Bldg. Off. RJB /ckh cc: The intent behind the term "substantial improvements" means the issuance of a building permit by the City of Tukwila. The action of applying for and obtaining a building permit demonstrates that the intent of construc- tion will be forthcoming. After a building permit is issued construction must begin within six months. One extension can be granted for a period of six months. In effect this gives you a 1 year extension. However, complete plans must be submitted and approved to obtain a building permit. There is no written legal definition of the term "substantial improve- ments." However, please be advised that the City of Tukwila will not issue a building permit for the project after February 14, 1980. If I can be of any further assistance, please call me at (206) 433 -1848. WAC 173 -14 -060 allows local government to extend the 2 -year time period to initiate action by a reasonable amount of time. Mr. MacDonald has requested an extension of one (1) year. This appears reasonable, however, an extension of the 5 -year period for completion of the project is not warranted at this time. As you are aware on January 11, 1979 our present application will be void unless we ask for additional time. It is our intent to take steps immediately to build the motel restaurant complex as approved. Although it is possible for us to meet the deadline of January 11, 1979 it would put an undue hardship on us to stop all other projects and concentrate on that one as of this date.
