NOTE: The following information is necessary and must be enclosed before the annexation can be processed
(RCW 35.1 260):
a. ��topies of the annexation certificate should be tilled out and signed.
b. ' opies of the relevant ORDINANCE containing the legal description of the annexed territory.
c. 'FetkpLinaps of the annexed area. The maps should conform to acceptable engineering standards, including
directional arrow, scale, and properly designated streets, highways, railroads, rivers, and other physical
characteristics relevant to the territory and boundaries of the annexed area as well as existing municipal
limits. The map shall be on an 8 x 11" sheet or folded to that size.
d. One copy of the Special Population Census Schedules used to enumerate the population in the annexed area.

Re: City of Tukwila - Annexation
As you are aware, • the City of Tukwila has proposed to
annex additional property within its city limits. This matter
has been approved by the King County Board of Boundary Review
and is to be placed on the ballot for February 8, 1977. The
following is a description of the proposed ballot:
For the submission of the questions of annexation to
the City of Tukwila and whether or not the property involved
should be assessed, taxed, and subject to the assumption of
outstanding indebtedness pursuant to Proposition No. 2 of
property described in Resolution No. 534 of the City Council
of the City of Tukwila, and authorized by Chapter 7, as amended,
of the laws of the State of Washington for 1965.

SAMPLE LETTER ONLY
RE: Request for an election date on the question of annexation.
Please find attached with this letter a letter from the King County
Boundary Review Board approving an election on the question of annexation
for the Lower Foster Area.
Please also find attached seven (7) certified copies of Tukwila Ordinance
#534, a resolution for the commencement of an annexation proceeding by the
election method of an incorporated area known as the Lower Foster Area.
The City of Tukwila respectfully requests that the election date be February
1979. 'This date is the same as the Southcenteral School District which
services the area proposed for annexation and hopefully would be a convenience
to all.
We would request the King County Council by Ordinance set February 1979,
as an election date on the question of annexation to the City of Tukwila of
the Lower Foster Area.

Letter from Mayor Bauch to the Tukwila City Council was read
recommending $3,000 be allocated for the survey of the addition to
Joseph Foster Memorial Park and the Duwamish Park Site as required
by the lease agreement with South Central School District.
Ms. Pesicka asked if both pieces would be done at the same time.
Mayor Bauch stated that bids are being accepted now to do both sites.
Mr. Regel, audience, asked why the School District doesn't pay for
this improvement? Mayor Bauch stated that the City has leased this
property from the School District for $1.00 per year. The
agreement reads that within six months a survey will be made to
establish property lines and then the City will pay for all
improvements.

THE MAYOR'S RECOMMENDATION AND HAVE THE PROPERTIES SURVEYED. *

The City Clerk Pro Tem read a motion of the Tukwila City Council
requesting that the King County Council set an election date on the
question of annexation to the City of Tukwila of the area commonly
known as the Lower Foster Area.
The City requests that February 8, 1977 be set as the election date.

Deputy City Attorney Hard read a motion of the Tukwila City Council
related to a joint application with King County for Housing and
Community Development Block Grant Funds to improve the Thorndyke
Community Club primarily for elderly.
MOVED BY HILL, SECONDED BY MS. PESICKA, THAT CITY COUNCIL MOTION
NO. 76 -12 BE ADOPTED AS READ. *
Mrs. Rudolph Regel, audience, stated that she knows the Thorndyke
Community Club Building having used it through Grandmothers Club and
Garden Club for many years. She stated that there are many drawbacks :..
that can not be overcome without a complete renovation of the hall.
To begin with, Senior Citizens object to the steps up to the building,
the women's restroom is down several steps and there is no heat,
the heating of the building is by gas and it is not satisfactory
during the winter, the sewer is not connected and the condition of
the roof is questionable. She asked who is going to pay the sewer
assessments and stated that the school expects $500 per year insurance.
Mrs. Regel stated that, personally, she does not think it a good buy.
Mayor Bauch explained that many'of the questions Mrs. Regel addressed
have been considered. The building has been inspected by the City's
Building Official and agrees that it will take a new roof. A ramp
will have to be provided beside the steps for access to the building.
The restrooms do have to be upgraded and there does have to be some
renovation in the building. It has been estimated that it will
take $15,000 to upgrade the building to a useable condition. In an
effort to obtain these funds the County was contacted. The County
came back with the idea that considerable more funds should be put
into the building to upgrade the kitchen so it would be eligible for
the Senior Citizen Hot Lunch Progr,m along with other activities.

