Mayor Van Dusen called the Regular Meeting of the Tukwila
City Council to order and led the audience in the Pledge of
Allegiance.

Council Member Hernandez asked to have the Vouchers removed.

Ross Earnst, Public Works Director, reported that two bids
were received for installation of the Water Telemetry and
Supervisory Control System and Demand Metering Control
System. This is the system that will operate the taps so the
reservoir will supply the excess demand, and this will elimi-
nate the demand charge. There was one protest against this
award, but the City Attorney determined it wasn't valid and

the bid could be awarded to the low bidder. The protest was
filed because the low bidder did not enclose his bid bond.
Mr. Earnst recommended that the bid be awarded to the low
bidder, Omega Contractors, Inc.
Attorney Colgrove explained that the bid bond requirement is
there to protect the City and the citizens. Where there is
an informality, it can be waived as long as it does not pro-
vide an unfair circumstance as far as the other bidders are
concerned. There is no reason for the City and the citizens
to be harmed by having to take the higher bid.
MOVED BY STOKNES, SECONDED BY MORIWAKI, THAT THE BID FOR THE
WATER TELEMETRY AND SUPERVISORY CONTROL SYSTEM AND DEMAND
METERING CONTROL SYSTEM BE AWARDED TO OMEGA CONTRACTORS,
INC., IN THE AMOUNT OF $290,150 (EXCLUDES WSST). MOTION
CARRIED.
Mayor Van Dusen declared the Public Hearing open on Pre
annexation Zoning and Comprehensive Plan Amendment for the
Schneider Annexation, located south of So. 178th St. and east
of I -5.
Rebecca Fox, Planning Staff, reported that the property under
consideration is 32 acres located south of South 178th Street
and east of I -5. The applicant's request is:
(1) Comprehensive Land Use Plan Map amendment from Low
Density Residential to Office.
(2) Pre annexation zoning designation from King Co. rs -9600
to P -0 (Professional Office without Residential).
(3) Rezone from R -A (Agricultural) to P -0 (Professional
Office without Residential).
The Planning Commission heard this request on June 23, 1988.
They recommended that Council deny the request but support
the annexation for the following reasons:
(1) The City is short of single family residential area;
(2) This parcel is quite large; if it were to be changed
from single family to office, it might set a precedent
for this action to occur in other parts of the City;
(3) There is still adequate property available within the
City that is properly zoned for office use.
The second Public Hearing on this proposal will be held
September 6, 1988.
Doris Geennotti read a letter from her sister, Carol
Lawrence. Mrs. Lawrence explains that their Grandfather
bought their 32 acres of property on So. 178th in 1902. They
are concerned about the State putting an off -ramp from I -5 to
So. 178th; it will probably take most of their property. Is
there any assurance that Tukwila will protect them from such
an off -ramp; who would want a single family home next to a
freeway exit. She asks Council to rule in favor of
Professional Office.
Doris Geennotti, speaking in favor of the Professional Office
Zoning, asked to be treated like their neighbors to the
north, the Gateway Office Complex. Also, they feel they are
no different than the Martin property to the east which was

rezoned. Their area is no longer suitable for single family
because of the encroachment of commercial and industrial uses
as well as the impact from I -5. They have lived here for
years, but would no longer consider building a home on the
hillside because of the change to commercial in the valley.
She asked Council to consider these facts as they decide on
their request for annexation and rezone.
Brad Collins, 365 Erickson Ave. N.E., Suite 326, Bainbridge
Island, WA 98110, is representing the applicant, Gerald E.
Schneider, in this annexation and rezone request. He com-
pared this property to the Martin property to the east. One
year ago, the Martin property was rezoned to Office. Mr.
Collins read, for the record, two statements from the Staff
Report for the Martin Rezone. "The Planning Department
generally concurs with the analysis and specifically conclu-
des that: (1) Existing land uses and roads, as well as
planned public improvements seriously degrade the viability
of the subject site for single- family residential use."
"Based upon the findings, the staff has concluded (3) The
proposed zone change is in response to development that has
occurred to the north and east of the site. What was once a
quiet agricultural and residential area has now become an
area with large numbers of commercial and industrial uses."
Mr. Collins explained that there have been significant
changes in this area since the 1982 Comprehensive Plan was
adopted. The impact on this property fiorn noise and traffic
would be substantial. The office proposal would be much less
sensitive to the noise. If the South 188th Connector is
constructed, there will be a freeway on both sides of this
property.
One of the reasons the Planning Commission decided against
this zoning request was because the area is too large.
Originally Mr. Schneider's property was included in the
application. It was at the request of City Staff that the
other properties were added.
COUNCIL MEMBER DUFFIE ARRIVED AT THE MEETING.
Gerald Schneider, applicant, explained that when they made
the original application, they felt they had the support of
staff. Being in the housing development business, this site
is not the place to build single- family homes. The noise
raises from the valley floor -I -405 is louder than I -5.
Council Member Moriwaki asked Mr. Schneider if he does not
get the zoning he has requested, does he still want to
proceed with the annexation. Mr. Schneider said he would
probably oppose the annexation because he does have the King
County zoning, which is more dense than the proposed Tukwila
zoning.
Ray Flink, owner of the property next to Mr. Schneider's pro-
perty, said he has no problem with this zoning request. He
commented that he would like to have his property rezoned to
multiple residence.
Bill Arthur, representing Mario Segale, said they are not
opposed to annexation but feel that single- family zoning is
appropriate for this area at this time. Council Member Hernandez
asked, Is this piece of residential property owner occupied or
is it a rental /investment property? Mr. Arthur said, It is not
an owner occupied piece of property but it is currently a residence
that is occupied.

City Attorney Colgrove read a resolution of the City Council
of the City of Tukwila, Washington, rejecting all bids for
personal computers and printers.
MOVED BY HARRIS, SECONDED BY DUFFIE, THAT RESOLUTION NO.
1084 BE ADOPTED AS READ. MOTION CARRIED.
Council Member Hernandez explained that she pulled a voucher
to Blumenthal Uniforms. Included with the purchase of uni-
forms is a gas gun for $356.00. This is a capital item that
was not approved in the budget. This voucher will be sent to
the Finance Committee for review.
MOVED BY BAUCH, SECONDED BY HERNANDEZ, THAT THE VOUCHERS BE
APPROVED LESS THE VOUCHER MADE OUT TO BLUMENTHAL UNIFORMS.
MOTION CARRIED.
Mayor Van Dusen distributed a draft agreement on the Commuter
Rail Demonstration Project. The project will start at
Puyallup and go into Seattle.
Mayor Van Dusen introduced a report on the consolidation of
the Municipal Courts and the District Courts from the
Association of Washington Cities. This item was turned over
to the Finance Committee for further investigation.
Council President Harris reported that the Sea -Tac Task Force
on incorporation would like to meet with City Officials to
discuss boundary lines between the proposed incorporation
area and the City. Mayor and Council agreed that the City
would take a strong stand to protect the City's sphere -of-
influence; the long range planning area is the proposed
annexation area.
