Council President Stoknes called the Committee of the Whole
Meeting to order.

Steve Wagner, consultant from Kramer, Chin, and Mayo, reported
on the process and schedule for planning a surface water plan.
Mr. Wagner reviewed the proper sequence of planning should be
documenting the need, devising the way to deal with the needs,
and then deciding how to finance the program. He stated the
study is about 80% complete.
The consultant will make periodic reports to the Utilities
Committee and to the entire City Council when it is desired.
Prop. Ord. authorizing Councilmember Moriwaki explained the proposed ordinance. The
arrest by police ordinance is to prevent violations of probation. A violator
officers of persons signs, as a condition of release or probation, a document
observed in violation that they will not loiter in a specified area between 11:00 a.m.
of court ordered pro- and 6:00 a.m. or they can be arrested. This would prevent
bation prostitutes or drug dealers from waiting in their usual hangouts
while on probation or while awaiting a court appearance.
MOVED BY ROBERTSON, SECONDED BY DUFFIE, THAT THE PROPOSED ORDINANCE
BE ON THE AGENDA OF THE NEXT REGULAR MEETING OF THE COUNCIL.

Councilmember Moriwaki explained the procedure would discourage
people from loitering in a specified area by enabling police to
arrest a trespasser if he /she is caught hanging out at the
property more than once. The police would contract with the
property owner to enforce criminal trespassing on his /her property
at all hours. Once a violator was warned to stay away from an
area he /she would sign a notice agreeing to such. If they were
caught there again police could cite them for criminal trespass.
Mayor Van Dusen explained this is an administrative action allowed
by the State that the Council does not have to approve. The law
allows the City to abate property which has been used for drug
activity. If illegal drug activity is cited at a property, the
property owner is notified he /she is responsible for cooperating
with police to ensure drug activity doesn't recur. If the owner
or manager then knowingly allows the property to be used for
illegal drug activities the City could, through civil action,
close and board up the house for a year. If it were an apartment
unit the City could close the entire complex for a year.
Update on status of Judy Stoloff, King County, discussed the interlocal agreement
Interlocal Agreements for the transition of responsibilities in the Fire District #1
w /King County. annexation are.
With respect to the Fire Department, Tukwila currently provides
fire protection and emergency medical services to that area. The
areas which were not part of the annexation will continue to
contract with the City for these services. The portions of the
agreement pertaining to roads and the 16th Avenue Bridge are
nearly completed. Surface water management is in discussion.
With respect to permits it has been determined that no outstanding
issues exist in Fire District #1. King County is being authorized
to continue processing existing permits on behalf of the City
so the projects will not be subject to undue delay or uncertainty
over standards. Permits not appearing on the list provided by
the County to the City will be required to undergo review by the
City prior to any decision as to which jurisdiction will handle
the processing.

REPORTS
City Council
The transfer of park property from the County to the City will
likely be accomplished through action which would surplus the
property and transfer it to the City. This will be referenced
in the agreement.
Tukwila will assume law enforcement responsibilities for Fire
District #1 upon date of March 31, 1989. Until that date the
City will contract with the County police if the rates can
be agreed upon.
The items not covered in the interlocal agreement is wetlands,
historic preservation and fair housing. Tukwila should adopt
own policy.
Councilmember Moriwaki explained the North Hill Reservoir Project
has been temporarily stopped by amount and type of rock at site
that needs to be removed. Administration will close out the
current contract and rebid to excavate the rock and construct
the reservoir. Costs will be higher due to extensive rock
excavation.
Councilmember Moriwaki explained the committee has recommended
one way to make ratepayers share costs equally. This would be
through a one -time connection charge to new developments to help
pay for water quality facilities like secondary treatment and
for expanding capacities to serve more people. At present
current ratepayers are paying for all these costs.
Councilmember Moriwaki stated the Utilities Committee has agreed
that it is appropriate for the City to send a letter to ratepayers
urging them to support State legislation to allow the connection
charges.
Councilmember Moriwaki explained the City has proposed hiring one
firm to inspect all of the City's construction projects. The
Transportation Committee approved hiring a firm to inspect two
construction projects that are ready. Entranco has been selected
for these two projects. If this arrangement works well after a
review has been made on these projects a decision will be made
as to whether or not they will be retained. The Mayor will negotiate
a contract with the firm.
The City Council /South Central School Board joint meeting is
scheduled for 7:00 n.m. on March 27. The issues scheduled for
discussion are: 1) Proposed new auditorium and possible City
use of and participation in project; 2) Future of Foster Library
including school district plans for land or building; 3) City
and citizen use of school facilities, specifically concern about
condition of school playing fields.
A representative of Friends of the Library stated they met and
they do not like the idea of the Foster Library combined with
Foster High School.
The matter will be discussed on March 27 when the City Council
meets with the South Central School Board.
Council President Stoknes stated the City needs to develop
restrictions on steep slopes.
Councilmember Duffle reported he has had signs printed regarding
stray cats and there will be an article in the Hazelnut.
Council President Stoknes stated she attended a Park Commission
meeting and has requested copies of the Park Commission meetings
be distributed to each Council member.
Council President Stoknes stated a canoe trip is being planned
to explore the amenities of the river.
Councilmember Robertson suggested the zoning code deal with
development on steep slopes and the development of an environmentally
sensitive ordinance.

City Attorney Colgrove reported the suit filed by World Wide Video
will have a hearing date soon. He will report to the Council on
the matter.