F THE WHOLE MEETING
Council President Hill read a letter from the Park Board dated
October 14, 1976. In the letter the Park Board made the following
recommendations: (1) City Park: That the metal building located it
the center of the park be removed, as it• detracts greatly from the
beauty and atmosphere of the park. (2) City Park: It has been
brought to our attention that the Public Works Department was going
to continue paving a maintenance road to the top of the park. We ar(
against such a move. We feel that a small 4 foot wide path would be
plenty. We also feel no other areas'in the park should be, paved
unless it is approved by the Park Board. (3) Duwamish School:
We would like to make a few improvements on the field there. Namely
the removal and replacement of the back stop and removal of the old
playground equipment in left field. Councilwoman Pesicka offered the
suggestion that the paved road was needed for maintenance. Kjell
Stoknes, Director of Community Development, said it was his opinion
the road was not needed for maintenance. He said it is possible the
top might have to be leveled by a bulldozer one time. He said it
seems like big equipment would not need to be taken up there:
Councilwoman Pesicka said if there is no need for the road she would
rather see just the path.. Mr. Stoknes said the Public Works Depart.
ment thinks there is a need for the road. Councilman Traynor said
he thought the Public Works Department should talk to the Park Board
and tell them why they need the road. Mayor Bauch'said he had told
the Park Board the letter they had written had been misdirected, it
should have come to Administration and it could have been handled
there. Mayor Bauch said he thought the metal building was in violat
of the building codes of the City and should be taken down.
MOVED BY MS. PESICKA, SECONDED BY SAUL, THAT THE PARK BOARD LETTER BI
REFERRED TO ADMINISTRATION. CARRIED.
Councilman Saul said he thought the City Council should know who
the Department Heads are; find out what the budget policies are;
how to meet the needs of the City; how to make the City Council work
as a team. He said other cities are doing-this and he would like
to see the City of Tukwila get together and discuss everything and
get a good feeling about things; get everybody going the same direc-
tion so our ideas will click. It could be an open meeting. City
Treasurer Mae Harris said she thought it would be a good idea. She
said she would like to see it done before the budget is adopted, it
seems it is too late after the budget is adopted. Mayor Bauch said
this was the program they were going to use last summer, but everyon
was too busy to get it done. Councilman Traynor said it would be a
good idea to do it in April or May.
-Mayor Bauch said he would bring formal. motion before the City Counci
for their action at the next Council meeting.
MOVED BY TRAYNOR, SECONDED BY SAUL, THAT THIS ITEM REGARDING THE
LOWER FOSTER ANNEXATION BE REFERRED TO THE NOVEMBER 1, 1976 MEETING
OF THE CITY COUNCIL. CARRIED.
Kjell Stoknes, Director of Community Development, said a time
should be set at this meeting to meet with the applicant. Mayor Bau
said he would recommend it be done at a regular City Council meeting
so action can be taken at that time.
MOVED BY TRAYNOR, SECONDED BY SAUL, THAT A PUBLIC HEARING BE HELD
ON NOVEMBER 15, 1976 DURING THE REGULAR MEETING OF THE CITY COUNCIL.
CARRIED.
Mayor Bauch said Councilman Traynor had called him and staff is
starting a survey to find out the names of contractors who will give
reasonable prices for the installation of electrical boxes where the
are needed. He said complaints had been received that some contrac-
tors are gouging people when they had to install wiring and boxes.

