Re: Proposed Public Right -of -Way
common to VIP'S Restaurant and
International House of Pancakes Sites.
In light of the discussion at the Planning Commission work meeting on Thursday,
November 9, 1972 regarding the aforementioned subject, I submit the following
information:
1. Ordinance #575 dated August 18, 1969, concerning rezone of VIP'S Site,
Property Use and Development Agreement, Paragraph 1. (e):
If a future study indicates the feasibility of a street along the
east property line, agree to join with adjacent owners in dedicating
the necessary right of way.
2. Ordinance #737 dated October 16, 1972 concerning rezone of International
House of Pancakes Site, Condition #6:
That a street meeting City standards be developed on the West property
line in conjunction with the landowner to the immediate West. This is
to be approved by the Director of Public Works.
3. Building Permit #120 for VIP'S Restaurant was issued on August 1, 1972.
Chronologically it is obvious that the staff and in particular the Building
Department can not enforce conditions imposed after the fact; i.e. restrictions
of Ordinance #737 can not be applied to a building permit issued 2 months
previous.
The requirements of Ordinance #575 (VIP'S Rezone) do not require "a street meeting
City standards" as stipulated in Ordinance #737 ( International House of Pancakes
Rezone), but merely a dedication of right -of -way if required by the City.

Because of the sequence of events as herein indicated, I do not believe the City
of Tukwila is in a position to require VIP'S Restaurant to alter their approved
site plan, which shows finished contours for that site development.
In my opinion, the City should require a.dedicated right —of —way from South 154th
Street to the Northern limitation of the driveway into the International House of
Pancakes in order to control this intersection. Also, the requirement for the
future right —of —wady dedication should remain, but the street not constructed at
this time.
In the future, if any question regarding the staff arise, please direct your
correspondence through me as they are under my supervision and they responsible
to me directly.

MEMORANDUM TO: John Richards, Building Official
FROM: Planning Department
SUBJECT: VI}?'s Building Permit
The Planning Commission Chairman has directed this
department to issue a memorandum to you in regard
to the problem encountered by the Public Works
Director in relation to the grade of the roadway
running northerly from Southcenter Boulevard.
The Director of Public Works informed the Commission
the half -road being provided by the House of Pancakes
is at 16% grade, while the corresponding half -road
provided by VIP's is at 5% grade.
The Commission inquires of the process required to
obtain a building permit. Did VIP's submit a final
grading plan prior to issuance of a building permit?
If so, what grade was designated on that plan for
the 25 -foot roadway?
The Commission would appreciate a thorough background
report regarding the circumstances which led to the
construction of the present grade of the proposed
roadway.

The C -1 zoning of the property on which the VIP's Restaurant will
be located allows structures of not more than thirty —five (35) •
feet in height.
This office anticipates some public expression concerning the
signing of the restaurant. We therefore ask the exact location
of the sign to be shown on any plans submitted for approval.
Square footage of the sign faces should be within reasonable
boundaries. Although our Sign Code has not been officially adopted
as an ordinance, we expect adoption in the near future.

Dear Sir:
We -are respectfully requesting that consideration be given to
granting approval of zoning that will permit the construction
of a 96 unit motel on the following described property.
That portion of the Stephen Foster Donation Claim #38, in
Section 15, Township 23 North, Range 4 East, W.M., in King
County, Washington described as follows:
