APPLICATION SUBMITTAL In order to ensure that your application is accepted for plan review, please make sure to fill out the
application completely and follow the plan submittal checklist on the reverse side of this form. Handouts are available at
the Building counter which provide more detailed information on application and plan submittal requirements.
Application and plans must be complete in order to be accepted for plan review.
VALUATION OF CONSTRUCTION Valuation for new construction and additions are calculated by the Department of
Community Development prior to application submittal. Contact the Permit Coordinator at 431 -3670 prior to submitting
application. In all cases, a valuation amount should be entered by the applicant. This figure will be reviewed and is
subject to possible revision by the Building Division to comply with current fee schedules.
BUILDING OWNER / AUTHORIZED AGENT If the applicant is other than the owner, registered architect/engineer, or contractor
licensed by the State of Washington, a notarized letter from the property owner authorizing the agent to submit this
permit application and obtain the permit will be required as part of this submittal.
EXPIRATION OF PLAN REVIEW Applications for which no permit is issued within 180 days following the date of application shall
expire by limitations. The building official may extend the time for action by the applicant for a period not exceeding 180
days upon written request by the applicant as defined in Section 304(d) of the Uniform Building Code (current edition).
No application shall be extended more than once.

Dear Mr. Lopez:
The purpose of this letter is to notify you that Building Permit Application No. B93 -0019 has been denied.
The denial results from a July 8, 1993 Board of Adjustment decision to uphold an administrative
interpretation related to the building permit request and to the City's Zoning Code, Chapter 18.70 -
Nonconforming Lots, Structures and Uses.
Should you wish to modify your request, a new application must be submitted.

1. request inspection (to determine whether unit is being used as
a permanent residence.... COOKING FACILITIES.
2. VIOLATION: letter dated March 15 to Ralph'Carrington.
Chronology:
a. 22 April 74. County approved mobile for 3233 S. 137th St. with
the condition that the mobile must be used as a GUEST HOUSE
only (no cooking facilities) (sic.)
b. 29 Jan. 1993. Stop Work Order posted.
c. 1 Feb. 1993. Inspected. Work had been continued.
d. 1 Feb. 1993. Letter from City to Lopez notifying him of Stop
Work Order and violation.
e. 8 Feb. 1993. Memo from Duane Griffin to City Attorney
requesting legal action against property owner.
f. 16 Feb. 1993. The property owner submitted bldg. permit
application (B93 -0055) to "rebuild roof & structure of mobile
home to increase it's conformity to permanent residence per
zoning 18.70 (inclusive) ". General purpose of construction
was to repair damage resulting from wind storm.
g.
10 March 1993. Memo to D. Griffin from D. Shefrin explaining
why permit could not be approved.
h. 11 March 1993. Letter to R. Carrington from D. Shefrin denying
permit. Letter explained why and cited sections of Z. code.
i. 12 March 1993. Letter from Dave Larson (building inspector)
to Linda Cohen outlining what was witnessed on site.

15 March 1993. Certified 11 March 1993 letter to R.
Carrington. Recv'd 18 March. He stated he had not received the
original letter.
k. 25 March 1993. Met briefly w/ R. Carrington to discuss status.
He was made aware of appeal of administrative decision
process. 5:00 deadline of same day missed. Letter not
received.
1. 26 March 1993. Left message re: letter.
m. 31 March 1993. Left message.
n. 13 April 93. Letter to R. Lopez giving 10 days to respond
after failure to meet at scheduled times.
o. 15 April 93. Left message w/ Lopez's son, Jim (329 - 8088).
Provided outline of issues.

15 April 93. Conversation w/ R. Carrington to discuss sent
April 13. Explained issues. Carrington stated may hire
attorney.
q. 28 April 93. Memo to file from D. Shefrin indicating April 26
deadline not met. Letter also stated site inspection would be
conducted June 28 to ensure mobile had been removed. Memo
also implied City should establish policies for such action.
r. 13 May 93. R. Carrington brought letter dated March 25, 1993
which he claimed he faxed. This letter was never received by
the City.
s. 18 May 93. Letter requesting zoning interpretation -
accompanied by notice to owners (prepared by Carrington)
asking for comment from neighbors.
t. 20 May 93. Memo to L. Cohen from D. Shefrin asking for
recommendation of how to proceed.
Comments:
Request for Variance, Appeal dated March 25 (FAXed, but not
received by City):
Issue:
You state the "residence was permitted in it's present
nonconformity ".
The County specifically stated the unit was to be used as a
guest house only and not intended as a permanent residence.
The County did not approve structural changes, alterations or
modifications to the originally- approved unit. I agree that
the unit was "legally pre - existing" thus making it a legal
non - conforming unit in accordance with the Tukwila Zoning
Code, but alterations were not authorized, nor can the unit be
used as a permanent residence.
For the above reasons, the plans submitted do not conform to
Section 18.70 of the TZC. The City's building inspectors have
verified that modifications to the unit were made without
permits issued either by the County or the City.
Letter dated May 18, 1993 - "Request for Code Interpretation per
(SEC) 18.72 Inclusive"
The key issue is because physical modifications to the unit
have been made, the unit is not longer legally nonconforming.
No section in the . Code addresses illegal - nonconforming
structures.
What you are seeking is not a request for a variance, but a
request for an interpretation to an administrative decision.