I have been in contact with the King County Boundary Review Board and I
have been notified that they have approved the election for annexation
of the above referenced area.
2. The City by Ordinance calls for the election and this ordi-
nance is filed with the County Council, who by ordinance set
the election officially.
Mr. Hard is in the process of developing the ordinance and has indicated
it will be ready for the regular Council meeting of November 1, 1976.
Staff would request that this item be placed on the November 1, 1976
Council Meeting and that the ordinance establish the date of the election
to be concurrent with the Southcentral School District Levy.
Please find attached with this memorandum a letter and an additional
memorandum from the King County Boundary Review Board regarding this
information.

the Committee of the Whole Meeting of October 25, 1976, then be

Mayor Bauch reported that the annexation has passed the Boundary
Review Board review period and there were no protests. It is hoped
that the Special Election date will be February 8, 1977 along with
the School Levy.
Councilman Saul requested two items be placed on the agenda for the
Committee of the Whole Meeting of October 25, 1976. They are:

Councilman Saul gave the following report from the City Treasurer:
"During September, $1,450,000 worth of investments came due and
were sold with a resulting revenue of $8,124.65 and $1,594,603.75
of surplus funds were invested ".
Attorney Hard, reporting on the results of the LID #28 Lawsuit,
stated that the trial started October 13th and ended October 18th.
He gave a brief report on the procedures. The Judge ruled that
everything the City did was proper and upheld all of the decisions
of the Council, the Planning Department and the Public Works Department,
Councilman Gardner noted that Metro is discontinuing the Tukwila
bus service the first of the year. Mayor Bauch stated he hoped one
of the Council Committees would study this problem and come up with
a viable solution that would meet the needs but not cost a lot of
money.
Mrs. Elanor McLester, 5118 South 164th, asked if the City is
considering the purchase of recreation property in the McMicken
, Heights area. Mayor Bauch stated that the Council has set
the acquisition of park property in that area as their No. 1
park priority.

final ordinance, forwarding it to King County, and the County circulating
it with the official canvas of votes to all County Departments, it en-
sures that the county records are officially changed-7 and that you de-
rive the necessary revenues from the area.

election on the question of annexation to the
City of Des Moines of unincorporated territory
contiguous thereto and declaring an emergency.
BE IT ORDAINED'BY THE COUNCIL OF KING COUNTY:
SECTION 1. The City of Des Moines by Resolution No. 206
has determined that the best interests and general welfare of
the City of Des Moines would be served by the annexation of
unincorporated territory contiguous thereto as described herein.
SECTION 2. Said Resolution does satisfy the provisions of
RCW 35.13.020 .. requesting the calling of an election to be held
among the qualified voters therein upon the question of
annexation.
SECTION 3. The King County Boundary Review Board by its
decision dated June 19, 1975, approved the proposal as submitted
all in accordance with,RCW 36.93.100; and further, the time to
appeal from' such decision has expired.
SECTION 4. A special election shall be held on the 16th

LOWER FOSTER ANNEXATION
Gentlemen:
As required by Chapter 36.93 of the Revised Code of Washington, a Notice of
Intention is hereby given by the City of Tukwila to annex by the election
method the territory commonly referred to as the Lower Foster Annexation.
This area lies contiguous to the northwestern city limits of Tukwila, generally
between 53rd Avenue South and the I -5 freeway south of Interurban Avenue.
The City of Tukwila herewith submits the following exhibits to assist the
Board in its consideration of the proposed annexation. It is understood .
that the Board will furnish copies of the Notice of Intention to the State
Department of Ecology, State Department of Social and Health Services, and
King County as required by State Law. The items transmitted are numbered in
accordance with the following list:

Description of the Proposed Action
The City of Tukwila proposes an annexation by the election method of land area
contiguous to the present incorporated limits of the City, and commonly referred
to as the Lower Foster area, under those applicable provisions of Chapter 35.13
Revised Code of Washington (RCW), with specific reference to Chapter 35.13.015.
The Notice of Intention is filed with the King County Boundary Review Board
under the provisions of Chapter 35.93.090 RCW and Chapter 36.93.130 RCW and
other specific sections relating to information to be considered by the Board.

