorporated area is
SR (Suburban Residential) which requires 5 acre lot sizes unless within an
approved subdivision.
5. The land area shown in Exhibit "A" as being. classified R -1 -12.0 was declared
to be a part of the City of Tukwila in 1961 under King County Resolution #23309.
6. A search of Planning Commission and City Council records between 1960 and 1963
only provide the knowledge that the city boundaries at that time were unclear
and that, in 1961, King County officially acknowledged that this area was, in
fact, within the corporate limits of Tukwila. There is no ordinance or other
official action on record which, after becoming a part of the city, established
a land use classification for this land area. (SEE, Exhibit "B ")
7. Section 18.08.020 states, in part, "All lands not classified...shall be
considered unclassified and, pending future classification, shall be subject
to the restrictions and regulations of single - family residence districts."

8. Section 18.04.010 authorizes the interpretation of all Zoning Code provisions
which is the basis upon which the administrative interpretation has been made
to apply the most restrictive of the R -1 classifications to unclassified lands,
specifically R -1 -12.0.
9. Section 18.60.160 states "A one family dwelling may be erected on any area of
land vacant and in separate ownership on December 23, 1957, and containing less •
area than required to house one family in the district in which it is located;
Provided the front, side and rear yard requirements of this title are met."
10. Application of zoning code 'restrictions could not be made until 1961, the
effective date of the land area's incorporation.
11. The subject property was issued a Demolition Permit in June 1974 to demolish
a residence.
12. Several houses within this unclassified area are located on lots considerably
smaller than 12,000 square feet. However, most appear to have been constructed
prior to the 1961 'incorporation' date.
13. The parcel of property located immediately south of the subject parcel is 6100
square feet in size according to the most recent information obtainable from
the King County Assessor.
14. Topography in the general vicinity varies from 0 - 15 %. The west half- of the
subject site is relatively flat while the east half is an approximate 10% slope.
15. Sanitary sewer service was installed in this area under LID #18 in 1973 and is
available to the subject site.
16. Water service is provided by Water District #38.
17. Storm drainage is accomodated by an open ditch on the east side of 53rd Avenue.
CONCLUSIONS:
1. All necessary utilities are adequate and available.
2. The interpretation of Section 18.08.010 to allow application of 12,000 minimum
lot size requirements pending classification is necessary to avoid "defacto"
commitment to 7,200 lot sizes.
3. The subject site apparently fails to meet the requirements of Section 18.60.160
in that the property was not vacant.
4. The 6100 square foot lot located immediately south of the subject parcel may be
an illegal non - conforming lot as a result of segregation subsequent to 1961.
The classification of 7200 density on the subject site would perpetuate that.
5. The potential annexation of the unincorporated area, coupled with the varying
lot sizes existing throughout the area, lead to the conclusion that the incor-
porated and unincorporated areas should be studied as a whole to determine the
appropriate density classifications.

6. The fact that the city, after acknowledging the inclusion of this entire land
area as a part of the city, apparently failed to properly classify the same
land area is justification for an action being, initiated by the Planning Com-
mission and refund the applicant's fee.
RECOMMENDATION:

Minutes of the 22 July 1976.
Commissioner Kirsop arrived at 8:08 P.
The regular July meeting of the Tukwila Planning Commission was called to
order at 8:05 P.M. by Chairman Mettler with Commissioners Richards, Link,
Bohrer•and West present. Kjell Stoknes,.Fred Satterstrom and Gary Crutchfield,
represented the Planning Department.
Chairman Mettler called for approval of minutes. Motion by Mr. Link, seconded
by Mr. West and carried to approve the minutes of the 24 June regular meeting
and 8 July special meeting as prepared.
III. City Council Actions
Mr. Crutchfield read the Staff Report explaining Council actions regarding
planning- related matters during the past month.
IV. OLD BUSINESS
Comprehensive Land Use Maps
Mr. Satterstrom read the Staff Report explaining the necessity to schedule the
next work meeting on the maps.
Mr. Crutchfield informed the Commission of Commissioner Bowen's desire to use
all maps in the work meetings and, if the rest of the Commission so desires, to
meet every Thursday until the map is finished.
Commission discussed their meeting schedule for the rest of the summer noting it
would be difficult to get all Commissioners every Thursday. General concensus of
Commissioners present to meet every other Thursday with the next work meeting
scheduled for 12 August 1976.

Fill Permit Application - Seattle City Light
Mr. Satterstrom read the Staff Report and referred to the Staff Report provided to
the Commission on 27 May 1976. Displayed map depicting original properties and
explained chronology of events since the property was annexed up to the present.
Mr. Larry Hard, Deputy City Attorney, explained the duties of the Commission as
set forth by Chapter 18.98 (TMC), the appeal process and that none of the Commis-
sioners are personally liable for their actions. Their duty is to consider what
is best for the community with an open mind and make the best possible decision
they are capable of.
Mr. Walter Williams, attorney for Seattle City Light, stated he was not aware of
any threats of lawsuit although the possibility remains. Added the following
major points to Mr. Satterstrom's chronology of events:
— Dedication of 30 foot strip of land for construction of Strander Boulevard.
— Granting of sewer easement in vicinity of Andover Park West.
— Problems between City Light and Puget Power.
— Letter from former Mayor Stan Minkler assuring that construction of
Andover Park West would not block drainage of the property.
— Participation in LID #21 and #22.
— Rezoning of property to CM.
Mr. Williams displayed drawing of pond indicating location of a 12 -inch drainage
culvert under Andover Park West. Asserted the construction of Andover Park West
blocked both ends of the culvert thus blocking drainage of the property. Noted
the storm sewer stubs installed in conjunction with construction of street are
at elevation 22.0 and can't be utilized unless the property is filled to that
elevation. Noted the deepest part of pond is, at present, 4 feet. During flooding
last December, it reached a depth of about 10 feet due to back -up of floodwaters
through storm drain system.
Displayed several photos depicting the growth of the pond from March 1966 to the
present. Noted the pond formed between January and March 1974 following construc-
tion of Andover Park West. City Light was not concerned about the forming of the
pond since they anticipated filling it upon completion of the roadway and storm
sewer system.
Pointed out vegetation on the pond site, asserting much of it was dying. Water
quality analysis had been done but City Light experts had been unable to make
accurate conclusions or projections from it. Generally concluded that water quality
decreases during the dry season due to increase in dissolved oxygen. Water is not
good for human consumption or recreational use.
Continued explaining State law requires municipal utilities to sell surplus property
at fair market value. Claimed nearly $2 million has been invested in this property
in one form or another and City Light simply wants to fill it like all the surround-
ing properties have done. The property cannot be sold with the pond.

Mr. Leonard Steiner, 13239 N.E. 100th in Kirkland, member of Audobon Society,
quoted SEPA sections and referred to map promulgated by Soil Conservation Service
which depicted areas of viable wildlife habitat desired to be maintained. The
Tukwila Pond is a rare form of wetland in this part of the valley and should be
retained.
Noted that most new Comprehensive Plan efforts by cities include policies regarding
the maintenance of open space and wildlife habitat. The Greenhead Gun Club, who
owned much of the property prior to Seattle City Light, operated a hunting lodge and
the pond was obviously a viable wildlife habitat long before construction of
Andover Park West. Many of the marshes in the valley have had fill placed near
them resulting in increased water depth. Noted that several court cases have
pointed out that ownership of wetlands does not include right to fill or destroy
wetlands. Stated the Audobon Society does not wish to halt all industrial devel-
opment, they merely desire to maintain the few viable wildlife habitat areas which
remain.
Ms. Sylvia Ludwig, 15150 - 65th Avenue South in Tukwila, stated she has been
visiting the pond for more than a year. Has positively identified 52 different
species of waterfowl, 5 of which are rare in this area. A low estimate of water-
fowl use would be about 3,000. Most of the trees are not dead and whether dead
or not they provide excellent habitat for waterfowl. The water quality analysis,
while certain with regard the waters' unfitness for human consumption or recreation,
says nothing about its fitness for the pond's users — waterfowl. Obviously is
good quality, the waterfowl is there.
Mr. Steiner noted the City of Tukwila is currently working on a new Comprehensive
Plan and that the fill permit should be denied until such time as the new plan is
done.
Mr. Satterstrom noted the pond area, prior to construction of Andover Park West,
was in fact wet and marshy and referred to 1966 photo. Referred to discussion of
direct significant impacts as a result of the fill proposal which included:
Earth: Proposed action would replace low depression containing pond with
fill and make site relatively flat.
Water: Draining pond would add one million cubic feet of water to storm
sewer system.
Fauna: Nearly all wildlife and wildlife habitat will be destroyed by pro-
posed action. Major impact will be to waterfowl.
Land Use: After filling, there will be little human use of property.
Natural Resources: Approximately 418,500 cubic yards of fill will be
excavated.
Transportation: To dump required fill, about 30,000 to 35,000 truck trips
will be required taking approximately 210 days with 160 truck trips daily.
Could result in congestion and roadway surface failure.
Aesthetics: Removal of pond will eliminate the contrast of Nature in an
urban area.

