Dear Mr. Johanson
The Planning Commission, at its regular meeting of 21 September 1972,
held a Public Hearing to consider a request to rezone from R-3 to
C -1 that parcel of property located at 5916 Southcenter Boulevard
and owned by Mr. Tony Kato.
It is the recommendation of the Commission to rezone the property
to C -1 subject to the following conditions:
1. The north line of the C -1 boundary be one hundred
(100) feet from the present C -1 zone north boundary
and run parallel to Southcenter Boulevard.
2. That land be provided for future public access to
land to the north and east of subject property, to
eventually tie with 62nd Avenue South and the exact
location of the right -of -way be mutually placed.
3. Provide left turn channelization and widening of
Southcenter Boulevard. Said widening shall provide
that the additional traffic lane be a minimum of 12
feet wide and 5 feet more for a future pedestrian
sidewalk. Said channelization and widening shall
be approved by the Director of Public Works and be
provided at no cost to the City.
4. All exposed slope cuts will be landscaped in accord-
ance with plans drawn by a qualified landscape
architect.
5. Provide storm sewer along Southcenter Boulevard at
no cost to the City.
6. That a street, meeting City standards, be developed .
on the west property line in conjunction with the
PLANNING DEPARTMENT

7. Agree to participate in any future L.I.D. for traffic
signalization along Southcenter Boulevard.
$. That a detailed definitive site plan displaying the

ORDINANCE 661E CONDEMNATION SHOP SITE
A proposed ordinance relating to and providing for the acquisition and condemnation of
property for the location of the City Shops and Maintenance Yards was introduced. Mr.
Hodge explained there still remained considerable difference in the City appraisal price
and the owners asking price on the land. If this site was still the Council's number
one choice for the location of the maintenance yards, the passage of the proposed ordinance
would be necessary to proceed with the acquisition of the property.
Mr. Bowen made a motion the proposed ordinance be placed on its first reading. Motion
seconded by Mr. Dunning and carried. Mr. Gardner made a motion the proposed ordinance
be placed en its second reading; by title only. Motion seconded by Mr. Johanson and
carried. Mr. Hill made a motion the proposed ordinance be placed on its t.hircl and final
reading for adoption, by title only. Motion seconded by Mr. Dunning and carried. This
being Ordinance 664.
ORDINANCE 665 CONDEMiNATION FOR SOUTH 144th et al PROJECT
A proposed ordinance relating to and providing for the acquisition and condemnation of
certain property for the establishment, laying out, extending and widening of streets
was introduced. Mr. Hill made a motion the proposed ordinance be placed on its first
reading. Motion seconded by Mr. Johanson and carried. Mr: Bowen made a motion the pro—
posed ordinance be placed on its second reading by title only. Motion seconded by Mr.
Sterling and carried. Mr. Gardner made a motion the proposed ordinance be placed on its
. third and final reacting for adoption, by title only. Motion seconded by Mr. Hill and
• carried. This being Ordinance 665.
ORDINANCE 666 -- SEWER CHARGES OUTSIDE THE CITY LIMITS
A proposed ordinance amending Section 4 of Ordinance 341 as amended and Ordinance 587,
providing for Sewer Service Rates was introduced. Mr. Hodge explained the purpose of the
ordinance and the contents thereof. Mr. Dunning made a motion the proposed ordinance be
placed on its first reading. Motion seconded by Mr. Bowen and carried. Mr. Hill made
a motion the proposed ordinance be placed on its second reading by title only. Motion
seconded by Mr. Bowen and carried. Mr. Gardner made a motion the proposed ordinance
be placed on its third and final reading for adoption, by title only. Motion seconded
by Mr. Dunning and carried. This being Ordinance 666.

Mr. Hill made a motion the city clerk prepair a resolution to advertise for a public
hearing for the vacation of the street. Motion seconded by Mr. Sterling and carried.
SCHOOL BOARD DIRECTOR — DISTRICT #5 .
Mr. George Drew present school board director from District No. 5 was present and anndurriced
he will not be running for office again. Filing fbr the vacancy will be open July 26th
through July 30th. Applicants may file for office at the County City Building or the
School District Administration building.

Several critical and explicit stipulations were included
in rezone ordinance #737, one of which reads as follows:
21 October 1974
Dear Mr. & Mrs. Kato:
On 16 October 1972, a portion of Tract 11 of Interurban
Addition, owned by you, was rezoned at your request to C -1
(Neighborhood Retail) in order to facilitate the construction
of what was anticipated to be an International House of
Pancakes establishment.
The date of this letter represents two years following the
effective date of ordinance #737 and the improvements have
not been constructed. Thus, this letter serves to notify
you of our intent to file with the County Auditor a
declaration reverting to R -3 zoning that portion of land
previously zoned C -1 and legally described in Ordinance #737.
Should you have any questions or desire any further information
regarding this matter, please do not hesitate to contact
this office.
