Anna Bernhard, citizen of Tukwila, commented that the citi- zens will not have a chance to voice their opinions on the annexations. They are not too thrilled about annexing everything. The City should have held a public hearing for citizen input. MOVED BY BAUCH, SECONDED BY STOKNES, THAT THE CONSENT AGENDA BE APPROVED AS SUBMITTED. MOTION CARRIED. Section 7 states that Council shall hold a public hearing six months from the date of this resolution or earlier to consider the effectiveness of the equipment. We have been monitoring the equipment since it was installed and have received one complaint and one complaint was filed with the Air Pollution Control Agency. The problem seemed to be on September 18, 19 and 20. Mayor Van Dusen said he has received three calls at home and he referred them to Air Pollution Control. Council Members Harris and Hernandez each had received one phone call at home. Don Williams, Parks Director, reported that the complaints at the Golf Course have been greatly reduced. Darlene Crostick, audience, said there is a big change for the better and is more pleasant on the golf course. TUKWILA CITY COUNCIL, REGULAR MEETING November 21, 1988 Page 2 PUBLIC HEARINGS Cont. NEW BUSINESS Ordinance #1490 Providing for licensing of adult entertainment cabarets by adding a new section to the TMC Ordinance #1491 Levying the general taxes for the year commencing January 1 1989 Allocate $1,250 for Housing Repair Loans $5,000 for Afford- able Monthly Loans property to the City by Barnard 0. Wilcox and authorize the Mayor to accept donation Mr. Barry Briggs, attorney for Seattle Rendering Works, reported they had a good summer; the new equipment was installed on time. He referred to his records that show the Rendering Works was closed on September 17 and 18 and did not open until 10:00 p.m. on Monday the 19th. They believe they have control of the problem. If people have a problem they can call the plant at 243 -7387. If they do get a call they can immediately check their facility. There being no further comments, the Public Hearing was closed. MOVED BY MORIWAKI, SECONDED BY DUFFIE, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Colgrove read an ordinance providing for the licensing of adult entertainment cabarets by the addition of a new chapter 5.56 to the Tukwila Municipal Code and repealing Section 5.08.070. MOVED BY MORIWAKI, SECONDED BY DUFFIE, THAT ORDINANCE NO. 1490 BE ADOPTED AS READ. MOTION CARRIED. MOVED BY HARRIS, SECONDED BY STOKNES, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Colgrove read an ordinance of the City of Tukwila, Wash., levying the general taxes for the City of Tukwila in King County for the fiscal year commencing January 1, 1989, on all property, both real and personal, in said City which is subject to taxation for the purpose of paying sufficient revenue to carry on the several departments of said City for the ensuing year as required by law. MOVED BY HARRIS, SECONDED BY ROBERTSON, THAT ORDINANCE NO. 1491 BE ADOPTED AS READ.* Council Member Bauch registered his opposition to this ordi- nance. If the State did not have a 6% lid law we would not be raising the taxes. He does not agree with the argument that we are going to lose revenue in the future if we don't do this. *MOTION CARRIED WITH DUFFIE, BAUCH, AND STOKNES VOTING NO. MOVED BY MORIWAKI, SECONDED BY ROBERTSON, TO ALLOCATE $1,250 FOR HOUSING REPAIR LOANS AND $5,000 FOR THE AFFORDABLE MONTHLY PAYMENT PROGRAM. MOTION CARRIED. City Attorney Colgrove read a resolution of the City Council of the City of Tukwila, Wash., accepting the donation of cer- tain real property to the City by Barnard 0. Wilcox, and authorizing the Mayor to accept the donation on behalf of the City. Resolution #1092 (cont) Resolution #1093 Establishing a policy to encourage recycling Resolution #1094 Setting forth the willingness of the City to consider annexation from the Sea -Tac incorporation area REPORTS Fort Dent Mr. Barnard Wilcox desires to donate Lot #10 of the Riverside Park Addition to the City with possible future donations of seven lots. An inspection of the lot shows about half of lots 6 to 10 have been eroded away by the river. Rip rap has been placed on the bank to stop the erosion. This land will serve as open space. *MOTION CARRIED. MOVED BY DUFFIE, SECONDED BY HARRIS, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Colgrove read a a resolution of the City of Tukwila, Wash., establishing a policy to encourage recycling in City facilities. MOVED BY MORIWAKI, SECONDED BY HARRIS, THAT RESOLUTION NO. 1093 BE ADOPTED AS READ. MOTION CARRIED. Mayor Van Dusen introduced a new resolution and read it in full. MOVED BY ROBERTSON, SECONDED BY MORIWAKI, THAT RESOLUTION NO. 1094 BE ADOPTED AS READ.* MOVED BY MORIWAKI, SECONDED BY ROBERTSON, THAT THE RESOLUTION BE AMENDED BY CHANGING SECTION 2 TO READ "PURSUE" INSTEAD OF "ENTER INTO. Rick Beeler explained that this resolution sets boundaries, it does not refer to services. Mayor Van Dusen clarified that, if the BRB turns down the incorporation, this is an offer to the Sea -Tac people that Tukwila would allow their annexation to occur in an orderly manner. *MOTION CARRIED. MOVED BY HERNANDEZ, SECONDED BY ROBERTSON, TO AMEND THE RESOLUTION TO INSERT THE WORD "PETITIONS" IN SECTION 1 AFTER THE WORD ANNEXATION. MOTION CARRIED. *MOTION CARRIED TO APPROVE THE RESOLUTION AS AMENDED. Council Member Moriwaki reported that the King County Parks and Natural Resources had a budget meeting and discussed the transfer of Fort Dent to the City of Tukwila on a one year lease. We would be responsible for maintenance, upkeep and repair. A one year lease is too short a time for this major transfer. After discussion, it was changed to a three month interim period with the County continuing to operate the park allowing time for an interlocal agreement. MOVED BY ROBERTSON, SECONDED BY DUFFIE, THAT THE MAYOR BE AUTHORIZED TO BEGIN NEGOTIATIONS WITH KING COUNTY ON AN AGREEMENT TO TAKE OVER OPERATION OF FORT DENT PARK.* Council Member Harris asked to have this come back to Council after the negotiations. *MOTION CARRIED. Mayor Van Dusen noted that there is nothing planned at this time. Park Commission Approved with change. Move $500 from Recreation, page 47, 07/574.20.40 to Park Commission, 03/576.800.40 for Tukwila Days. Library Advisory Board Hold until the formula for the contract fees is reviewed. City Attorney Approved subject to approval of scope of work. The 1989 budget provides for in -house legal counsel as well as contracted professional services. MOVED BY HERNANDEZ, SECONDED BY STOKNES, THAT THE IN -HOUSE LEGAL COUNSEL CONCEPT BE APPROVED SUBJECT TO APPROVAL OF THE SCOPE OF WORK. MOTION CARRIED. Police Department Approved with noted change. Jail costs, page 63, Intergovernmental Services Taxes increased to $135,000. The Police Dept. budget reflects 1.5 new positions. Fire Department Approved. No new personnel in this budget. Recreation Department Approved as changed. $500 moved to Park Commission. Park Maintenance Approved. Finance Department The 1989 proposal reflects the 3/4 posi- tion of Accounts Payable Clerk increased to full time and the addition of a 1/2 time data entry position.