Background Information
During the summer of 1972, the annexation of a portion of what is now considered
the Lower Foster area was instigated by private citizens through the petition
method. This effort immediately followed the installation of sanitary sewers
in the area by LID #18. However, due to an error in the petition form filed by
the petitioners with the City, a new and proper petition was required. Having
to start anew probably put a damper on the petitioners' enthusiasm and the
annexation effort gradually lost momentum and expired.
In limbo for almost three years, interest in annexation was rekindled in January
1976, this time by the Tukwila City Council who requested that the Planning De-
partment undertake to gather information on two unincorporated areas contiguous
to the City -- one of which was the Lower Foster annexation area. This report
was prepared and on February 2, 1976 the Planning Department presented it to the
City Council.
The Planning Department's report emphasized two main points regarding the Lower
Foster annexation area. First, this area was environmentally and socially tied
to and interrelated with the City of Tukwila; and, secondly, that this area was
a natural extension of the City's service area, (i.e., present city manpower and
equipment were adequate to service it).
Subsequently, on May 3, 1976 the City Council adopted Resolution No. 534 calling
for the commencement of an annexation proceeding by the election method of the
Lower Foster area.

A REVIEW OF FACTORS IN RCW 36.93.170:
Area, Zoning, and Comprehensive Plan
The proposed Lower Foster annexation is approximately 27 acres in area.
Most of the land within this potential annexation area is zoned suburban/
residential, which requires minimum lots of five (5) acres per dwelling
unless within an approved subdivision. Property located adjacent to Interurban
Avenue is generally zoned BC (Commercial) with some RM 2400 (multiple- family)
zoning forming a buffer between the commercial and single - family residential
districts. One land parcel adjacent to Interurban Avenue and south of South
135th Street is zoned suburban /residential because no access is available
directly onto Interurban Avenue due to the steep terrain.
The existing King County Comprehensive Plan for land use in the Lower Foster
area calls for single - family residential use in the upland areas off of Inter-
urban Avenue. In the lowland along Interurban Avenue where street -level access
is available to abutting lands, the King County Plan designates a narrow strip
of land for commercial uses. A buffer of multiple - family use is designated
between the lowland commercial area and the upland single - family residential area.
According to Resolution #534 declaring the City's intent to annex the Lower
Foster area by the election method (a certified copy of which is included in
this report as Exhibit 10), the present King County zoning classifications in
the annexation area would be converted to the nearest similar City zoning class-
ifications. These changes would be as follows: S -R to R.1 - 12.0, RM 2400 to
R -3, and B -C to C -2. In this manner, annexation of the Lower Foster area would
neither create non - conforming uses nor cause landowners to individually make
applications for rezone from R -1, (upon annexation, all property becomes class-
ified as R -1 according to existing city ordinances).
Land Use, Population, and Growth Potential
Most properties within the proposed annexation area are presently developed;
very little vacant land presently exists.
The predominant land use within the annexation area is single - family residential.
Nevertheless, several small business /commercial uses exist along Interurban Avenue
north of 52nd Avenue South. Adjacent to 52nd Avenue South is one 4 -plex and pre-
sumably several duplexes (probably converted single - family homes) are interspersed
in the area.
Adjacent to South 139th Street is located a piece of South Central School District
#406 property, of which approximately three (3) acres is leased by the City of
Tukwila for park purposes. A school district maintenance facility is also main-
tained on this property.
There are approximately 89 single - family homes and 19 living units in multiple
quarters (two units or more per structure). It is estimated that the majority
of the structures were constructed prior to 1950. Of the single - family units,
approximately 60% are thought to be owner- occupied.
The 1970 Census shows the Lower Foster area by census block as having a popula-
tion of approximately 317 persons. The population of the area appears to be
homogeneous with that of the remainder of the Tukwila Hill. Using planned land
use as a guide, the saturation population of the annexation area is 600 to 800
persons.
Growth potential of the Lower Foster area in the next ten years would seem to
be gradual and slight, but this could change depending on a number of factors.
Currently, the subject area is built up and very little vacant land exists.
However, because of the age of some structures, it can be expected that a
number of these will be replaced with new structures as time goes on. Water
and sanitary sewer service do exist in the area and will provide a sound basis
for any growth which may occur.
Natural Features
The Lower Foster annexation area is located on the north and northwestern
flanks of what is commonly termed the Tukwila Hill. The upland areas in
the annexation reach to 175 feet in elevation, sloping gently, sometimes
steeply, to the Duwamish River lowland at 17 feet elevation. The subject
area is located in the South Riverton drainage basin. Soils in the area
are till soils; in some areas they overlie hardpan, in others bedrock.
In either case, these till soils have good bearing capacity and provide
good sites for building.
Boundaries
While the boundaries of the Lower Foster annexation area are highly irregular,
they are very logical ones. The annexation area presently is an "island" of
King County sandwiched between the Interstate 5 freeway and the existing City
Limits of Tukwila. The subject area is viewed as a natural extension of the
Tukwila City Limits for this reason.
Proximity to Populated Areas
The distribution of population within the annexation area — i.e., approximately
12 persons per acre — is consistent with that of the single - family residential
districts within the. City of Tukwila to which it is contiguous. The population
of the annexation area together with the incorporated area of the Tukwila Hill
would comprise a total population of about 3000 persons, all physically and
socially interrelated by virtue of their geographic disposition.
The Lower Foster annexation area is located in the heart of the Tukwila Planning
Area, which also includes Foster and Riverton Heights to the west, Allentown to
the north, and McMicken Heights to the southwest. Total population of the Tuk-
wila Planning Area is approximately 22,000 (1970 datum).
Financial Characteristics
The 1975 assessed valuation of the Lower Foster annexation area was $1,382,100.
Of this total, $72,100 (5%) was tax exempt South Central School District property/
improvements while $1,310,000 was tax paying (95%). The total assessed valuation
calculates to approximately $4360 per capita, or $4130 if only tax paying properties
are considered.
Governmental Characteristics
Tukwila is a third class city and has a Mayor - Council form of government which
operates under the provisions of Title 35, RCW. The Council is comprised of
seven members, elected city -wide, who are responsible for establishing policy,
appropriating funds, and other legislative duties. The Mayor (part -time) is the
chief executive and is responsible for the overall administration and enforcement
of policy. The various departments, which,are responsible for specific functional
areas, report to and are responsible to the Mayor.
The Mayor and City Council are responsible to the citizens of the community in
meeting day to day problems as well as planning for the future. Citizen partici-
pation in local government in the City of Tukwila is illustrated partly by the
list of citizen boards and commissions noted below:

Public Safety
The proposed annexation is now served by Fire District #18. Upon annexation,
fire service would be provided by the'City of Tukwila. The City presently
maintains a professionally- staffed fire station (with aid unit) approximately
3/4 mile from the annexation area atop the Tukwila Hill.
Also upon annexation, the City of Tukwila Police Department will assume police
service from the King County Department of Public Safety which presently serves
the Lower Foster area. Like the Fire Department, the Tukwila Police Department
is located about 3/4 mile from the annexation area.
Both Police and Fire Departments anticipate being able to serve the annexation
area without expanding their manpower or equipment needs.
Utilities
Presently the entire annexation area is served by Water District #38. This
service would probably be continued even after annexation since the City main-
tains no main water lines in the area.
As mentioned earlier . in this report, sanitary sewers (LID #18) were installed
in the Lower Foster area during 1972. These sewers were built and are'presently
maintained by the City of Tukwila.
Upon annexation, it is likely that the City's program of undergrounding electrical
and communication lines would be extended to the Lower Foster area.

REVIEW OF FACTORS IN RCW 36.93.180:
The annexation of the Lower Foster area will effectively bring properties
which are physically and socially related to Tukwila into the City. As
such, the boundaries of neighborhoods will be enhanced by the elimination
of fragmented service districts and jurisdictions.
The configuration of Tukwila's boundaries will be more logical after the
Lower Foster area is annexed. Instead of an irregular city boundary bordered
by.an isolated portion of unincorporated King County, the City limits will run
logically along the Interstate -5 freeway. Hence, all the property visually,
physically, and socially related to the Tukwila Hill will be governmentally re-
lated as well.
Because of the area's geographic relationship to Tukwila, annexation of the
subject area should also provide for logical service areas, especially with re-
gard to police and fire protection. It is expected that existing city forces
will be able to adequately service the annexation area.
The proposed annexation is almost wholly developed to urban densities and the
remainder undoubtedly will be developed to urban densities. It would be accurate
to state that,any future development, if annexed, would reflect City goals and
standards which would, in turn, make for a more harmonious, healthy urban envir-
onment.

