They also authorized in the waiver a joint application for a rezone so that other properties in the vicinity of yours between Interurban Avenue and the 25 foot contour line could also make a joint application with you for a com- mercial rezone application. At this point it is necessary for you to come into the Planning Department and make a formal application for a rezone and supply us with a $100 filing fee. CITY OF TUKWILA PLANNING DEPARTMENT CITY COUNCIL STAFF REPORT REQUEST: Request for waiver to Resolution 489 for rezone PETITIONER: Burton Lutes PROPERTY 13903 Interurban Avenue South LOCATION: June 14, 1976. The applicant is requesting a waiver to resolution 489 allowing him to apply for a rezone on the referenced property from R -1 -7.2 (Single - family) to C -2 (Commercial) for the lowland portion from Interurban Avenue to approximately the 25 foot contour elevation line. This requires City Council action waiving subsection 4.A of Resolution 489. The procedures of Resolution 489 requires Planning Department analysis of four items. They are as follows: 1. Is the proposed action consistent with the presently emerging Land Use Policy Plan? STAFF COMMENTS: The presently emerging Comprehensive Land Use Map shows the proposed property for commercial land use. The policies that have already been reviewed by the City Council indicate that commercial zoning should only extend from Interurban Avenue to the toe of the slope in this area. The proposed rezone is consistent with these concepts and therefore is consistent with the presently emerging Land Use Policy Plan. 2. Does the proposed action represent a unique condition which is insignificant in scale and to which no other apparent alterna- tives are reasonable? STAFF COMMENTS: It appears from the existing zoning map that there are only two properties in the lowland area adjacent to Interurban Avenue that are not already zoned for commercial uses. Because of this it would seem that the proposed request does represent a unique condition. In addition, since the development trend in the area is for commercial uses and since this property lies within an area where this trend is occurring, it would appear that the proposed rezone would be insignifi- cant in scale and that other alternatives would be limited. City Council Staff Report Attachment: Application for waiver questionnaire • Page 2 14 June 1976 3. if the request for waivers involves grading, excavation, filling or development in geographical areas identified as having potential natural limitations for development, are mitigating measures provided? STAFF COMMENTS: The property is not located in a area which has been identified as having potential natural limitation to development. 4. Do the requirements contained in Resolution No. 489 impose a special hardship to a site for which a waiver of the provisions would not necessitate a major policy commitment prior to the adoption of the Land Use Policy Plan? STAFF COMMENTS: Since the zoning in the vicinity of the property, the development pattern in the vicinity of the property, and the emerging Comprehensive Plan all seem to indicate commercial use is desirable for this area, it would appear that the requirements con- tained in Resolution No. 489 do impose a special hardship to the site and that granting a waiver to the provisions of this resolution would not cause a major policy commitment prior to the adoption of the Land Use Policy Plan. RECOMMENDATION: Staff recommends that the waiver to Resolution No. 489 allowing the applicant to apply for the rezone should be granted with the following condition: That the application not be processed before the Planning Commission until such time as the Planning Commission has completed its recommen- dations on the Land Use Maps that they are presently in public hearing on for the Comprehensive Plan Update. This recommendation is made to give the Planning Commissioners more time to consider only Comprehensive Planning issues at this time without being dis- tracted by current land use issues. It is estimated that it may take the Planning Commission from one to two months to come up with a recommendation on the Land Use Maps.