The letter dated March 15, 1993 cited violations to the zoning code

The applicant met with me briefly this morning to indicated he
wished to pursue a Board of Adjustment decision for interpretation
to the code discussed as an option in my letter.
I requested a very ,specific letter stating such request to be .
submitted. today. He agreed to provide letter by 5. p.m. and
requested a follow -up meeting with staff once staff has reviewed
the request.

Dear Mr. Carrington:
This letter responds to your building permit application for "rebuild roof and structure of a mobile home
to increase it's conformity to permanent residence per zoning 18.70 (inclusive)'.
Based upon information contained in the file for the above address to modify an existing mobile structure
on a residential lot zoned R1 -7.2, the Planning Division must DENY this permit application. Denial is
based on the following:
Mobile homes are not permitted in residential zones. Those mobile units permitted by King
County prior to annexation into Tukwila are considered legal non - conforming structures. Tukwila
strictly limits changes or modifications to legal nonconforming structures as specified in Chapter
18.70, Section 18.70.050 of the Zoning Code.
According to our records, King County issued a permit in 1974 which approved a mobile unit at the above
address with two conditions:
1. That the unit be used as a guest residence only, and
2. That the unit not contain cooking facilities.
Anv modifications to either of the above two conditions would not be permitted by the City of Tukwila
including conversion of the unit to a permanent residence. Minor repairs such as repainting and re-
roofing could be permitted. Please keep in mind that re- roofing does not imply that structural alterations
compared to the original roof configuration are acceptable as shown on your drawings submitted with
your permit application.
Normally, mobile and manufactured homes (Section 18.70.055) could be replaced if the County had
approved the unit as a permanent residence, and the criteria listed in Section 18.70.055 of the Tukwila
Zoning Code was met.
In my discussion with Ken Nelson of the Building Division, a carport has also been constructed, however,
according to the City's and County's records, no permits had been Issued. The current application does
include the carport within the proposed roof structure. Additionally, the existing carport also does not
comply with the required 5.7 -foot side yard setback.

I indicated that the City can only approve minor repairs to what
has already been permitted by the County. If the applicant wished
to repair the roof only, new drawings would be required. Further,
the mobile unit did not include a pitched roof as part of the
County permit. Therefore, the City can only approve a re -roof in
its original configuration.
Mr. Carrington will be in Thursday, March 11 at 8:30 a.m. to
discuss the issue. He earlier agreed to modify the application to
request.a permit to re -roof only.

proposed scope of work due to its non-conformance with the
following codes.
1. The existing mobile home may not be altered without first
receiving the approval from the Washington State Department of
Labor and Industries in accordance with WAC 296-150B-115 and -
120.
• 2. After discussion with Planing Staff on the City Zoning Code
Section 18.70.050 (5), this structure will not allow an
increase in bulk (size) as well as other zoning concerns.
This file will be immediately passed on to the Planing
Division for their follow up.
PLEASE NOTE; Due to the disregard of the. STOP WORK ORDER assigned
1/29/93 to this property, an investigation and other actions may be
taking place by city staff as authorized by U.B.C. Section 202(a),
(b), (d), (e), (g), 205, and 304(e).

As we discussed this morning, the attached permit
application is being forwarded directly to you for action.
It is my understanding you will take expeditious action to
determine if . the construction work proposed on the existing
mobile home will be allowed under the zoning code. Since
there is a question about this we will wait for your answer
before doing any • further construction type plan checking, or
any further follow -up action with the. State regarding their
restrictions on modifying mobile homes.
As we also discussed, it appears the State will have to
approve the modifications to the existing mobile home if'it
should be determined by you that it can be modified and
remain on the property. This is based on conversations Ken.
Nelsen had 'with State Dept of Labor & Industry people while
he was doing a preliminary review of the application. For .
this reason I suggest the applicant be informed as soon as
possible if you decide the zoning code prohibits approval;
or, I be notified if you are going to approve it so I can
refer the matter to the State for compliance with the RCW
regarding the modification of mobile homes.