Mr. Satterstrom reiterated that Staff's recommendation was, in the spirit of
SEPA, to mitigate the identified direct significant impacts.
Mr. Arthur Lane, attorney representing Seattle City Light, referred to LID
agreements in 1973, participation in costs and elevation of storm sewer stubs
obviously support the assumption that the property would be filled.
Mr. Walter Williams stated the pond area was dry when owned by the Greenhead
Gun Club which piped water from the hill to form the marsh.
Mr. Al Pieper, 17083 - 53rd Avenue South, stated he has lived at his residence
for the past 25 years. His residence looks over the valley and the pond. Assured
the Commission that the pond has been in existence for many years prior to 1973.
Mr. Hard stated, in response to the Commission's inquiry, that the City of Tukwila
has fulfilled all obligations of the rezoning.
Considerable discussion ensued between the attorneys present regarding the
obligations and drainage.
Considerable discussion ensued among Commissioners and attorneys regarding previous
filling of portions of the property and drainage problems.
Mr. Stoknes pointed out that the discussion was centering on legal points which
cannot be resolved at this level. The matter at hand is the fill permit applica-
tion in consideration of the Environmental Impact Statement.
Some discussion followed regarding surplusing of property and fair market values.
Motion by Mr. Bohrer and seconded by Mr. West to deny the permit application.
Mr. Bohrer stated the motion is based on the fact there is no intended use proposed,
hence the impact of development cannot be assessed. Development alternatives which
incorporated the pond would be irretrievably lost if the permit is issued. The
Comprehensive Plan, which has been reviewed by both the Planning Commission and
City Council and is intended to be adopted, contains policies in both the Natural
Environment and Open Space elements relating to the discouragement of the filling
of lands when not in conjunciton with development plans. The proposed fill carries
with it significant adverse environmental impacts as identified in the EIS.
Mr. Link, in discussion on the motion, stated that part of the City Light property
has been filled for many years and the pond, without fresh water, will deteriorate.
Stated his objection to the motion for denial of the permit.
Mr. Bohrer called for the question. MOTION FAILED. Ayes: 2, Nays: 3
After some discussion, motion by Mr. Richards to issue the fill permit with the
stipulations recommended in the Staff Report.
Mr. Roy Murray, Seattle City Light, stated the fill permit with the proposed
conditions was useless to Seattle City Light. Emphatically stated the matter
is an "either -or" situation.

Mr. Richards withdrew his motion.
Motion by Mr. Richards, seconded by Mr. Bohrer to deny the fill permit applica-
tion. MOTION PASSED with Mr. Link voting NO.
PUBLIC HEARING - REZONE (Farrell)
Mr. Crutchfield noted the applicant was not present. Commission agreed to
postpone the hearing to allow the applicant to be present and Chairman Mettler
directed Staff to notify the applicant and nearby property owners of the new
hearing date.
PUBLIC HEARING - REZONE (Lutes)
Mr. Crutchfield read the Staff Report on this item and Chairman Mettler opened
the public hearing at 11:15 P.M.
Mr. Burton Lutes, 13903 Interurban Avenue South, stated he desires commercial
zoning on his land which is level with Interurban Avenue. The new Comprehensive
Plan indicates commercial use to the toe of the slope and he anticipates no
disruption of the slope in conjunction with development.
Commissioners discussed maintenance of the hillside and its present wooded
character.
There being no further comments, Chairman Mettler closed the hearing at 11:25 P.M.
Motion by Mr. Bohrer, seconded by Mr. Link and carried that based on the findings
and conclusions of the Staff Report, the Commission recommends the City Council
rezone the land from R -1 -7.2 to C -2 with the stipulation that any development of
the property classified for commercial use by this action shall not permit excava-
tion of the land lying above elevation 25, the original toe of slope.
PUBLIC HEARING - COMMUNITY DEVELOPMENT PLAN
Chairman Mettler, due to the late hour and to allow Staff time to prepare a final
draft, postponed the hearing on this matter until the next regular meeting in
August.
BOARD OF ARCHITECTURAL REVIEW
Site Plan - Segale #752
Mr. Crutchfield read the Staff Report noting the proposed 60 -foot curb cut.
Mr. George Hall, Segale Business Park, explained Andover Park West is a private
street within Segale Business Park.
Commissioners discussed application of Section 18.56.040 (TMC) to private streets
and concluded it was appropriate.

subject to the following stipulations:
1. Curb cuts shall comply with Section 18.56.040 (TMC)..
2. Landscaping shall conform to Master Landscape Plan previously approved.

Mr. Richards excused himself from participation in this matter.
Mr. Crutchfield read the Staff Report noting the Andover ACC will be reviewing
this item in the near future and expressed concern regarding possible future
expansion.
Motion by Mr. Kirsop, seconded by Mr. Link and carried to approve the plan with
the following stipulations:
1. Any additional future expansion will be subject to ensuring provision
of adequate parking space and truck maneuvering space.
2. Review and approval by Planning Commission of detailed landscape plan.
3. Compliance with any conditions imposed by the. Andover Architectural
Control Commission (ACC).
Chairman Mettler noted the work meeting scheduled for Thursday, 12 August 1976,
to work on the Comprehensive Land Use Maps.
There being no further business, motion by Mr. Link, seconded by Mr. Kirsop and
carried to adjourn the regular meeting.
Chairman Mettler adjourned the regular July meeting at 12:15 P.M.
