HomeMy WebLinkAboutOrd 0346 - Municipal Court (Repealed by Ord 415 and Ord 569)TOWN OF TUKWILA Ordinance No. 346 REPEALED BY ORD 415 ORD 569 AN ORDINANCE of the Town of Tukwila establishing a municipal court, providing for the appointment of judges, establishing rules of pleadings, practice and procedure and repealing any and all ordinances in conflict therewith. WHEREAS, the Town of Tukwila is a Town of the fourth class under the laws and statutes of the State of Washington which had hereto- fore for many years passed operated its own municipal court known as the Police Court of the Town of Tukwila, and WHEREAS, Chapter 299 of the State of Washington Session Laws of 1961 also known as the "Justice Court and Other Inferior Court re: Organization Law" permits town of the fourth class to establish and operate its own municipal court system as provided for in Chapter 6 of said Act, and WHEREAS, the Town of Tukwila has elected to so establish its own municipal court under said Chapter, NOW THEREFORE, Section 2: The judge of the municipal court shall be appointed by the Mayor of the Town of Tukwila, with the approval and concurrence of the Town Council and such appointment shall be for a term of four years, commencing on January 15, 1962. Succeeding appointments shall be made in like manner by the 15th day of December preceding the end of eivery such four year term. BE IT ORDAINED BY THE vIAYOR AND THE TOWN COUNCIL OF THE TOWN' OF TUKWILA, as follows: SECTION 1: Pursuant to the authority conferred by Chapter 299 of the Laws of the State of Washington 1961 Session, there is hereby created a municipal court entitled "The Municipal Court of the Town of Tukwila "which court shall have exclusive original criminal jurisdiction of all violations of town ordinances and shall have original jurisdiction of all other actions brought to enforce or recover license penalties or forefeitures declared or given by such town ordinances or by any state statutes. The municipal court is empowered to forfeit cash bail bonds and issue execution thereon; to hear and determine all causes, civil or criminal, arising under such ordinances and to pronounce judgments in accordance therewith. Section 3: The person appointed as municipal judge shall be a citizen of the United States of America and of the State of Washington. Section 4: The salary of the municipal court judge shall be fixed for the initial term of four years in the sum of ONE HUNDRED (6100.00) DOLLARS per month. Section 5: The municipal court shall be open and shall hold regular sessions on the following days: Can the last Monday of each month between the hours of 8:00 P.M. and 10:00 P.M. Together with such additional times for regular and /or special session; as may be prescribed by the Town Council of the Town from time to time. Section 6: All fees, costs, fines, forfeitures and other moneys imposed or collected by the municipal court for the violation of any municipal ordinance, together with any other revenue received by the municipal court shall be deposited with the town treasurer as a part of the general fund of the Town. Section 7: That the Rules of Pleadings, Practice and Procedure as set forth in Chapter 299, Sessiom Laws of 1961, Chapter 6, Section 61 through Sections 94, three copies of which are on file in the off ice of the Town Clerk of the Town of Tukwila be and the same are, hereby adopted by reference by the Town of Tukwila, and all the details and provisions of said sections are hereby made a part of this ordinance as fully as if set forth in full and incorporated herein. Section 8: Every person convicted by the municipal court of the Town of Tukwila of a violation with criminal provisions of an ordinance shall be punished by a fine of not more than X300.00 or imprisonment in the Town Jail for a period not to exceed 90 days, or both such fine and imprisonment. Section 9: All cases, proceedings an(' matters coming before Justices of the Peace immediately before January 15, 1962, where actin as municipal or police judges of the Town of Tukwila, shall on January 15, 1961, be transferred to the municipal courts established by this ordinance, together with all files,records and proceedings relating to such cases and shall be disposed of therein in due course of law. This ordinance shall not effect any appeal from any police justice or muni- cipal judge of the Town of Tukwila, commenced and pending prior to January 15, 1962, but such appeal shall be conducted and concluded as if this Chapter had not been enacted, except that if remanded from the Superior Court, the Municipal Court shall have authority and power to enforce the judgment in the lower court. All furniture and equipment belonging to the Town in which the court is located, now under the car( and custody of the Justice of the peace and /or Municipal Judge, shall be transferred to the Municipal Court established by this ordinance on or before January 15, 1962, for use in the operation and maintenance of the Municipal 'ourt. Section 10: Any and all ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 11: This ordinance shall be in full force and effect from and after its passage, approval and legal publication. PASSED BY THE TOWN COUNCIL this 4th day of December, 1961.