WHEREAS, the City Council of the City of Tukwila has
determined that the best interests and general welfare of the
City of Tukwila would be served by the annexation of a certain
unincorporated territory contiguous to the City, commonly re-
ferred to as the "Lower Foster Area ", and more particularly des-
cribed in Exhibits "A" and "B ", both of which are attached hereto
and by this reference incorporated herein, and;
WHEREAS, the City Council of the City of Tukwila has
determined that the annexation proceedings should be initiated
within the provisions of RCW 35.13.015, providing for the elec-
tion method,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA
does hereby resolve as follows:
1. Annexation proceedings by the election method shall
be commenced as provided in RCW 35.13.015, covering an unincor-
porated area adjacent to the City of Tukwila, commonly known as
the "Lower Foster Area ", the legal description of which and a
map describing which are attached hereto and marked Exhibits "A"
and "B ", respectively, and are incorporated herein by this refer-
ence.
2. There are //6 voters residing in the subject
annexation area, the "Lower Foster Area ".
3. An election should be held among the qualified voters
in the subject annexation area, "Lower Foster Area ", upon the
question of annexation and the City of Tukwila shall pay the cost

Mayor Bauch introduced two new Police Officers, Gerald E.
.Myklebust and Joseph E. Snyder and administered the oath of
office to each. The newly appointed officers were then
introduced to members of the City Council and audience in
attendance.
After a brief overview by Kjell Stoknes, Planning Director,
of the Transportation /Utilities Element of the Comprehensive
Plan and its content, Mayor Bauch opened the public hearing
at 7:27 P.M. Mr. Charles 0. Baker, Executive Director of the
Tukwila Industrial Council, spoke to Section 1 of the Roadways
Statement regarding Policy No. 2, stating his concern with
discouraging maneuvering of automobiles or trucks on public
rights -of -way. His comment was that he would like to see this
area of policy more flexible. Mr. Richard Bowen, Chairman of
the Citizen Review Committee for the Transportation /Utilities
Element stated that serious consideration was given to this
policy. He noted that trucks are becoming larger and more
difficult to maneuver and therefore, the purpose of this policy
statement was to allow future consideration for more area.
Steve Hall, Public Works Director, noted that roads and turning
radiuses are not designed for larger trucks and that his
office is investigating establishment of specific truck routes
and will be coming back to the Council in the future with plans.

Councilwoman Harris pointed out that the salaries set forth
within the attached agreement to the Resolution do not reflect
longevity and that those employees entitled to longevity
would continue to receive it.
Mayor Bauch made several announcements and reported on
current events that are of interest to the citizens of Tukwila.
Deputy City Attorney Hard gave an updated report to the
City Council and audience on the status of legal matters
concerning the City. He also reported on the many items
under present investigation for the various departments
of the City.
MISCELLANEOUS AND FURTHER AUDIENCE COMMENTS
Bicentennial Cabin Mr. Burton Lutz informed the Council that the fireplace and
front porch at the Bicentennial Cabin are now complete.

Councilman Traynor noted that a small city that has a
Federal Agency within its boundaries was able to obtain
its own zip code and once again noted that the City of
Tukwila is without its own zip code:
Steve Hall, Public Works Director briefly reported on
the progress of items within his departmental jurisdiction.
Chief Sheets noted that May 5, 1976 will be opening day
at Longacres and that there is little the City of Tukwila
and the State Patrol can do with the traffic situation
and informed the Council that it is matter of living with
it for the next 100 days.
Mr. Burton Lutz lodged his verbal complaint regarding the
odor that seem to generate from the Seattle Rendering
Works. Public Works Director, Steve Hall suggested these
types of complaints be lodged with Puget Sound Air
Pollution Control Agency. Councilwoman Harris suggested
that citizens first call the owners and lodge their complaints
first hand. She also suggested that part of the problem
could be from the Metro Treatment Plant.
